VATICAN CITY (CNS) — Pope John Paul II appealed again for a peaceful settlement of the crisis in Iraq and sent a high-level envoy to Baghdad to press for greater Iraqi cooperation with U.N. weapons inspectors.

Speaking at a noon blessing Feb. 9, the pope called on Catholics to pray the rosaiy for '. .. if there's peace. "In this hour of international concern, anyone that might he we all feel the need to turn to the Lord to implore the great gift of peace," he said. Proceeds benefit Magdalene House, a Catholic Worker facility on the coast at the service of homeless families. Msgr. Thomas Kennedy, a 'priest 's priest,' dies

By Jack Smith Msgr. Thomas Kennedy died peacefully at Nazareth House, San Rafael on February 5. He was 87 years old.

Msgr. Kennedy is remembered most by the people of Marin County as an active civic leader and longtime pastor of St. Raphael parish. But his service to Christ and His Church spans many decades , professions and places on back to his childhood.

Tom Kennedy was born on September 11, 1915 in San Francisco. He was the youngest of five childre n born to Martin and Margaret Kenned y. The example of service to the Church was instilled at an earl y age by his father who was one of the Irish Catholics in the Mission district who helped build St. Paul' s church.

Msgr. Kennedy was baptized there and attended grammar school at St. Paul' s, where the example of its priests had a great effect on his decision to dedicate his life to the priesthood and to service. "He loved his years as an altar server at St. Paul's, and spoke with great respect and love of the late Msgr. Connoll y and Father Cornelius Kenned y," Father Joe Walsh said at the funeral Mass at St. Raphael on Monday.

Msgr. Kenned y later attended , St. Ignatius High School and then St. Joseph' s College and St. Patrick' s Seminary. He was ordained June 7, 1941, "six months to the day before Pearl Harbor ', he liked to say," Father Walsh said. Service to the community would be the hallmark of his chosen vocation as it was for his brothers, one a firefighter and one a policeman.

"Tom liked to say that in the three boys in the family, all the bases were covered - fire , police and church ,"

Father Walsh said. "Tom was all priest , down to his fingertips. He was a priest 's priest , who loved the priesthood and the company of priests. "

He joined the Rotary Club , "because a priest in the community needs to know who the movers and shakers were and where the bodies were buried ," Father Walsh said.

Msgr. Kenned y then became the firs t priest to be elected President of the Rotary. He was proud of much of the work Rotary did throughout his tenure , including the building of a retirement facility for the less affluent in San Rafael , called Rotary Manor.

Msgr. Kenned y also served as Chaplain to the Serra Club of Marin and was active in local affairs even after his retirement to Our Lady of Loretto in Novato.

After an assignment as associate pastor at St. Emydius in San Francisco, "Father" Kenned y, as he preferre d to be called even after being named a monsignor in 1976 , began his school career. He taught religion and history at Sacred Heart Hi gh School in San Francisco and then at Junipero Serra High School. He was then appointed Vice-Principal at Marin Catholic High School and served as Principal from 1952 to 1955. From then he served six years as Principal of Serra.

In 1961, Msgr. Kennedy was chosen to be the founding pastor of a newly begun St. Denis parish in Menlo Park. St. Denis was founded in 1853 by a Jesuit priest named Father Joseph Bixio. Father Bixio was a chap lain in the Civil War to both sides of the conflict. "Tom wondered if he were an Irishman ," Father Walsh said. The parish was closed in 1871 and re-founded 90 years later

Bishop s in South urge reform of j usticesystem, concern for victims MARTIN , Ky. — A pastoral statement by 40 Catholic bishops in a dozen Southern states criticizes the criminal ju stice system and asks that it be reformed to ensure it respects "the essential human di gnity of each and every victim and each and every offender."

The statement points out that one out of every 27 Americans over 12 is the victim of a crime each year and that African-Americans and Hispanics are victimized more often than people oF other racial and elhnic groups. It notes that the United States leads the world in the rate of incarceration of its citizens and says that there is evidence of racism in the system.

"The death penalty has been used for too often and in an unfair and unjust fashion," the bishops say. More than 80 percent of the people who have been executed in the United States were put to death in the South and yet the region still has the hi ghest murder rate in the nation , they said.

The bishops asked local church communities to reach out to every crime victim through counseling, support for the criminal justice process and recovery of loss. They encouraged further development of mediation and reconciliation programs.

The tax revenue would have, among other things,- saved long-term care for low-income seniors and kept schools from having to cut days off the academic calendar and the state police from reducing the number of troopers. The Oregon Catholic Conference is calling for a summit of political leaders, charity heads and even the National Guard to devise a p lan for those who lose vital services such as housing and medical care.

Church leaders led a campaign asking Oregon lawmakers not to balance the state budget by cutting human services. After five special sessions, the Legislature approved major cats in spending. Measure 28 was offered as a way to soften the budget blows.

Catholic Bishops ' Conference has urged the South African government to intervene to prevent starvation and civil war in nei ghboring Zimbabwe. "There are deeply disturbing signs that Zimbabwe is on the brink of total breakdown into civil war with massive food and fuel shortages and increasing levels of organized state terror," the bishops said in a Feb. 6 statement.

The bishops expressed alarm at the government training of young Zimbabweans to be terrorists. These youths "have already been responsible for the abduction and torture of several opposition party and civil society leaders" in Zimbabwe, they said, Zimbabwe faces its worst economic and food crisis since its 1980 independence; at least 6.7 million people — more than half Zimbabwe 's population — face starvation.

WILMINGTON, Del. — A Catholic school here fired a middle school religion teacher five days after her name appeared in a newspaper advertisement as a supporter of abortion. Michele Curay-Cramer 's name was one of more than 600 that appeared as a full-page advertisement in the Wilmington News Journal .on Jan. 22, the 30th anniversary of Roe vs. Wade.

Ms. Curay-Cramer, was given a chance to retract her participation in the advertisement before her firing, Barbara Griffin , president of Ursuline Academy, said. "She chose not to do so, and indicated that she had thought about the implications of her action and the possible repercussions beforehand. " The teacher had worked at the independently owned, private Catholic school for 18 months. She has challenged her dismissal, saying that because Ursuline is independently owned it is not exempt from laws that prohibi t discrimination against, an employee based on race, religion, gender or national bac kground.

NEW YORK —The canonization cause for Rose Hawthorne, founder of an order that cares for patients terminall y ill with cancer, was opened in a ceremony Feb. 4 at the New York Catholic .Center.

The daughter of author Nathan iel Hawthorne, Rose Hawthorne was a wife, mother, widow and convert to Catholicism. She began caring for poor people suffering from cancer in the slums of Manhattan in the 1890s and established the Dominican Sisters, Servants of Relief for Incurable Cancer, in 1900. She established two homes where the sisters cared for the poor without charge, St.'Rose 's in Manhattan and Rosary Hill in Hawthorne. She died in 1926.

Both homes are still in operation, along with four others.

VATICAN CITY — Pope John Paul II encouraged the Serbian Orthodox Church to conti nue promoting reconstruction and reconciliation in the Balkans and pledged the cooperation of the Catholic Church in the task.

'The unspeakable suffering of numerous populations in the Balkans " in the 1990s and attempts to use "reli gious and patriotic values to inflict deeper wounds on their neighbors" call for clear action on the part of the churches , the pope said at a Feb. 6 meeting with a delegation of the Hol y Synod of the Serbian Orthodox Church. NEW YORK — Catholic Medical Mission Board has launched a major public health initiative in Haiti in association with the Catholic Church , the Salesian Sisters of St. John Bosco and the St. Boniface Haiti Foundation.

The "Bac k to Haiti" initiative will offer preventive health activities for mothers and children throughout the Caribbean nation. He urged partici pants , in dealing with war and peace and security issues back in their home dioceses , to acknowledge and discuss those fears. "We achieve nothing by disparaging the fear of others or not owning up to our own ," he said.

But he also reminded them that courage does not mean being fearless: "Rather , courage lies in the determination to do what is ri ght despite being afraid. " He also reminded them that it was because the disciples were afraid that Jesus is found saying to them , "Do not be afraid. "

VATICAN CITY (CNS) — Blessing sick pilgrims in St. Peter 's Square , Pope John Paul II told them the sick are on the "front line" of prayers for peace and for the family.

The pope greeted the pilgrims from his apartment window, rather than joining them as he usuall y does in St. Peter 's Basilica at the end of their annual Mass marking the World Day of the Sick Feb. 11.

"In this year shaken by concerns for the fate of humanity," he said, he had proclaimed a Year of the Rosary and asked particularl y that peop le pray the rosary for peace and for the family. "You, dear sick brothers and sisters, are on the front line in interceding for these two great aims," said the 82-year-old pope , who shows signs of physical suffering.

Holding a large candle propped on his window sill as darkness settled on the square , the pope said he was thinking of "all the world' s sick," especiall y those participating in the Catholic Church's main World Day of the Sick celebration in Washington and those marking the feast of Our Lady of Lourdes in France.

"War would be a catastrophe in every respect. Above all, it would have grave consequences for the Iraqi population and would also make it increasingly difficult for the United Nations to work for the unity of the human family," Cardinal Etchegaray said.

The cardinal said a war would aggravate relations between the West and Muslim countries.

Latin-rite Archbishop Jean Benjamin Sleiman of Baghdad told Vatican Radio Feb. 10 that Catholics in Baghdad were informed during Sunday Masses about Cardinal Etchegaray's arrival. Many were hopeful that his mission would bring peace, he said.

He said Cardinal Etchegaray's visit came at a moment of "great anguish" for Iraqis in the capital. "Many people are trying to move out; they're already fleeing from the war," he said.

On Feb. 18, the pope was scheduled to meet with UN. Secretary-General Kofi Annan to discuss the Iraqi crisis, Vatican officials said.

Last fall, the pope wrote to U.S. President George W. Bush and Saddam Hussein, making the arguments for a peaceful resolution of the crisis. In recent weeks, Vatican officials have strongly warned against a pre-emptive military attack on Iraq, especially if it were carried out without U.N. authorization .

The Vatican's diplomatic move, announced Feb. 9, came a day after the pope warned that "peace is in danger. " "We need to multiply our efforts. One cannot be immobile in the face of terrorist attacks, nor when faced with the threats that are being raised on the horizon. One should not give up, as if war is inevitable," he said Feb. 8 in a speech to the Sant'Egidio Community, an Italian lay group that has worked for peace around the world.

Catholic Hour radio program needs help to continue The Catholic Radio Hour program , which is anchored by the praying of the rosary each weekday evening and feature s news, information, music and commentary, is facing financial pressures that may bring the long-running radio program to an end.

Hosted by Father Tom Daly, the Catholic Hour is broadcast on 1450 AM radio each weekday evening from 7 p.m. to 8 p.m. Contributions from listeners to the program are intended to cover the cost of radio airtime.

The Archdiocese of San Francisco 's Catholic Communications mmm mmm^mmmm,„ M— Center took over responsibility for producing the program in December 2000. This itself was a rescue mission when it appeared the program would come to an end at that time.

Maurice Heal y, director of Communications & Outreach for the Archdiocese of San said , Francisco , "With a great respect for the program , which has been on the air for more than 50 years, the Archdiocese stepped in to try and help. We have tried to improve the program content and increase listener contributions. " However, the cost of radio airtime has consistently been substantially more than contributions from listeners, he said.

the other features of the program , we cannot continue to bridge the gap between expenses and revenue," Healy said. "All of us work on the program with love and knowledge that it meets a great need in the region for a Catholic radio program."

The Catholic Communications Center is trying to raise general awareness about the plight of the radio program and also is exploring options that would cut the airtime expense. Healy said alternatives include cutting the length of the program and airing it at a different time. However, he said it is difficult to find a half-hour time slot that is acceptable.

Peace is focus of prayer service, Quinn Colloquium Catholics of the Archdiocese of San Francisco are invited to participate in an Interfalth'Prayer Service for Justice and Peace Feb. 16 and to a March 1 colloquium on a Catholic approach to war.

The prayer service will take place on the main stage of the San Francisco Civic Center from 11 a.m. until noon Feb. 16. Participants may join a march against war with Iraq following the service or conclude their participation with the prayer service.

On March 1, the Archbishop John R. Quinn Colloquium on Catholic Social Teaching will focus on the theme: "How Should the Catholic Theological Tradition Approach the War on Terror?" Speaking at the event, will be: George Lopez, Director of Policy Studies and Senior Fellow at The Joan B. Kroc Institute for International Peace Studies, University of Notre Dame Marie Dennis, Director of the Maryknoll Office for Global Concerns and Vice President, Pax Christi International , and Pax"Christi USA Ambassador of Peace George Weigel, Senior Fellow at the Ethics and Public Policy Center in Washington, D.C., biographer of Pope John Paul U and columnist whose writing appears in Catholic San Francisco.

By Jeffrey M. Burns A fter thirty-one years of dedicated service, Archbishop Alemany gladly turned the JLM Archdiocese over to his Coadjutor Archbishop, Patrick W. Riordan. On December 28, -X A1884 Riordan became the second Archbishop of San Francisco. He would serve for three decades and oversee an era enormous growth in the Archdiocese. He would ably live up to the high standard set by Alemany for San Francisco 's archbishops.

Riordan was born August 27, 1841 in Chatham, New Brunswick, Canada, son of Matthew Riordan , a ship carpenter, and Maiy Dunne, both Irish immigrants. In 1848, the family moved to Chicago, where Patrick decided to study for the priesthood. He completed his studies for the priesthood at the American College at Louvain, Belgium, and was ordained to the priesthood in Mechlin , Belgium on Ju ne 10, 1865

by Cardinal Englebert Sterckx. After a brief term of teaching at St. Mary of the Lake Seminary in Chicago, he served in several parishes before being appointed pastor of St. James Parish in Chicago in 1871, where he remained until 1883.

While there, Riordan distinguished himself as an excellent administrator, builder, and fundraiser, skills that would serve him well in San Francisco.

In 1883 he had been named Coadjut o r Archbishop for the Archdiocese of San Francisco with the right of succession, and was consecrated bishop on September 16, by Archbishop Patrick Feehan in Chicago.

Riot'dan 's reputation as a builder and fundrai ser was quickly evident as he began to expand and enhance the foundation laid by Archbishop Alemany. Distressed by what he considered to be the poor quality of the buildings in the archdiocese, Riordan began a lhassive building and restoration program to upgrade wooden churches and structures to brick and stone buildings. An ardent supporter of Catholic education , he significantly expanded the parochial school system. The crowning achievements of the first fifteen years of his episcopate, however, were the construction of a new St. Maiy 's Cathedral , and the construction of St. Patrick's Seminary in Menlo Park. [Riordan 's contentious relationshi p New St. Mary 's Cathedral, with his most fiery priest , Father Peter C. Yorke, will be treated in a future article in this series.]

St. Mary s Cathedral

After less than three decades of service , the old St. Mary 's Cathedral , built in 1854, found itself increasingly unwanted. The environment around the Cathedral had deteriorated so badly that Archbishop Alemany decided to move the Cathedral to a better part of town. In 1881, he issued a pastoral letter in which he noted "the necessity of removing the cathedral from its objectionable location to some more respectable and suitable part of the city." By the end of 1883 Alemany had purchased a lot for the new Cathedral in the western part of town

at Van Ness and O'Farrell. He left die construction and funding of the new Cathedral to his successor.

Archbishop Riordan concurred with Alemany 's assessment. He wrote, "The location of the present Cathedral is such that it can scarcely be approached from any direction without a shudder at the sinfulness and filth of its surroundings , henceâ&#x20AC;&#x201D;even for no other reason the necessity of a new Cathedral in a more secluded and respectable location, is one of the greatest and most pressing wants of this Archdiocese." So abhorrent did Riordan find the location of the Cathedral that he refused to live in the Cathedral rectory; instead he took up residence in the small parish of St. John the Baptist on Eddy Street between Octavia and Laguna , where he remained until the completion of the new Cathedral.

Riordan set about raising funds for his new Cathedral. Ground was broken in December 1885, though the cornerstone was not laid until May 1, 1887. Finally, the new Cathedral was completed and dedicated with elaborate ceremonies on January II , 189 1 as St. Mary of the Assumption. The impressive red brick structure was built in the style dubbed "Modem Romanesque" at a cost of about $350,000. The Cathedral served impressively for more th an seven decades before being destroyed by fire in 1962.

With his Cathedral completed, Riordan turned his attention to his next major endeavor â&#x20AC;&#x201D; the construction of an archdiocesan seminary.

St. Patricks Seminary

In one of his first actions as archbishop in 1885, Riordan had been forced to close the second seminary established by Archbishop Alemany,but he did not give up the idea of having a seminary of his own. There was a desperate need for native clergy. On his ad limina visit to Rome in 1888, Archbishop Riordan stopped in Paris to importune the Superior of the Society of St. Sulpice, Henri-Joseph Icard, to send his priests to staff a new seminary in San Francisco. The Sulpicians are a society of diocesan priests who devote themselves to training seminarians. Founded in 1641

by Jean Jacques Olier, the Society had gained international renown as seminary instructors.

Icard , however, declined Riordan 's request.

Undeterred , Riordan proceeded to Rome where he informed Pope Leo XIII of his p light.

Leo reportedly responded , "I shall intercede for you'. You shall have the Sulpicians. " Riordan , not content with mere papal intercession, took his request to a higher source. On his way back to Paris he stopped at Lourdes , where he sought Our Lady 's help - asking her to intercede on behalf of his seminary. Whether it was the Pope, the Blessed Mother, or his own pleadings, Icard gave Riordan a verbal commitment to supp ly Sulpicians for his new seminary. It was to be another decade, however, before Riordan 's plan came to fruition .

Finally in late summer 1898, St. Patrick's Seminary opened in Menlo Park on 83 acres of land donated by Mrs. Kate Johnson. The new seminary was designed by the highly respected architect Charles Devlin , and though only two-thirds of dedicated January 11, 1891 the building was completed in 1898, it was decided that this was sufficient to open the minor seminary. On August 24 , 1898, the seminary was dedicated , and on September 20, the seminary received its first students. St. Patrick's opened as a minor seminaty with 31 high school students and three advanced students. In 1904, the Department of Theology was opened; the twelveyear academic program was now complete and in place. 1904 also marked the arrival of the new Superior of the Seminary, Sulpician Father Henri A. Ayrinhac affectionately , known to the students as "The Boss," who served as rector from 1904 to 1930. Since that time hundreds of priests have emerged from St. Patrick's to provide dedicated service to the archdiocese.

The Pious Fund With his seminary up and running, Riordan enjoyed two legal victories. In 1900, California voters endorsed his campaign to amend the California state constitution to eliminate taxes on church buildings. More significantly, the long-running Pious Fund case was settled in favor of the archdiocese. The Pious Fund had been established in Mexico as a trust to fund missionary activity in Baj a and Alta California, but it had been appropriated by die Mexican government in 1842.

In 1875, the archdiocese had won an initial j udgment in the case, but as of 1902 problems persisted. In tliat year the governments of Mexico and the United States agreed to submit the case for arbitration to the Permanent Court of Arbitration at The Hague. Tire Hague Tribunal, as it was popularly called, grew out of an international peace conference held at The Hague in 1899The Pious Fund was the first case to be argued in front of the court. On October 14 the Archdiocese was victorious. The Court instructed Mexico to pay the Archdiocese $1,240,684.67 in back payments, and ordered the government to pay an annual fee of $43,050 each year on February 2 "perpetually.. .in money having legal currency in Mexico. " Mexico complied with the decision until 1913, when it again defaulted in its payments as a result of the Mexican Revolution . The case would not be finall y resolved until the 1960s.

The 1906 Earthquake

Mercifully, Archbishop Riordan was not in the city when the earthquake hit. He was in Omaha, Nebraska on his way to a national meeting of the United States bishops. Many felt the shock of seeing his archdiocese destroyed would be too much for the archbishop. Riordan decided not to return to San Francisco immediately, opting instead to raise funds in the east before returning.

Upon his return to San Francisco, Riordan visited the refugee camps and tried to rally the drooping spirits of the dazed San Franciscans. He celebrated Mass outdoors for the people, and assured them, "We shall rebuild ."

Riordan prodded San Franciscans to endure. According to his biographer , James Gaffey, "After a survey of his see city, Riordan played a conspicuous role in restoring San Francisco. " In a dramatic speech delivered at a meeting of the Citizen 's Committee , Riordan began with the words of St. Paul, "I am a citizen of no mean city, although it is in ashes. Almighty God has fixed this as the location of a great city. The past is gone, and there is no use lamenting or moaning over it. Let us look to the future and without regard to creed or place of birth , work together in harmony for the upbuilding of a greater San Francisco."

True to his word, Riordan committed himself to the reconstruction of the Catholic Church in San Francisco. By 1908, eveiy earthquake-damaged parish save one had reopened.

In the midst of all its success, the archdiocese and the city of San Francisco were about to experience a major setback. On the morning of April 18, 1906 at approximately 5:13 am , San Francisco was rocked by a devastating earthquake , destroying much of what had taken Archbishop Riordan twenty-two years to build. Though no accurate Final Years reading exists , it is estimated that The last nine years of the earth quake was a magnitude Riordan 's episcopate were con8.4 on the Richter scale. As devassumed by his efforts to restore the tating as the earthquake was, a Church in San Francisco. Even greater disaster was in the offing. before the earthquake , however, Fires had broken out in a number of places in the city; as firemen Riordan had petitioned Rome to send him a coadj utor bishop tc rushed to put them out , they made assist him with his extensive archthe awful discovery that they had diocese. On February 8, 1903 no water. All the water mains into George Montgomery was appointthe city were broken, making it ed, but after serving impressivel y impossible to put out the fires. for four years, he died prematurely Fires would rage for the next St. Patrick Seminary, dedicated 1898 on January 10, 1907 , forcing three days destroying the entire Riordan to resume his search foi downtown area to Van Ness Avenue. an assistant.

His nomination of Edward Hanna of Rochester , a seminary professor, resulted in and much of the South of Market District. More than 450 city blocks were destroyed. City builda long and bitter dispute with the Vatican, which denied Hanna 's appointment on die grounds ings , schools , churches , homes, businesses were all engulfed by the raging fire. The official that Hanna was a "modernist. " Ultimately, Hanna was appointed as an auxiliary in 1912, and death toll was 456 but clearly many more had lost their lives. An estimated 250,000 San succeeded Riordan as archbishop in 1915; however, the whole episode left a bitter taste in Franciscans were left homeless (in a city of about 400,000) . Many sought refuge in camps at Riordan 's mouth. the Presidio and at Golden Gate Park. Others fled to Oakland or to the Outer Mission District.

Archbishop Riordan died on December 27, 1914, one day short of his thirtieth anniverThe Catholic Church suffered massive losses. James Kelly wrote in The Monitor's 1953 sary as archbishop. Riordan 's diirty-year episcopate had been an eventful one. He had taken Centennial Histoiy of die Archdiocese, "More than half the churches and Catholic institu tions the frontier archdiocese he inherited from Archbishop Alemany and had built a modern dioin San Francisco were totall y destroyed or badly damaged.... Churches destroyed: St. cese.

In 1906, he saw much of his efforts destroyed , but he peisevered. By the time he died, the ' Patrick's. St. Francis [of Assisi], St. Ignatius, St. Dominic 's, St. Joseph's, Old St. Mary s, St. church in San Francisco was firmly established and prospering mightily.

Follow the money

Beyond the war in Ira q Many Catholics of good conscience strongly agree witii the view ot the Bush Administration that a war against Iraq is necessary to disarm that country of weapons of mass destruction and dispose of the regime of Saddam Hussein.

At the same time, many other Catholics of good conscience strongly oppose a war in Iraq, viewing this action as beyond the means necessary to accomplish the goal of Iraqi disarmament and concerned with war 's destruction and unknown consequences.

In January, Pope John Paul II spoke out against a possible war, saying that military force always must be "the very last option. " He said, "war is not always inevitable " and is "always a defeat for humanity."

While acknowledging the dangers posed by the current Iraqi regime, U.S. Catholic bishops have raised questions about the moral legitimacy of any preemptive and unilateral use of military f orce to overthrow the government of Iraq.

In a recent statement on Iraq the bishops said, "We have no illusions about the behavior or intentions of the Iraqi government. The Iraqi leadership must cease its internal repression, end its threats to its neighbors, stop any support for terrorism, abandon its efforts to develop weapons of mass destruction , and destroy all such existing weapons."

However, the bishops said their consideration of moral questions led them to urge alternatives to war in the Middle East. "It is vital that our nation persist in the very frustrating and difficult challenges of maintaining broad international support for constructive, effective and legitimate ways to contain and deter aggressive Iraqi actions and threats," the bishops said.

On the other hand, U.S. theologian Michael Novak has supported the case for war in Iraq, say ing military action is justified under traditional self-defense princi p les and not under some new concept of preventive war.

Novak argues that Saddam Hussein has disrupted international order by refusing to disarm and that Iraqi weapons risk falling into the hands of international tenorists eager to strike countries around the world with no advance warning. He maintains that "a limited and carefuUy conducted war to bring about a regime change in Iraq is, as a last resort, morally obligatory."

Nonetheless, there continues to be a sharp divide in opinion among the American population , even as the nation moves ever closer to war in Iraq .

While most Americans agree that the nation should respond militarily to threats of imminent danger, a national debate on how we should deal with the very real dangers posed by the Iraqi regime has not taken place.

Political leaders are reluctant to challenge any steps put forward under the banner "everything changed after 9/11." Actions , such as preemptive wars, which are counter to the traditions of the nation , now are promoted as absolutely essential. . .

The nation would have tried to destroy the Japanese carriers bent on attacking Pearl Harbor, of course. But would we have attacked Japan if we only believed diat Japanese militarists had the weapons and the desire to strike?

Secretary of Defense Donald Rumsfeld said recently that the case for war against Iraq "is clear to anyone who has the will to see it." But what does this say to people who believe that there are alternatives to the imperative for war presented by the Bush Administration?

Already, the institutions of the United Nations and NATO have been shaken as they face the choice of either acceding to die will of the United States or becoming irrelevant.While the UN certainl y is an imperfect organization, a weakened world body is a dangerous prospect for world peace.

The war in Iraq inevitabl y will cause destruction and death to an Iraqi population already weakened by oppression and deprivation. What will be America 's involvement and cost in the process of post-war nation building in Iraq ? How will this new commitment affect our present obligations in Afghanistan, Israel , Egypt , South Korea and other parts of the world?

With the nation already facing a monstrous projected budget deficit — even without the war cost — how will we revive the U.S. economy, pay down the deficit , create jobs and pay for needed services for our citizens?

President Bush in his State of the Union speech in 2002 spoke of an "Axis of Evil" that included North Korea, Iran and Iraq among other countries. In the Administration's approach to the dangers posed by Iraq, are we establishing a paradigm that will be the model for future action against Iran and North Korea? Are we looking at a future of constant war and certain catastrophe?

Are we prepared to impose a Pax Americana throughout the world? Are we willing to accept all of the consequences of being in that position?

As the nation contemplates the prospect of a near-certain war in Iraq, some very serious thought and discussion should be given to what lies ¦ beyond the war.

While I am not an atheist , I totally agree with Father Lorenzoni about Msgr. John Heaney and the 40 year old charges against him. Also, add to that list, Father Carter of Immaculate Heart in Belmont. Both of these men have had their good names mined. They will never get them back.

I call upon the archdiocese to act quickl y on its own, and if there is nothing to the charges, reinstate these good men, g ive them their names back.

These charges are not about justice but about parasitical lawyers and money, money, money. Lawyers and their allies in state legislatures all across the country have changed statute of limitations laws to target the Catholic Church alone in this greedy attempt to make more money, knowing that these 25 p lus year old cases cannot be defended. As Father Larry said, follow the money.

Yes, there are cases that are legitimate claims, but they are easy to differentiate.

I do not believe these two fall into the legitimate category.

Also, great thanks to Bishop Weigand and Msgr. Kavanagh for their stand barring Governor Davis from distributing Christmas gifts because of his support for abortion. God love these two good priests. We need more like them.

The latter were a prominent order in the East and the Midwest, but not in early California.

Since the early orders not only administered, but also financed most of the charitable works of the Church in San Francisco, I hope this will be recognized in the future .

I was surprised that in George Weigel's explanation of "The Catholic Difference" (CSF - Feb. 6) he stated that Catholic doctrine is that decisions as to go to war must be entrusted to those who have responsibility for the common good.

This seems to leave no room to question whether those with such responsibility are properly exercising that responsibility. Whether Hitler properly acted when he ordered the invasion of Poland or Russia. Whether the Japanese leaders properl y acted when they ordered the invasion of China or war with the United States. Whether Saddam Hussein properly acted when he ordered the invasion of Kuwait.

In each case they were the people with responsibility for the common good of their people, as were the leaders of Venice when they conquered Constantinople, as were the Ottoman leaders when they conquered Constantinople, as were Attila and Theodoric.

On the other hand, the leaders of the American Revolution had no such authority, George III had it.

It seems that this Catholic doctrine as explained by Mr. Weigel should be reconsidered.

Bishop William Weigand of Sacramento has made clear the obli gation of selfproclaimed Catholics who defy unequivocal Catholic doctrine to refrain from receiving communion until they experience a change of mind and heart. The Holy See has underscored the particular obligation of such who are legislators.

Congresswoman Nancy Pelosi, the Democratic leader in the House and of Representatives , Congresswoman Anna Eshoo from the mid-Peninsula are such persons.

Both are among the most fervent proponents of abortion, including that hideous procedure known as partial birth abortion .

Archbishop William Levada is their bishop. Please God, he might follow the example of Bishop Weigand. As St. Ambrose wrote, "Not for every idle word must a man render an account, but for every silence."

A jo y to read Zappia

One the of joys of reading Catholic San Francisco is that of knowing about dedicate d people whose mission is to help others see ——' themselves the way God created us to be. I am referring to Ms. Evel yn Zappia 's article on "Gracenters Newest Challenge" {CSF - Jan. 24) The objective of the Good Shep herd Sisters Gracenter as embodied in the Congregation 's motto, "One person is more valuable than the whole world ," gives us a picture of how we as God' s creation should treat other people. Like anyone else, during our trying times, during the dark days of our lives we need caring and supportive people to walk with us. We need people who understand us and take us for what we are. We need people to help us clear our minds when we are confused. We need people to rejoice at our triumphs no matter how simple they may be. We need people to feel and cany our pains with us. We need people to show us that no matter how rough the sailing, if we have a strong faith in God and if we believe in ourselves, life will go on we can stand and face the trials of life. The women at Gracenter found all these from the Good Shepherd Sisters and the staff.

I am blessed to personally know one of the Sisters you featured in the article. Sister Olga Cristobal is my sister. 1 have also met Sister Madeleine Munday, the inspiring administrator and the other encouraging Sisters - Barbara , Gertrude , Joan and Danielle.

Congratulations to the Sisters and the staff and residents for their dedicated service. May you be rewarded for wholeheartedl y giving of yourselves to others .

I hope the readers of Catholic San Francisco will give their financial and moral support to Gracenter 's addiction treatment program. Programs like this will be successful and will continue if everybody lends a hand.

The end of "I'm personally opposed, but... " In an editorial issue marking the thirtieth anniversary of Roe v. Wade, the National Catholic Reporter urged the U.S. bishops to "find a way to work productivel y with pro-choice Catholics in hi gh office , " arguing that pro-abortion Catholic politicians "should not face banishment from public events on Catholic soil because of their public policy views , nor should they fear refusal at the communion rail. " "Quiet respect , not burnt brid ges, is both the prudent and productive course of action ," the Reporter counseled.

As that issue of the NCR was hitting mail boxes and news stands , Bishop William Wei gand of Sacramento was taking a dramaticall y different tack. At the Pro-Life Mass at Blessed Sacrament Cathedral on January 22, the bishop confronted the problem of California Governor Gray Davis ' s insistence that he was proud to be a "pro-choice Catholic. " After recountin g the efforts of Governor Davis 's pastor to get him to examine his conscience and think throug h the anomalies of his position , Bishop Weigand noted that the governor had continued to insist that his pro-abortion position was authenticall y Catholic. The bishop then said what had to be said: "As your bishop, I have to say clearly that anyone — politician or otherwise — who thinks it is acceptable for a Catholic to be pro-abortion is in very great error , puts his or her soul at risk , and is not in good standing with the Church. Such a person should have the integrity to acknowled ge this and choose on his own volition to abstain from receiving Holy Communion unti l he has a change of heart."

Governor Davis 's spokesman , Russ Lopez , said that the governor "would not back down " and criticized

Bishop Wei gand for "telling the faithfu l how lo practice their faith. " One wonders what Mr. Lopez imag ines bishops are for. Moreover , one wonders whether the National Catholic Reporter agrees with Mr. Lopez and Governor Davis.

The incongruity of the NCR 's claim that abortion is merel y another "public policy issue " was driven home by the Congregation for the Doctrine of the Faith' s recent "Doctrinal Note on Some Questions Regarding the Partici pation of Catholics in Political Life." Its stod gy title notwithstanding, the "Doctrinal Note " should mark the end of Cuomoism in the U.S. Church: the attempt , primaril y by Catholic Democrats , to finesse the abortion issue by declaring oneself "personall y opposed" to abortion but equall y opposed to "imposing my values " in a "pluralistic society."

The "Doctrinal Note" shreds this preposterous claim in two ways. First, it unabashedl y teaches that not all issues are equal. Some questions cut to the very foundations of justice in a society; legal protection for the inconvenient unborn and the burdensome elderl y is one of (hem. This is not a debate about paving the intestates or expanding national forests; it 's a debate to determine whether there reall y is justice for all in America.

Secondl y, the "Doctrinal Note " teaches that the Catholic defense of the right to life is "not a question of 'confessional values '." The Church' s teaching about the right to life is grounded in princi ples accessible to anyone willing to think through a moral argument . The Church' s defense of the right to life , in other words , is genuinel y public in character.

Catholics have a "duty to be morall y coherent ," the "Doctrinal Note" states , and Governor Gray Davis isn 't .

Neither is o p Representative Nancy o £ Pelosi , the new D. rig Democratic minority _l 3 <aj leader in the House of Representatives. Neither g are Senators Biden , Collins , Daschle , Dodd , George Weigel Harkin , Kenned y, Kerry, Leah y, Mikulski , Murray, Reed , and many others on both sides of Capitol Hill (not to mention the several governors ' mansions and state leg islatures).

"Pro-choice Catholicism " is morall y incoherent.

"I' m personall y opposed , but.... " is just as morall y incoherent , and its incoherence is compounded by its profound misunderstanding of the relationshi p between moral truth and democratic politics. Would "I' m personall y opposed , but..." have been an acceptable stance on apartheid?

President Bush has announced his fi rm support for bans on partial-birth abortion and on all forms of human cloning. Some Catholics in Congress will vote against these measures. In the aftermath of such dereliction of duty, whether their bishops take public , pastoral stands similar to Bishop Weigand' s will tell us something important about the nerve and the moral authority of the American episcopate.

Perilous chore of telling weeds from wheat Gardening has become for me a reli gious experience, for going about my weeding and planting, many of Jesus ' parables of seeds and soils and sowers float throug h my mind.

The other day, for examp le, while I strugg led against the grasses taking over the iris bed , I thoug ht of the admonition to let the weeds grow up with the wheat until both are full grown and the Lord of the Harvest returns to jud ge them.

I did not doubt that I needed to give the irises more room , but as I tugged away at the grass , I inadvertentl y damaged some of the tender iris shoots. Undesired plants are often more hardy and tenacious than desired ones, I saw. So, I had to slow down and be more careful.

At least among the irises it is easy to tell the plants apart. Not so in other parts of the garden , where young plants , both wanted and unwanted, can be indistinguishable. After I sow flower seeds, I agonize over

whether the little seedlings that appear are the ones I planted or the vengeful offspring of the weeds I had previousl y dug up. I often misjudge the case and pull out the wrong plant; or, I correctl y identif y a weed, but a whole bunch of other plants come up with it.

As if weeding were not perilous enough already, there is the added ambiguity of classify ing weeds in the first place. I have heard weeds defined as misplaced plants. But that definition imp lies that the something or someone who made them has made a mistake, or at least a decision that inconveni ences me.

I used to think of dandelions as pests and destroyed them without a second thought , until I discovered that their leaves are edible and very nutri tious. Now, instead of throwing them away, I add them to tossed salads.

Believe it or not , they taste better than some of the gourmet greens that sell for $6 a pound in the grocery.

The Church is often maligned for making unjust judgments because she teaches ri ght from wrong. But

by poking around in the garden, it becomes clear that proclaiming the moral law is not the behavior Jesus was condemning when he said, "Judge not." No, it is the ultimate value , or destiny, of our fellow human beings that Vivian W. Dudro we are not permitted to determine , for we do so on the basis of their usefulness to us, forgetting by Whom and for what purpose they were made .

Home: not defined by blood but by faith Among the kinds of loneliness that afflict us, there 's one we don ' t often recognize and deal with very well , the loneliness of moving on. There 's a loneliness that comes 'w ith leaving home, with forever losing loved ones , loved places , and loved things.

Home , T.S. Eliot says, is where we start from. But we never get to stay there for long. Neither does anyone else. From the time we ' re born until we die, we, and everyone else, are on the move. People, places, things , organizations , and knowled ge are passing throug h our lives in a way that is forever cutting away at our roots , destabilizin g us , and leaving us scrambling to find a home.

Finding a home is not , in the end , so much a question of finding a buildin g, a city, a country, or a p lace where we feel we belong. That 's part of it. More deeply, finding a home is a question of moral affinity, of finding another heart or a community of hearts wherein we feel at one, safe, warm , comfortable , able to be ourselves, secure enough to express both faith and affection.

To find a home is to feel what Adam felt when he first saw Eve: "At last , bone from mv bone , flesh from

my flesh!" That 's not so much an expression of sexual attraction as it is of moral comfort. What Adam sensed in Eve , that he didn 't sense in the rest of creation, was a home.

We go throug h life lonel y, looking for a home, aching to stand one day before some person , some place , some truth , or some family and , like Adam, realize that this, among all the others , is what we are looking for — "At last , bone of my bone!" But how to find that? Where is home?

Everywhere and nowhere , it would seem. There 's an incident in the Gospels where Jesus tells us where home is. He 's seated among a circle of disci ples when someone comes to him and says: "Your mother and brothers and sisters are outside asking for you!" Jesus' response is a curious one. No doubt , he loved his mother and his relatives; yet he doesn ' t get up and go out to them. Instead he says: "Who is my mother? Who are my brothers and sisters?" Pointing to those around him , he says: "Here are my mother and my brothers . Anyone who does the will of God, that person is my brother and sister and mother. " Jesus is not distancing himself from his natural

mother , Mary, since she, in fact , among all the peop le around him, is the one who most trul y fits the description for disci p leship that he has just laid down. She, more than anyone else , did the Father will of God. Jesus is redefining what makes Ron Rolheiser for family, for home , for homeland.

Norm ally we define famil y by blood ties , common ancestry, ethnicity, language, skin color, gender, nalionality, or geograp hy. Blood , we say, is thicker than water .

But, according to Jesus, the waters of baptism and faith are thicker even than blood. A share d faith , more than a shared blood , makes for a family. Faith is what ulti mately gives you a home , a homeland , a nationalit y, a mother tongue , a skin color, and a famil y that is lasting.

Liturgy

Music and the law: the Church has something to say I always make it a point to tell my students at the seminary not to quote me. This has nothing to do with being shy (which I' m not) or with being mentioned in public . So what 's the problem? Don 't quote me because I am not the authority behind what I teach.

At my best, I strive to teach the liturgy documents of the Catholic Church. My greatest joy is to see students pour over the Church' s teachings for themselves, work with them , incorporate them in their lives, and apply them in parish situations.

Take the example of music at Mass. In their parish assignments, I urge students to say, "We sing the psalm because that is what the Church teaches." Or "we sing a familiar entrance song which unifies the assembly because that is what the Church teaches." Or "we begin singing the communion song as soon as ihe priest receives communion because that is what the Church teaches." I assure tliem that they won 't get very far outside of the seminary telling people to do something "because Sister Sharon says." The worst idea !

So 1 tell them that I' m not making all this up ! And then I show them where they can find the liturgical law for the whole Church. Regarding music, we study the General Instruction of the* Roman Missal (written for Catholic Churches in every country), and Music in Catholic Worship and Liturgical Music Today (written by the bishops of the United States for all our parishes).

I also stress with them that the goal here is to be wise shepherd s of the people. Understand exactly what the Church teaches and why. When do we sing? What do we sing ? Wh y do we sing? Knowled ge of the liturgical law can mean that then pastoral application of the law can come from thoug htful choices and deep understanding, not individual preference. They are urged as newly-ordained priests not to rely on the phrase: "Sing it this way because that 's what I like." The more important question is what does the Church teach?

How would pastoral ministers even begin to approach the tension between those who long for a deeply contemp lative celebration of the Eucharist (with all the times for silence that the liturgy calls for) and those who long to be revived and rejuvenated with extended times for raising hearts and voices in sung prayer? Can both longings be accommodated?

Study the documents and become your own expert.

Join your parish Liturgy Committee and immerse yourself in the stimulating world of what the Church understands to be the nature of our prayer together. All this is really not a matter of personal preference.

As criticall y import ant as competence is in the area of liturgical law regarding music, it is also vital to be renewed and refreshed in the experience of prayerful and inspiring Church music . We are blessed that just such an

event is happening at St. Mary 's Cathedral on Saturday, Feb. 22: the San Francisco Archdiocesan Choral Festival.

Evangelization

Love changes everything "Love changes" everything " so says Andrew Lloyd Webber in his song of the same name . During the month of February, we are in some ways, forced to think of love.

February 14, the feast of St. Valentine, reminds us of the importance of reaching out and letting people know thai we • love them. Because of the commercial angle to tins we cannot walk into a store or shopping mall without seeing • hearts and reminders to express our love for friends , family and co-workers. This can be very annoy ing to some of us but it can also help us to think about what that little word "love" really means for us.

The Gospels tell us that God so loved the world that he sent His only begotten Son to redeem us. Our gracious God willingly sent His only Son to make the ultimate sacrifice to teach us what love really means. What an amazing thing love is! Because God loved us so much and acted out of love , love changed everything!

St. Paul defines love in his First Letter to the Corinthians, when he says: "Love is patient, love is kind. It is not jealou s, is not pompous, it is not inflated, it is not rude, it does not seek its own interests, it is not quick-tempered, it does not brood over injury, it does not rejoice over wrongdoing but rejoices with the truth. It bears all things, believes all things, hopes all things, endures all things. Love never fails". (13:4-8) It seems to me that our faith tells us that love is a "big deal." It defines who we are as Catholic Christians. If we

take seriously our mandate, as baptized Christians, to follow Christ perhaps we should take a more serious look at how we practice love in our every day living. Here we are not talking about "romantic love " which could reall y be better defined as sentiment. St. Paul was a practical person and in his definition he was giving us a very practical checklist, a way for us to, as it were, keep tabs on how we are doing with this virtue called love.

The way in which the early Christians were recognized was by how they loved each other. In fact we are told that this was what got them into trouble sometimes.

Because of their great love for God, and each other, and for the "new way" of living then faith they were thrown to the lions in Rome. What a powerful force true love must be!

Have you ever met people, who, by their actions, prompted you to think that they are loving persons; persons who personif y love in action? Actually, all Catholic Christians, to be worthy of the name, should be recognized in this way.

I know that it is not easy many times to be the loving people we are called to be. However, I think that if we take St. Paul's definition, one step at a time, and try to practice each step, we will find that, over a period of time, we will begin to get a handle on the virtue of love. It's sort of like learning to dance. Once we learn the steps and practice them all together we can move with the rhythm, in this case, the rhythm of love for God, for each other and love for self.

In St. Luke 's Gospel in response to the scholar who asked Him, "What must I do to inherit eternal life?"

Jesus asked him, "What is written in the law?

The man replied, "You shall love the Lord, your God, with all your hearf, with all your being, with all your strength, and with all your mind, and your neighbor as yourself . Jesus replied, "You have answered correctly; do this and you shall live."(10:25-28) By living the "law of love " we can evangelize the world one person at a time. If we choose to live in love we will discover, as Andrew Lloyd Webber says in the end of his song, "that nothing will remain the same ". So let 's start living today !

as faithfulness and love," he told about 3,500 pilgrims in the Vatican's Paul VI audience hall.

"In a technological world undennined by an eclipse of the sacred, in a society that congratulates itself in a certain self-sufficiency, the witness of the prayerful person is like a ray of light in the darkness," he said.

"Today 's world greatly needs the witness of men and women who pray and encourage others to pray," the pope said. At first , encountering a prayerful person, is likely to arouse an observer 's simple curiosity, but for those who are reflective it also can lead to "questioning the heart and makes for family is not biology but by faith.

In another incident in the Gospels a woman says to Jesus: "Blessed is the womb that bore you and the breasts that nursed you!" In today 's idiom, she's saying: "You must have had a wonderful mother!" Jesus' answer: "Blessed rather are those who hear the word of God and keep it!" He's saying: "Yes, I had a wonderful mother, more wonderful than you imagine; but she didn 't just give me biological birth, she gave me faith!"

We come into this world as a stranger and some people pick us up and make us part of their family. In faith, that happen s again, except our new family is

oneself about the meaning of prayer, and finally, it can prompt a growing desire to experience it," he said.

"For this reason, prayer is never a solitary event, but tends to spread itself as far as involving the whole world," he said.

As in past weeks, the 82-year-old pontiff read only a portion of bis prepared audience text. But he spoke in a clear, relaxed voice and looked up frequently from his text when emphasizing points. After reading a greeting to English-speaking pilgrims, he looked up and added, "Thank you very much. God bless you." bound together b y something beyond blood , ethnicity, and geograph y, and so it outlives these.

Mexican , U.S. bishop s call f or immigration refo rm

By Father Anthony E. McGuire Common advice to overreaching government offices is, "If it is not broken , don 't fix it. " Equall y compelling advice is , "If it is broken , fix it. " This is the advice the bishops of the United States and Mexico have given to their respective governments regarding their immigration policies: they are hopelessl y broken and need to be fixed.

The bishops raised these issues in their first joint pastoral statement. "Strangers No Longer: Together on the Journey of Hope," released last month in both countries.

The signs of brokenness are multi ple. Since 1998 more than 2,000 migrants have lost their lives entering the United States illegall y from Mexico. Since 1994 billions of US dollars have been invested in sophisticated equipment and personnel for border enforcement resulting not in a decrease in undocumented immi grants but in an increase, from 4 million in 1994 to 8 million in 2000. Such a large number creates an underclass of people who live here without legal safeguards or basic security.

The immigration policies routinel y require up to eight years of separation before spouses and children can be reunited. In addition , these policies now demand detention of asylum seekers so that many who escape jail in their own country end up in jail here . These policies are broken and need to be fixed because of the human suffering they are causing.

The pastoral statement draws five princip les from Catholic social leaching and makes recommendations based on them: • Persons have the ri ght to find opportunities to work in their homeland. The bishops recommend the development of employment opportunities in Mexico through the creation of living-wage jobs especiall y at the border and in municipalities and rural areas which have the hi ghest rates of emigration.

• Persons have the right to mi grate to support themselves and their families. Sovereign n ations have die right to control their borders . "These teachings complement each other," the bishops say. "While the sovereign state may impose reasonable limits on immi gration , the common good is not served when the basic human rights of the individual are violated. In the current condition of the world, in which global poverty and persecution are rampant , the presumption is that persons must migrate in order to support and protect themselves and that nations who are able to receive them should do so whenever possible. " • Refugees and asy lum seekers should be afforded protection. Procedures now deny appropriate j udicial remedies and protection to asy lum seekers fleeing from wars and persecution.

• The human di gnity and human rights of undocumented migrants should be respected. They should not be subject to punitive laws or demonization in the media.

The bishops detail these basic ri ghts and the reasonable limits in Ihe following recommendations: the establishment of a new framework for immi gration policies to allow for swifter famil y reunification , a broad legalization program for the undocumented , provision of legal avenues for workers to obtain permanent and temporary living-wage jobs with appropriate benefitsand labor protection, humane enforcement policies in Mexico and the United Slates, and the restoration of due process ri ghts removed by the 1996 immigration legislation.

The bishops were also concerned about the pastoral accompaniment of migrants fro m place of origin , en route and at point of destination. This includes counseling about the dangers of migration , the importance of fidelity to the sacrament of marriage , information about houses of hospitality and Catholic churches and social services along the way. In each stop along the way, migrants should be nourished by the sacraments of reconciliation and the Eucharist.

Mi grants should recognize themselves as bearers of culture and faith who can be evangeJizers in their new country.

The pastoral statement begins with a premise that migration between the two nations is necessary and beneficial for both countries. It is part of the globalization reality which characterizes the connection between Mexico and the United States. Just as there has been globalization of production and investments, so there should be a corresponding globalization of labor.

Both economies have become dependent on the labor of immi grants. Mexico has come to depend on the remittances sent back home, which amount s to $8 billion to $10 billion dollars a year, one of the largest sources of foreign currency in Mexico. In the Unite d Sates one million undocumented are employed in manufacturin g, 600,000 in construction , 700,000 in restaurants , and 1.2 million in agriculture.

The foundation for the bishops ' policy recommendations is the dignity of the worker. The migrant must be seen as a person with dignity and ri g hts whose work is valued and whose salary and working conditions reflect that dignity. ".. . the United Stales needs Mexican laborers to maintain a health y economy and should make a special effort to provide legal avenues for Mexican workers to obtain in the United States jobs that provide a living wage and appropriate benefits and labor protections ," the bishops say. "The U.S. emp loyment-based immi gration system should be reformed to feature both permanent and , with appropriate protections , temporary visa programs for laborers . A system that is transparent and that protects the ri ghts of workers should be formulated. " The bishops also recommend a generous legalization program to address the issue of the millions of undocumented in the country. This recommendation favors those who have lived in the United Stales and have built equities and otherwise contributed to their communities. Famil y

reunification has been a value which both bishops ' conferences have fostered over the years and that value is reiterated in this document with recommendations for a new framework to offer more opportunities for Mexican spouses and children to reunite with their loved ones.

The bishops acknowled ge that they have the primary responsibility to promote a spirit of hosp italit y in diocesan structures and in all parishes. They encourage the development of multicultural liturg ies when appropriate and social outreach to newcomers through parishes and Catholic Charities. Special emphasis is given to the need for competent lawyers to hel p mi grants sort out legal difficulties.

The bishop s pledge themselves to advocate for the ri g hts of migrants , especiall y unaccompanied minors , and to denounce injustices against them. Particularl y urgent is the proclamation of Ihe Church' s social leaching on mi gration in seminaries and periodicals and pul p its , and the preparatio n of appropriate catechetical material to hel p both those coming and those receiving them.

Many dioceses , especiall y in the southern part of the United States, have found themselves without sufficient resources to respond adequatel y to the needs of hundreds of Spanish-speaking immigrants. To deal with this problem , the bishops pled ge themselves to study the dioceses in Ihe United States which are in need of an infusion of pastoral workers : priests, reli gious and lay leaders.

The bishops hope to organize a more comprehensive pastoral outreach which will accompany the migrant at p lace of origin, en route and at p lace of destination. Discussions are to take p lace on the possibility of seminaries for the prepara tion of priests specializing in this ministry or on the possibility of specific reli gious communities focusing on this ministry. More frequent exchanges between parishes and dioceses in both countries are encouraged. .

The bishops hope that this document will jump-start the talks between Mexico and the United Stales which were abandoned after the terrorist attacks of September 11 , 2001. While security issues are critical at this point, a more transparent and just system of immigration flow will also contribute to greater security because the clandestine elements are removed.

The Spanish edition of the document was issued in the Basilica of Our Lady of Guadalupe in Mexico Cily; in the same p lace and on the same dale in which four years earlier Pope John Paul 11 promul gated Ecclesia in America which encouraged solidarity among the local churches of America. This loving presence of Our Lady of Guadalupe is the insp iration which guided the bishops as they strove to respond creativel y to the tragic circumstances of mi grants. " The appearance of Our Lady of Guadalupe to St. Juan Diego revealed the compassionate presence of God reaching out to Mary to be in solidarity with a suffering peop le.

In the same spirit , we, the Catholic bishops of the United States of Mexico and the United States of America have written this letter to give hope to suffering mi grants. "

This landmark book has been reissued in a 25th anniversary edition. It contains essays by Abbot M. Basil Trappist Pennington, Trappist Father Thomas Keating and Jesuit Father Thomas E. Clarke presenting a prayer method traditionally honored and taught all over the world.

Centering, or contemplative , prayer was part of the church's tradition until the 16th century, Father Keating writes, when it began to be discouraged and neglected in favor of more active forms of prayer supposedl y better suited for the apostolic life. Controversies of that time produced a distrust of mysticism, and mystical writers of the past were then ignored. Later, an j unhealth y emphasis on private devotions and apparitions led people to confuse contemplation with strange visions, the stigmata or levitations — experiences not meant for ordinary people.

Msgr. Heaney's trial is delayed pending high court decision In another San Francisco sexual abuse indictment , handed down the same week, a neurosurgeon accused of sexually abusing patients , including a minor, wilh forced penetration after drugging the alleged victims, bail was sought by the same office at $250,000. Those allegations are current with named witnesses.

At Msgr. Heaney 's arrai gnment on Jan. 29, more than 100 police officers and others fi lled the courtroom in support of the priest who has been chap lain to the San Francisco Police Department for 35 years. He also was supported by four former police chiefs and Senator Dianne Feinstein, according to lawyer Jim Collins , who represents Msgr. Heaney.

Collins has said Msgr. Heaney is innocent of the charges, and at the hearing he argued for the dispensation of bail on the basis of Msgr. Heaney 's decades of service to the City and the police and his failing health. He said Msgr. Heaney posed no flight risk and that after decades of service and ministry to tens of thousands of San Francisco and Marin youth , no other allegations of improper contact had been made against him. When Mr. Collins asked who would vouch for Msgr. Heaney 's future court appearances, several officers shouted "Here, here!"

Over objections of the prosecutor, Superior Court Jud ge Kay Tsenin reduced bail to $ 150,000 and ordered Msgr. Heaney to home detention pending resolution of the case.

Last week, the District Attorney's office announced that Msgr. Heaney 's case would be postponed until June or later.

A trial on abuse charges against Msgr. John Heaney will be postponed pending the decision of the United States Supreme Court on a case which could impact thousands of older sexual abuse cases across the country.

San Francisco District Attorney spokesperson , Mark MacNainara does not believe the Court 's decision in Stogner v.

California will result in a dismissal of Msgr. Heaney's case.

Nonetheless , a defense request to delay a trial in Heaney 's case pending the Supreme Court 's decision was granted.

Msgr. Heaney was indicted by a San Francisco Grand Jury Jan. 23 on allegations that he abused a boy 40 years ago. The name of the alleged victim , now 49 years old , as well as the names of two persons testifying to the indictment have been concealed. They are listed in the indictment only as Richard E., Rodney E., and Bruce E. No specific dates of any violations are stated in the indictment and it includes the names of no named witnesses in the 40-year-old allegations.

Several days after the indictment , Erin Gallagher, with District Attorney Terence Hallinan 's office posted a message on the website of the Survivors Network for those Abused by Priests (SNAP) seeking witnesses against Heaney.

Msgr. Heaney surrendered voluntaril y to authorities on Jan .

27. He was held on the District Attorney 's proposed bond of $800,000, or $100,000 for each alleged contact with the same alleged victim.

Law lifting statute of limitations is challenged In December the U.S. Supreme Couit agreed to hear a case challenging a California law that lifted the time limit for pressing charges in cases of child sexual abuse.

In 1998, Mario Stogner was arrested and charged with sexual abuse of two members of his family during the period 1955 to 1964. Stogner was charged under provisions of a 1994 California law which lifted the statute of limitations in such cases. Criminal cause for action against Stogner would otherwise have expired. Stogner appealed the charges. His appeal was denied, and he then went to the Supreme Court, which will hear oral arguments in the case on March 31.

The question before the court is whether the legislature's revocation of the statute of limit ations violates the Constitution's ban on Ex Post Facto laws. Numerous states have, in recent years, altered or extended time limits in child sex abuse cases.

expired cases under the new statute of limitations is unconstitutional, thousands of cases nationwide could be dismissed according to Adult Victims of Childhood Abuse (ADVOCA). The group monitors legal developments affecting the ability of adults to seek redress for childhood abuse, Its estimate of several thousand cases potentially affected by the Stogner appeal is based on a broad view of the extent of child sexual abuse in America and not limited to priest sexual abuse cases. "Pedophiles do not hide only behind the cloth; they are hidden among our trusted neighbors, our teachers, our soccer and Little League coaches; they are to be found everywhere children gather, and their victims are legion," according to ADVOCA, Professor William Basset of the University of San Francisco School of Law, said the traditional reasoning for a Statute of Limitation "is that problems of evidence and false accusation grow exponentially over time."

Following the bail hearing, David Clohessy, president of the Survivors Network of those Abused by Priests, and local SNAP representative Terrie Light, sent a letter of protest to the San Francisco Police Chief. A modified version was reprinted, in part, by the Son Francisco Chronicle.

Mr. Clohessy and Ms. Light claim that victims of abusive priests were "hurt and angered by what these officers did." They feel that some potential future claimants "may be frightened or discouraged, and may be intimidated into keeping silent," if they see "officers rallying behind accused child molesters."

According to the bail reduction motion by defense attorney Collins , police support Heaney because over the last 30 years, Heaney has counseled "several thousand police officers, firefighters and merchant seamen... responded to every shooting involving a San Francisco Police officer . . . said Mass at every police funeral of officers who have died in the line of duty . . . received the Medal of Valor for successful intervention in a hostage situation ," and for 30 years "has assumed primary responsibility" for notifying and counseling the families of officers killed in the line of duty.

Mr. Collins said that as chap lain of the International Association of Police Bomb Squads , Heaney worked 12 to 16 hour days searching for alleged bombs and digging through the rubble of the World Trade Center following the September 11 attacks.

Last week, the San Francisco Police Commission, responding to SNAP's request , agreed to bar uniformed or on-duty police officers from showing up in support of accused persons hi court. However only a handful of the hundred Heaney supporters at his bail hearing showed up in uniform.

In his letter, Clohessy demands the police department require all officers on or off duty who supported Heaney, offer a "mandatory apology ", attend a special sensitivity training session, be banned from future court appearances in support ot defendants and be formally reprimanded and disciplined. He further states that it is "imperative " that the San Francisco Police Department "not allow any future public displays of support for Heaney."
