Do You Need Title Insurance? Let’s say you bought a property. One day, you come home to find a legal notice saying someone is claiming rights to your property. This same property that had a title search and was sold to you as free and clear of all encumbrances! First, you become highly excited (understatement of the year) and then call the attorney who handled your closing, all the while praying they are still alive or in business! Their first reaction will likely be “I will get back to you” hopefully followed by: “I’m glad I encouraged you to buy that Title Insurance Policy!”  Usually poorly understood, many might be aware of the existence of title insurance but not understand its workings. Even seasoned Realtors might admit they don’t really understand it or why buyers might need it. Oh the other hand, title insurance is well understood by those that deal directly with it, typically attorneys, title examiners and others involved behind-the-scenes helping to bring properties to close. Realtors defer to the attorneys, when asked about title insurance. Often, title insurance doesn’t come up between Realtors and their clients.   What exactly is Title Insurance? Title insurance protects property owners and the mortgage holder (if there is one), against defects in title to a property. There are generally two policies which buyers should be aware of; owner’s (“fee”) and lender’s (“mortgagee”) title insurance. Lenders, usually require a title insurance policy be purchased at the time of closing to protect their interest in the property; the money loaned. Home buyers mistakenly assume this insurance protects them too, but it doesn’t! The buyer needs to buy their own insurance for protection. If a buyer buys both the fee and mortgagee insurance at the same time, they get a discount on their mortgagee insurance.   During the home buying process, it is mandated by law that buyers be offered the opportunity to buy an owner’s “fee” title insurance policy BUT, only if they are obligated to buy the mortgage title insurance must the buyer be made aware what these insurances are and what they cover. During the buying process they will be expected to sign a document acknowledging that they were informed. If there is no commercial mortgage involved, buyers may not be made aware of this option for their financial protection.  Not all attorneys recommend that buyers purchase Fee Policies and may only discuss basic details as required by law. Since title insurance is not required for non-commercial mortgage users, many buyers believe they don’t need it assuming they’ve even heard of it’s existance. When I was a fledgling real estate salesperson, I remember this topic being covered in class. We were told that in most cases, this is an unnecessary fee for the buyer. But, as I matured into the profession, I see now that I would never buy a property without this insurance, because of the low cost and high potential value.  Title insurance is unique in that, unlike your home owners insurance policy, it pro-

tects against past instead of future events. Home-owners buy home-owners insurance to cover future possibilities such as fire or people becoming injured on the property, who in turn, might sue the home owner. Title insurance covers what may have already have happened. Liabilities that may be well hidden and not easily found.   There is a large gamut of possibilities that could affect ownership of a property. There may have been a failure to notify all creditors in a prior foreclosure action, gaps in chain of title, forged deeds, wills that were not probated, mortgages that were not discharged and many other legalities which can and do fill legal books!  James A. Marino, Esq., a Rochester real estate attorney, also noted “in this day and age of identity theft and internet fraud, the claim being made on the property may not even be valid, but a title insurance policy will cover the attorney fees and legal costs of defending against such claims.” Further, he stated that “In a high number of cases, it’s the attorney fees and costs that are financially and emotionally destructive rather than the claim itself.”  One example might be the story of an uncle who gave a quit-claim deed to his home to a nephew, and the deed was never recorded. Subsequently the uncle dies without a will, but the nephew was not aware of his death. Probate was initiated and the property disbursed to the presumed hairs. The home was given to the heirs since there was no knowledge of the deed to the nephew. The heirs sell the home and eventually the nephew finds out. He actually has some claim to the property that will need to be settled in court. Now title insurance comes into play. The buyer bought the property with a mortgage. Their mortgage company required title insurance. A mortgagee policy was bought.  This is where home buyers normally find out they themselves are not covered for loss, since they did not know or understand that the mortgagee policy covers only the mortgage holder’s losses. Most buyers assume that this policy protects them. It does NOT. This policy only covers the mortgage company. Fortunately the buyer in this story, had an attorney that highly recommended that they purchase what is known as a Fee Title Insurance Policy.   Besides recommending that his client buy the Fee Title Insurance Policy, the attorney made the buyers aware that there was also a Fair Market Value Rider available. This is

purchased at time of buying the “Fee Title Insurance Policy” and covers home value increases over time. If a “Fee Title Insurance Policy” is bought, it’s highly recommend that a Fair Market Value Rider also be bought. While Fee Title Insurance is mandated by some attorneys, especially when 10% or more is put down on the property, not all attorneys mandate this additional rider. Luckily, the buyers in this story bought the additional rider.   So, having lived in this home for ten years, they were stunned to learn that the nephew had a legitimate claim on the property. A court battle ensued, costing thousands in attorney fees, but the buyers were covered due to having bought both forms of title insurance. Unfortunately for them, the court decided that indeed, the nephew did own the home and that it was improperly sold. The nephew, suddenly having a nostalgic bend towards his uncle, decided he absolutely MUST live in the home and the buyers now must leave.  The buyers mortgage company is paid the moneys that they insured for, and because the buyers bought the Fee Title Insurance Policy, they are covered too, and are paid the money that they put down on the property. Since they also bought the Fair Market Value Rider, they are also covered for equity in the property. This is a very important point. They would not have recovered any earned equity due to rising home prices if they had not bought that additional rider. They would have literally walked away only with the money paid on the mortgage, and none of the additional value.  Because they were covered by both a Fee Title Insurance Policy Fair and Market Value Rider they were able to put their lives back together and buy another property quickly and move forward. Had they not bought the Fee Title Insurance Policy, they would have lost their down payment and closing costs,

which can be considerable in some cases. Having additionally bought the Fair Market Value Rider, the buyers were able to capitalize on the large increase in value over the ten years they lived in the property. Keep in mind the Market Value Rider only covers increases in value due to market increases (inflation) and does not cover improvements to the property, so the cost of any improvements such as a new sunroom, would not be recouped. The buyers financial damage was kept to a minimum and they were able to recover quickly.  Wade Radtke, a sales account manager for Chicago Title Insurance Company here in Rochester, told me a story. At an event, a Realtor accosted him, decrying the waste of money title insurance poses to buyers. Wade defended the need for title insurance by recounting to that realtor a personal experience. Wade is a firm believer in title insurance, not only because he sells it, but because it saved his father from a loss in real estate value. His father had bought a property where eventually a property line dispute arose. His father lost and in the process lost three acres. He was covered though, through the title insurance he had taken out and so was able to recover the value of the three acres and was also protected from the large legal fees spent defending his position.   Now that you have read this article, perhaps you realize your situation is that you don’t have a Fee Title Insurance Policy or Fair Market Value Rider. It’s not too late. You can get these insurances, as long as you are not currently experiencing a challenge to your ownership of title to a property. Contact a trusted real estate attorney and ask them for a recommendation on who to contact to set it up or look online for title insurance companies. There are quite a few companies ready to work on your behalf. If unsure that you have the Fee Title Insurance Policy, contact your attorney and ask them to review your documents. To be forewarned is to be protected, as long as you take action!

Do you love to cook or not so much? Personally, I love to cook, but I rarely use a recipe. Blame it on my mother and grandmother who both were wonderful cooks. I never saw a cookbook growing up. Not a Betty Crocker to be found. They cooked and concocted from scratch and memory and I am sure they both cooked as their mothers did. They used their senses of touch and smell and taste as they prepared chicken parm, stuffed artichokes, clam casino, and gnocchi. Occasionally on a Sunday we would go to a restaurant to have something we didn’t have at home. Those were the days of family owned and operated establishments and the cooks were usually an uncle or grandma in the kitchen.   There are restaurants that my hubby and I visit to enjoy a meal that I do not make at home. Ice Damming a timely reminder

Relatively warm, mild temperatures sprinkled through the typical snow accumulations and cold weather of winter bring concerns of ice damming to the forefront. Roof leaks and interior water damage tend to occur as a result this seasonal problem. The combination of cold temperatures and regular snowfall are Mother Nature’s ingredients for ice damming. A lack of insulation, poor attic ventilation, shallowpitched roofs, and complicated roof lines (many valleys) are contributors to the icicles that dangle from our homes. Together, these factors can lead to many home repair headaches from ice and leaks. Ice damming is the accumulation of ice on the cold overhangs of roofs. The lump of ice that forms prevents additional water (i.e. melted snow) from draining off the roof. It is the resulting puddle that forms between the ice lump and the roof that can

cause leaks into attic space and even interior ceilings and walls. Ice damming can be reduced or prevented with good attic insulation and ventilation to keep the roof cold. Insulation prevents heat from escaping into the attic and ventilation removes any heat that does make it up there. However, making improvements to insulation and ventilation can be impractical once the winter has begun. Modern roofing standards require an ice and water barrier under the edges of our asphalt shingle roofs. This barrier can prevent leaks from ice damming, but it must be installed when the roof is installed. Electric heating cables can be installed and turned on before the snow falls to effectively prevent ice damming leaks. The heating cables run in a zig-zag pattern on the roof edge and through the gutters and

downspouts to maintain a path for water (melting snow) to get off of the roof. Obviously, there is a cost associated with the electricity to operate these cables. The use of a “roof rake” or “snow rake” can be very effective in preventing ice damming. After a snowfall, the homeowner must rake snow off of the edge of the roof with this plastic blade on the end of a long aluminum pole. Even just a few feet of snow raking up away from the roof edge will often be effective to keep the roof overhang clear of lumps of ice. Many homeowners will chip snow and ice off of the roof with a sharp shovel and damage the roof. This should be avoided. Sometimes solutions of warm salt water or similar snow-melting solutions will be used to melt ice to make a path for water to get off of the roof. These should only be used as a last resort, since they can

sometimes damage building materials and actually result in more ice when the water re-freezes. Preventing ice damming is ideally be accomplished with good insulation and proper attic ventilation, along with proper roofing materials, including ice and water barrier. However, electric heating cables and snow rakes (roof rakes) are things that can be used to more directly control the problem until better long-term preventive measures can be put in place. Ice damming can be troublesome and frustrating with our “normal” winter weather.
