“Hi Noah, we recently had a clog in our sewer and they sent a camera down the line where they noted that the cast-iron had a lot of buildup and it wasn’t flowing correctly . We aren’t planning to change that out right now, but would I need to disclose this to a future buyer? It’s still working, so I feel like I don’t need to. What are your thoughts?”
Answer:
Good question and I’m from the school of thought that it’s better to over disclose then have liability following you around after you close escrow. Let’s take this scenario for example, you don’t say anything and the buyer doesn’t do their own inspection of the sewer lines when they purchase, but a few months after they move in, they also have a clog and by chance they call the same plumbing company that you used. That plumber
says “oh yeah, I remember looking at the sewer lines and telling the owner at that time that they really need to change these out and they’re not flowing correctly.” That’s a huge liability for you and I think those buyers would have grounds to come after you for non-disclosure of an issue you were aware of and you might be buying them new sewer lines. So it’s always better to put all the details out there and see what stuff is a concern for a buyer.
