Focus now turns to 2021 General Market Comments The highly anticipated implications of COVID-19 have not been as dramatic as many would have expected, although New Zealanders are still being warned to prepare for a recession during 2021. The economy has dealt with and bounced back significantly well from the initial lockdown periods, however the economy continues to remain vulnerable, and businesses are being warned to expect more tough times heading into the new year. Economists are expecting GDP quarters to fall three times throughout 2021 despite experiencing positive growth during the September and December quarters this year. However, investment in commercial property is not necessarily seen as undesirable as the directive of RBNZ has slashed the OCR to a record low of 0.25%, which means interest on borrowing has significantly decreased. Office overview Many office-based businesses have seen adjustments to expectations endured from the COVID-19 lockdown and the ability to work digitally from home. The idea of working from home has been questionable in recent years, although many businesses saw great success during the lockdown period without loss of productivity. Many

businesses are introducing strategies that encourage employees to work from home as productivity increases due to less time spent commuting while being able to minimise overhead costs related to office-based expenses. Combining these factors with the rising rate of unemployment has resulted in increased vacancy rates throughout the country.

Summary
The retail sector initially saw the greatest impacts resulting from COVID-19. Contributing factors for this were due to decreases in quarterly spending, and restrictions placed on consumer movement and transport earlier in the year. However, consumer confidence has rebounded positively in recent months, which has created a more positive outlook for the retail sector heading into 2021. Industrial overview In spite of COVID-19, the industrial sector has continued to show significant resilience against current market conditions. Escalating demand and scarce supply factors have meant the industrial sector has been able to maintain strong performances across the country. Although, with a particular level of uncertainty in respect of what 2021 will bring and the possibility of

Commercial Property Management COVID-19 (Oh no not again) Property Brokers Commercial Property Management is responsible for over two billion dollars of property across New Zealand, a number that has been affected due to the impacts of COVID-19. Tenants were put under pressure to pay their rent while their businesses were not fully operating, while landlords were under pressure to meet their mortgage commitments. Some landlords panicked and agreed to conditions out of proportion to the economic damage. Hindsight is a wonderful thing, but to be fair, these were unprecedented circumstances. Property Brokers’ Commercial Team were grateful that we could gather intelligence from our software provider and commercial portfolio to set fair rates and protect the value of the asset for our landlords. On 16 May 2020, the notice period for unpaid rent was extended from 10 working days to 30 working days. This gave commercial tenants more time to catch up on rental payments. If tenants were unable to catch up, we were able to negotiate temporary changes to the rent or lease agreements. This helped the tenant get by until they could resume operating as usual. The Government introduced this to share the financial pain between landlord and tenant, though, in practice,

landlords were often refused payment holidays by banks. So, though we may be biased, landlords tended to get a bigger share of the COVID-19 pain. The current law also says that lenders must give 20 working days notice before they use their powers to take possession of or sell a mortgaged property. The temporary law changes extended that period to 40 working days. I haven’t heard of any forced sales in any of the Property Brokers regions however. On 30 July 2020, the Minister of Justice announced a government subsidy to assist with the cost of mediation and arbitration for New Zealand businesses and landlords around adjusting rent and other issues related to COVID-19. At the time of writing, this has not been tested by any property managers I’ve talked with. The best approach is to work together constructively to find a solution which
is sustainable and will meet all parties’ needs. This is an approach that many commercial property managers and tenants are developing and using successfully. The economy is recovering better than expected. The commercial sector is doing well in the regions and with a vaccine likely the future looks very positive. Building Compliance A case study Many property transactions commence as a typical landlord/tenant leasing scenario where a tenant enters into a conditional agreement to lease part of a landlord’s building. In this case study, the tenant required a change in the fit-out and agreed to complete this work at tenant cost. Building consent application was made by the tenant for minor fit-out changes. The Territorial Authority, as part of granting building consent, required a new firewall between the residential and retail parts of the building, and a fire alarm upgrade covering the entire building. The tenant’s view was that they should not be involved in anything outside of their tenancy. The landlord’s view was that the tenant agreed to fund the entirety of the fit-out, and did not agree to fund anything.

The learnings are that the Building Act is quietly growing in technical complexity. Its interpretation can be difficult for the non-experienced to anticipate. It is not advisable to enter into an agreement to lease involving fit-out without an up to date understanding of the implications of the consent process.
