Beating the Competition

tips on creating a winning offer against multiple buyers The Rochester real estate market is moving full speed ahead! In some areas multiple offers are coming in. What do you do to make your offer the one the seller will select? You can successfully bid with the right mind set and preparation. Read these tips and write the offer that gets accepted!   Find an experienced Realtor to guide and advise you in this process. They have negotiated offers like this before and will advise you on what has to happen to have the offer selected. Surprisingly, it’s not always the highest offer that’s selected! Before writing the offer your agent should call the listing agent and ask about possible competition. It’s good practice to allow agents to advise their clients accordingly.   When you are involved in an multiple offer situation, your offer is not likely to be accepted if you still have to sell your own home. If you are buying in a market of multiple offers, you must sell your own house first! No seller will accept your offer over non-contingent offers. Your offer is more risky because it has a possibility of not closing if you do not sell your home. Why would a seller chose your offer over a non-contingent offer?   If you need to sell your home before buying, get your house on the market and price it to sell before looking for a new one. To sell quickly it needs to be in tiptop shape. If showings or offers don’t happen, talk with your agent to see what needs to be corrected, don’t be insulted by what they have to say. Remember, price trumps all other issues and fixes many problems.   Always submit your offer with a trusted lenders pre-approval or if you are a cash buyer, “proof of funds”. These show you are a qualified buyer. Submit a “pre-approval” and not a “pre-qualification” letter. Pre-approval means the lender has seen actual documentation and proof of your income and credit. Pre-qualifications are not as strong since your credit & income has not been verified. Obviously, a pre-approval letter has more worth. Take the time with your lender to begin the process for your pre-approval, doing so not only tells the buyer you are qualified, but are serious about closing quickly.   Once you find your dream home, great! What next? Usually your agent will prepare a comparative market analysis (CMA), to determine what was sold (and at what price), that is similar to the home you want. Often buyers estimate a property value based on information from the internet or tax assessments and don’t really compare like properties. Agents compare properties based on the following: type of house (ranch or colonial for example) square footage, number of bedrooms

and bathrooms, location, condition and much more. Compensating adjustments are made. CMA’s indicate a starting point for your offer. Making an offer based on a CMA is making an educated offer and one more likely to be accepted.   When bidding on a house with other offers coming in, the scenario is different because of competition. With multiple offers, buyers often pay over asking price. The sellers want to get the highest price and best terms, and in this situation can and will get them. A common multiple offer scenario is all buyers are notified of the situation and asked for their “highest and best offer” by a particular date and time. There usually is not another opportunity after the deadline. The seller will decide which contract to accept based on offer strengths and weaknesses. They may counter-offer but that is pretty rare.  With multiple offers, negotiations rarely occur because several offers are competing for the seller’s attention and are usually favorable to the seller. If one clearly stands out considerably from the rest, and is favorable to the seller, that offer is usually accepted. Go in with your best foot forward. When there are is no competition for a property, some buyers submit low-ball offers expecting to be countered. If there is too large a distance between the offer and what the seller is expecting, there may no response because the sellers are too insulted to respond. In those situations buyers can try again, but understand the waters may have been tainted and the seller may refuse to deal with that buyer. It is best to be within the ballpark with price if you really want the property.   You want to entice sellers to select your offer and one way would be to structure your offer with the least amount of contingencies. You could eliminate contingencies such as inspections, attorney approval or seller concessions. It’s not always about price, terms are important as well. A high offer asking for many concessions could put you in last place! Try to not ask for sellers concessions. Buyers needing sellers concessions are considered weaker buyers, less capable of closing than those not asking.   Normally, buyers ask for attorney approval as a contingency. Consider waiving

attorney approval of the contract since the period for attorney approval leaves an open window for another buyer to come in and scoop up the house with a better offer. A seller can accept that offer and instruct their attorney to disprove your contract. In New York State the attorney does not have to give a reason why the contract was disproved. By waiving attorney approval, you are not waiving having an attorney work on the deal. You are waiving the right to having him disprove the contract. By not asking for attorney approval, the seller will not be able to have their attorney disprove a contract if a better deal comes in after you’ve inked yours.   If the home is in good condition, and you are willing to take a chance, do not ask for an inspection contingency. This makes your offer extremely palatable since the seller knows there will be no further negotiation or demands from the buyer for repairs. This is a desirable position for sellers and will count heavily. But only do this is if you are knowledgable about construction and can spot issues as well as what they cost to repair. Your agent is not an inspector and while they can point out issues, that would be the extent of it.   Your offer should have larger than normal deposit, indicating your seriousness and the lesser risk of your walking away from the deal. Remember the seller is trying to distinguish whom, among the prospective buyers is financially secure, the least demanding and most likely to bring the contract to close. Show your financial soundness by putting a larger down payment towards a mortgage, indicating to the seller that you are on sound financial footing and serious about closing.

Don’t ask the seller to give you personal items, with the exception of what is noted in the listing such as stove and refrigerator, as these often come with a home. Sometimes sellers make exclusions of fixtures, the most common being chandeliers! I always advise my sellers to remove any items being excluded from the listing and replace them before the home is put on the market, to prevent stand-offs between buyers and sellers. If an item is listed as excluded, don’t demand that item. Do you want to lose a home because of a $400 chandelier? If personal items are offered, write an addendum later and not make it part of the initial contract. Be aware of course, that if you wait too long, the owner may have already sold them, thinking you were not interested.   Ask your agent to find out what needs the seller may have. They may have children in school and need a few extra months to finish out the school year. Consider offering that they be able to live in the home until the school year is over. What other issues might a seller appreciate a buyer working with them on? Doing so may make the difference in your offer being accepted instead of a higher offer!   Lastly, get personal. Ask your agent if you can include a letter telling the seller about yourself and why you want to buy that home. Most sellers have an emotional attachment to their house and want to see it loved by the buyer, as they loved it. Show the seller why you are that buyer. Tell them what it is that you love about the house, how you like the neighborhood and why you deserve to be chosen as the winning offer. Be sincere in your words. Think about what you would like someone to say to you if they were buying your home.   In multiple offer situations, the seller has many options and most of the control. But this does not mean that you as buyer, cannot guide them toward accepting your offer! Happy House Hunting!

Air-Chek can be reached at 800-247-2435. Recent media attention has focused on granite countertops and whether they can increase your indoor radon levels. While testing your home is always a good idea, a few clarifications are in order.  FACT: All natural products, especially stone, minerals, and sand, contain trace amounts of some radioactive elements called NORMs (Naturally Occurring Radioactive Mineral) that can produce measurable amounts of radiation and sometimes radon gas.   This includes all concrete products, clay bricks, most non-plastic plates and dishes, coal and the fly ash produced in coal-fired power plants, natural gas (contains radon), phosphate fertilizers used in your garden - ALL contain potassium and small amounts of uranium and thorium, and the vegetables grown using those fertilizers. (The Border Patrol often catches truck loads of marijuana because it is loaded with radiation producing potassium.) All glass made using silica (even eye glasses, wine glasses, mirrors, windows, etc.), and granite too.   However, the key word is “measurable”. As an illustration, compare the radon produced by your naturally-occurring stone surfaces, such as granite, to the heat produced by a birthday candle. Although you wouldn’t be able to heat your entire kitchen using a birthday candle you can easily feel the heat if you

put your hand over it. This is similar to placing a geiger counter over a tiny speck of uranium, thorium, radium, or potassium. The detector will make thousands of clicks per minute but be of little concern. If your stone surface emits a small amount of radon, as happens in most cases, it will generally be insignificant when diluted with the quantity of air in your entire home. You are hundreds of times more likely to be at risk for radon emanating from the soil beneath your home.   I still want to test my granite surface. What should I do? Recently, many radon labs reported that consumers are placing their radon-in-air test devices on granite surfaces under bowls, buckets, baking pans, or other similar containers. BEWARE of suggestions to place an ordinary radon test kit under an inverted container of an unknown volume. Such an experiment will, 99% of the time, grossly over-report the radon levels.   Why? Because only a charcoal device that has been calibrated to measure true “radon emanation” captured in a known volume for a precise amount of time can provide valid information.   It’s important to use a test where the laboratory knows the EXACT exposure volume, test multiple locations on the granite surface due to possible “hot spots”, and to simultaneously perform additional tests in the area of the granite surface and in another area at least 20 feet away. If your indoor radon levels in both areas are similar, the granite likely does

not have a measurable effect on your indoor radon-in-air levels. If the levels of radon in the area containing the granite are higher than your indoor levels in other areas of your home AND the surface top test devices also return high results, then it is possible that the granite is contributing to, or is the source of, your indoor radon levels.   Why Geiger Counters will not accurately measure radon. Most web videos and TV demonstrations measure the granite counter top using a Geiger Counter. These simple audible devices are being used for dramatic effect and are misleading in two principle ways: 1. Simple hand-held Geiger Counters are not calibrated for measuring ONLY the radonproducing Radium in granite. This means they will almost always over-respond when attempting to measure the radon emissions. 2. Not all the radiation making the clicking sound comes from radon-producing Radium. In most cases the noise is produced by two other naturally occurring elements: Potassium and Thorium. In fact, up to 95% of the Geiger Counter clicks may come from Potassium, a very common element found in our own bodies, as well as many foods and vitamin supplements.  FACT: Testing has shown that a “pancake” style Geiger Counter (like those used on TV) will over-respond 10 to 20 times more than a professional grade radiation detector like those used in hospitals and nuclear power plants.  FACT: Potassium does not produce radon gas and Thorium produces a different type of gas called Thoron. Thorium is a shorter-lived element which is similar to radon but decays

about 6,500 times faster. Thoron has a halflife of about 51 seconds, whereas Radon has a half-life of just over 92 hours. Because most of the Thoron gas never makes it very far from the granite’s surface, the US EPA does not consider Thoron a major contributor to health problems.   The bottom line. Simple hand-held meters alone CANNOT tell you how much radon is being produced by your natural stone materials. These meters grossly over-respond to the actual radiation coming from the stone.   Gamma measurements can only be used to find “hot-spots” that may be emitting radon. These “hot-spots” can then be tested using calibrated activated charcoal devices. Results, or emanation rates, from the surface tests are reported as “volume-per-surface-area-per-time” of radon gas. The Air Chek surface tests are collected for a specific amount of time (i.e., 4872 hours) in a known volume, over a known surface area, and can be properly analyzed and calculated with sophisticated laboratory equipment. a change of seasons can bring about home improvement scammers Warm weather is here and so are the scam artists who prey on homeowners, especially the senior citizens. These rip off scammers, more commonly known as “drifters” usually go door to door offering a variety of home improvements and repairs from roof and chimney repair, gutter cleaning, driveway sealing, tree trimming, etc. They often say they can do the job at a really low price, as they have left over materials from another job. Many times, these scam artists are driving trucks with magnetic signs and out-of-state license plates, or operate out of store front offices that they can quickly move out of once they finish their scam or if they think local authorities have knowledge of them. The Better Contractors Bureau recommends that you do the following to protect yourself against these fly-by-night operators: Before you give permission to anyone to do work on your home that you have not actually called and especially before you allow them into your home you should check them

out with the Better Contractors Bureau, as to whom the owner of the company is their address and reputation. Ask for identification (Drivers license) and if they show you an out of state license then tell them that you are not interested. Be firm and do not allow them into your home, as most scam artists work in pairs and while one keeps you busy the other will search your house to steal valuables. Some even work with children and ask if their child can use your bathroom. NEVER FALL FOR THIS APPROACH!! Don’t fall for the high-pressure stories like “this offer is only good if you take it now” or “once we leave your street we won’t be able to give you such a bargain again”. If you have checked the contractor out and do feel confident that they are truly a legitimate, local contractor and want to have them do the job for you then be sure to get everything in writing on a bona fide NYS contract required by law. In the contract it must state along with all the specifications, that you have 72 hours to change your mind and any money

given as a down payment or draw must go into an escrow account. Never give a large down payment and never pay in cash no matter what they tell you or what discount they may offer you! Always pay by check, payable to the company name, not an individual! If you have a large project or repair that you feel will be expensive you should get at least 3 estimates from similar size companies, all in writing. Never allow a contractor that you have not called to go up on your roof to check the roof, chimney or gutters, as they sometimes have been known to actually damage those items so that they can show they are in need of replacing or repairing. Make sure the contractor you finally decide on is properly insured with liability insurance and if he has employees on the job show proof of Workman’s Comp Insurance. Always try to use a Better Contractor Bureau member, as they are registered and you will have recourse if they don’t do a good job.

The Cure for the Summertime Blues

If you are a 60’s child, you may remember the song The Summertime Blues by Blue Cheer. They were searching for the cure, and I may have found it! Pouring over my stack of catalogs filled with pages of patio furniture and accessories, the one constant is the color blue. Pottery Barn has tuned into aqua blue this season. They are featuring cushions, dishes and tableware bathing in ultra cool shades, almost the color of the pool water. Frontgate features beach towels and pool floats in navy. And another catalog, Serena and Lilly, offers sling chairs and outdoor rugs in patterns using denim blue as the backdrop.   If you are deciding to add some blue to your home this summer, let’s begin with wall color. Paint is always a quick and painless fix. Although some paint companies are asking very high prices for a gallon of paint, there are always coupons and sales, so be on the outlook for those.   Benjamin Moore paints has some soft

blue shades. Watercolor blue, Mediterranean breeze, and Blue ice are easy on the eye blues. One of my favorites from Benjamin Moore is Lake Placid. If you are looking for a deeper blue try Wythe blue, a historical color. And if you are looking for a bright navy, take a peak at Blueberry Hill.   Sherwin Williams paints offers a bounty of soft, light blues. Topsail is a soothing blue as well as Windowpane. One of my favorites from Sherwin is Rainwashed, and going a bit deeper is Quietude.   If you are searching for an aqua shade look for Meander, a bright aqua, or for less color try Buoyant Blue.   C-2 paint which has always been a favorite brand of mine has rich, saturated blues with plenty of depth of color. Stockholm blue is a perfect choice if you are designing a room around denim. This color is especially good for a boy’s room. Another good blue is Deep Freeze. Softer blues are Oxygen, Fresco, and

Harmony. Back in 2007, I had a Homearama house’s interior painted Argyle blue. It was perfect, just enough color and the furniture was all in cream tones. I admit it was pretty, soothing and upscale.   One of my new loves is Farrow and Ball paint company. Although we can’t buy it locally, it is available on line. Since 1946, this company has made just beautiful, upscale paint, using very subdued colors and 13

finishes. Some really great blues are Pitch blue, a dull tone, Lulworth blue, a grey sky blue, and Drawing Room blue, a deeper tone not quite navy. If you want to paint a blue that is greenish, Arsenic is your friend.

SENIOR LIVING “Senior Living” is not “Assisted Living”, which is the first thought that pops into many peoples heads. People often think this term does not apply to them if they are 50 years old or older, when actually, it does. Senior living as defined by the Assisted Living Federation of America, is a “lifestyle choice for individuals seeking an independent lifestyle with as much assistance they need or want.” There often comes a time in peoples lives when they decide to make changes to their style of living because their needs and wants have changed. Some of these changes are a result of aging or health issues, others are due to a change of priorities and interests.   As the baby boomers age out, they have brought a great deal of change with them to the traditional view of becoming a senior in our society. As a group, they have varied interests and no matter how old they’ve become, they continue to be active and involved with their interests. Most abhor the idea of becoming dependent on their children and try to chose options with that intent in mind. The good news is there are many more options today than there ever have been. When it comes to real estate, The National Association of Realtors (NAR) has recognized there are special needs and considerations that agents need to be aware of and resolve when dealing with clients considered seniors in our society. To help agents with this task, NAR has created a designation that a Realtor can earn after taking the required classes.   The Senior Real Estate Specialist designation (SRES) can be found after a Realtors name in their advertising. One way to

find agents in Rochester who have earned this designation is to go the SRES website: SeniorsRealEstate.com. At the top of the page is a link reading “Find an SRES”, click there and the rest is easy. There are 49 Realtors in the Rochester area with this designation. Some of the highlights of their training are that they are familiar with HOPA which stands for Housing for Older Persons Act and all that pertains to it. They also specialize in the differences of housing options available and the suitability of each depending on their clients needs. Options run the gamut from agerestricted communities and aging in place designs to assisted living. SRES designated agents understand how their clients can use their pensions, 401k accounts and IRA’s in real estate transactions. They are also aware of mortgage and loan schemes targeting the 50 year+ crowd and can help their clients avoid these traps. One of the most important skills SRES realtors come with is familiarity with Medicaid, Medicare and Social Security and how these programs can affect the real estate decisions of clients over 50 years.   Realtors who provide these services have learned to create a specialized approach to individual needs. They can often help identify options to reduce out of pocket expenses, work with varied income streams possibly allowing a person to stay independent as they age, or may even be able to procure financial assistance for them. As with all real estate agents, SRES agents come with a network of referrals, but these agents are able to make referrals to specialists capable of making an individuals “Senior Living” lifestyle possible.

A home that for years may have been a source of pride can become a source of anxiety because of the stress of maintaining it. An owner may no longer want to clean a large home or pay for its upkeep. This is often the catalyst for change leading to a simpler lifestyle. This does not mean that person has become incapacitated, simply that their interests have changed away from home maintenance to other things such as spending their time volunteering or socializing with friends and family. No matter the reasons, eventually the time will come where a transition point is reached and part of that transition involves selling the beloved family home.   What options are out there for those that have decided to make a change? Actually, there are as many options as there are seeking change. The first step is to locate a Realtor, with or without the SRES designation. There are many agents in the Rochester area that have experience with seniors and are more than willing to offer assistance. For instance, sellers shouldn’t be surprised if on their first visit, the agent actually offers to assess their home to see if it might be modified to allow the seller

to stay in their home longer. Should the determination be made to sell, they will then provide information on current market conditions, create a Comparative Market Analysis as well as go through the home providing insight for the owner on what to do to make the home marketable or contribute to bringing in the best price possible. If during the process, the decision is made to “stage” the property, the agent should be able to recommend a staging professional to help with the process. Besides recommending a stager, the agent should have a list of painters, cleaners, landscapers, and even estate sales companies in the Rochester area.   Making the decision to adapt a senior living lifestyle can be difficult for many, causing emotional turmoil for individuals and their families. To some it means giving up, to others, admitting they have gotten on in years. No matter what emotions the idea stirs, it is comforting to those in need and their loved ones, that there are many options available to them. Also comforting is that there are Realtors ready and equipped to help with this stage of a persons life – with care and understanding.
