Property Tax Assessments is there any recourse?

Do you think that you pay too much in property taxes? The first thing to do is to check your assessment. You need to have a good idea of property values in the neighborhood to be certain your assessment is correct. Once you determine your property is over-assessed, it’s time to seek help. Call your favorite Realtor or seek one out. Explain that you need a CMA (Comparative Market Analysis). While some Realtors will gladly do this for free, especially if you are a regular client, be prepared to pay them a nominal sum for their time and effort - unless you expect others to work for you for free. Once you determine your property is over-assessed, don’t worry, you have options! But you should be aware that you are only allowed to challenge your assessment within prescribed time frames. (Deadlines at the end of this article.) You will need to decide whether to challenge the assessment yourself or hire someone to do it for you. At this point, I disclose that my partner Rick specializes in property assessment reductions. Because of this, I get to see (and participate in) the work involved, up close and personal. It is time consuming and requires hours spent visiting and photographing properties, finding and pouring over comparable’s, all the while planning a strategy for successfully getting that reduction. We go through too many ink cartridges to count and by the time property assessment challenge season is over, the relief is palpable.

Researching this article, I have come across articles urging home owners to present their own challenge claiming assessors and tax boards are irritated when professionals are hired. If anything, we see the opposite, at least in the Greater Rochester region. Many of the tax boards that review cases include real estate professionals who know property values. Unless you are as well versed as someone who works with property values daily, usually you come out on the short end of the stick. I see this when our office gets calls from people who decided to go it alone and either didn’t win or got a nominal token drop in their assessment to make them go away. They then come to Rick to salvage the situation. At that point there is little to do until next year, or if there is a possibility of helping, Rick is now faced with a much more difficult situation to overcome and often the resulting reduction is less generous than what he would have anticipated had he been on the case from the very beginning. Assessors deal yearly with homeowners complaining of their home being over-valued. Many of them bring incorrect comparable’s and base their demands on emotions instead of facts. Some homeowners are belligerent and demanding, doing little to win their case. It is crucial before challenging an assessment to understand that no matter what, property values are based on facts. Only if you are intimately familiar with these facts and can use

them to challenge the assessor, will you come to the table capable of achieving maximum results. When not properly prepared, I liken this to going to battle with one hand tied behind your back. If you decide to hire someone, how to do so? Some use their attorney, which is expensive (in my opinion). Retainer fees are paid up front whether you win or not, and you will be charged on a per hour basis, which can amount to as much or more of the first years savings total. Alternately, you can find Real Estate professionals who specialize in assessment reductions. For some reason, in this area there are only a few who specialize in this skill. Your search will be harder than if you lived down-state where there are companies solely devoted to this field. Plan to find these specialists on-line or ask your Realtor, CPA, Appraiser or Attorney for a referral. Rick regularly gets referrals from Realtors, Attorneys and Appraisers who are aware of his skills. Those that specialize in providing this service usually have a success rate between 90-95%. Of course, understand that they don’t take all cases that come, because they don’t earn anything unless they win the case. Cases are accepted relative to chance of success. If the specialist concludes a win is unlikely, they won’t take the case. This is very advantageous for home owners. Remember, if the professional takes the case, they believe they have a good chance at winning the assessment challenge.

They know if they are unsuccessful, they don’t get paid, hence the caution to selecting the most winnable cases. Most charge 50% of the first years savings. The rest is “free money” for the taxpayer, since without the services of this professional, they would be paying higher taxes for a few years, instead of saving the amount resulting from the reduction. The amount paid to the professional is money that would have been paid in taxes, hence “free money”. I advise being wary of services demanding money up front, since you can’t be sure your case is truly winnable. These types of companies can just pocket your cash and shrug when you don’t get a reduction. They may promise something they can’t deliver just to get the fee up-front. These “services” are often scams. If you go it alone, your first stop should be the internet. Become familiar with MonroeCounty.gov. Under “Real Property” you will find town and city assessment dates, equalization rates, tax tables, contact information, and forms and publications. This will start you on your way. The deadline to file varies, depending on where you live. The City of Rochester deadlines are first. Suburban deadlines come later (see end of article). Learn the laws pertaining to how your assessments are devised. Are you entitled to any special categories such as senior citizen exemptions? Call your city or

Things to know before you hire a contractor There are many factors that you should be aware of before selecting your roofing contractor. Here a just a few. The New York State residential code has requirements dealing with the roofing of a home. First and foremost is article R907.3, which addresses recovering versus replacement. The law states that any new roof coverings shall not be installed without first removing the existing roof coverings where any of the following conditions occur: 1. Where the existing roof covering is wood shake, slate, clay, cement or asbestoscement tile. 2. Where the existing roof covering is water-soaked or has deteriorated to the point that the existing roof or roof covering is not adequate as a base for additional roofing. 3. Where the existing roof has two or more applications of any type of roof covering. This particular part of the law is the one that gives the homeowner the most trouble as some contractors may confuse customers as to what should really be done. It’s really very simple. If you are going to have a new roof put on your house,

you cannot go over the existing roof unless there is only one roof there at present. Any more than one roof means that all layers must come off before a new roof can be installed! The law doesn’t say anything about being able to remove a layer or layers to get down to one roof but I would suggest that if any layers have to come off then you have all the layers taken off down to the wood sheathing. There are other sections of the law too numerous to mention but when reading specifications of a contract you should be sure that an ice and water shielding product is installed on the roof edges a minimum of 3' from the house wall edge up and in all valleys and areas where you may have had a leak problem before. In past years, snow and ice has backed up even farther than the required 3' so I would suggest that you insist that the roofing contractor install the ice and water shield a minimum of 6' up from the house wall for added protection. Another thing to watch out for is proper ventilation of the roof. Without proper ventilation you will have all kinds of problems. In the summer your attic will be too

hot making air conditioning work overtime and in the winter you will have ice back-up problems that can cause all kinds of damage to the interior of your house. The usual rule of thumb is one roof vent for every 150 feet of roof area but I would suggest a continuous roof vent. However, no matter how your roof is vented if you don’t have a good soffit (overhang) venting the ventilation will not work properly. The next step after familiarizing yourself with the information above is the selection of a reputable and professional roofing contractor. There are many so called roofing contractors in the business and because of the many fly-by-night ones you should make sure you do some homework. Get at least three estimates from similar size companies and be sure to check them out with the Better Contractors Bureau at 338-3600. Also have them all bid on similar work specifications. Check to see if they are insured and ask to see a copy of their certificate of insurance showing that they carry enough liability coverage also, if they have employees, evidence of their workmen’s comp. After you decide on a roof-

ing contractor to do the work, you should make sure that the contract meets all requirements under Article 36A of the NYS Business Law. The most important aspects of the contract should be your 72-hour right to cancel, escrow clause, a start and completion date, payment schedule, warranties, and a complete specification list. Be sure the specifications list everything including, if it will be a complete tear-off, type of shingle, debris removal, warranties and guarantees, etc. Remember that if they tell you your roof is warranted for 25 or 30 years it only pertains to the materials and not the workmanship which, is usually guaranteed for only one year. Don’t give a large down payment and by all means don’t make final payment until the job is completed to your satisfaction! Remember the saying, “Let the buyer beware” also pertains to the home improvement business!

If the new year brings the promise of finding a new home this spring, here are a few ideas to update your kitchen to maximize your current home’s value and quicken the sale. Decide what needs to be done. Is the wall color too bold? Is the backsplash nonexistent? Would new lighting compliment your kitchen? Is the floor a disgrace? Are your cabinets just plain out of style? Does your island need to be perked up? Has your sink sunk? The kitchen is the hub of the home. When a prospective buyer enters your home, you can be sure the kitchen will be the first stop, so let’s make a good impression. There are subtle improvements you can make that will give big results and big improvements that will yield you more dollars in the end. The first step is to make a punch list and go for what ever is in your budget. Painting by far is the quickest and most affordable fix. Neutralize your kitchen walls, try warm shades of taupe and cream. The Pantone color of the year is pinkish-purple, to my ears

that sounds like mauve. Don’t go there. If you just can’t find the right neutral, select a warm white, nothing looks fresher. If selecting a backsplash was always on your to do list and never got done, find a tile that is simple and neutral and use grout that will blend with the tile. Easy on the eye layout patterns would be a good choice too, like a straight match or slightly offset match. Forget about tile with fruit patterns or dots and triangles. There are numerous new pendant lights in the market. Select one, two, or three lights to have hanging over the island. If you use one make sure that it is sizeable, larger is better than smaller here. A new kitchen floor can make a dramatic change. If you have vinyl, think about tile in large neutral squares. Consider a floating floor that can be laid over the existing floor. Some floating floors can mimic wood planks or ceramic tile. They are an easy fix for a nasty floor. If your kitchen cabinets are outdated, try painting them. Use a soft white, cream or even

dark charcoal gray paint. If painting them is not an option, just change the hardware. Select oil rubbed bronze or brushed nickel finish. The main problem here is finding the right size. Open a door and measure between the holes to get the right measurement. A new kitchen sink and faucet is always a great improvement. If you have a laminate counter, select a drop in sink made of stainless steel or porcelain. Select a faucet that has a

sprayer built in and is high enough to accommodate a large pot underneath the faucet head. Making small changes in your kitchen will give you huge aesthetic results and a dramatic plus in your home’s value.

town assessors office to ask if their data base is available to citizens, allowing you to search for comparables, or hire an appraiser to do an appraisal of your home. Explain to them what you are doing. Most appraisers understand and will look for comparable’s that will help you with your case. They should explain the comparables and why they were used so that you have a firm understanding of the case and can answer the assessor or board of reviews questions in a knowledgable way. In New York State, appraisers are prohibited from representing you in the hearing, but can supply you with the information needed to bolster your case. Check the information your assessor has on your home. Is it correct? If not, that could be part of your challenge. Check if the square footage, lot size, number of baths or bedrooms is correct. Are special features attributed to your home that are not there? Did you remove a shed, deck or pool? Is the house in the condition stated on the report? If the assessor claims your house is pristine but in actuality is a fixer upper, that can be challenged. Take photographs of the property, especially anything that would bring value down. Do be prepared to have the assessor tour your property to verify your claims. Accompany them when they go through and make sure they see the problems, or they will seek out the good points which they might be able to

justify their assessment with, possibly missing the issues with the property that could lead to reduction. Know that you should be certain beyond a doubt that you are over-accessed since once you start this process, this is an invitation for the assessor to check your property. If you refuse to let them in, for many towns, the policy is to assess at the highest value possible.
