HERITAGE TRAIL

After virus delays, work commences By Jesse Buchanan Record-Journal staff

SOUTHINGTON — After delays caused by the pandemic, town officials said they’re continuing with plans to design the last portion of the Farmington Canal Heritage Trail from Lazy Lane to the Plainville town line. Jim Grappone, assistant town engineer, said the trail’s expected path takes it through wetlands at five different points, requiring both local approval and permission from the Army Corps of Engineers.

Michael Miller, owner of Hop Haus, stands behind the bar of the business in Plantsville. Hop Haus is planning to open a second location, in Plainville. Dave Zajac, Record-Journal

Southington engineers have been working with the state Department of Transportation, which had been short-staffed due to the virus. That slowed the state’s approval process for Southington’s trail design, Grappone said. See Trail, A17

Touting almost 30 beers on tap and American fare sourced from local farms, the Plantsville-based Hop Häus is planning to open a second location in downtown Plainville this spring. The new restaurant will be located at 24 Whiting St., formerly the home of Trenta Tavern, and will feature an outdoor patio, banquet hall and indoor seating for between 250 and 300 customers, according to owner Michael Miller.

Hiring between 14 and 18 new employees is the main hurdle he still has to clear, but Miller hopes to hold a grand opening for the second location in mid to late March. Expanding at a time when many restaurants are still suffering the effects of the coronavirus pandemic, Miller credits Hop Häus’ success to its slate of Connecticut-brewed beers and the careful attention paid to keeping its customers safe from exposure to the virus. Two charged with vandalizing Sandy Hook memorial mural

The Top Legal Concerns for Seniors You may have to make difficult decisions while you still have the mental and physical capacity to deal with financial, legal and health care issues. Personal and health affairs management, estate planning and administration, and long-term care and how to pay for assisted living or nursing home care are needs that must be addressed by all of us—the sooner, the better.

By Lauren Sellew Record-Journal staff

SOUTHINGTON — Two people face charges after police said they spray painted a mural honoring victims of the Sandy Hook shooting along the Farmington Canal Heritage Trail. A mural dedicated to the 26 victims of the Sandy Hook

These documents help you ensure that family, friends and providers carry out your wishes.

“Although there have been incidents in the past, vandals in this incident were the first to deface the actual memorial mural,” Egan said. Egan said the vandals, later identified as Cavallo and Lombardi, used spray paint to cover the mural, including butterflies that represent the victims. The phrases “who do the police help but themselves” and “not safe” were

spray painted on the mural. On the side of the building, phrases including “(Expletive) the police,” and “repaint this” were spray painted, according to a police report. Police noted there were names mentioned in some of the phrases that provided a connection to Cavallo and Lombardi. See Vandals, A18 For 35 years, our family taking care of your family!

Under the umbrella of estate planning and administration, seniors will want advice and counsel on: • The preparation of documents such as wills, trusts, and durable powers of attorney. • Real estate titling, sale, conveyance or gifting. • Advance planning in order to qualify for future Medicaid benefits. • The financial and tax implications of any of these proposed actions, as well as real estate, gift and estate taxes (Connecticut and federal). Planning for incapacity is not fun, but facing it is wise. Consider the appointment of: • An attorney-in-fact. • A Health Care Representative • A conservator for you and/or your property. • A representative payee for your Social Security benefits. Many of these roles are similar, but there are important differences regarding who has control of what and under what circumstances. For example, power of attorney allows someone to act on your behalf. But if that power of attorney is durable, it remains in effect even if you become incapacitated and are unable to make decisions for yourself. You will probably want to look into how capacity is determined and what level of capacity is required for various legal activities where you live or own property. You may be the subject of conservatorship proceedings or other protective arrangements — who should represent you? You will want a plan to allocate responsibility to someone you trust. An attorney can explain who can have what level of control over your finances, your life and any trusts. End-of-life medical and living assistance Long-term care insurance may be something you will want to explore. It is prudent to understand your rights as a patient or resident of hospitals, nursing homes, assisted-living facilities and continuing care retirement communities. Key considerations include admission, transfer and discharge policies, and quality of care.

Police responded to a report of vandalism at the detached garages at 245 Summer St., on Nov. 28, 2020 about 9:30 a.m., Lt. Keith Egan said in a statement. The owner donated the back of the building for a mural painted in remembrance of the 26 victims of the Sandy Hook School shooting in 2012. The owner of the building said he was extremely bothered and upset by the incident.

In the health arena, powerful instruments give authority over life and death decisions: • Advance Directives includes the appointment of a Health Care Representative, end of life decisions/Living Will, Organ donation and the designation of a future conservator.

Among other legal issues to hone in on are: • Housing and financing options, such as mortgage alternatives, renovation loan programs, life care contracts and home equity conversions. • Pensions, retiree health benefits and unemployment benefits. • Income, estate and gift tax advice, especially the consequences of plans offered. • Litigation and administrative advocacy for contested wills, capacity issues, elder abuse, financial or consumer fraud, fiduciary administration, public benefits, nursing home torts and discrimination. This checklist of legal issues you may face can serve as a good preliminary overview of areas you will want to consider. Without proper planning, the estate you worked to build could go to a long-term care facility instead of to your loved ones. Our office will be happy to consult with you to address these legal concerns.

Need a hand with your hands? The festive display on Hillscrest Road in Plainville. Aaron Flaum, Record-Journal

Light displays pull in some 3,000 lbs of food Along with creating holiday cheer, two area holiday light displays accepted donations for local food pantries. A display on Strawberry Lane in Southington has been collecting food for the Southington Food Pantry since 2016 when the display started attracting attention. This year Nicole Woodruff, who hosts the display, said they collected 1,537 pounds of food.

we’ve collected over the past years I would have to say is between 4,000 to 5,000 pounds,” Woodruff said. Krysta Tsangarides, food pantry worker, said that donations from Strawberry Lane came in throughout the holiday season. “They came in with boxes of canned vegetables, canned fruit, snacks,” Tsangarides said. “... Mac and cheese, cereal, everything.” Woodruff was appreciative of all of the donations.

Aaron Flaum, Record-Journal

“I think last year we were a little under 1,000 (pounds) and in the past, it was definitely lower,” Brunelle said. “So this year has definitely been one of the higher years.” Susie Woerz, executive director of the Plainville Food Pantry, said donations from Brunelle’s light display were impactful. “There’s a lot of food being given out ...” Woerz said. “The food is needed. There are a lot of people that are still unemployed and are utilizing our facility.” “With COVID, people are having troubles,” Brunelle said. “I hope the donations will help out people who are in need of the food.”

Panel recommends inflationary pay hike for officials By Keith M. Phaneuf © The Connecticut Mirror

ont will order those increases remains uncertain.

A state panel narrowly recommended Friday that Connecticut legislators and constitutional officers receive their first pay hikes in two decades — albeit very modest ones.

The Commission on Compensation of Elected State Officials voted 3-2 Friday morning to tie the salaries for lawmakers and constitutional officers to inflationary factors.

But whether the General Assembly and Gov. Ned Lam-

since 2001 and constitutional officers since 2003. “Inflation over the years certainly has dimmed the value of their compensation.” A 2019 report from the National Conference of State Legislatures confirms Balducci’s assessment that Connecticut’s compensation hasn’t kept up with its relatively high cost of living.

Nine other states pay their legislators on a daily, weekly or sessional basis, rather than on a set annual amount.

Though Connecticut’s General Assembly serves parttime – with regular sessions stretching roughly five months in odd-numbered years and three months in even-numbered years — commission member Mary Ann Handley, a former state senator from Manchester, said there is recognition legislators’ jobs are becoming more time-consuming.

“Unless we provide a reasonable income for somebody who’s going to be a legislator, we’re really cutting out a lot of people who can’t afford to take this kind of job,” Handley said, adding that weakening diversity in the General Assembly harms its ability to represent all interests. But commission member Justin Bernier of Plainville said the current compensation is “within the range of normal” and added that many citizens are struggling without raises in an economy weakened by the coronavirus. “We’re not seeing real wage increases in Connecticut for many years now,” he said, adding that raises for state officials at this time “doesn’t make sense to me.”

ership titles that raise their wages. Compensation for leaders ranges from $30,403 to $38,889. The state provides $5,500 annually to senators and $4,500 to representatives for expenses they don’t have to document. And legislators also receive a mileage reimbursement — which they don’t have to document. As long as they demonstrate they came to the Capitol, they receive this reimbursement, even if — for example — they arrived at no expense by carpooling with a colleague. This mileage reimbursement also is counted when calculating legislators’ pensions. Rep. Holly Cheesman, R-East Lyme, introduced a bill this year to end that practice. “Why would it even be included in the first place?” she asked.

But Balducci noted the committee’s proposal would not dramatically boost state officials’ pay, only end the stagLegislators also receive other nation that’s gone on for the forms of compensation. past two decades. Most lawmakers hold lead-

For example, the Social Security Administration announced a 1.3% cost of living adjustment in October. The Consumer Price Index for the federal fiscal year ending September was 1.4%. If those same conditions exist when the next state term begins in January, legislators’ base pay would rise from $28,000 to $28,364. Lamont, a Greenwich millionaire, does not accept his $150,000 salary, but the governor’s base pay — on paper — would rise to $151,950. Similarly, the annual compensation for other constitutional officers would grow from $110,000 to $111,430. Lawmakers would continue to receive inflationary pay adjustments at the beginning of each subsequent, two-year term — and constitutional officers at the start of each following, four-year term — under the compensation panel’s proposal. The General Assembly approved a similar arrangement for judges’ compensation in 2012.

Leaders of three of the four legislative caucuses stopped short of endorsing the raises but agreed with the commission’s conclusion that legislators’ responsibilities have grown, even as their pay has stagnated.

During an interview with police, Lombardi was apologetic, saying she didn’t know the significance of the mural and did not intentionally deface it. She was “frustrated with law enforcement over an incident in Plainville, felt helpless and had a bad knee-jerk reaction,” Egan said. She told police she partially vandalized the mural and said Cavallo was responsible for the additional graffiti. Police made several attempts to contact Cavallo during the investigation, but were unsuccessful.

Lombardi offered to clean the spray paint from the mural, but the owner told police he wanted to check with the Southington Art Council. The owner said the estimated cost to repair the mural would be about $2,500, in addition to another couple hundred dollars to remove the graffiti on the side of the building. The internationally recognized artist who helped create the mural, Ryan Christenson, known as Arcy, returned last month to restore the artwork. Cavallo and Lombardi were arraigned in New Britain Superior Court. Both were released on a promise to appear in court.
