Real Estate Deal Killers!

possible obstacles to a successful closing On the surface, it would seem that once a contract has been signed for a home, that the Realtors job is done. In actuality, it is just beginning. This is the area where an experienced and savvy Realtor is worth their weight in gold. In today’s real estate climate there are many challenges to getting to the closing table, both for buyer and seller. Unqualified buyers! Today’s buyers are ever more educated. They generally understand that they need to have pre-approval by a bank before beginning their house hunting and especially before putting an offer in on a property. Agents too, are insisting on verifying pre-approvals before taking buyers out to look. After all, what is the point in taking the time away from qualified clients or family, money paid for gas and wear & tear on the car, as well as expending considerable effort to show homes to people who ultimately do not qualify to buy. I still find agents who do this, having taken their buyers word that they are ready to buy. One way I protect my sellers is to insist on a pre-approval letter or if a cash deal, proof-of-funds to accompany the offer. When they are not readily available, that they come within two days of acceptance of offer. If not, then the deal dies - this is written as such in the acceptance of the offer as a condition. You would be amazed how many deals have gone by the wayside, once these conditions were enforced. There is no reason today, to accept an offer with out the buyer extending proof they are able to close the deal. What comes with the house? When working with sellers getting ready to list their homes, I always ask if there are any fixtures that are not staying. I often get puzzled looks, as I begin to explain that fixtures such as chandeliers, liquor bars, handicap aids such as a stair-lift, may be assumed to come with the home, if they are attached physically to the walls, ceilings or floors. After the explanation, I ask if there are to be exceptions to this rule, and often at that point get a response that Grandmas Victorian light over the kitchen table or the spectacular selling point, a $10,000 chandelier that just “makes” the front entry way, are not staying. I immediately ask that the seller remove these items and replace them before we put the home on the market. Often the seller wants to leave these items in place, explaining that they will help sell the house. This is when I have to explain how that item can become a deal killer. If left in place, often a buyer is as charmed by them, as the seller. These items can become such a bone of contention a deal could fall apart at the closing table or before, even if

they are listed as not coming with the house in the listing information. There are many the buyers who, in an act of bravado, declare: “If that doesn’t come with the house we aren’t buying it!” To that I respond: “Everything is negotiable” and write it into a contract to be offered. Now the seller has to decide, take the deal as is or risk losing it because of an item they refused to remove prior to the house coming onto the market. Often in cases such as these, the sad thing is that the buyer would have never missed that item, it did not sell the house, but became a “spoils of war” in their attempt to get the best deal possible. Inspections. This is the most common reason deals fall apart: an inspection that just does not come in as hoped. There might be too many repairs needed and a buyer may see the house as a lemon, one that they do not want. But sometimes, inspection results are the door to negotiating the price down further, after an offer has been accepted. Further negotiation is a possibility I counsel my sellers could come along, and if it does, it is my job to try to keep the deal intact. To circumvent this, when I am the listing agent I sometimes suggest to the seller that they have the house inspected prior to going on the market. Once inspected, I recommend the sellers repair the major issues that could cause a deal to fall apart, if they can afford it. If the seller cannot afford this, I ask that the cost of repair be built into the price, which is known as a price adjustment. I additionally ask that the owners get several estimates for repair and have them available for potential buyers to see. This usually prevents buyers from inflating the repair cost unreasonably; which could prevent an offer being written. The price adjustment is always pointed out to the buyers agent, prior to their bringing clients through. If the buyers know in advance there is an issue and the price has been adjusted, they are more likely to bring a realistic offer to the table. If there is no home inspection by the seller, I always prepare them to expect some demands from the buyers in form of repairs or sellers concessions at the closing table. More importantly, I council buyers prior to going out looking for their new property, that inspections are primarily to be used to determine the condition of the house. If these conditions are health and safety we can and should ask for repairs. This is not intended as a tool for a free-for-all moment where the buyer can “shop” for home improvements on the sellers dime. The buyer is aware of what the house needs and should put an offer in, priced accordingly.

Fortunately, most buyers agents understand the need to educate their clients on the purpose of the home inspection; which is a tool to prevent the buyer from buying unexpected problems, as well as an opportunity to have items fixed or compensated for (if not already done in pricing of the property) that concern health and safety. Unfortunately, there are buyers agents that do see the inspection as a tool for reducing the price even further. This allows that agent to write a higher priced offer than the buyer would normally have agreed to, locking the house into contract. The buyer and agent are operating from the assumption that the seller will agree to any demands resulting from inspection since they do not want to lose the deal. This is a false premise. Once the inspection is done, the buyers are counseled by the agent to ask for larger than normal concessions or repairs to items that have nothing to do with health and safety. This creates an adversarial atmosphere. While there are some sellers that will cave, there are others that absolutely refuse and insist on the deal dying. This type of representation by an agent, is counter-conducive to deals coming together in an honest way and create ill-will all the way around. The good news is that while most inspections yield some need for repair or concessions, they are handled professionally by most agents on both sides and don’t stall or kill a deal. My advice to buyers is ask a potential buyers agent what they believe the purpose of the home inspection is. If they offer it as a tool for price re-negotiation, be aware that success in acquiring a property may be hard to come by. Buyers Spending Spree! When working with buyers one of the first things I tell them is stop buying things! Immediately. Even though they have a pre-approval, buyers often do not know that if they were to buy on credit, a big ticket item such as a car or many items that accumulate up to a sizable dollar amount, that they could become ineligible to buy their home, due to too high a debt load. Bankers look for certain debt to income ratio before issuing the mortgage. The guidelines are defined by the type of mortgage. Buyers should discuss any proposed large purchases with their mortgage officer prior to the buy to make sure they do not ruin their debt ratio to where they can buy that item. Often, once they have closed they are still able to make the purchase, they will still be approved. The buyer might want to ask themselves, is buying a car or furniture more important than

buying the house? In most cases, they for-go or postpone their buys until after their closing. Often buyers do not realize that the debt ration is reviewed periodically during the contract period, but is always reviewed in the days immediate to closing, so any purchase(s) will be uncovered, Better to wait, always! Attorney Approval. Yes, this happens for a large variety of reasons. There may be an issue that an attorney spotted. Or sometimes, especially if the attorney does not represent buyers and sellers on a daily basis, they try to be a hero and nit-pic what normally are nonissues, such as where the deposit will be held. Buyers and sellers can instruct their attorneys to disapprove a contract for ANY reason, within the contractually allowed time agreed to, for attorney approval. No explanation is needed, merely a disapproval letter. Sometimes a better offer came in and the seller knew the attorney had not given approval yet, or the buyer looked at one just more house, they loved more and want to buy - just after the seller accepted their offer. I had a situation where my buyers found out (to our horror) during a casual conversation with a friend, that the house they had an accepted offer on was where a murdered girl was found weeks after disappearing! She had been murdered by a neighbor who disposed of her body in the neighbors unoccupied home! This is not required to be disclosed in New York State by the sellers, and so was unknown to us. But, when the buyer called me, after getting over the horror and shock; my first words were: “Your attorney has not yet issued attorney approval. Do you want out of the deal? If so, I will call him right away and tell him to disapprove.” My clients opted out of the deal. There are many more obstacles to deals successfully closing. These are but a few. They are all preventable. Buyers and sellers need to pre-empt some of these issues by working with agents that recognize potential issues and are the type to be able to work in a conciliatory manner to over come issues when they are found. Agents must be able to come up with solutions that are fair and honest for all, and buyers and sellers must be realistic in what it is they expect when buying their home. I always say: “Everything is negotiable.” But what everyone who believes that must also believe is “with-in reason!”

How Long Will It Last? As home inspectors and engineers one of the most common questions we are asked is how long a system or component in a house will last. Without being specific to any brand or type, here is a general guide to the average expected lifespan for these components.

Furnaces The most common type of heating system in our area is a gas fired forced air furnace. The life expectancy of a furnace will vary depending on the quality of the unit and how well it is maintained - much like a car. Higher quality cars that are well maintained end up providing more worry free miles. Even a basic brand of gas forced air furnace should last at least 15 years if it is well maintained. Average-to-good quality furnaces should provide 20-25 years of useful life.

Boilers Hot water boilers are also common heating systems in our area, and to a lesser extent, steam boilers. As with furnaces, the quality and materials of the unit and the frequency of routine maintenance can affect overall life. On average, boilers tend to have a long lifespan. Thirty to forty years is not unusual. It should be understood that many heating contractors will push for heating system replacement based strictly on the fuel savings that may be obtained by installing a

new and more efficient unit. It is our experience that it is difficult to justify replacement of a working furnace or boiler based solely on fuel cost savings. We have found that the cost of replacement is such that the “payback” from fuel savings tends to be relatively long, but this can vary widely.

Air Conditioners A typical residential air conditioner will usually provide 15-20 years of reliable service. Once again, proper routine maintenance will result in a reliable and long life. The number of run-hours also has an effect. If the house is in the shade, the air conditioner might not run as often and it can last longer.

Heat Pumps Heat pumps are essentially air conditioning units that work in reverse. They provide both heating and air conditioning. Their life expectancy is shorter than air conditioning units because the number of run hours is significantly higher. Average life of a heat pump is closer to 10 to 15 years.

Water Heaters Residential tank-type water heaters usually last between 10 and 15 years. Unlike furnaces, routine maintenance is less critical; especially with homes on a good municipal water system. Hard well water can adversely affect the life of a water heater, making it much shorter.

You Are Now Entering… He died at Strong Memorial Hospital, it was June of 1975. He was born in Syracuse on Christmas day, 1925, to Jewish parents. He spent many years of his youth in Binghamton, acting out scenes from pulp magazines. In high school he was on the debate squad and excelled in tennis, he wanted to play other sports but was hampered by his height of 5’4”. He was editor of Binghamton High School’s newspaper, where he blossomed into a young writer. After high school he enlisted in the Army, where he trained as a paratrooper. Here he fell in love with boxing and competed as a flyweight. After serving in the military, he enrolled

in Antioch College in Ohio, majoring in Literature. He became involved with the campus radio program, where he wrote and directed many programs. The love of his life, Carol, was also a student and they married soon after graduation. Carol’s grandmother owned a cottage on Cayuga Lake, where he and his family spent their summers for many years, and where he wrote about time travel, monsters and ghosts. Who is this famous writer and man of many talents that loved upstate New York? Do you remember the Twilight Zone? It is Rod Serling, creator, writer and narrator of that popular sci-fi series of the 1960’s.

Rod earned six Emmys in his lifetime, many for the Twilight Zone and one for writing “Requiem for a Heavyweight’. I can remember as a child waiting for the program to begin and hoping that I would not be too scared to go up to bed. The stories were always macabre but usually ended in a moral being told. After the Twilight Zone series ended, he wrote and produced Night Gallery, another series of scary tales usually starring very famous actors of that time. Rod Serling also co-wrote Planet of the Apes, a sci-fi adventure movie from 1968. In his later years, Rod taught screenwriting at Ithaca College. He wished to remain

close to his home on Cayuga Lake, so close that he is buried in Interlaken. A bit of local history is always a good tale to tell, especially if it is Halloween and Rod Serling was master at scaring us out of our wits. “You are traveling through another dimension, a dimension not only of sight and sound, but of mind” Happy Halloween !
