No Gloves Required The Art of the Counter-Offer
Rochester’s home sales market is beginning to hum. Buyers are out looking and offers are being made! There are things buyers and sellers need to know to successfully come to agreement on an offer for a home. One of the trickiest items for agents to navigate is the “counteroffer”. There is not one experienced agent out there that hasn’t heard a client casually toss out “counteroffer” when talking terms of the sale contract. And there isn’t one experienced agent that doesn’t immediately begin to explain the true nature of counter-offers and how to successfully use them in a sale situation. Unfortunately there are those (seller and buyers) that refuse to listen and thanks to misunderstanding the true purpose of counter-offering, the deal falls apart before it gets going.
large a yawning chasm, then the sellers agent may suggest that they counter. A counter-offer can bring both parties together, often in the middle. This successful outcome is the most common counter-offer scenario in Rochester real estate deals.
What is a counter-offer? It is in essence, another offer based on the original offer, submitted back to the other party. Sometimes there is a term in the offer that the seller is not in agreement with. Their agent will suggest that they counter the offer with an offer of their own. The body of the original offer comes back to the buyer with the changes the seller stipulates necessary to come to agreement. The buyers can agree or try to negotiate further. Counter-offers can change closing dates, sellers concessions, pre-possession requests, the reasons are unique to each deal. Counter-offers fine tune the contract to satisfy both parties needs. There is no limit to how many counter-offers can go back and forth between both parties, but most agents would agree that the more counters that fly, the less likely the deal will come together.
There are cases where a buyer is unrealistic on price. Most agents have been out with such buyers, especially in the last few years. They have taken the term “buyers market” firmly to heart. Often these buyers consider themselves experts in real estate, when generally they’re not. They may have been paying attention to home sales and market trends, but too often neglect the nuances agents must understand and consider when c onduc ting a price analysis. They may refuse to use their agent’s comparative market analysis (CMA) of the home when putting in an offer. In these cases, the offer made is typically well underpriced and is usually followed by: “If they don’t like the price they will counter-offer”. Umm, no, not always.
One of the most common reasons counter-offers are used is when the offered price is not agreeable to the seller. If the difference is not too

of their home, most understand its real value. When an offer comes in that grossly undercuts that perceived value the first response the seller has is often anger, followed by feeling insulted and then feelings of distrust of the buyer, buyers agent and sometimes their own selling agent. If too low, an adversarial atmosphere is developed, making a successful conclusion to the sale difficult and sometimes impossible. In these cases, most sellers refuse to respond to the offer. Their agent will get back to the buying agent and tell them such, only to hear: “Well, have the seller counter.” If the seller refuses, a good buying agent will try again, to educate their buyers and suggest re -subm it t i n g a more realistic offer. If they do that, the sellers may forgive the “faux pas” on the part of the buyer to get the deal done.

So the actual outcome is usually no counter-offer, no deal. When countering, time limits for response are important to move the process along. Buyers must be especially aware during the negotiation process of counter-offers that the house is still on the market and another buyer can come in and scoop the house out from under them. I have shown and had offers accepted on homes that were in the midst of offer/ counter offer negotiations because in the end, my client’s offer was more favorable to the sellers. Before going to see the house I tell my buyers the situation and school them that their first offer has to be their best and final offer since they were in competition with another buyer. Sadly for the other buyers, my buyers perceived more value and chose not to haggle over details because they wanted the house more than a good deal. The sellers perceived my buyers as being more reasonable and so went with their offers instead of haggling over details with the first buyers.
Counter-offers have their place in the art of buying and selling homes, but they must be used judiciously. They are a tool for negotiation. Both buyers and seller must approach using this tool in the spirit of creating a win-win situation for both parties. Weekend Projects I am getting really antsy. Waiting for spring is grinding on me. The new plant is on the bath vanity and I am looking for an easy, weekend project, one that will give me lots of satisfaction and also add some zest to my home. If you find yourself antsy as well, here are a few, very simple projects to give your home a small shot in the arm. Change the knobs in your kitchen and bath. If your hardware is brass, update to brushed nickel, polished nickel or oil rubbed bronze. Bronze is very popular these days, great for a rustic or Euro look.
If you are the type for a clean, fresh look, choose nickel. Install a new showerhead in your bath. If you enjoy the force of water pressure at a luxurious hotel, treat yourself to one. We purchased one that is a combo of a hand held and rainfall head. The head changes pressure to a soft, gentile shower or a pulsating surge of water. This is a treat. I especially like the heavy power when I (or somebody else) cleans the tub. Did I mention that it is pretty cool looking too? Organize your cleaning supplies. I find this idea so ho-hum, but if you have a
couple of baths, this could save some time. Purchase a lazy susan to store supplies and place it in your linen closet. Personally, I am really trying to be more green these days, so I have a bottle of white vinegar both upstairs and down. Vinegar will clean anything, so add a bottle to your arsenal. With your cleaning supplies, store some micro fiber towels. These towels will clean most everything streak free, because they have long fibers that do the work. Use them on mirrors, tile and glass. Purchase new CFL light bulbs. Change your incandescent bulbs to compact fluo-
rescent. This is the future. Not only will you save dollars long term, you will be doing one green thing to help our environment. While you are purchasing your bulbs, why not change your lamp shades too. Look for new fabric shades, they could be linen or hemp. Black shades will ground your room. Shop for different shapes as well, drum shades and oval shades are interesting choices - they don’t always have to be round and white. Tackle a few of these chores and you will have time saved for your weekend garden projects.

the ins and outs of residential humidifiers
Residential humidifiers have gained a great deal of popularity in recent years. They have become quite common in houses that are heated with forced air heating systems. Unfortunately, many homeowners do not understand how their humidifier works, how is gets adjusted, and how it should be maintained. Some homeowners might not even realize they have a central humidifier. As you are probably aware, indoor air tends to be somewhat dry during the winter season in the Rochester area. This is because it is cold and dry outside. As a result, it is beneficial to introduce some moisture or humidity into the living space. This can be Modern Humidifier
accomplished through the use of a standard air humidifier that is installed on a forced air heating system. Older style humidifiers consisted of a sponge-like media material that was mounted on a drum or wheel. A small motor turned the wheel, allowing the media to become saturated as it passed through a small basin of water. Air from the heating system passed through the humidifier, introducing moisture to the air. This style humidifier tended to be problematic since it relied on the operation of a small motor and a small float valve. Also, there was constantly a basin of standing water, which eventually would become dirty

and filled with mineral deposits. Modern style humidifiers are simple devices. They consist of a water supply (controlled by an electric solenoid valve) which trickles water through a “water panel”. As is the case with the older style humidifiers, moisture is introduced to the air as it passes through the humidifier. However, with these modern units, excess water is immediately drained out of the system. As a result, the maintenance on these systems is minimal. The water panel should be replaced annually. Humidifiers operate automatically. They are controlled by humidistats. A homeowner simply needs to adjust the humidistat to

their desired humidity level. Humidifiers are typically wired so that they will only operate during the heating cycle. The humidifier will then function if the humidity level of the air in the house is lower than the setting on the humidistat. People often ask us how they should set their humidistat. A good starting point would be between 30% and 35 % humidity. If a homeowner finds that the inside of the house feels somewhat damp or that there tends to be condensation formation on the windows, they should decrease the setting on the humidistat. Any payments received by a contractor from a customer prior to substantial completion of the job must be placed into a escrow account in a bank located in New York State within five business days and the customer must be informed where the money is held within ten business days. The contractor can only withdraw the deposit only in the following circumstances: under the terms of the payment schedule agreed on by the contractor and the customers; upon substantial completion of the job; or if the customer violates the contract, but only to the extent that the amount covers the contractor’s reasonable costs. 6. A complete specification description of the work and materials, including brand names, model numbers and other identifying information. 7. A consumer notice that reads as follows: “The customer has an unconditional right to cancel the contract until midnight of the third business day after the contract was signed. Cancellation must be done in writing. If the contractor or subcontractor who does the work is not paid, he or she may have a claim against the customer’s property under the Lien Law. 8. Warranties and guarantees should be stated in the contract. Be sure to understand if the warranty or guarantee covers both the materials and labor and if they are prorated and transferable. Contractors can also face civil fines for violating the provisions of the law, especially with the protection of the customer’s payments.

Right after the holidays many consumers will be thinking of that remodeling project that they want. Whether it is roofing, siding, windows, that new kitchen or an addition it will be a costly investment and you should protect yourself before signing a contract. New York State regulates the sale of home improvement goods and services and applies requirements to most types of improvements costing over than $500 purchased by homeowners. The law requires contractors to give you a contract that includes many provisions. The main ones are summarized below: 1. The name, address and phone number of the contractor must be on the contract. (Do not accept a P.O. Box number as the contractor’s address) 2. The exact amount of the project including progress payments. 3. A start and completion date, including any contingencies which would change the completion date such as bad weather. You may also want to have included a penalty clause for running over the completion date. A $100 per day deduction off the contract price is common for every day that the project runs over the completion date. 4. A clause that reads that “any progress payments received by a contractor from a customer can only be made if they bear a reasonable relationship to the work actually done, materials purchased or related costs.”

“As soon as the economy and housing market improve, mortgage rates will go up.” That is a sensible and common belief among economists and experts in finance. “Mortgage interest rates won’t go up until 2014.” That is what the government economists are saying. Well, you, the real Buyers looking for houses are smarter than that. You know that rates under 4% are tremendous. I know you know that because you are coming into the market in huge numbers in nearly every market across the United States. They Are Reaching in Your Pocket Over and Over It is possible that interest rates on mortgage loans will stay low for quite a while but Federal fees on those loans have gone up and that trend is likely to continue. Instead of the banks making the additional income on higher interest
rates the government is collecting that income with increased taxes, mortgage insurance and fees. Either way, the result will be that the cost of buying a home with a mortgage is likely to increase steadily. So, be sure you know the total cost of the home you’re interested in to avoid costly surprises. Other Problems? Real Estate prices are driven by supply and demand. In some markets around the country there will be an influx of foreclosure homes that will depress prices further. For Buyers this is an opportunity not a problem. Sellers in those areas will be wise to put their house on the market sooner than later. The problem for Buyers will occur at the peak of the spring market. In most markets around the country, there will be a few weeks or a month this spring
when the greatest flurry of Buyers will be buying. For that period demand will exceed supply. You will know it is happening when every house you look at sells quickly and most have multiple offers on them. During that period prices will peak and Buyers will be forced to pay a premium. Most years those higher prices are sustained and values rise. It is likely that this year, like the last few, prices will slide back to pre-peak levels by summer. So, Buyers would be wise to buy sooner than later as well. How do you know this? I am in a unique position. Real Estate Agents from all over the country send me their sales and activity numbers, literally every day. I know how much they are selling, where their Clients are coming from, what’s hot, what’s not and how it all compares to the past three years. We, my Real Estate Agent Coaching Clients
and I, see trends weeks and months before they are reported. We see them in real time as they are happening “on the street.” My Clients took advantage of the foreclosure bust by developing relationships with banks nearly a year before it became obvious that there was a serious problem. The Agents I coach informed their Clients, the Buyers and Sellers in their markets of trends that make them or save them money. This is the market people will look back on and say, “I wish I had bought then.”

not over-use a humidifier. Excessive amounts of moisture in a house can lead to problems from excess condensation. On the other hand, if the indoor air tends to be too dry (or if a person is being “shocked” as they walk around the house in their stocking feet) the humidistat should be turned up. In general, as severely cold temperatures are reached outdoors (such as -20F), the humidifier setting should be changed from 35% to 25% or 15%, to prevent excessive condensation on windows, walls and other surfaces. The water panel in the humidifier should be changed once each year as maintenance. Sometimes, when the winter is not too cold and dry, the panel can last two years before changing it. Excess minerals in the humidifier can be cleaned out with a solution of white vinegar and then water. On most humidifiers or the connected ductwork there is a bypass damper. This damper should be opened during the winter
