What You Should Expect from your Realtor

Having Realtor representation is valuable for both sides of the equation, whether the client is a seller or buyer. Here’s how and what sellers and buyers should expect from their Realtor:   Expect honest and open communications with the listing agent. An agent should get back to their client within 24 hours. Most try to call their clients back within six hours. If a seller’s property was shown, the listing agent should try to get feed back from buyer’s agents and to present it to the seller, good or bad (better to not sugar-coat in my opinion.) If a home is on the market for a period of time, a seller can expect an updated comparative market analysis, at least every two months, preferably every month. Sellers need to understand what is happening on the market currently. If there is no traffic through a listing, the seller’s agent should talk with their client about current market conditions and how to trouble shoot the situation. Reducing the price will always help, but sometimes that isn’t the answer. Sellers can expect their agents to try to exhaust all other options first; such as asking that the seller clean or stage their home, do repairs, shovel the walk-ways in the winter – what ever it takes to present their home in the best possible light, even if that conversation is uncomfortable for both seller and agent. A good agent is an honest agent. Being honest saves time and headaches down the road. Good agents will do everything possible to get their listings into the public eye in the most favorable way.   When selling a home, Realtors should put the listing together with thought and attention to detail. Once listed, sellers should receive a copy of the Realtor version of the listing for review. Sellers can expect to see all the pertinent information, including number of bedrooms and baths, taxes, showing instructions, directions, and the private agent to agent comments the public does not get to see, and especially multiple photos. The sellers should not hesitate to correct information if necessary.   Photos! Photos help sell listings, period! If there are no photos, often a potential buyer will just pass by that listing. Photos must be properly framed and focused with the right amount of light. How many agents, as well as buyers, have looked on line and found a listed property with only one photo? Photos sell! The exception can be a rental property, due to tenant privacy rights photos could be limited or even no interior shots. Most tenants will allow photos if the owner requests it, but are not required to do so. In owner occupied homes, there is no reason for limited interior photos. The exterior must be shown.   When there are photos, the agent should discuss with the seller some details that could create an unfavorable impression of their home. Dirty counter-tops, clothes strewn all over, unmade beds and (ironically) obviously unused vacuum cleaners are among the many distractions and, turn off’s for buyers. The agent should get the best photo possible. They need sellers to clean up and present their home in the best possible

light. When a listing agent makes suggestions regarding preparing for photos, sellers should be listening and act accordingly. This is not a situation where an agent is trying to hurt the clients feelings, they just want to do their job, which is to sell the house!   Regarding price, expect listing agents to be honest about the price of the property. There are some agents who will list at unrealistically high prices hoping to reduce the price later, just to get the listing. Sellers should be aware if an agent promises to sell their property at an inflated price or guarantees to sell in a really short time. Remember, if it seems too good to be true, then it probably is. Sellers must be realistic on price. How do you know realistic pricing? If three agents come and give their opinion but one agent is well out of line with the other two, chances are the two more closely aligned agents are coming to the seller with accurate price suggestions.   Every Realtor – EVERY Realtor has had listings in the past that they listed at the wrong price point but did so because the owner insisted. Every one of these Realtors hoped the price would come down. Sadly, when they could not persuade the owners to bring the price to where it needed to be, the Realtor was blamed for the lack of a sale and the seller turned to another Realtor, who is then anointed to be the “real” expert. With time working in their favor, as well as a more motivated seller, a new Realtor can typically get the price down and sell the property. Nothing is so disheartening to work so hard and see the situation play out this way for a Realtor. Experienced agents rarely take listings where owners are not price realistic and hope they get another shot at the listing after the seller has had a go-around.   Expect honest and open communications with the buying agent! Buyers should expect the same communication and honesty from their agent. It is important for buyers to understand they must be honest with agents they speak with too. It is not unusual for selling agents to have a potential buyer demanding to see the listing. A good agent will ask if the buyer is working with an agent. Buyers have been known to lie, answering no, when they indeed do. This is not a good strategy. Creating distrust when it’s time for a seller to decide whose offer to accept is not to your advantage. If a selling agent detects a fib, they will let the seller know. Also, selling agents expect the buyer’s agent to come through the property with their clients, especially if the selling agent is not personally there to show it.

A good buyer’s agent will prepare the buyer to successfully go out into the market to buy. They will ask that the buyer be pre-approved to buy and ask to talk to the buyer’s mortgage officer to verify what the buyer is qualified to buy, as well as what type of mortgage will be used. The type of mortgage will determine how the contract is written up. Buyer agents should have a system in place to locate appealing offerings to show their clients in a timely manner. Buyers expect to be listened to and provided options that actually meet their needs. If the buyer’s agent consistently fails to do so without cause, instead pushing properties out of agreed upon search parameters, it could be time to rethink working with that agent since they are not listening to their client.   The reality of the situation should always be addressed! Buying agents should be honest with you about what they think about the property being looked at. While agents cannot tell you where the “good” neighborhoods are or perform a house inspection(unless licensed as inspectors), they can detail the ease or difficulty of selling the property at a later date. If it is perceived as a difficult sale, they should be able to identify why, such as being on a busy road or having a trashy neighbor littering up the neighborhood, reasons are as varied as there are houses.   When the house to buy is found, the buyer’s agent should create a buyer’s comparative market analysis to help determine the offer price. The agent will need to know what their client expects to pay and analyze that price. If it seems off, they must be able to explain why and back up what they have to say with data.   Above all else, buyers should not let an agent push them to buy if they’re not ready or to pay more than they are comfortable paying.

A buyer may be able to pay more but may not be comfortable doing so. It is true that some agents have a number in their head of how many homes they are willing to show a buyer before they decide that buyer is wasting their time. Others might not have a number, but will evaluate buyers as much as they themselves are evaluated by the buyer. If the buyer is sincere and earnest about the job at hand, many agents will stick with them until the goal is achieved.   Once the offer comes together, both agents have to work it! Their jobs are just beginning after an offer is accepted! Deals today are much more difficult to successfully steer to close. Realtors sometimes have to think outside the box to make things work. They need to be good at negotiation and be diplomatic too.   Agents, on both sides of a deal, should explain what each clause in the contract means, before signature and initials are applied. They should analyze price, explaining why it is or isn’t a good offer. Clients should expect explanations about contingencies and conditions to their complete understanding and satisfaction. The agents may refer questions to their clients real estate attorney, and that’s ok, since agents cannot answer the legal questions and should defer to the attorney. That said, agents are qualified to explain the contract and get it put together.   Agents should make sure legal deadlines are adhered to and when they can’t be met, to write addendum’s or have the client’s attorney write them, protecting their interests. Agents from both sides should work in a cordial manner to facilitate the deal going through in an nonadversarial manner. There are some cringeworthy agents out there. Ones that other agents hate to deal with, knowing a deal will always be difficult if they are on the other end. Difficult agents typically mean additional obstacles when it comes to closing. Clients should be very careful in their choice of agent, paying attention to the agent’s every nuance before deciding who to hire. Happy House Hunting!

Finished Basements In some parts of the country it is rare to even have a basement. In our region, most homes have basements and many are of considerable size. No matter how many single-story “ranch-style” homes you enter, it’s always amazing how big the basement is. With so much basement space at our disposal, it makes sense to try and use it as additional living space. Using basements as living or utility space is nothing new. Many older homes from the 1800’s used a portion of the basement, which was cooler than other areas of the house, as a summer kitchen. Today’s basements are used as workshops, artist studios, and more. Over the years, building codes and standards for finished basements have developed to improve the safety of these spaces. Unless the house was designed with a walk-out basement, most basements that were finished before the 1980’s don’t have large windows or doors. Low ceiling heights in older finished basements could result in “headknockers” as well. When finishing a basement today, homeowners should apply for a building permit with the local town building department and get the proper inspections and sign-offs when finishing the space. Most building departments have a pamphlet or document for homeowners to clearly explain the requirements for

finished basement living spaces. These requirements are basically the same requirements that apply to all living spaces, including on the main levels of the home. Although they can vary slightly from town to town, New York State residential codes dictate the minimum requirements for new, finished spaces. Some of the main requirements include: • Minimum ceiling height of 7', although beams, ducts or obstructions can project down to 6' 8". • Rooms with a floor area of at least 70 sq ft and at least 7' in length and width. • Natural ventilation of not less than 4% of the floor area or equivalent mechanical ventilation. • Smoke and carbon monoxide alarms (hard wired, with battery backup, and interconnected). • Insulated walls with moisture barrier. • Bottom sill plates for interior walls that are metal or pressure treated lumber. • Permanently installed heat sources (usually supply and return registers).

Obviously, some homes have basements that do not have adequate headroom to properly finish the space. Other basements are damp or wet and need improved drainage and waterproofing so the investment to finish the space isn’t wasted. The most talked about requirement for finished basements is the egress window or the second exit. If a room will be a bedroom (i.e. a sleeping room), then there must be a second means of exiting the room (and a means of allowing fire rescue) directly from the room. If a room will be an office, fitness room, or recreation room, the second means of egress can be through an adjoining room. Although a second stairway and exterior door can provide the necessary second means of egress, the path of egress cannot be through a garage. Egress windows and the exterior window wells can take many forms. However, some of the applicable standards include:

• Window wells are necessary when the sill of the window is below the level of the adjacent grade. • Window wells with an area of 9 sq ft. At least 3' in each horizontal direction. • When the window well is deeper than 44", it must have a ladder or steps. • Window wells need proper drainage provisions.

When purchasing a home that has a finished basement, it is good practice to check on whether or not the basement was finished with proper permits and approvals. If not, it makes sense to see what would be required to bring it up to modern standards. Many people choose to live with finished basements that are “pre-existing and non-compliant”. However, if the basement was finished more recently, without the correct permits and approvals, you could be opening yourself up to potential costs to finish the job correctly or to “un-finish” the space. To Cut or Not to Cut that’s a good question

It seems lately we have been experiencing more violent storms then ever and with them much more property damage from trees falling. There are not many people that are experienced enough to know whether a tree is rotted or decayed and if it warrants being cut down or not. Carmen Santora, Executive Director of the BCB says, “because of the danger and fear of what falling trees can do to life and property, another scam is starting to develop. It starts with a concerned call from a homeowner to a tree and landscape company.” Most times after a storm the homeowner is worried and only calls one contractor for a price to trim or cut down dangerous trees. They are at a disadvantage and can be taken advantage of very easily, especially senior citizens. The way the scam works is the home owner is told the tree(s) in question are rotted, decayed and very dangerous and must be cut down immediately before they fall and causes damage or injury to themselves or their neighbors. Prices charged by the scam artists are usually higher than normal and pay-

ment is asked for up front preferably by cash or by credit card that is processed immediately. Most times there is no contract and many times nothing is given in writing explaining what will be done and what will not be done. The scammer will tell the customer that they are a NYS Certified Arborist when all they are is a member of an arborist association. Consumers should be warned that when in danger they are the most vulnerable and should make sure they are dealing only with long established reputable tree service companies. If they have questions about trees they can also call a Tree Pathologist. Some times the small fly by night tree contractors are not insured, or if they are, they may only have liability insurance to cover landscaping and not tree cutting which is much more expensive. If an accident occurs while they’re doing tree work and they don’t carry liability insurance for tree work the homeowner could be liable for injury or damages to neighbors and their property and usually a homeowners policy will not cover the incident. need of tree work: Never be pressured into signing a contract or work order only because the threat of danger may be imminent. Unless the tree has already fallen and caused damage to property, always get three estimates for the work. Never pay by cash and only make checks payable to a company name not to a personal individual. If asked to do so that should be a warning that the contractor is operating deceptively. If a contractor says they are a NYS Certified Arborist check to see that they are and not just a member of an arborist association. Make sure everything that is to be done is specified in writing, especially as to who will remove the tree limbs, stump and debris. Ask to see a copy of the contractor’s liability insurance certificate and check if they are insured as a tree contractor not just a landscaper. If in doubt call the insurance company to verify it, as tree removal insurance is much more costly then landscaping insurance. If it is not an emergency situation check the contractor out with the Better Contractors Bureau at 338-3600.

July is a very special month. It is National Hot Dog Month. Americans eat 7 billion hot dogs between Memorial Day and Labor Day. That means about 60 hots a year per person. Hot dogs are not just for baseball games. They have become quite gourmet in the hot dog world. There are dogs made for every taste. For the vegan, there are tofu dogs, for the beef lover, there are angus beef dogs, and for the calorie conscious there are turkey and chicken hot dogs. In Rochester we have our famous Zweigle’s Hot Dogs, and my husband eats at least 2 porkers a week, if not more (porker aka Rochesterian white hot). Where did the hot dog get its name? Back in 1901, in New York City, at a baseball game, a food vendor was sell-

ing sausages on bread. They were called ‘dachsund’ sandwiches, which evolved to hot dogs. How do people eat their dogs around the country? Out west, the dog is topped with chili. In Chicago, the dog is topped with caramelized onions and mustard, and New Yorkers love their dogs topped with mustard (Frenchs’) and ketchup, and I love relish too. The proper way of dressing you dog, according to the National Hot Dog Council, is to place your dog on the roll (unheated), add your condiments on top of the dog, ketchup first, then mustard, then relish. There you have it the perfect dog. What is in a hot dog? After much research, I am not going there. But I can tell you they have better ingredients than

ever. There is also protein and iron in the dog, so, who knew, they are almost good for you! Have a super July roasting your tube steaks on the grill. Oh, and I almost forgot July is National Ice Cream Month too.
