Considerations for Unmarried Couples don’t let romance cloud your thinking

Recently I covered the topic of single people buying property. An equally important focus is unmarried couples who plan to buy a home together. Realtors are seeing more unmarried couples eager to purchase a home. Few Realtors are comfortable with gently inquiring if the couple has completely worked out details regarding the property in the unpleasant possibility of a split, some might be, but they’ll only do so if they feel that the couple is receptive. Most Realtors might feel it is not their business to ask, either way, the real onus is on the couple seeking to buy. It is important that clients be educated and proactive in home ownership - including selling the property in the future (hopefully because the couple is up-grading, not splitting!) The intent of this article is not to scare unmarried couples from buying a home, but to encourage them to do so completely prepared for all situations, as best as they can.

No one goes into a committed relationship expecting the worse, and some feel addressing the possibility of the worst, actually jinxes the relationship. Sadly Realtors and attorneys witness, all too often, the end result of situations where this very thing happens. As a Realtor, I have had clients who were desperate to be rid a property they had bought with a former partner.

Once the breakup occurred, the house became one of the major obstacles to severing all ties to the other person. In this situation, one or even both parties can often suffer severe financial harm during the process.

So what to do? If buying a property with a partner, how does a person protect themselves? Anthony LaFay, Esq. of LaFay, Bryne & Lafay on W. Main Street in Rochester gave some very succinct advice: “Approach the buy as a business deal first.”

No matter how committed a couple is, this is rule #1. He explained that people do not come to him until they are in a troubled situation and often, it is too late to help them.

If the prospective buyers take some steps, they can go a long way to helping themselves and each other in preventing disaster and the headaches that are involved in separating financially after a break-up, without the protections offered by marriage.

In making the decision to buy a home together, so many questions need to be looked at closely. What if incomes are unequal? Is ownership of the house unequal if expenses are not equally shared? Who pays the down payment? Who gets what part of the cost of down payment when the house is sold? Whose credit gets used, if not both?

What are the contingency plans if illness occurs to one partner, or they die? What if they split up and the house has to be sold, and it sells at a loss? Who absorbs the fi-

nancial fall out? What if the house is sold at a profit? Who gets what? What if a split occurs and one partner wants to keep the house? Can the other be forced to continue to pay the mortgage to prevent a foreclosure and/or bad credit rating? Notice that in the end, most questions center around finances.

Those pesky financial questions! But sadly, many of these questions are ignored because of the confidence of the couple in their relationship. This is where the problems lie if they actually do break up. Nothing has been decided before hand and in the heat of a break up, it’s often too late to expect these questions to be answered amicably.

Now what to do? The best thing to do is for each partner to speak to their individual attorneys BEFORE buying the house.

This means each party is represented in the transaction. James Marino, Esq. of James Marino Law, located on South Washington Street, Rochester, explained that: “Both parties should consult with an attorney prior to entering into the transaction. Ethically an attorney would, most likely, be prohibited from providing legal counsel to both parties due to conflicts of interest, regardless of the persons affections for each other.”

Is this sounding more like a business deal?

It should, because it is. Only in marriage are these issues covered by law. Unmarried couples should have a contract in place between the two of them regarding the property, in the case of a split, whether if by agreement or death. “However,” Jim concedes, “the practical consideration is that most people do not have the money to speak to an attorney to iron out these issues.” This is true, since often the couple is working hard to come up with all the expenses they will incur when they buy the house.

What to do in that case? This is the moment of truth for a couple, when they must be able to honestly consider these questions and come to agreement on the answers and write them down. Whatever is agreed upon, should be put in writing with a copy going to both parties. Should it ever land in front of a judge, this will go a along way in helping the judge see the situation clearly.

Couples should keep careful track of who pays what in connection with the purchase and ownership of the house. This includes keeping receipts on behalf of the person

paying. This way if there is a break up each person should be able to recoup their investment, before the profit (if there is any) is divided. Also this allows for losses to be fairly divided.

During this session(s), the couple needs to consider their individual current and future financial position. Are they both steadily employed? What if one becomes unemployed? Can one partner support the property if the other is incapacitated? If not, they should explore options such as insurance covering poor health or death. It’s important to outline both parties expectations.

If the property is being bought using one persons credit, does that entitle them to be the sole owner? Does the other partner have the right to expect money out of the house when it is sold in the future regardless if the couple is still together (especially if both contributed to the mortgage payment)? If both are on the mortgage, they need to recognize that they BOTH are still responsible for that mortgage and cannot just be taken off the mortgage, even if they no longer live in the house. If there is a lot of “sweat equity” in the house, is one person more entitled than the other? If there is, the couple should determine a fair market value for this and this amount is attributed to the person contributing the “sweat equity”. An agreement must be come to regarding the down payment, including who gets what in the event of a sale. These are the types of questions the couple needs to ask and answer. The idea is to imagine all scenarios, no matter how painful.

Both need to be clear on their position in the ownership of the house. What is it that each partner expects regarding home ownership? Does one partner legally own

the house and the other does not? If one partner does not legally own the house, are they expected to put in equally and do they expect to be treated as an equal partner legally? Does one person have the power to evict the other from the home? If meeting with an attorney, some of this is hashed out while deciding what type of tenancy they will want. Married couples own a home together by “Tenancy by the entirety.” This means if one spouse dies, the other usually inherits the other’s half. If there is a split, laws govern the disposition of the property, regardless of who put in what, financially.

Unmarried couples can chose to own together in a “Joint tenancy with right of survivorship,” which covers the other partner if one dies. Lastly, there will be “Tenancy in common,” where if one partner dies, their share is passed on to whom ever they chose in their will or without a will, ownership will be decided by a judge. This is the least secure position for a partner to be in since they might not automatically inherit their partners share and could be forced to sell their beloved home should the new owner of deceased partners’ share, force a “sale by partition.” Sadly, attorneys often find themselves having the discussion of ownership and what it entails, when the couple has a signed purchase contract and are coming to the attorney for the first time. Couples need to broach these difficult questions prior to putting an offer in on the home of their dreams, to prevent the situation from turning into a living nightmare down the road should the worst occur.

The best thing couples can do is to prepare themselves in all aspects of their future home ownership. Knowing the answers to these questions is important as it will keep the relationship harmonious, by the very fact that both partners know what the expectations are. Happy Relationship-Happy Home! Trim That Ivy

before it gets a hold on you Spring is the time of year when everything begins to grow again. After the spring flowers fade away, the green of your yard takes over. There is nothing like a welllandscaped and manicured yard to attract buyers to look closer when considering a property.

The care taken with the exterior landscaping is often an indicator to the overall care and condition of a house. A beautifully landscaped yard usually indicates a diligent homeowner with a wellmaintained home. Conversely, a sloppy yard often indicates a poorly maintained home.

Many owners of older stone, brick and stucco homes love the look of vines and ivy growing up one of the walls or up the

chimney of the house. It reminds them of stately university buildings or churches.

Unfortunately, these plants can do lasting harm.

Ivy will hold moisture against the house, leading to rot of the wood siding, trim and windows. The ivy will penetrate small cracks in the brick and masonry walls.

Freeze-thaw cycles then cause additional damage. Some types of ivy secrete an enzyme that attacks older lime-based mortar used in older structures (pre-1920); causing the mortar to disintegrate. Vines can even work their way between materials and into walls, causing damage to window frames and interior plaster. Also, thick vines and ivy will attract wildlife and pests, including birds, wood boring inspects, and more.

Estate Solutions

What should be done if a house has a thick growth of ivy or vines? First, cut off the base of the growth and allow the vines to die for several weeks (perhaps over the winter). Then, remove the dead vines as carefully as you can from the building.

There might be damage that requires repair. If so, a qualified mason or repair person should perform the work, to match existing materials as much as possible. Next, remove any accessible stumps and roots.

If there is remaining residue and tendrils from the ivy, you should paint over them or leave them alone to wear off and fall off over upcoming months or years. Usually, it is best not to power wash or otherwise remove them, since this could cause further damage.

Although vines and ivy might look good on some buildings, the potential harm and damage it can cause is significant. The cosmetic advantage is usually not worth the cost of potentially rebuilding a chimney, pointing a brick wall, or replacing rotted windows.

Whether it’s roofing, siding, windows, that new kitchen or an addition, remodeling is a costly investment and you should protect yourself before signing a contract.

New York State regulates the sale of home improvement goods and services and applies requirements to most types of improvements costing over than $500.

The law requires contractors to give you a contract that includes many provisions. The main ones are summarized below: 1. The name, address and phone number of the contractor must be on the contract.

(Do not accept a P.O. Box number as the contractor’s address) 2. The exact amount of the project including progress payments.

3. A start and completion date, including any contingencies which would change the completion date such as bad weather. You may also want to include a penalty clause for running over the completion date. A $100 per day deduction off the contract price is common for every day that the project runs over the completion date.

4. A clause that reads that “any progress payments received by a contractor from a

customer can only be made if they bear a reasonable relationship to the work actually done, materials purchased or related costs.”

5. Any payments received by a contractor from a customer prior to substantial completion of the job must be placed into an escrow account in a bank located in New York State within five business days and the customer must be informed where the money is held within ten business days.

The contractor can only withdraw the deposit in the following circumstances: under the terms of the payment schedule agreed on by the contractor and the customers; upon substantial completion of the job; or if the customer violates the contract, but only to the extent that the amount covers the contractor’s reasonable costs.

6. A complete specification description of the work and materials, including brand names, model numbers and other identifying information.

7. A consumer notice that reads as follows: “The customer has an unconditional right to cancel the contract until midnight of the third business day after the contract was signed.

Cancellation must be done in writing. If the contractor or subcontractor who does the work is not paid, he or she may have a claim against the customer’s property under the Lien Law. 8. Warranties and guarantees should be stated in the contract. Be sure to understand if the warranty or guarantee covers both the materials and labor and if they are prorated and transferable. For example a new roof job may warrant the materials for 25 years but the contractor may only warrant his labor for one year.

There are penalties against contractors and consumers may sue for actual damages, plus a $500 penalty and reasonable attorney’s fees if the contractor has used fraudulent written statements to get the contractor to sign the contract. The Attorney General is also authorized to go to court to stop illegal practices and order contractors to compensate defrauded customers.

Contractors can also face civil fines for violating the provisions of the law, especially with the protection of the customer’s payments.

Tips For Consumers: • Determine exactly what work you want done before you decide to get estimates.

• Get three estimates from contractor companies that are similar in size. Be sure to check for verification of Liability and Workmen’s Compensation Insurance.

• Check the contractor’s reputation with the Better Contractors Bureau, banks and suppliers.

• Make sure when you decide on your contractor, that you are signing a contract that meets all the requirements of Article 36A of the NYS Business Law. • Do not pay a large deposit in advance of the start of the project unless it is for a specific reason such as special order (cabinets or windows, etc.) Instead negotiate a payment schedule tied to the completion of specific stages of the job.

• Don’t pay the final payment unless you are satisfied and the job has been completed as per the contract specifications.

They’re Back!!

It seems the stink bug, originally from China, made its first appearance in Pennsylvania in 1998. The bug feeds on produce trees mostly, they love apples and corn. The armored bug has a stink sack and they use this sack to spray enemies like wasps and birds. If you squish a bug, they will expel this odor, the stink. And although I have captured many a bug, I still have not had the delight of smelling the nasty scent. It seems the most efficient way to get rid of the bug is to pick it up with a tissue then flush it. Other ways to get rid of them is to pick them off of their surface and put them in a jar with rubbing alcohol. Remember not to squish, squash or squeeze. Some say the stink smells like coriander, but I certainly don’t want to find that out. Another way to kill the bugs at home is to fill a spray bottle with warm water and blue Dawn.

Spray the bugs, the mixture will coat the bug and eventually leave them lifeless.

The Department of Agriculture is working on a pheromone to use in fields, a ‘love’ trap. The bugs have to be eliminated in the fields and orchards before they can be eradicated from our homes.

Until then, I will be armed with Dawn, tissue and alcohol [maybe a scotch], to fight the war on stink bugs.

Last year I wrote an article about the nasty, shielded stink bug. This spring they are back! I thought I did all the right preventive measures. I sprayed the house.

I sprayed vinegar around my door and windows. I raked all fallen leaves from my yard. But, they are back, how stumps me. How they get in stumps me, so I decided to research them further.

It seems that by accounts of those really infested, my problem is slight, but it still grosses me out. I have read stories of some people not being able to leave their homes at certain times of the day when the bugs are busiest. Some people have their gardens swarming with the stink bugs, and others have hundreds crawling up their drapes and walls. The situation in my home thankfully is not that severe, but a bug or two a day still bothers me at the core.
