The Denninger Report Should sellers sell their home by themselves? With all the listing opportunities on-line, why in the world would anyone use a Realtor? It’s easy to sell, just advertise and the buyers flock in! Right? Hmmm, sounds easy enough until looking deeper. Here’s what Realtor’s add to the transaction.

Access to over 90% of ALL home buyers. The National Association of Realtors (NAR) annually crunches numbers and watches market trends. Over the last twenty years almost all buyers work with Realtors, understanding what experienced Realtors bring to the transaction and most would never go it alone. So even if a seller decides to go the Fore Sale By Owner (FSBO) route, it’s a rare buyer without a Realtor. And, their compensation is included in the offer. Or, the buyer discounts the commission from their offer, paying their agent out of pocket at closing. Also, buyers agents represent the buyer only, leaving the seller at a disadvantage.

Time is money. 18% of FSBO homes didn’t sell in their anticipated time frame. The longer properties sit, the lower an eventual offer will be.

Price. FSBO sellers are trying to save paying a commission. They hope to pocket the savings. They usually don’t. Yes, some get lucky especially in a hot market, but not often. Buyers always discount the commission off their offer price. Seller’s not expert in their market have no REAL idea what their house is worth. They can research but aren’t trained in the nuances of pricing a home. In 2016 according to NAR, FSBO’s on average sold for 16% less than Realtor represented properties. Assuming a commission is 6%, that means the seller lost 10%! And if a FSBO is sold to a friend or family member, the seller goes home with even less!

FSBO’s can now be listed in the MLS, through services that do this. When no commissions are offered, buyers usually hesitate to see the property if their agent is not joining them. Safety. Or worse; yearly, Realtors are killed or seriously injured holding open houses or showing properties. Having a Realtor provides a buffer to the seller. Agents are trained to prevent problems that one time sellers have no idea exist. Selling a home as a FSBO works, but sellers should recognize the value added to the transaction by using a Realtor!

Breezing Through... Don’t Fall for the Con Warm weather is here and so are the scam artists who prey on homeowners, especially the senior citizens. These rip off scammers, more commonly known as “drifters” usually go door to door offering a variety of home improvements and repairs from roof and chimney repair, gutter cleaning, driveway sealing, tree trimming, etc. They often say they can do the job at a really low price, as they have left over materials from another job. Many times, these scam artists are driving trucks with magnetic signs and out-of-state license plates, or operate out of store front offices that they can quickly move out of once they finish their scam or if they think local authorities have knowledge of them. The Better Contractors Bureau recommends that you do the following to protect yourself against these fly-by-night operators: Before you give permission to anyone to

do work on your home that you have not actually called and especially before you allow them into your home you should check them out with the Better Contractors Bureau, as to whom the owner of the company is their address and reputation. Ask for identification (Drivers license) and if they show you an out of state license then tell them that you are not interested. Be firm and do not allow them into your home, as most scam artists work in pairs and while one keeps you busy the other will search your house to steal valuables. Some even work with children and ask if their child can use your bathroom. NEVER FALL FOR THIS APPROACH!! Don’t fall for the high-pressure stories like “this offer is only good if you take it now” or “once we leave your street we won’t be able to give you such a bargain again”. If you have checked the contractor out

and do feel confident that they are truly a legitimate, local contractor and want to have them do the job for you then be sure to get everything in writing on a bona fide NYS contract required by law. In the contract it must state along with all the specifications, that you have 72 hours to change your mind and any money given as a down payment or draw must go into an escrow account. Never give a large down payment and never pay in cash no matter what they tell you or what discount they may offer you! Always pay by check, payable to the company name, not an individual! If you have a large project or repair that you feel will be expensive you should get at least 3 estimates from similar size companies, all in writing. Never allow a contractor that you have not called to go up on your roof to check the roof, chimney or gutters, as they sometimes

have been known to actually damage those items so that they can show they are in need of replacing or repairing. Make sure the contractor you finally decide on is properly insured with liability insurance and if he has employees on the job show proof of Workman’s Comp Insurance. Always try to use a Better Contractor Bureau member, as they are registered and you will have recourse if they don’t do a good job. To Cut or Not to Cut... That’s a Good Question higher than normal and payment is asked for up front preferably by cash or by credit card that is processed immediately. Most times there is no contract and many times nothing is given in writing explaining what will be done and what will not be done. The scammer will tell the customer that they are a NYS Certified Arborist when all they are is a member of an arborist association. Consumers should be warned that when in danger they are the most vulnerable and should make sure they are dealing only with long established reputable tree service companies. If they have questions about trees they can also call a Tree Pathologist. Some times the small fly by night tree contractors are not insured, or if they are, they may only have liability insurance to cover landscaping and not tree cutting which is much more expensive. If an accident occurs while they’re doing tree work and they don’t carry liability insurance for tree work the homeowner could be liable for injury or dam-

ages to neighbors and their property and usually a homeowners policy will not cover the incident. Here are some helpful tips when in need of tree work: Never be pressured into signing a contract or work order only because the threat of danger may be imminent. Unless the tree has already fallen and caused damage to property, always get three estimates for the work. Never pay by cash and only make checks payable to a company name not to a personal individual. If asked to do so that should be a warning that the contractor is operating deceptively. If a contractor says they are a NYS Certified Arborist check to see that they are and not just a member of an arborist association. Make sure everything that is to be done is specified in writing, especially as to who will remove the tree limbs, stump and debris. Ask to see a copy of the contractor’s liability insurance certificate and check if they are insured as a tree contractor not just a landscaper. If in doubt call the insurance company

It seems lately we have been experiencing more violent storms then ever and with them much more property damage from trees falling. There are not many people that are experienced enough to know whether a tree is rotted or decayed and if it warrants being cut down or not. Carmen Santora, Executive Director of the BCB says, “because of the danger and fear of what falling trees can do to life and property, another scam is starting to develop. It starts with a concerned call from a homeowner to a tree and landscape company.” Most times after a storm the homeowner is worried and only calls one contractor for a price to trim or cut down dangerous trees. They are at a disadvantage and can be taken advantage of very easily, especially senior citizens. The way the scam works is the home owner is told the tree(s) in question are rotted, decayed and very dangerous and must be cut down immediately before they fall and causes damage or injury to themselves or their neighbors. In some parts of the country it is rare to even have a basement. In our region, most homes have basements and many are of considerable size. No matter how many single-story “ranch-style” homes you enter, it’s always amazing how big the basement is. With so much basement space at our disposal, it makes sense to try and use it as additional living space. Using basements as living or utility space is nothing new. Many older homes from the 1800’s used a portion of the basement, which was cooler than other areas of the house, as a summer kitchen. Today’s basements are used as workshops, artist studios, and more. Over the years, building codes and standards for finished basements have developed to improve the safety of these spaces. Unless the house was designed with a walk-out basement, most basements that were finished before the 1980’s don’t have large windows or doors. Low ceiling heights in older finished basements could result in “head-knockers” as well. When finishing a basement today, homeowners should apply for a building permit with the local town building department and get the proper inspections and sign-offs when finishing the space. Most building de-

partments have a pamphlet or document for homeowners to clearly explain the requirements for finished basement living spaces. These requirements are basically the same requirements that apply to all living spaces, including on the main levels of the home. Although they can vary slightly from town to town, New York State residential codes dictate the minimum requirements for new, finished spaces. Some of the main requirements include: • Minimum ceiling height of 7', although beams, ducts or obstructions can project down to 6' 8". • Rooms with a floor area of at least 70 sq ft and at least 7' in length and width. • Natural ventilation of not less than 4% of the floor area or equivalent mechanical ventilation. • Smoke and carbon monoxide alarms (hard wired, with battery backup, and interconnected). • Insulated walls with moisture barrier. • Bottom sill plates for interior walls that are metal or pressure treated lumber. • Permanently installed heat sources (usually supply and return registers). • Emergency egress window or another second means of egress.

Obviously, some homes have basements that do not have adequate headroom to properly finish the space. Other basements are damp or wet and need improved drainage and waterproofing so the investment to finish the space isn’t wasted. The most talked about requirement for finished basements is the egress window or the second exit. If a room will be a bedroom (i.e. a sleeping room), then there must be a second means of exiting the room (and a means of allowing fire rescue) directly from the room. If a room will be an office, fitness room, or recreation room, the second means of egress can be through an adjoining room. Although a second stairway and exterior door can provide the necessary second means of egress, the path of egress cannot be through a garage. Egress windows and the exterior window wells can take many forms. However, some of the applicable standards include:

However, if the basement was finished more recently, without the correct permits and approvals, you could be opening yourself up to potential costs to finish the job correctly or to “un-finish” the space.
