Finished Basements In some parts of the country it is rare to even have a basement. In our region, most homes have basements and many are of considerable size. No matter how many single-story “ranch-style” homes you enter, it’s always amazing how big the basement is. With so much basement space at our disposal, it makes sense to try and use it as additional living space. Using basements as living or utility space is nothing new. Many older homes from the 1800’s used a portion of the basement, which was cooler than other areas of the house, as a summer kitchen. Today’s basements are used as workshops, artist studios, and more. Over the years, building codes and standards for finished basements have developed to improve the safety of these spaces. Unless the house was designed with a walk-out basement, most basements that were finished before the 1980’s don’t have large windows or doors. Low ceiling heights in older finished basements could result in “headknockers” as well. When finishing a basement today, homeowners should apply for a building permit with the local town building department and get the proper inspections and sign-offs when finishing the space. Most building departments have a pamphlet or document for homeowners to clearly explain the requirements for
finished basement living spaces. These requirements are basically the same requirements that apply to all living spaces, including on the main levels of the home. Although they can vary slightly from town to town, New York State residential codes dictate the minimum requirements for new, finished spaces. Some of the main requirements include: • Minimum ceiling height of 7', although beams, ducts or obstructions can project down to 6' 8". • Rooms with a floor area of at least 70 sq ft and at least 7' in length and width. • Natural ventilation of not less than 4% of the floor area or equivalent mechanical ventilation. • Smoke and carbon monoxide alarms (hard wired, with battery backup, and interconnected). • Insulated walls with moisture barrier. • Bottom sill plates for interior walls that are metal or pressure treated lumber. • Permanently installed heat sources (usually supply and return registers).
Obviously, some homes have basements that do not have adequate headroom to properly finish the space. Other basements are damp or wet and need improved drainage and waterproofing so the investment to finish the space isn’t wasted. The most talked about requirement for finished basements is the egress window or the second exit. If a room will be a bedroom (i.e. a sleeping room), then there must be a second means of exiting the room (and a means of allowing fire rescue) directly from the room. If a room will be an office, fitness room, or recreation room, the second means of egress can be through an adjoining room. Although a second stairway and exterior door can provide the necessary second means of egress, the path of egress cannot be through a garage. Egress windows and the exterior window wells can take many forms. However, some of the applicable standards include:
• Window wells are necessary when the sill of the window is below the level of the adjacent grade. • Window wells with an area of 9 sq ft. At least 3' in each horizontal direction. • When the window well is deeper than 44", it must have a ladder or steps. • Window wells need proper drainage provisions.
When purchasing a home that has a finished basement, it is good practice to check on whether or not the basement was finished with proper permits and approvals. If not, it makes sense to see what would be required to bring it up to modern standards. Many people choose to live with finished basements that are “pre-existing and non-compliant”. However, if the basement was finished more recently, without the correct permits and approvals, you could be opening yourself up to potential costs to finish the job correctly or to “un-finish” the space. Carmen Santora, Executive Director of the Better Contractors Bureau in an effort to help homeowners contemplating a major remodeling project and who are concerned if the cost invested would be recouped should they decide to sell their home offers the following information. His analysis is based on a national average “cost vs. value” survey and condensed to specifically relate to our local area. The resale value depends on a lot of variables, such as the state of the housing industry and local market conditions in particular at the time of sale. A lot of homeowners are concerned that their remodeling investment might price their home out of the neighborhood averages. This should only be taken into account if you think that you may be selling your home in the near future. If a homeowner has small children and is thinking of adding extra bedrooms or an additional bathroom they may want to think of the advantages of staying where they are. If the schools are great, they live close to their workplace and shopping and are in an area of lower taxes or other personal conveniences, then they shouldn’t worry about pricing themselves over their neighborhood averages, especially if they intend to stay there for many years.
However, if the homeowners know they will be staying where they are for only a short time then a major remodeling would be foolish. Things like energy efficient updates such as new replacement windows, high efficiency furnace, roofing or siding, kitchen or bath updates would add to their comfort and help to sell the house faster and save them money while they still remain in the home. Major expenditures for a new kitchen and bath can run into thousands of dollars and unless money doesn’t matter or you don’t care
about resale values then by all means go for it. It’s important to know that there are a variety of variables that can effect both the cost of the remodeling and the resale of the home such as the size of the remodeling company estimating the project and the values of the properties in the surrounding neighborhoods. Below are some area examples of the cost of what some remodeling projects can cost and what could be recouped if you sell your house. The numbers pre-

A Dabble In Apples!

It is apple season. And from one end of the Rochester area to the other, you can purchase ripe red orbs of deliciousness. Last week I bought several varieties, colors ranging from yellow to green to deep red and pink. When I make an apple dessert, I mix them up to blend the flavors of sweet and tart. Later, I will share my Apple Betty recipe, a sure winner and I have used it for more than 40 years. The apple first arrived in America in the 17th century, coming with the colonists. Apple trees grew wild in Europe and Asia but are best known to have grown in China. They are a cousin to almonds, peaches and roses. The best thing about apples for the early settlers is that they could be eaten all year. They were dried in the sun and most importantly they were pressed into cider. If the cider fermented, it became hard cider and that was the main alcoholic drink. Hard cider was popular until prohibition when many apple orchard farms were forced out of business. We all love a fresh apple, and lucky for us, so many varieties are grown right in our backyard. Here is a dabble of apple facts.
Cortland: The Cortland is a large round apple that is a good choice for cooking because it stays fairly firm and doesn’t discolor like some others. Granny Smith: Named after the Australian woman that first cultivated it. Green in color and firm and tart and is a perfect choice for a pie especially when mixed with a sweeter apple. Jonagold: Yellowish in color and crisp, it is a good choice for applesauce. Macoun: Macouns are an all around good eating apple, and are a cross between a Macintosh and a Jersey Black. Macintosh: This apple is known for its juice. It is probably the most popular and well known apple. Red Delicious: This apple is near to my heart because I have a tree in my yard that I planted when my kids were young. Now this once dwarf tree feeds the deer that live on my property. They come down to feed every morning, and I feel good about that! This apple has a bulbous shape and a thicker skin and is sweet. My deer’s fav. Winesap: I am not too familiar with this apple but I should be. It is said the juice tastes like wine, must be like Boones Farm!
My gift to you is my recipe for Apple Betty: - Slice about 8 apples, mix your varieties. - Pile in a glass baking vessel - Mix in ¼ cup any fruit juice Make in another bowl make a mixture of: - ½ cup sugar - ½ cup flour - 1 teaspoon cinnamon - Pinch salt - 1 stick of butter- cut in - 2 tablespoons of brown sugar - And a bit of nutmeg
Cover the apples with this mixture and bake at 350 for about 45 minutes or until the apples are bubbling hot and the top in melted and caramelized. Enjoy

does your home have skeletons? nary home in an ordinary neighborhood. The owner had died in a retirement home and now the children were closing out the last details of her life. As I pondered what to do, just before picking up the phone to call the buyers attorney, I received a call from the seller’s agent. They had accepted a non-contingent offer, knocking my buyers out if they did not remove their contingency. I breathed a sigh of relief and feigned distress to the agent, but was full of glee calling my clients - they were released!! I wonder to this day if the buyers of that house know? Do they swim in that pool? Buyers should ask themselves: how significant would a death in the home be to them and why? Would a natural death be less significant than a murder? What if a death occurred many years ago? Years ago family members died and were laid out for viewing in their home. Would knowing bother you? Circumstances of the death can taint buyers perspectives especially if the death was violent. Some people believe places are haunted if death occurred there. The mention of ghosts complicates everything. There are those sensitive to spirits. I experienced a buyer who loved my listing but refused to buy since she saw unfriendly spirits. I have to admit that day, opening the house up, I experienced a frightening, creepy feeling in the basement, so scary that I ran up the stairs and then laughed at myself for being foolish; or so I thought, until the potential buyer spoke up. Yet my own home, the scene of a friend dying peacefully here of illness, does not conjure up spirits or creepy feelings. I won’t tell my friends that he died in the dining room! They might not come back! So, what if a buyer absolutely does not want a death house? Since NY State does not require disclosure, it’s on the buyer to do the research and this needs to be done before putting in an offer. To wait could create a situation where the buyer might not be able to extricate themselves from the deal without financial penalty, the least of it being loss of their deposit. Doing what my clients did, putting the address in a search engine might yield information. There are also companies that for a small fee will search; such as “diedinhouse.com”. Yes, this is real, and there are many more! Buyers can search local newspaper archives. In Rochester, the librarians at the Main Public Library will kindly set you up and explain how to do a search. The Monroe County Clerk’s Website allows buyers to research the property title. Once a potential buyer has the name of
multiple former owner(s), they need to track down death certificate information to determine where (if) they died. But, what about others living in the home? Those that do not show up on paper? They could have died there. There may be no way to research this. For example, during high school my neighbors son accidentally shot himself, dying in his bedroom. The home has been sold and resold many times through the years, and I am pretty certain the current owners do not know, since most of the neighbors who would know about this have either died or moved away. Buyers could visit neighbors as another research tool for property facts. But, even if neighbors know something, they are not legally obligated to reveal anything. Now for my annual “True” ghost story. My last one was about Chretien Point Plantation, this one is about kindly apparitions in Appalachia. A couple was driving in the 1930’s on their honeymoon through the Appalachian mountains, enjoying the quaint “hollers” and sights. As night fell, a driving rain quickened fiercely. The dirt roads began to wash out. The couple frantically looked for safe harbor. For miles there were no lights until finally a porch light beckoned them. They made their way to a farm house. An elderly couple open the door and after hearing their dire situation, invited them in, insisting they stay the night safely out of the storm. The young bride spied a marbletopped victorian table in the hallway, admiring it profusely. The farmers wife smiled and said it was a gift form her husband on their first anniversary. “I hope my husband does something like this for me” the bride remarked. “I’m sure he will.” The elderly couple put their unexpected guests in a room at the front of the house, retiring to the rear. “We’ll send you on your way with a proper breakfast in the morning”

winked the elderly farmer as he disappeared around the corner. The young couple woke early, the sun was just starting to rise but obscured by deep fog. Not wanting to inconvenience the elderly farm couple, they dressed quietly and as they left, put a silver dollar on the marble-top table, as thanks for the elderly couples kindness. They drove down the road and after a bit found a roadside gas station with diner attached. As they settled in to their menu, the owner came up and remarked that they weren’t “from these parts”. “No,” the husband replied, “on our way through.” The owner remarked about last nights storm: “One like that hadn’t been seen in a spell.” “By the way, where did you stay? You couldn’t have driven through that!” “Oh no, we didn’t. We couldn’t find a place to stay anywhere, until we came to this farm house up the road from here.” The owner looked at them quizzically and asked where? Conversation stopped in the diner as all eyes turned to the couple. “We were at the Andersons farm down the road.” sputtered the young man suddenly nervous “They were so kind to take us in.” The silence was deafening. “That can’t be! There’s no farm house there anymore. It burnt down years ago, in a storm like last nights. It was so bad no-one could get there in time to save them!” The Anderson’s were killed by the fire!” The blood drained from the young couples faces. “That’s not possible, We were there! We left a silver dollar to thank them!” they protested to the rapt audience. They described the house, the table and the couple at length. People murmured and clucked. Some kept their distance, moving away from them. The couple wolfed their food down and ran to the car. They back tracked. There was the big old tree on what was a front lawn and ramshackle barn in back, but no house. They walked up to where the house should be, finding charred timbers and old stairs, molding in the daylight. Gasping, the wife shrieked: “There’s the marble table top! AND our silver dollar!!!” This here’s a true story!

Our annual Halloween issue is here, with it comes some creepy things to think about when buying a home. Really? How creepy can that be? Well, when you think deep it can be pretty creepy, after all what do you REALLY know about that house? Have you ever heard of a “Death House?” Yeah, didn’t think so, neither did I, and I am the Professional here, so if you never heard of that it’s ok! A “death house” is a home where a death occurred though one of many causes: old age, illness, crime, murder, suicide or accident. It could have occurred recently or years ago. Most people never think of such things and for the most part, neither do their Realtors. Death has become so removed from the places we live in that we just don’t think about it. In NY State, disclosure of death on the premises is not required, since it is not considered a material fact (meaning the death does not affect the structure and function of a home.) If a buyer asks and the seller has information regarding a death in the home, they should answer truthfully if they know, but are not subject to legal action. Only if the home has a haunted reputation and the seller has profited on that does NY State require disclosure. Becoming a “death house” can affect the salability and price. Normally thinking about “death homes”, we think of homes where famous people died like Marilyn Monroe, Jon Bennet Ramsey, Elvis Presley or Curt Cobain. The list of people, famous and those who became famous for, dying in their homes is almost endless. The Ramsey home was sold multiple times by the same agent, who claims the home is stigmatized. Each seller and buyer bought and sold below market value. I can attest to the fact that death touching a home can indeed stigmatize it. Years ago, clients of mine had their (contingent on the sale of their home) offer accepted and were at a dinner party excitedly telling their friends about their prospective new home. One friend pipes up:”Hey isn’t that where that dead girl was found in the pool?” WHAT?! The next morning I had a frantic call from my buyers. “We have to get out of the contract for the house!!!” “Huh?” I asked “Why?” They sounded determined, this was serious. They had come home and immediately plugged the address into a Google search; there it was. The neighbors grandson had murdered a girl, hid her in his grandmothers’ basement, then snuck her body to the neighbor’s seasonally closed up pool, an ideal place to hide her body. He threw her in, under the tarp. It was some time before she was found. Ugh. Even if the pool had been completely drained and cleaned, I don’t know if I could swim in it… I was horrified. My mind raced. What do we do, (?) mingled with horror that I should have known! I should have prevented this! But realistically, it is unlikely any Realtor would have known and been able to prevent it. The home was an estate sale. It was an ordi-
