Worst Case Scenario

pre-purchase considerations for unmarried partners Are you part of an unmarried couples who plan to buy a home together, or know someone who is? If so, read this!. Realtors are seeing more unmarried couples coming together to purchase. Some Realtors, would like to gently inquire if the couple has completely worked out details regarding the property in the unpleasant possibility of a split, but only do so if they feel that the couple is receptive. Other Realtors feel it is none of their business and not part of their job description. I fall into the former, since I want my clients to be educated and proactive in home ownership and some times that includes selling the property in the future. Hopefully I will be called to sell their home because the couple is up-grading, not splitting! The intent of this article is not to scare unmarried couples from buying a home, but to encourage them to do so completely prepared for all situations, as best as they can.

No one goes into a committed relationship expecting the worst, and some feel addressing that possibility actually jinxes the relationship. But Realtors, all too often, see the end result of when the worst actually happens. As a Realtor, I have had clients who were desperate to be rid a property they had bought with a former partner. Once the breakup occurred, the house became one of the major obstacles to severing all ties to the other person. Additionally, in the process, one party often becomes severely harmed financially, as a result.

So what to do? If buying a property with a partner, how does a person protect themselves? Anthony LaFay, Esq. of LaFay, Bryne & Lafay on W. Main St. in Rochester gave some very succinct advice: “Approach the buy as a business deal first”. No matter how committed a couple is, this is rule #1. He explained that people do not come to him until they are in a troubled situation and many times, it’s too late to help them. If prospective buyers take a few steps at the start, they can go a long way to helping themselves and each other in preventing the headaches involved in separating financially, should a break-up occur without the protections offered by marriage.

In making the decision to buy a home together, so many questions arise and must be looked at closely. What if the incomes are unequal? Is ownership of the house unequal if expenses are not equally shared?

Who puts down the down payment? Who gets what part of the cost of down payment when the house is sold? Whose credit gets used, if not both? What are the contingency plans if illness occurs to one partner, or they die? What if they split up, the house has to be sold, and it sells at a loss? Who absorbs the financial fall out? What if the house is sold at a profit? Who gets what? What if a split occurs and one partner wants to keep

the house? Can the other be forced to pay?

Notice, in the end, most questions center around finances.

Those pesky financial questions! Sadly, many of these questions are ignored because of the confidence of the couple in their relationship. This is where the problem lies if they actually do break up. Nothing has been decided before, and in the heat of a break up, it is often too late to expect these questions to be answered amicably. What to do then?

The best thing is to speak to their individual attorneys BEFORE buying the house.

This means each party is represented in the transaction. James A. Marino, Esq. of James Marino Law, located on South Washington St. in Rochester, explained that: “Both parties should consult with their own attorney prior to entering into the transaction. Ethically an attorney would, most likely, be prohibited from providing legal counsel to both parties due to conflicts of interest, regardless of the party’s affections for each other.” Is this sounding more like a business deal? It should, because it is.

Only in marriage are these issues covered by law. Unmarried couples should have a contract in place between the two of them regarding the property in the case of a split or the death of one of the partners. “However,” Jim concedes, “the reality is that most people do not have, nor do they desire to spend, the money to consult with two different attorneys and have an agreement negotiated.”

This is true, since often the couple is working hard to come up with all the expenses (closing and moving costs) they will incur when they buy the house.

What to do in that case? This is the moment of truth for a couple, when they must be able to honestly consider these questions and come to agreement on the answers and write them down. Whatever is agreed upon should be put in writing and signed by both parties. Should it ever land in court, this may go a long way in helping the judge see the situation clearly.

During this session(s), the couple needs to consider their individual current and future financial position. Are they both steadily employed? What if one becomes unemployed? Can one support the property if the other is incapacitated? If not, they should

explore options such as insurance covering poor health or death. It’s important to outline both parties expectations. If the property is being bought using one partner’s credit, does that entitle or require them to be the sole owner? Does the other partner have the right to expect money out of the house when it is sold in the future - especially if they contributed to the mortgage payment, regardless of whether the couple is still together? If both are on the mortgage, they need to recognize that they are still responsible for that mortgage and cannot just be taken off, even if they no longer live in the house. If there is a lot of sweat equity in the house, is one person more entitled than the other? An agreement must be made regarding the down payment, including who gets what in the event of a sale. These are the types of questions the couple needs to ask and answer. The idea is to imagine all scenarios, no matter how painful.

Both need to be clear on their position in the ownership of the house.

What is it that each partner expects regarding home ownership? Does one partner legally own the house and the other does not? If one partner does not legally own the house, are they expected to contribute equally financially and, notwithstanding that their name is not on the deed, do they expect to be treated as an co-owner? Does one person have the power to evict the other from the home?

Some of this is hashed out while deciding how the parties will named on the deed. Most married couples own a home together by “Tenancy by the Entirety.” This means if one spouse dies, the other, automatically, by operation of law, becomes the sole owner of the

property. If there is a split, divorce laws govern and judges decide the disposition of the property considering all facts and circumstances.

Unmarried couples can chose to own real property as “Joint Tenants with Right of Survivorship”. This type of ownership affects the same result as if the property were owned by a husband and wife. Another option is to own the property as “Tenants in Common.” If one partner dies, their share is passed through their will or if there is no will, according to state law, “intestacy.” This is the least secure position for a surviving partner to be in since unrelated parties have no rights of inheritance if there is no will and most young couples don’t have wills. The surviving partner could be forced to sell their beloved home by their new co-owners – the estate of the deceased partner or worse still, have to be co-owners with the deceased partner’s parents or siblings. Sadly, often attorneys find themselves having the discussion of ownership and what it entails when the couple attends the closing.

Based upon the “new normal” of relationships in our society, nothing about a relationship may be assumed when different surnames are used on purchase contracts and loan applications. For example it is now completely normal for a woman to continue to use her maiden name after marriage. To make inquiries about the purchasers’ marital status based on different surnames might be perceived as rude, judgmental and, possibly, discriminatory.

Couples need to broach these difficult questions prior to putting an offer in on the home of their dreams, to prevent the situation from turning into a living nightmare down the road, should the worst occur.

The best thing couples can do is to prepare themselves in all aspects of their future home ownership. Knowing the answers to these questions is important as it will keep the relationship harmonious, by the very fact that both partners know what the expectations are. Happy Relationship - Happy Home!

Eggceptional Easter Eggs !

We have all been down this path, coloring Easter eggs with our kidlets or grand kidlets.

We usually purchase the Paas egg coloring kit, fitted with buttons of color and an egg holder. I have found some really fun ideas for you to color your eggs this year and the kidlets will think that you are one cool mom.

First let’s make the perfect boiled egg. Place one dozen eggs in a sauce pan, add a pinch of salt, and cover the eggs with water. Bring the eggs up to a boil, then remove from heat and cover for about 12-15 minutes. The next step is to place the eggs in an ice bath or drain off the hot water and add cold water and ice cubes. FYI, eggs will peel easily if they are a week old, otherwise the shells will come off in maddening its and bits. Hard boiled eggs will last for about 3-5 days.

Have you ever colored eggs naturally? The basic recipe is to boil in a non-metal pot, a quart of water and 2 tablespoons vinegar. For color you can add blueberries for a soft lavender. For yellow add yellow onions to the water or a couple of tablespoons of cumin,

for red to pink add cranberry juice. For a very natural brown egg, add coffee to the vinegar mix. Boil beets to make deep red, and spinach or kale for a softened green. Make sure your eggs are dry before coloring them.

Another fun idea but a bit messier is to paint the hard boiled eggs with chalk board paint.

When the black paint is dry, the kids can make designs with chalk and wash them clean to repaint. I wouldn’t eat these, but the creativeness is endless. You could write the names of your dinner guests on the eggs and use them for place cards.

This year I have read several recipes for shaving cream dyed eggs. Spread shaving cream onto a baking sheet pan, add drops of food coloring, then swirl the colors with tooth picks or wooden skewers. Roll the eggs through this messy cream, and you have marbleized colored eggs. Make sure you rinse the eggs and dry completely. I have heard that you can substitute cool whip for the shaving cream. I wouldn’t eat these either, cool whip isn’t cool.

Now if you really want to go natural for Easter, you can grow your own grass, or have the kids do it. In a small dish cover grass or alfalfa seeds with water and wait, it is like growing a chia pet without the pet. Another way to have natural grass is to shred paper in your shredder. Use manila colored paper and the result is much like excelsior from the craft store. I always hated plastic grass, like pine needles it tends to hide in the house for months!

Leave the additives, the harmful chemicals, and the plastic grass out of your baskets.

Trim That Ivy

before it gets a hold on you Spring is the time of year when everything begins to grow again. After the spring flowers fade away, the green of your yard takes over. There is nothing like a well-landscaped and manicured yard to attract buyers to look closer when considering a property.

The care taken with the exterior landscaping is often an indicator to the overall care and condition of a house. A beautifully landscaped yard usually indicates a diligent homeowner with a well-maintained home.

Conversely, a sloppy yard often indicates a poorly maintained home.

Many owners of older stone, brick and stucco homes love the look of vines and ivy growing up one of the walls or up the chimney of the house.

It reminds them of stately university buildings or churches. Unfortunately, these plants can do lasting harm.

Ivy will hold moisture against the house, leading to rot of the wood siding, trim and windows. The ivy will penetrate small cracks in the brick and masonry walls. Freeze-thaw cycles then cause additional damage. Some types of ivy secrete an enzyme that attacks older lime-based mortar used in older structures (pre-1920); causing the mortar to disintegrate. Vines can even work their way between materials and into walls, causing damage to window frames and interior plaster.

Also, thick vines and ivy will attract wildlife and pests, including birds, wood boring inspects, and more.

What should be done if a house has

a thick growth of ivy or vines? First, cut off the base of the growth and allow the vines to die for several weeks (perhaps over the winter). Then, remove the dead vines as carefully as you can from the building. There might be damage that requires repair. If so, a qualified mason or repair person should perform the work, to match existing materials as much as possible. Next, remove any accessible stumps and roots.

If there is remaining residue and tendrils from the ivy, you should paint over them or leave them alone to wear off and fall off over upcoming months or years. Usually, it is best not to power wash or otherwise remove them, since this could cause further damage.

Although vines and ivy might look good on some buildings, the potential harm and damage it can cause is significant. The cosmetic advantage is usually not worth the cost of potentially rebuilding a chimney, pointing a brick wall, or replacing rotted windows.

a change of seasons can bring about home improvement scammers Warm weather is here and so are the scam artists who prey on homeowners, especially the senior citizens. These rip off scammers, more commonly known as “drifters” usually go door to door offering a variety of home improvements and repairs from roof and chimney repair, gutter cleaning, driveway sealing, tree trimming, etc.

They often say they can do the job at a really low price, as they have left over materials from another job. Many times, these scam artists are driving trucks with magnetic signs and out-of-state license plates, or operate out of store front offices that they can quickly move out of once they finish their scam or if they think local authorities have knowledge of them.

The Better Contractors Bureau recommends that you do the following to protect yourself against these fly-by-night operators: Before you give permission to anyone to do work on your home that you have not actually called and especially before you allow them into your home

you should check them out with the Better Contractors Bureau, as to whom the owner of the company is their address and reputation.

Ask for identification (Drivers license) and if they show you an out of state license then tell them that you are not interested. Be firm and do not allow them into your home, as most scam artists work in pairs and while one keeps you busy the other will search your house to steal valuables. Some even work with children and ask if their child can use your bathroom. NEVER FALL FOR THIS APPROACH!!

Don’t fall for the high-pressure stories like “this offer is only good if you take it now” or “once we leave your street we won’t be able to give you such a bargain again”.

If you have checked the contractor out and do feel confident that they are truly a legitimate, local contractor and want to have them do the job for you then be sure to get everything in writing on a bona fide NYS contract required by law. In the

contract it must state along with all the specifications, that you have 72 hours to change your mind and any money given as a down payment or draw must go into an escrow account.

Never give a large down payment and never pay in cash no matter what they tell you or what discount they may offer you! Always pay by check, payable to the company name, not an individual!

If you have a large project or repair that you feel will be expensive you should get at least 3 estimates from similar size companies, all in writing.

Never allow a contractor that you have not called to go up on your roof to check the roof, chimney or gutters, as they sometimes have been known to actually damage those items so that they can show they are in need of replacing or repairing.

Make sure the contractor you finally decide on is properly insured with liability insurance and if he has employees on the job show proof of Workman’s Comp Insurance.

Always try to use a Better Contractor Bureau member, as they are registered and you will have recourse if they don’t do a good job.

Lastly, you should always go with the old saying, “you get what you pay for”.
