Waterfront Buying Guide
lake, pond or stream, find a property that matches your lifestyle When it rains it pours… right into the many lakes, rivers and streams that make upstate NY one of the best destinations for those looking to buy waterfront property. Buying and selling waterfront properties is a specialty field within real estate business. While there are no agents that devote themselves entirely to waterfront sales in the Rochester area, some are more experienced in this field. How this became one of their specialties practices varies with each agent. But most important is that an agent have knowledge of the intricacies of buying and selling water front properties. For buyers there are different factors to consider when buying by the water. Significantly, what potential use does the buyer expect from their new property? Some prefer to just enjoy a beautiful view while others plan to use the property for very specific purposes involving access to a body of water. This area offers so many waterfront lifestyle choices. Those that motor boat or sail, may require water deep enough, close to shore, to bring their boats in. They additionally, may need docks or the right to build docks, without too many problems from the local authorities. Others might be kayakers or canoeing enthusiasts that could prefer a quiet body of water over a very active large body of water like Lake Ontario. Still others might want to step out of their house to fish in the trout stream gurgling by. Then again, many lakefront property buyers are looking for a home to easily enjoy summer seasons strolling down to the beach for a swim or to provide a wonderful place for entertaining family and friends. Once a decision is made regarding needs and desires, the process can begin. When a mortgage is needed to buy, the first step is consulting with a loan officer regarding possible requirements a property may need to have in order to get the mortgage. Locally the mortgage process is no different from buying a land-locked home, with the exception of whether the property lies in a flood zone which would require the buyer buy flood insurance. We do not have problems like downstate’s coastal exposure to hurricanes so there is no issue with getting basic insurance on a house, unlike when buying oceanfront properties. Flood insurance is required if the house sits in a flood zone when buying with a mortgage. FEMA runs the flood insurance program nationwide. It is possible to learn about flood zones and if properties are located in flood zones by going to the FEMA website at: http://www.fema.gov/nationalflood-insurance-program. Pricing can be a factor - often waterfront is expensive, especially on large bodies of water. Canandaigua Lake is a premier up-state vacation destination and multi-million dollar homes are not unusual on this lake. Buying an inexpensive waterfront getaway on this lake is getting increasingly more difficult. The other Finger Lakes in the area are also experiencing an increase in real estate values, especially in recent years. Due to its size, Lake Ontario still
offers a multitude of pricing possibilities and can be more affordable. To those that want water front property, don’t despair. There are so many lakes, ponds and other types of water in our region affordable pricing can be found, albeit, with some concessions on the part of the buyer. No matter what price range, serious consideration must be made to the land itself, not just the structures on the property. The real value is NOT the house, but the land! This is opposite from non-waterfront properties, where the house is the most valuable part of the property. The location of the parcel is important. The closer to a community, generally the higher the prices, with variables of course. These variables make finding a Realtor knowledgable with local waterfront issues, important. They should know what restrictions are currently in place for the area under consideration, such as limits to put up a sea wall or if it is forbidden by local ordinance. If they do not know, they should be able to advise buyers how to find this information. Some of the important attributes of waterfront land are: View, Beach, Type of Lot, Closeness to Water, Privacy, Restrictions and Utilities. Buyers should keep these in mind when looking since they are the factors they’re paying for. How is the view? Is there a view of the water? If there is obstruction, can it be removed? Are there restrictions regarding cutting trees and brush away? A beautiful view is often one of the most important things to owners of water property, and will factor heavily into the resale of the property when the time comes. What is the beach like, if there is one? Does the house have a rocky or sandy beach? If the buyer wants to swim, they would usually prefer a sandy beach. Is there an HOA managing a particular property? If not, who is responsible for maintaining the beach? Buyers need to find out what local rules and regulations are regarding the waterfront. Buyers should be aware of how fluid the shoreline is. Does it change drastically due to erosion or silt deposits? Agents, buyers and their attorneys should be very careful to make sure that the property to be purchased actually extends down to the water line. If not, what is the possibility that the land between the property and water could be sold off to someone who would potentially build on it? (If that were to happen the “beachfront property” is no longer beach front and will significantly devalue!) In some communities the beach front is publicly owned and will
not be sold off without first right of refusal going to owner of the property most close, in other communities the beachfront is part of the property. Is the beach level with the house or located fifty feet below requiring a walk down a set of stairs alongside a cliff to access it? The harder it is to access the beach, the less desirable a lot is, with some exceptions. A Realtor would be able to explain those exceptions since they are always unique to each property. Keep in mind if the beach is not easily accessed, problems are unique to the person who owns the property. As owners age they may find it more difficult to access the beach. Also, a cliffside home poses significant dangers for young children living there or visiting. Closeness to the water is important. If a house is a good distance away from the water, this will affect the value of the property to the extent of distance and how the water view is affected. If completely obscured by distance or trees, the less waterfront living is offered. Many waterfront properties have little privacy. If buyers desire privacy their search will probably be longer, but not impossible. Their privacy is dictated by the amount of water frontage the property has and where the house is built. Waterfront yardage most heavily dictates price. If a property has significant waterfront as part of the deed it is more expensive than another local property with a narrow frontage and a deep lot. So privacy, on the waterfront, comes with a price. While restrictions are not an actual attribute of a land parcels, they are equally important in that they shape the use of the property. For example, if there are no docks allowed on a waterfront, then a serious boater might chose to bypass that property. It is crucial that potential buyers learn what conditions, covenants or restrictions might be part and parcel with the property, prior to putting an offer in, or when

writing an offer make it a contingency that they be able to opt out if they find out there are restrictions of use that do not fit into their plan. This is why it is important the Realtor be familiar with waterfront properties and writing offers for them. They will be able to advise the buyer what to ask for in conditions or inspections. A buyers attorney is another layer of protection and should be an established Real Estate attorney. If the buyer is envisioning making changes to the property their attorney should be able to research rules and regulations for them to make sure these are changes that would be allowed. Additionally, the potential buyer could also consult the local zoning board for more information. If there are potential changes, the buyer must research prior to buying! Additionally the attorney may make satisfactory answers part of their attorney approval conditions. Utilities such as gas, electric and sewers are not uniform for beach front properties. What is offered depends on the location of the property. Waterfront lots are often not connected to public sewers and/or do not have septic allowances. Buyers should know up front how they will obtain their water, heating fuel, electric, even cable or internet, as well as any additional costs that can arise. Proximity to established communities will influence what utilities are available for a property. Buyers should never assume the utilities are the same as an adjoining suburb or town! Lastly, the house! The type and cost of the house are personal preference. What is important though, is that buyers understand that houses on the waterfront are more exposed to the elements and are more costly to maintain. In the Finger Lakes region waterfront properties see more ice and wind damage than inland homes. Buyers should determine if the home is insulated against our cold weather since lake frontage is often colder and more extreme. Note that this article barely touches on buying the house and what to look for, (rather everything but!) for a reason. Waterfront property is it’s own specialty in real estate and must be treated accordingly. Good luck with finding your special waterfront property!

Bed Bugs come crawling back! You’ve seen it in the news, the issue of bed bugs seems to be growing in epidemic proportions. We’ve asked our business partner, John Fraysier from Castleguard Pest Elimination in Fairport to give us some insight on these pests. John can be contacted at 585-381-0395. For the Pest Management Professional, bed bugs have become the new cockroaches of the early 21st century. Why the comparison? It’s not a biological one. The two pests are distinct species and there are many differences between them. The comparison lies in their proliferation in the US and throughout the world. And the fact that getting rid of them is not easy. The good news is that with the introduction of pesticide baits back in the 1990’s, cockroaches have become easier to control and heavy infestations can be eliminated without the use of sprays. Unfortunately, no “silver bul-
let” solution exists for eliminating bed bugs. Surprisingly, bedbugs are a favorite prey of the cockroach. It’s not uncommon to have a problem with both pests at the same time because of this relationship - just don’t think of this as a natural method of bed bug control as both pests are highly undesirable. While both bugs may inhabit the same space, there are significant differences in the two pests. Cock roaches are known carriers of food borne illnesses like salmonella, whereas the bed bug has not been found to carry any dis-
ease transferable to humans. Studies continue to go on, but thus far scientists are baffled as to why this is the case. The feces left behind from both pests have been found to cause allergic reactions in some, and asthma in others. But these are allergy problems, not disease. So why is it that bed bugs have come crawling back? Forty years is a long time for them to be away. The quick answer often sited is the absence of DDT. This is taking on less importance now as research is showing that bed bugs were developing re-
sistance to DDT back when it was used. It is now presumed that DDT, if it were used today, would be ineffective against bed bugs. Another answer commonly given is the change in pest management in the past fifteen years. Before the use of insect baits, liquid sprays were used liberally in homes and institutions for the control of cockroaches. These sprays, it is postulated, helped to keep bed bugs out of buildings as a side benefit. Baits have no such secondary benefit. Studies are underway to try and link genetic changes in the bug to their resurgence. Whatever the reason, bed bugs are back in force. So next time you hear, “Mommy, there’s a monster under my bed,” check it out. Maybe there is.

These rip off scammers, more commonly known as “drifters” usually go door to door offering a variety of home improvements and repairs from roof and chimney repair, gutter cleaning, driveway sealing, tree trimming, etc. They often say they can do the job at a really low price, as they have left over materials from another job. Many times, these scam artists are driving trucks with magnetic signs and out-of-state license plates, or operate out of store front offices that they can quickly move out of once they finish their scam or if they think local authorities have knowledge of them. The Better Contractors Bureau recommends that you do the following to protect yourself against these fly-by-night operators: Before you give permission to anyone to do work on your home that you have not actually called and especially before you allow them into your home you should check them out with the Better Contractors Bureau, as to whom the owner of the company is their address and reputation.
Ask for identification (Drivers license) and if they show you an out of state license then tell them that you are not interested. Be firm and do not allow them into your home, as most scam artists work in pairs and while one keeps you busy the other will search your house to steal valuables. Some even work with children and ask if their child can use your bathroom. NEVER FALL FOR THIS APPROACH!! Don’t fall for the high-pressure stories like “this offer is only good if you take it now” or “once we leave your street we won’t be able to give you such a bargain again”. If you have checked the contractor out and do feel confident that they are truly a legitimate, local contractor and want to have them do the job for you then be sure to get everything in writing on a bona fide NYS contract required by law. In the contract it must state along with all the specifications, that you have 72 hours to change your mind and any money given as a down payment or draw must go into an escrow account. Never give a large down payment and never pay in cash no matter what they tell

Never allow a contractor that you have not called to go up on your roof to check the roof, chimney or gutters, as they sometimes have been known to actually damage those items so that they can show they are in need of replacing or repairing. Make sure the contractor you finally decide on is properly insured with liability insurance and if he has employees on the job show proof of Workman’s Comp Insurance. Always try to use a Better Contractor Bureau member, as they are registered and you will have recourse if they don’t do a good job.
