Worst Case Scenario

pre-purchase considerations for unmarried partners In the last issue, our topic was single people buying property. An equally important focus is unmarried couples who plan to buy a home together. Realtors are seeing more unmarried couples coming together to purchase. Some Realtors try to gently inquire if the couple has completely worked out details regarding the property in the unpleasant possibility of a split, but only do so if they feel that the couple is receptive. Other Realtors feel it is none of their business and not part of their job description. I fall into the former category since I want my clients to be educated and proactive in home ownership. That includes considerations about selling the property in the future. Hopefully I will be called to sell their home because the couple is up-grading, not splitting! The intent of this article is not to scare unmarried couples from buying a home, but to encourage them to be prepared for the future as best as they can. No one goes into a committed relationship expecting the worst, and some feel addressing that possibility actually jinxes the relationship. But Realtors, all too often, see the end result of when the worst actually happens. As a Realtor, I have had clients who were desperate to be rid a property they had bought with a former partner. Once the breakup occurred, the house became one of the major obstacles to severing all ties to the other person. Additionally, in the process, one party often becomes severely harmed financially, as a result. So what to do? If buying a property with a partner, how does a person protect themselves? Anthony LaFay, Esq. of LaFay, Bryne & Lafay on W. Main St. in Rochester gave some very succinct advice: “Approach the buy as a business deal first”. No matter how committed a couple is, this is rule #1. He explained that people do not come to him until they are in a troubled situation and many times, it’s too late to help them. If prospective buyers take a few steps at the start, they can go a long way to helping themselves and each other in preventing the headaches involved in separating financially, should a break-up occur without the protections offered by marriage. In making the decision to buy a home together, so many questions arise and must be looked at closely. What if the incomes are unequal? Is ownership of the house unequal if expenses are not equally shared? Who puts down the down payment? Who gets what part of the cost of down payment when the house is sold? Whose credit gets used, if not both? What are the contingency plans if illness occurs to one partner, or they die? What

if they split up, the house has to be sold, and it sells at a loss? Who absorbs the financial fall out? What if the house is sold at a profit? Who gets what? What if a split occurs and one partner wants to keep the house? Can the other be forced to pay? Notice, in the end, most questions center around finances. Those pesky financial questions! Sadly, many of these questions are ignored because of the confidence of the couple in their relationship. This is where the problem lies if they actually do break up. Nothing has been decided before, and in the heat of a break up, it is often too late to expect these questions to be answered amicably. What to do then? The best thing is to speak to their individual attorneys BEFORE buying the house. This means each party is represented in the transaction. James A. Marino, Esq. of James Marino Law, located on South Washington St. in Rochester, explained that: “Both parties should consult with their own attorney prior to entering into the transaction. Ethically an attorney would, most likely, be prohibited from providing legal counsel to both parties due to conflicts of interest, regardless of the party’s affections for each other.” Is this sounding more like a business deal? It should, because it is. Only in marriage are these issues covered by law. Unmarried couples should have a contract in place between the two of them regarding the property in the case of a split or the death of one of the partners. “However,” Jim concedes, “the reality is that most people do not have, nor do they desire to spend, the money to consult with two different attorneys and have an agreement negotiated.” This is true, since often the couple is working hard to come up with all the expenses (closing and moving costs) they will incur when they buy the house. What to do in that case? This is the moment of truth for a couple, when they must

be able to honestly consider these questions and come to agreement on the answers and write them down. Whatever is agreed upon should be put in writing and signed by both parties. Should it ever land in court, this may go a long way in helping the judge see the situation clearly. During this session(s), the couple needs to consider their individual current and future financial position. Are they both steadily employed? What if one becomes unemployed? Can one support the property if the other is incapacitated? If not, they should explore options such as insurance covering poor health or death. It’s important to outline both parties expectations. If the property is being bought using one partner’s credit, does that entitle or require them to be the sole owner? Does the other partner have the right to expect money out of the house when it is sold in the future - especially if they contributed to the mortgage payment, regardless of whether the couple is still together? If both are on the mortgage, they need to recognize that they are still responsible for that mortgage and cannot just be taken off, even if they no longer live in the house. If there is a lot of sweat equity in the house, is one person more entitled than the other? An agreement must be made regarding the down payment, including who gets what in the event of a sale. These are the types of questions the couple needs to ask and answer. The idea is to imagine all scenarios, no matter how painful. Both need to be clear on their position in the ownership of the house. What is it that each partner expects regarding home ownership? Does one partner legally own the house and the other does not? If one partner does not legally own the house, are they expected to contribute equally financially and, notwithstanding that their name is not on the deed, do they expect to be treated as an

co-owner? Does one person have the power to evict the other from the home? Some of this is hashed out while deciding how the parties will named on the deed. Most married couples own a home together by “Tenancy by the Entirety.” This means if one spouse dies, the other, automatically, by operation of law, becomes the sole owner of the property. If there is a split, divorce laws govern and judges decide the disposition of the property considering all facts and circumstances. Unmarried couples can chose to own real property as “Joint Tenants with Right of Survivorship”. This type of ownership affects the same result as if the property were owned by a husband and wife. Another option is to own the property as “Tenants in Common.” If one partner dies, their share is passed through their will or if there is no will, according to state law, “intestacy.” This is the least secure position for a surviving partner to be in since unrelated parties have no rights of inheritance if there is no will and most young couples don’t have wills. The surviving partner could be forced to sell their beloved home by their new co-owners – the estate of the deceased partner or worse still, have to be co-owners with the deceased partner’s parents or siblings. Sadly, often attorneys find themselves having the discussion of ownership and what it entails when the couple attends the closing. Based upon the “new normal” of relationships in our society, nothing about a relationship may be assumed when different surnames are used on purchase contracts and loan applications. For example it is now completely normal for a woman to continue to use her maiden name after marriage. To make inquiries about the purchasers’ marital status based on different surnames might be perceived as rude, judgmental and, possibly, discriminatory. Couples need to broach these difficult questions prior to putting an offer in on the home of their dreams, to prevent the situation from turning into a living nightmare down the road, should the worst occur. The best thing couples can do is to prepare themselves in all aspects of their future home ownership. Knowing the answers to these questions is important as it will keep the relationship harmonious, by the very fact that both partners know what the expectations are. Happy Relationship - Happy Home!

From the Pantry Do you get a rash from your bath and tile cleaner? Does oven cleaner take your breath away? Do you search under the sink for brass cleaner when you need it… once a year? Maybe we should search out and use natural products for all those hateful, household chores that we buy countless, chemical products for. Personally, I am ‘deliqua’. My skin is so sensitive, that I pursue hypo-allergenic skin creams and makeup, and usually try to wear gloves when cleaning, or I will get that nasty rash. There are very effective, natural ways to clean and care for everything. The Earth takes care of itself, so let’s take care of the Earth.

White vinegar is the most versatile of all pantry ready cleaners. Use it to clean the coffee pot, soak tea cups to remove stains, and clean glass to a sparkling shine. Mix with warm water for windows [use a sponge and squeegee], add salt to make a cleaning scrub for the microwave, and to remove wallpaper - add very hot water and liquid soap. Clean your tub and tile with vinegar too, it will cut through soap scum better than the scrubbing bubbles. Use microfiber cloths to scrub your tiles and grout. Ketchup on your fries?? Ketchup also cleans brass and copper. Rub it on your pots and pans with a soft cloth, then rinse thor-

oughly. A paste of oatmeal and water is the perfect scrub for gardener’s hands. Rub with olive oil for smooth, velvety skin. You can also use that oatmeal paste on your face as an exfoliant, add some sugar to the mix to scrub your rough heels. To clean your garden tools, brew a pot of very strong tea, soak your tools overnight. You can also use Coke to clean your tools, (there’s no five cent deposit on tea). To clean the oven, we are back to the almighty vinegar. Mix ½ cup of it with ¼ cup of baking soda to make a caustic free, oven cleaner. Baking soda is ammo in your pantry. Use

it to deodorize, it neutralizes acidity and reduces odor. Sprinkle on the carpet, furniture and mattress for a clean, fresh, smell, then vacuum. And for the all important and untouchable toilet bowl, sprinkle baking soda around the bowl, then add white vinegar. Scrub with your toilet brush and mix white vinegar and water in a spray bottle for use as a weekly spray to keep the bowl sparkling clean. Ugh ! The take away from this article is to load up in the pantry. Baking soda, ketchup, salt, oatmeal, olive oil, and vinegar and your home too can smell as clean as a Cobb salad.

Things to know before you hire a contractor There are many factors that you should be aware of before selecting your roofing contractor. Here a just a few. The New York State residential code has requirements dealing with the roofing of a home. First and foremost is article R907.3, which addresses recovering versus replacement. The law states that any new roof coverings shall not be installed without first removing the existing roof coverings where any of the following conditions occur: 1. Where the existing roof covering is wood shake, slate, clay, cement or asbestos-cement tile. 2. Where the existing roof covering is water-soaked or has deteriorated to the point that the existing roof or roof covering is not adequate as a base for additional roofing. 3. Where the existing roof has two or more applications of any type of roof covering. This particular part of the law is the one that gives the homeowner the most trouble as some contractors may confuse customers as to what should really be done. It’s really very simple. If you are going to have a new roof put on your house,

you cannot go over the existing roof unless there is only one roof there at present. Any more than one roof means that all layers must come off before a new roof can be installed! The law doesn’t say anything about being able to remove a layer or layers to get down to one roof but I would suggest that if any layers have to come off then you have all the layers taken off down to the wood sheathing. There are other sections of the law too numerous to mention but when reading specifications of a contract you should be sure that an ice and water shielding product is installed on the roof edges a minimum of 3' from the house wall edge up and in all valleys and areas where you may have had a leak problem before. In past years, snow and ice has backed up even farther than the required 3' so I would suggest that you insist that the roofing contractor install the ice and water shield a minimum of 6' up from the house wall for added protection. Another thing to watch out for is proper ventilation of the roof. Without proper ventilation you will have all kinds of problems. In the summer

your attic will be too hot making air conditioning work overtime and in the winter you will have ice back-up problems that can cause all kinds of damage to the interior of your house. The usual rule of thumb is one roof vent for every 150 feet of roof area but I would suggest a continuous roof vent. However, no matter how your roof is vented if you don’t have a good soffit (overhang) venting the ventilation will not work properly. The next step after familiarizing yourself with the information above is the selection of a reputable and professional roofing contractor. There are many so called roofing contractors in the business and because of the many fly-by-night ones you should make sure you do some homework. Get at least three estimates from similar size companies and be sure to check them out with the Better Contractors Bureau at 338-3600. Also have them all bid on similar work specifications. Check to see if they are insured and ask to see a copy of their certificate of insurance showing that they carry enough liability coverage also, if they have employees, evidence of their workmen’s comp. After you decide on a roofing contractor to do the work, you should make sure that the contract meets all requirements under Article 36A of the NYS Business Law. The most important aspects of the contract should be your 72hour right to cancel, escrow clause, a start and completion date, payment schedule, warranties, and a complete specification list. Be sure the specifications list everything including, if it will be a complete tear-off, type of shingle, debris

removal, warranties and guarantees, etc. Remember that if they tell you your roof is warranted for 25 or 30 years it only pertains to the materials and not the workmanship which, is usually guaranteed for only one year. Don’t give a large down payment and by all means don’t make final payment until the job is completed to your satisfaction! Remember the saying, “Let the buyer beware” also pertains to the home improvement business!
