Section 32 Statement essential Written by | realestateview.com.au in buying DESPITE being an essential component of the real estate purchasing process, the Section 32 Statement is often overlooked or underestimated. Unfortunately, many homebuyers, particularly first-time buyers, remain unaware of its existence, and they often sign the contract of sale without reviewing the Section 32 Statement carefully. Whether you are buying a home in the city or rural property, it’s essential to understand this legal document because you will inevitably encounter it at some point. By gaining a solid understanding of the Section 32 Statement, you can ensure that your investment in a property doesn’t result in any unpleasant surprises. Why does a Section 32 Statement exist? As part of the Sale of Land Act, a Section 32 Statement is intended to provide a purchaser with relevant information that could potentially influence their decision to enter into a contract of sale. It is important to remember that a Section 32 Statement is not a contract of sale. Although these two are sometimes mistaken as one and the same, they are separate documents, and the signing of a contract of sale is contingent on the provision of a Section 32 Statement. When does a buyer receive a Section 32? Prior to signing a contract of sale, the vendor’s lawyer will often provide their

real estate agent with the Section 32 Statement, which will then be passed on to prospective buyers and their legal representatives. While only the vendor’s signature is required on the statement, a real estate agent may request that a potential buyer also signs it as evidence of the agent’s involvement in providing the statement to interested parties. Note: in some cases, a sale of contract will state that the legitimacy of the contract is depended on the subsequent approval of a Section 32 Statement. In this case, the contract of sale is compromised and a buyer has the freedom to cancel their contract. It is recommended that you seek the guidance of your lawyer before attempting to peruse this legislation, which can at times be complex. They will have experience in how to read a Section 32 Statement and how to approach the process. our lawyer’s experience in interpreting Section 32 Statements and approaching the process can be invaluable. They can assist you in identifying the statement’s contents, evaluating its accuracy, and most importantly, point out any important information that may be missing.

DO YOUR HOMEWORK: Of all the research you do buying a home, make sure you read the Section 32 Statement. A Section 32 will often include: Vendor’s details Details of the title. This is a very important part of the statement and requires your attention. Note: check the measurements of the property within the title vs. what you think you are buying. If it is a subdivided property especially, are you getting what you think you are? Information regarding building permits for recent renovations to the property. Note: if there have been renovations and permits and insurance information is not included in the Section 32 then ask yourself, why not? Zoning information. Be sure that you are aware of whether it is a commercial or residential zone and what sort of residential zone it is. Notices of any upcoming works or orders issued by authorities. This is important in case of changes to the area that may affect you. Outgoings These can include rates and body cor-

porate/strata fees. Easements These are areas of your land that someone else has the right to use for a specific purpose, even if they aren’t the landowner. This is most common in the form of drainage. Be aware of these easements as they may affect/compromise any renovations you have planned. Things to remember If you are selling your property privately, it is important to keep in mind that as the vendor, you are responsible for providing a Section 32 Statement. To ensure accuracy, consider having your lawyer prepare this document and provide it to the potential buyer or their legal representative. It’s worth noting that if the Section 32 Statement contains incorrect information, the buyer may be able to withdraw from the sale, and in some cases, take legal action. So it’s crucial to ensure that the statement is correct and up-to-date.
