The Smart Real Estate Buyer preparation leads to success
The end of the year is upon us. We are all looking forward to the holiday festivities, buyers, seller, and Realtors alike. Traditionally this time of year sees a slow down in the real estate market. Not this year! The market has kept a steady pace. This points to a promising year ahead for our local market. What do buyers need to think about while in the process of buying their home? First and foremost, they should seek out a Realtor to act as a consultant and advisor. The client should feel that the Realtor is looking out for their interests and that they are not “just another client”. An excellent realtor will ask questions, sometimes even ones that might be uncomfortable, such as: “Have you been pre-approved?” They need to understand what stage of the process a buyer is in. A buyer who has not gone through the pre-approval process or resists doing so, may have a difficult time finding an experienced Realtor. Experienced agents will often pass on working with a client who may end up wasting time that could have been better spent working with another more viable buyer (or even just staying home watching movies with the family) instead of trudging out in the winter snows with a person not qualified to buy. Money, in that it costs a realtor to drive around looking at homes with clients is also a factor. Agents need to pay for gas and wear and tear on their cars. Once the Realtor and client have established a rapport, excellent agents begin to discover who their clients are and what their needs are and will strive to locate homes that fit those needs. They will not pitch homes that don’t fit the bill in hopes of persuading the client to explore “other options”. Through the years I have heard too many times: “ I started working with this Realtor, but they kept showing me houses that were too big, too little, too far away, too close, too, too, too. You get the idea. If a buyer feels the Realtor is not listening or does not care, then
they probably aren’t listening and don’t care. Time to find another Realtor. The advantage of starting the search by finding the Realtor is that a good Realtor can help the buyer work through what it is they want and need more efficiently. They can tell the buyer what is going on in the market. They can set their client up with a search engine that will send clients properties based on their criteria. Realtors will do this happily, months in advance, if the buyer is just coming to the market and wants to get a feel for it. But if buyers are not ready to buy, they should not expect their Realtor to take them to see homes, not just yet. That comes when they are ready to sign a contract. This does not mean buyers should not go to open houses to check out the market - please do! An educated buyer is a smart buyer. Their Realtor will guide them, help them prepare and will happily help buyers locate loan officers, attorneys and property inspectors. Realtors make their recommendations based on past successful outcomes. They do not get “kick backs” for recommendations - that is against the law! Buyers need to make sure they find a loan officer they feel confident in. It is crucial that a buyer have all their P’s & Q’s taken care of. They need to have the loan officer at hand for several reasons besides the realtor knowing they are serious buyers. A smart buyer knows what they comfortably can afford, thanks to being pre-approved by their LOCAL loan officer. Sometimes buyers think they are qualified for a certain amount solely based on using a “how much can you afford in a mortgage” website. They plug a few numbers in, and quite often the actual amount a buyer is eligible for is vastly off mark, higher or lower. There are so many variables that contribute to ascertaining if a buyer is eligible to buy and for how much, that are not being considered by those online sites. So many times buyers march out and
start looking, only to be disappointed that they cannot afford the home they so desperately want and thought they were qualified for. This can be avoided by simply walking into a loan officers office. Buyers who have developed a relationship with their loan officer do not waste time looking at homes they can’t afford or conversely, looking a homes in a lower price bracket than they want thinking it’s all they can afford. These buyer are looking at the homes in their price range and are not missing out on great opportunities. A buyer with a good relationship with the loan officer is a very strong buyer, one that all Realtors want to work with. These buyers know exactly what works for them, preventing them from losing ground in an active market and missing out on the perfect property. When the buyer has found their perfect home, it’s likely that others might think it’s perfect too. In our current market, the early bird is getting the worm, as long as they have the right pre-approval in hand or have the means to quickly modify that pre-approval; tailoring it to the offer to be submitted. What does that mean? One thing on every Realtors wish list in regards to buyers, is that their loan officers be readily available, not just during bankers hours. Real estate is a daily market. Often buyers and their Realtors need service from the loan officer over the weekend or during evening hours. Being incommunicado can mean the difference between scoring the buyers dream home or not. At the very least it could result in a buyer paying more than necessary for their home. Initially, loan officers issue pre-approvals declaring the highest amount their client is qualified to buy at. Submitting this preapproval with an offer, lets sellers know just how high the buyer can go, and based on that knowledge, sellers may feel comfortable to counter, asking for more. Once the dream home is found and the price to be offered is worked out, the buyers savvy Realtor should be able to call their loan officer and ask for a pre-approval at the dollar amount being offered, rather than show the seller and their Realtor how much the buyer can actually afford. This leaves the seller and their agent guessing; are they taking a risk by countering for more? Can the buyer afford more? If not, will they lose a buyer for the difference of a few thousand? If the loan officer is not available and time is of the essence, then the buyer could end up spending more than
necessary by revealing just how much they can spend. Buyers should always ask how available the loan officer is. Once the buyer has lined up their loan officer its time to think about who they will use for their attorney to handle the real estate transaction. I always recommend that buyers use an attorney who specializes in real estate. To do otherwise could cost the buyer more in the long run. If they are paying their attorney an hourly fee for the real estate transaction, they could end up paying more than if they hired a specialist who usually charges a flat fee (not withstanding unforeseen issues that could arise require extra time to resolve.) If the deal goes normally, there will not be any extra costs. But if there is a problem, buyers and sellers want attorneys that recognize these problems and are able to solve them as efficiently and successfully as possible. Real estate attorneys know how to successfully protect their clients in real estate deals including using diplomacy rather than adversarial procedures. More than once in my early years as a Realtor (before I took a strong stand in this matter with my buyers and sellers) I cannot tell you how horrible deals could go if an attorney was acting in an adversarial manner. These adversarial prone attorneys were generally the family’s trusted advisor who handled their everyday legal matters, whether mundane or criminal. It’s important buyers and sellers understand real estate is not an everyday transaction, but one with many facets. Usually only an experienced real estate attorney will recognize the many potential pitfalls that can come with these transactions and be able to deal with them successfully. They also have the experience to recognize an issue that might not be so obvious to an attorney not well versed in that field. I have come to the point of strongly advising my clients that they need a real estate specialist for their attorney, to do otherwise is often a waste of time and money on their part. If you are a buyer excited to find your new home, now IS the time! Get ready to go out there and snag that fantastic home you have been hoping for. Just remember, a little planning and prep-work will get you where you need to go that much faster and easier! Happy Holidays and Happy House Hunting!

What Should Be In A Contract! Whether it is roofing, siding, windows, that new kitchen or an addition, remodeling is a costly investment and you should protect yourself before signing a contract. New York State regulates the sale of home improvement goods and services and applies requirements to most types of improvements costing over than $500 purchased by homeowners. The law requires contractors to give you a contract that includes many provisions. The main ones are summarized below: 1. The name, address and phone number of the contractor must be on the contract. (Do not accept a P.O. Box number as the contractor’s address) 2. The exact amount of the project including progress payments. 3. A start and completion date, including any contingencies which would change the completion date such as bad weather. You may also want to have included a penalty clause for running over the completion date. A $100 per day deduction off the contract price is common for every day that the project runs over the completion date. 4. A clause that reads that “any progress
payments received by a contractor from a customer can only be made if they bear a reasonable relationship to the work actually done, materials purchased or related costs.” 5. Any payments received by a contractor from a customer prior to substantial completion of the job must be placed into a escrow account in a bank located in New York State within five business days and the customer must be informed where the money is held within ten business days. The contractor can only withdraw the deposit only in the following circumstances: under the terms of the payment schedule agreed on by the contractor and the customers; upon substantial completion of the job; or if the customer violates the contract, but only to the extent that the amount covers the contractor’s reasonable costs. 6. A complete specification description of the work and materials, including brand names, model numbers and other identifying information. 7. A consumer notice that reads as follows: “The customer has an unconditional right to cancel the contract until midnight of the third business day after the contract was signed.
Cancellation must be done in writing. If the contractor or subcontractor who does the work is not paid, he or she may have a claim against the customer’s property under the Lien Law. 8. Warranties and guarantees should be stated in the contract. Be sure to understand if the warranty or guarantee covers both the materials and labor and if they are prorated and transferable. For example a new roof job may warrant the materials for 25 years but the contractor may only warrant his labor for one year. There are penalties against contractors and consumers may sue for actual damages, plus a $500 penalty and reasonable attorney’s fees if the contractor has used fraudulent written statements to get the contractor to sign the contract. The Attorney General is also authorized to go to court to stop illegal practices and order contractors to compensate defrauded customers. Contractors can also face civil fines for violating the provisions of the law, especially with the protection of the customer’s payments.
Tips For Consumers: • Determine exactly what work you want done before you decide to get estimates. • Get three estimates from contractor companies that are similar in size. Be sure to check for verification of Liability and Workmen’s Compensation Insurance. • Check the contractor’s reputation with the Better Contractors Bureau, banks and suppliers. • Make sure when you decide on your final contractor to do the job that you are signing a contract that meets all the requirements of Article 36A of the NYS Business Law. • Do not pay a large deposit in advance of the start of the project unless it is for a specific reason such as special order cabinets or windows, etc. Instead negotiate a payment schedule tied to the completion of specific stages of the job. • Don’t pay the final payment unless you are satisfied and the job has been completed as per the contract specifications.
