No Gloves Required The Art of the Counter-Offer

Rochester’s home sales market is beginning to hum. Buyers are out looking and offers are being made! There are things buyers and sellers need to know to successfully come to agreement on an offer for a home. One of the trickiest items for agents to navigate is the “counter-offer”. There is not one experienced agent out there that hasn’t heard a client casually toss out “counter-offer” when talking terms of the sale contract. And there isn’t one experienced agent that doesn’t immediately begin to explain the true nature of counter-offers and how to successfully use them in a sale situation. Unfortunately there are those (seller and buyers) that refuse to listen and thanks to misunderstanding the true purpose of counter-offering, the deal falls apart before it gets going. What is a counter-offer? It is in essence, another offer based on the original offer, submitted back to the other party. Sometimes there is a term in the offer that the seller is not in agreement with. Their agent will suggest that they counter the offer with an offer of their own. The body of the original offer comes back to the buyer with the changes the seller stipulates necessary to come to agreement. The buyers can agree or try to negotiate further. Counter-offers can change closing dates, sellers concessions, pre-possession requests, the reasons are unique to each deal. Counter-offers fine tune the contract to satisfy both parties needs. There is no limit to how many counter-offers can go back and forth between both parties, but most agents would agree that the more counters that fly, the less likely the deal will come together. One of the most common reasons counter-offers are used is when the offered price is not agreeable to the

seller. If the difference is not too large a yawning chasm, then the sellers agent may suggest that they counter. A counter-offer can bring both parties together, often in the middle. This successful outcome is the most common counter-offer scenario in Rochester real estate deals. There are cases where a buyer is unrealistic on price. Most agents have been out with such buyers, especially in the last few years. They have taken the term “buyers market” firmly to heart. Often these b u y e r s consider themselves experts in real estate, when genera lly they’re not. They may have been paying attention to home sales and market trends, but too often neglect the nuances agents must understand and consider when conducting a price analysis. They may refuse to use their agent’s comparative market analysis (CMA) of the home when putting in an offer. In these cases, the offer made is typically well underpriced and is usually followed by: “If they don’t like the price they will counter-offer”. Umm, no, not always. Home selling and buying has its own unique psychology. Sellers are

attached to their homes and while some may over estimate the value of their home, most understand its real value. When an offer comes in that grossly undercuts that perceived value the first response the seller has is often anger, followed by feeling insulted and then feelings of distrust of the buyer, buyers agent and sometimes their own selling agent. If too low, an adversarial atmosphere is developed, making a successful conclusion to the sale difficult and sometimes impossible. In these cases, most sellers refuse to respond to the offer. Their agent will get back to the buying agent and tell them such, only to hear: “Well, have the seller counter.” If the seller refuses, a good buying agent will try again, to educate their buyers and suggest re-submitting a more realistic offer. If they do that, the sellers may forgive the “faux pas” on the part of the buyer to get the deal done. When dissecting these situations, usually what happened was that the buyer decided to toss a low-ball offer out, in hopes it would be accepted, so that they would be the “winning party” in the deal. This buyer fully believes that the seller (in a buyer’s market) is so desperate to sell they will accept almost any offer, or will counter-offer at

a price point that would be much lower than the original asking price. But the reality is that such desperate sellers are rare in our regional market. So the actual outcome is usually no counter-offer, no deal. When countering, time limits for response are important to move the process along. Buyers must be especially aware during the negotiation process of counter-offers that the house is still on the market and another buyer can come in and scoop the house out from under them. I have shown and had offers accepted on homes that were in the midst of offer/ counter offer negotiations because in the end, my client’s offer was more favorable to the sellers. Before going to see the house I tell my buyers the situation and school them that their first offer has to be their best and final offer since they were in competition with another buyer. Sadly for the other buyers, my buyers perceived more value and chose not to haggle over details because they wanted the house more than a good deal. The sellers perceived my buyers as being more reasonable and so went with their offers instead of haggling over details with the first buyers. Counter-offers have their place in the art of buying and selling homes, but they must be used judiciously. They are a tool for negotiation. Both buyers and seller must approach using this tool in the spirit of creating a win-win situation for both parties. If this is done, a transaction will come together and end in a positive outcome for both parties.

Moss Build-Up on your roof

We all have seen roof surfaces where moss, algae or lichen has begun to grow or collect on the surface. Often times people make the assumption that a noticeable buildup of moss or lichen is an indication that the roof needs to be replaced. This is not necessarily the case, but it should not be ignored. First, you should understand that moss, algae and lichen tend to collect on roof surfaces that are heavily shaded and/or are regularly damp or wet. The buildup of moss occurs very slowly over a long period of time. As a result, it is somewhat rare to see significant moss buildup on a roof that is very young in age.

Over the long term, a buildup of moss can be detrimental. The moss traps moisture, eventually causing accelerated wear, especially in cold climates. For this reason we typically advise homeowners to take steps to clean a roof that has a buildup of moss and/or lichen. Steps can also be taken to help prevent the eventual of buildup of moss, lichens, and algae. Roofing contractors can install metal strips at the peak of the roof. The metal is usually zinc, but galvanized metal and copper are also used. Minerals and ions that wash off the metals when it rains will retard the growth of moss or algae on the shingles. Installing metal strips

along the ridge of a roof that already has some moss or lichen buildup can also be beneficial. It will help to kill lichen and moss when rainwater gradually washes over the roof system. Care must be taken when trying to clean roofs that have a buildup of moss, lichen or algae. Gentle cleaning with a soft brush can be beneficial. It is important to not aggressively scrub the roof since it can damage the shingles. Of course, if the roof shingles are already worn, dried, cracked and brittle they are probably beyond saving, and roof replacement becomes more imminent. There are also roofing contractors who can be hired to clean a roof. You should consult with

a number of contractors so that an educated opinion can be made as to whether the cost is justified, and whether the methods used are truly beneficial. The contractor that you choose should be able to provide you with references so that you can consult with satisfied customers.

It is important to consider the mood you are attempting to create when choosing color, and how one room will relate to the others. A color story tells that tale. Blue. The coolest color of the color wheel, can evoke feelings of calmness and serenity. It is a perfect choice for a bedroom or a nursery. You can choose a pale blue or a blue with green undertones for your bath, and you will create a spa-like space. Purple. A color of royalty and playfulness. A young girl’s room is always charming in lavender, add accents of light green. Brown. The ultimate earth tone, the color of sand and soil. Brown is a peaceful, conservative, easy to live with color. Considered the most neutral of all colors today, it is a perfect color solution for common spaces like family rooms. Traditional and contemporary styles work well with browns, from the color of coffee with cream, to the rich tones of deep sand. Black. The total no color-color. Strong and formal, black can anchor any room, and I would have every room with some black. Add some white and green to black to make a banker’s grey, and you have a

sophisticated and upscale color, clean and uncluttered. White. Clean, pure, and simple. I always prefer all trim painted in some shade of white. When desiring a white room, change the shade of white for the trim. This will give needed contrast, and will make an interesting play of the white color. Your white walls will open up the room and make your eye think the space is larger and cleaner. A well chosen color palette for your home will create the feelings you want to surround you and your family. Be it warm and cozy, conservative and neutral, fresh or lively, you can say it all with color!
