Transformative Changes in Real Estate Commissions
Prior to the 1990s, purchasing a home involved a much different approach than what we know today. Potential buyers would drive around neighborhoods searching for “For Sale” signs. Upon finding a home of interest, the next step typically involved contacting the listing agent, who was hired to market and sell the home on behalf of their client - the seller. Although these agents represented the seller, they could assist buyers in writing an offer. The listing broker’s compensation was paid from the sale proceeds at closing, typically between 5-6% of the sales price, depending on negotiation. However, this process did not always guarantee fair or dedicated representation for buyers.
The landscape began to change in the early 1990s with the introduction of buyer representation and buyer brokers. This change encouraged buyers to hire their own agents, who were committed to representing their best interests. While sellers continued to sign listing agreements, the real estate commissions paid at the close of escrow were now split between the listing broker and the buyer broker. The buyer broker compensation, known
as “cooperative compensation,” was published in the MLS to attract well qualified buyers to the home. Fast forward to nearly three decades after the introduction of buyer brokers and commission practices, a class action lawsuit was filed against the National Association of Realtors (NAR) in 2019 by a group of homeowners in Missouri who claimed unfair commission practices. Bringing attention to the issue of sellers setting the commission for the buyer’s broker, plaintiffs believed this could limit competitive practices. The plaintiffs argued this system prevented buyers from effectively negotiating their broker’s fees, challenging the principles of competition and fairness.
In March 2024, as a response to this lawsuit, NAR proposed a settlement without admitting any wrongdoing. This proposed settlement seeks to remove all offers of buyer broker commissions from MLS listings. Moreover, it mandates a buyer-broker agreement between buyers and their agent that clearly defines the terms of the buyer’s representation and buyer broker compensation before ever touring a home. approval, this settlement is anticipated to be implemented in mid-July 2024.
With these proposed changes, how would buyers’ brokers be paid? It’s important to acknowledge that real estate commissions are not being eliminated but will be negotiated differently. Buyer brokers can be paid directly by the buyer, receive compensation from the seller, from a portion of the listing broker’s compensation, and other ways. This change emphasizes the negotiability of commissions for the buyer’s broker, allowing them to directly discuss their fee with their clients. This advancement is aimed at creating a more transparent and equitable framework, ensuring buyers and sellers understand how brokerage fees are paid and detail the real estate services they will receive throughout the transaction.

Memory Lane Indian Hills Camp
When my family moved to Jamul in 1992, I was 9 years old. Originally from Plainfield, New Jersey, where my family had owned a Victorian home built in 1911, that house was the last of the Victorians on our street, and 1328 South Ave still stands as a testament to another time. All other Victorians had been replaced with either commercial structures or apartment buildings. We lived across the street from a car wash and deli, and next to a gas station and apartment building. To paint a picture, our “old home” was in a very similar situation to the home featured in the Pixar movie “Up”. Growing up in that home is where my passion for real estate started, curating a deep appreciation for old world craftsmanship and local history.
Moving from the inner city of New Jersey to Jamul was a bit of a shock for me, as the landscape was unlike anything I had ever seen on the east coast.It was not long after we moved into the 91935 that we began attending the Jamul Community Church. Through JCC, my family was introduced to an incredible young couple who began watching over me while my parents went out for a date night. Back then, Danny and Nikki Long were just dating and happened to be connected to Indian Hills Camp.
As an only child new to the area, Indian Hills presented a chance to meet new friends, as well as become acquainted with the rural countryside we just moved to. Between the oak tree groves, massive boulders, and rolling hills, the 86-acre site that makes up Indian Hills is such an incredible place for children and families to make memories and learn a deeper appreciation for God. Attending JCC and going to various events at Indian Hills just seemed to go hand in hand.Founded in 1960, Indian Hills is a pillar in Jamul, serving thousands of guests every year as the camp offers overnight experiences for kids, youth/church retreats, scouting
events, family camping, picnics/day use, and sixth-grade camps.
One of my favorite activities that Indian Hills Camp offers is Gold Rush Days, which teach about the history of gold mining, complete with panning and faux mine portal (which was featured in the March Edition of Community Connections). Indian Hills Camp was established to instill and strengthen children’s faith in Jesus Christ, and it continues to serve our community by employing wonderful staff, offering unique activities to truly enrich the lives of their guests.
Indian Hills Camp has many unique structures on it. The camp has sleeping accommodations for up to 144 in their “Cabins”, 96 in their “Covered wagons”, 96 in their “Tepees”, and 72 in their “Miner Shacks”, with additional capacity of 200 in their Tent Camping/RV area. In addition to sleeping quarters, the camp hosts a variety of indoor and outdoor meeting areas, The Folsom Barn, Winchester’s Outpost, Oak Rock Amphitheater, Western Town, and Old Miner Jack’s gold rush area. I can still picture Danny Long leading Worship with his guitar in the big barn, as well as the massive sliding boards and swimming pool. Since my time there as a child, they have added many additional activities, like a BMX pump track, zip-line course, paintball, a farm yard petting zoo and new hiking trails.
In the spring of 2020, Indian Hills began to fulfill another need for local San Diego County families. During the peak of the pandemic, Indian Hills became a haven for families that needed support for their children, at a time when public schools were shuttered, and traditional after school programs had disappeared. Rochelle and I personally know multiple families that leaned into Indian Hills during that time, many of which said that the camp fulfilled a need that was not

offered anywhere else at the time. I will be forever grateful for the positive impact that Indian Hills Camp had on childhood and Faith, and to Danny and Nikki Long for introducing me to the camp, and for providing such an incredible example of what it means to make a difference in your local community.

Can you share your story on how you came to settle in Jamul? What were the key factors or events that led you to this community?
Our son, Todd, and his wife, Sunshine, attended SDSU and remained in San Diego following graduation. We knew it was time to move to San Diego when we learned we would be grandparents! This was a huge leap for us, since we had lived happily in the Santa Ynez Valley (Santa Barbara County) for 35 years. Our search for horse property and riding trails led us to our forever home in Jamul.
What are some of the most significant changes you have witnessed in the community since you’ve been in Jamul?
To our surprise, shortly after we moved here, we learned of the community battle against building a casino in Jamul. Thus, the most significant change has been the completion of the casino and the increase of traffic on Hwy. 94. As a member of Jamul Kiwanis and responsible for the trash clean up along SR-94, I have seen a considerable amount of litter with Jamul Casino’s name on it (e.g., paper stubs, water bottles, etc.) the result of traffic from the casino.
If someone was visiting the area for the first time, what’s one place you would recommend they visit?
A wine tasting experience at Granite Lion Cellars is a must do. Granite Lion’s has a wonderful staff and spending an afternoon in the cattle ranch-like setting is a great country experience (I’ve had the good fortune to have been horseback riding on the property). Having a picnic by the stream and a hike to the gazebo is such a treat. When the new tasting room is complete the entire “wine experience” will be even more amazing.
What aspects of the community do you value the most, and how have they impacted your life?
Jamul is a special community of good people who enjoy an eclectic and rural lifestyle. We have an amazing neighborhood and felt welcome in Jamul from the get-go. We joined Jamul Kiwanis to give back to our new community and have found a “family of friends” in its members. Jamul, just far enough
from the coast, allows my fishing enthusiast husband to fish and hoop for lobster in SD bay as well as fish in the local lakes. And who would have guessed that there is a “Jamul Tuna Club”? Yep, that was a must for Jim to join. I, on the other hand, have enjoyed the riding trails adjacent to our home as well as Hollenbeck and Horse Thief Canyon.
If you were to describe the spirit or character of Jamul to someone who had never visited, how would you describe it? I would say that Jamul is a “diamond in the rough”. A little rough around the edges but shiny and beautiful and living here is worth a fortune.
