PREVIEW hether we stay or leave the European Union is a complex issue, and members of the business community will be taking a hard look at how the ‘in or out’ vote affects their particular workplace, studying factors such as international trade, recruitment, manufacturing and skills.

Meanwhile wider emotional issues such as welfare and immigration will undoubtedly be making headlines and possibly swaying the ‘don’t knows’ in the weeks to come. The politicians will certainly be having their say and locally prominent figures such as Liberal Democrat Nick Clegg and Labour’s Paul Blomfield are strongly in favour of the UK remaining in the EU, while we wait for the emergence of a strong local ‘No’ campaign. Polling day may seem a long way ahead (23 June) but, with the debate undoubtedly set to heat up during the next few weeks, consultant editor Andy Waple has been looking at the steps being taken locally to ensure business owners have the key facts to hand before they cast their vote. It seems there is still a significant number of ‘don’t knows’ in the business community, and for those who feel they have not yet been presented with a full breakdown of facts, there are public
meetings to attend and websites to view before we make what may be the biggest decision of our lifetime. Meanwhile there is one subject on which the verdict is most definitely in – Sheffield City Region stands out from the crowd when it comes to hosting business events. snap poll by the Federation of Small Businesses revealed that many business owners have yet to decide which way to vote in the EU referendum and more than half felt they didn’t have sufficient information to make an informed decision. The survey discovered that more than 40 per cent of small business owners asked could be swayed either way by the arguments put forward by those for and against staying in but they were very keen to hear the facts so they could make an informed decision. Mike Cherry, Policy Director for the Federation of Small Businesses, said: “Our research shows small business owners want both official campaigns to focus on the practical impact that remaining within or leaving the EU would have on their firms. We will push both sides to address the questions our members want to see
answered, before they cast their vote.” Implications on economic impact on the UK, the administrative burden of complying with regulation and the cost of EU membership appear to be the main issues, he added. The landscape is confirmed locally by chartered accountants UHY Hacker Young, that reports conflicting views. John Wingfield, Senior Partner, said: “Some of our clients, mainly those who import goods from outside the EU, have suffered from import tariffs and antidumping regulations. These will no doubt be in favour of leaving the EU. Many others, particularly those who are subsidiaries of EU-based companies or who export to the EU will probably vote to remain in.” For those undecided, there will be at least two opportunities for local businesses to clue themselves up on the facts.

Sheffield Chamber of Commerce, in association with the Sheffield City Region Local Enterprise Partnership and Sheffield University Management School is preparing an event for April 12 to “clear some of the fog” surrounding the debate, in the words of Richard Wright, the chambers’ executive director. Meanwhile, the University of Sheffield has unveiled a public meeting to explore “the momentous decision” whether to leave or to remain in the EU. As a representative of a diverse range of opinions across the business community it is no surprise to see the Sheffield Chamber sitting on the fence on the issue, but is instead encouraging informed debate. Mr Wright said: “Staying in or leaving the EU is a complex question that is often confused with emotional issues like welfare and migration. For business it needs to be a hard-nosed economic assessment. “The Chamber has not taken a position yet because our consultation clearly shows that what is important to one business is less to another. What is also very clear is that many businesses are confused because they feel overwhelmed by the politics and counter arguments and, basically, don't know whether to believe them.
“Our event will allow the local business community to listen to the arguments on both sides and try to relate those to the local economy. From this, we hope people will leave better informed and in a position to make the right choice at the referendum.”

The British Chambers of Commerce QES is the largest and most representative independent business survey of its kind in the UK. Businesses are questioned on a wide range of issues, including home sales and orders, export sales and orders, employment prospects, investment, recruitment difficulties, cashflow, confidence and price pressures. The latest survey, which launched last month in partnership with the Sheffield City Region LEP, the region’s four Chambers and the University of Sheffield Management School, will help give a mandate to the LEP’s and Chambers’ lobbying work with local, regional and national Government and decision makers to help shape the region’s economic strategy and >>>
“The Sheffield City Region Chambers are preparing an event on 12 April to try and clear some of the fog. We hope as many members of the business community as possible can join us.” The results of the next Quarterly Economic Survey (QES) – sponsored by RBS South Yorkshire & North Derbyshire – focuses heavily on the EU Referendum and its impact on businesses will be shared at the event to be staged at The Edge at Endcliffe Village. The breakfast meeting will feature economic arguments for and against Europe, relating these arguments to the local economy to give businesses a greater understanding of the decision as to which way they will vote. Mr Wright added: “This is a year of big decisions for the economy, on a local, regional and national level – we have the devolution deal, HS2 station location and now the EU Referendum.

“Whether it is international trade, recruitment, skills or manufacturing, there is something in the survey that affects all business and it is their opportunity to flag up any issues of concern.” Meanwhile the university-led event public meeting will debate the main questions with the help of academics and representatives from the voluntary and business sectors. Members of the audience will be given the chance to pose questions to the panel and discuss the effects for Sheffield and the region. The panel will feature Dr Matthew Wood, Crick Centre, University of Sheffield; Susan White, CEO of Voluntary Action Sheffield and member of the European Strategic investment Fund Board; Gary Bell Volunteer Advocate at ASSIST; Julie Kenny, Chair and CEO of Pyronix (Rotherham) and member of the Local Economic Partnership; Professor Simon Bulmer, University of Sheffield and Professor Michael Keating, University of Aberdeen. Meanwhile the views of local politicians are likely to be well aired in our region, particularly as we have Nick Clegg making a strong case for remaining with the EU on behalf of the Liberal Democrats. The former deputy prime minister is a prominent lobbyist for the pro-Europe case, and has already appeared on a number of public platforms to support his arguments. His opinion is that leaving the European Union while trying to keep one foot in the camp with Brussels would be a disaster for Britain. He argues it would be impossible to enjoy the trade benefits such as unfettered access to the single market if we turned our back on membership. In response to claims from supporters of ‘Brexit’ that countries outside the EU have prospered because they are free of

We would be left powerless and voiceless.” Locally for Labour, Sheffield Central MP Paul Blomfield, is also strongly in favour of the UK remaining in the EU. He said: “Over the weeks until the referendum I’ll be doing all that I can to keep Britain in the European Union. I’m working with Alan Johnson as part of the team that’s running the Labour In for Britain campaign, and I’ll be supporting the cross-party Britain Stronger in Europe campaign. “The referendum is not about Cameron’s deal. It’s a ‘once and for all’ decision not just facing us now, but with an impact on generations to come.” “There’s more we need to do together in tackling the economic challenges we all face. But leaving the EU and turning our back on our neighbours would leave Britain weaker and less able to build a secure future.” We are yet to see the emergence of a local ‘No’ campaign, but we surely will as June 23 gets closer.

KEEPING CONTROL WHAT’S THE BEST WAY OF PROTECTING YOUR BUSINESS WHEN EMPLOYEES LEAVE? OUR DREAM TEAM GIVES ITS ANSWER. KEVIN KERLEY, ENTREPRENEUR AND CHAIRMAN OF THE ACADEMY FOR CHIEF EXECUTIVES I have used restrictive covenants in employees contracts with successful outcomes, I am sure my legal colleagues will agree that the key to making them stick is to ensure that you have them correctly drafted by a legal expert in the first instance which will ensure they are enforceable. They do act as a very effective deterrent to protecting your business confidential information, they are however very expensive to enforce and will require a court injunction to prevent an employee from using sensitive confidential information that may be damaging to your business. The considerations that the court will give to the circumstances are also complex and weighed in favour of the employee not being restricted from applying their trade experience to gain work. So you need to weigh up the cost versus the likely outcome before enforcement is invoked. The cost will also include the distraction from day-to-day activities and stress caused by a legal fight. If you are concerned about a leaver going to a competitor and taking business with them, in my experience in most businesses this does not happen.You may lose the odd customer, however the clients are usually loyal to the services that you provide them. The key to prevent this happening as much as is possible, in my opinion, is to ensure that no one individual has all the relationship with the clients and build a strong brand so that your customers will buy into the brand, rather than any particular individual within the business. I do however understand your concern

I have thought about introducing a restrictive covenant to restrict the activities of former employees, but are they actually worth the paper they are written on and can they be enforced?
and I think that most business owners will share the concern, implement well written restrictive covenants into senior personnel contracts, build a strong brand and not become a stranger to your key clients should lessen the likelihood of this happening to you.
ROB MOORE, RECOVERY EXPERT AND PARTNER AT TAYLOR & EMMETT One of the biggest risks for any employer relates to staff leaving and taking with them confidential information which may then get into the hands of a rival business. It is essential therefore that you try and protect your business, although it is not always the case that a restrictive covenant is enforceable. Nevertheless, it is still worthwhile all employees having restrictions in their employment contracts to ensure that your staff who sign up to the restrictive covenants will expressly agree not to do certain things once their employment has come to an end. Whether or not you are able to rely on a restrictive covenant and enforce it depends on whether it is legally compliant.You will not be able to rely on

a restrictive covenant unless it is necessary to protect your legitimate business interests, it does not apply for a longer period than is necessary to protect those interests and it is reasonable. It is very important that you are not too heavy handed when incorporating a restrictive covenant into an employment contract. It is also the case that different restrictive covenants may apply to different members of your staff. A court is far more willing to enforce a restrictive covenant against a senior employee who has regular access to your confidential information but may be less willing to enforce the same covenant in respect of a more junior employee who has no or little access to confidential information. Whether a covenant is reasonable or not usually depends on the type of business you operate. However, if your covenant contains a general prohibition not to contact any customers or clients, that is far less likely to be enforceable than a narrower covenant which prevents contact with customers or clients whom your employee had dealings with in, say, the last 12 months. Likewise, your ability to rely on a covenant which contains a general prohibition against any of your employees working in your industry anywhere within the UK is far more likely to be rejected by the court than a covenant which prevents one of your employees working in your industry within, say, 3 miles of your premises.

heffield’s Metropolitan Hotel has been acquired by the London Town Group of companies.
Founded in 1988, London Town Group owns and operates several hotels in the UK, four of which are Mercure branded. The Group started out in the hospitality industry with a single budget-brand hotel in Earls Court. It has now grown to be an established property investment company largely focusing on four-star hotels in London until 2008 when the group acquired a hotel in Nottingham’s Lace Market. Working with business partners the Group has created a global market presence for all its hotels. In 2009, in partnership with InterContinental Hotels Group it opened the first Hotel Indigo outside North America in Paddington, London. Hotel Indigo London Paddington is a unique four-star boutique hotel in the heart of London’s Paddington area. In partnership with Accor Group, London Town Group has successfully established a strong presence of Mercure hotels in Paddington, Kensington and Nottingham. It has also acquired Days Hotel in Derby, which is located opposite Derbyshire Cricket Ground.
The Group’s latest investment is the Sheffield Metropolitan Hotel, a stylish and contemporary 112-bedroom purposebuilt hotel in the heart of the city centre. ithin just a few weeks of opening it seemed that everybody was talking about Jump Inc., be it children, parents or grandparents.
W
To achieve such a buzz around a new business venture is quite an achievement – so it might not be too much of a surprise that founder Chris Hayes is taking advantage of his quick success. He is well on the way to opening his second trampoline park, at Meadowhall, and will have opened a further two – in Sheffield city centre and Barnsley town centre – by the time this year is out. So where did it all begin for the former Brita water filter salesman? “About 18 months ago I went to Australia with my family and we visited a trampoline park,” explained Chris. “I thought ‘this is a great idea’. I had never
seen the concept before. We came home and I kept thinking about it. “I found out there was a trampoline park in Manchester – the first in the UK – so took my daughter to visit. “My first thoughts were that it was really good and that it would do well, but the more I thought about it the more I could see areas in which I could do it better. We had to fill out forms on arrival, none of the staff were in any kind of uniform and it was full of basic trampolines.” Chris put together a business plan, organised discussions with business contacts, refinanced his own buy-to-let properties and managed to get enough money together to get Jump up and running. “I thought the finance would be the most difficult part but it turned out to be

relatively simple,” he said. In fact, Chris found sourcing the premises the biggest challenge.
ABOUT JUMP n Jump Meadowhall will be half trampoline park and half ninja park. Chris describes the ninja park as a cross between an obstacle course and TV’s Gladiators. It is ideal for competitions and corporate events.
“I grew up in Handsworth so really wanted to open the business in Sheffield,” he said. “I thought renting a commercial property would be similar to renting a house but it is another world. Landlords wanted to see three years’ accounts which obviously I didn’t have so because I was a new business nobody would touch me. I eventually came across this 24,000 sq ft unit at Parkgate which had been empty for two years so they were keen for it to be occupied. It proved to be just what I was looking for.”
n Jump Parkgate cost around £600,000 to set up, with the trampoline equipment costing about £350,000. n Jump Parkgate has a performance trampoline, ideal for gymnasts. The Meadowhall park will have five.
With a mortgage to pay and a family to support – a four-year-old, two-year-old and another baby on the way – Chris left his sales job, submitted planning applications, ordered trampolines – and opened the doors to Jump Inc. on 27 November 2015.
n The total build time from approval of planning permission to opening the Parkgate site was around 13 weeks.
“I couldn’t have asked for it to go any better,” said Chris. “In the first four weeks we had 34,000 jumpers through the doors. I knew it would do well but I never expected that. “Some people thought the numbers I’d predicted were too high to stack up but we are smashing them and currently bringing in 30 per cent more than forecast. After that first week of opening I started to sleep a bit easier.” Chris puts a lot of the success down to doing things differently. “I have been to all of the trampoline parks that are now open around the country,” he said. “They are generally very ‘kids play centre’ style with sticky tables! They are predominantly targeted at the 4-8 age group and I didn’t want to do that. Jump is aimed more at teenagers, although we do appreciate that people want to come with younger children so we specifically run toddler mornings, to encourage people to bring younger children when there aren’t bigger kids jumping around.” Weekends are always fully booked at Jump and Chris has come up with a number of clever ways to make sure the space is utilised throughout the week including the toddler sessions, fitness sessions, corporate events and, more recently, school and charity sessions. Customers can expect a slick and professional experience, down to the smallest detail. All staff members wear uniform, customers check themselves in
on a computer screen and can sit at chairs and tables handmade in Sheffield. Even the safety briefing is high-tech, with all ‘jumpers’ required to watch a video in a dedicated briefing room before using the park. “In my previous job I was a national account manager looking after £15m worth of business and this gave me a good grounding in the corporate side of things,” said Chris. “A lot of people come to Jump at Parkgate and think it’s a franchise and I take that as a compliment.” Chris, aged 36, has done such a good job of creating a professional, yet friendly, environment that his staff have even declared themselves part of the family. “It has been nothing to do with me but they have decided to call themselves the ‘Jump family’,” he said. “It really is a great atmosphere and I’ve always said I want the Oz mentality here. I want everyone to have fun while they are at work. You spend a lot of time at work so you need to enjoy it.”
The ‘Jump family’ is currently made up of the 58 members of staff at Parkgate, but will soon expand significantly. A further 65 will be employed at the 36,000 sq ft Meadowhall park, due to open in June. By the time the Sheffield city centre and Barnsley town centre parks are open – planned for June and September respectively – Chris will employ about 180 people. At around half a million pounds per park the expansion is not cheap, but the success of the Parkgate site has enabled Chris to use asset finance to expand the business quickly. “In another three to five years’ time trampoline parks will probably be popping up everywhere and that’s why I’m keen to move quickly and get a majority share of the market,” he said. “At the minute there are two companies in the UK which have two parks. The award runs in over 500 communities world-wide and 19 high calibre people were nominated locally. Jill, along with other inspiring businesswomen, took centre stage at the International Women’s Day event, organised by the Barnsley and Rotherham Chamber of Commerce Women In Business group. An audience of 100 at Tankersley Manor also listened to Andrew J Coombe Esq, HM Lord-Lieutenant of South Yorkshire, lead commissioner for Rotherham Sir Derek Myers and Master Cutler Craig McKay.

West End performer Michael Sterling – who has played the Phantom in more than 1,000 performances of the classic musical and also starred in record breaker Les Misérables – will lead the entertainment in An Evening With the Phantom at the Cutlers’ Hall on June 18. JULIE KENNY BECOMES A PATRON OF LOST CHORD South Yorkshire businesswoman Julie Kenny has become a patron of dementia charity Lost Chord. Julie is the managing director of Rotherham intruder alarm manufacturer Pyronix, a company she founded in the 1980s, and she is also a director of its parent company, Secure Holdings. In addition, she is a director of the British Security Industry Association, a UK commissioner for employment and skills, sits on the Small Business Forum, is a member of both the Better Regulation Stakeholder Group and the Administrative Burdens Advisory Board and is an honorary director of Rotherham Chamber of Commerce. In her new role as patron of Lost Chord she will be joining opera star Lesley Garrett, Dame Vera Lynn and pop star Sir Cliff Richard. Lost Chord is the South Yorkshire charity that provides vital interactive musical experiences for people living with dementia in care homes and days centres both across the region and nationally.

FOUNDRY EXPERT JOINS CASTINGS TECHNOLOGY INTERNATIONAL A foundry expert, whose technical capabilities include producing complex components with a cast weight of up to 40 tonnes, has joined Castings Technology International as an iron castings consultant. Graham Jagger started his career in the foundry industry as an apprentice pattern maker in 1965, becoming a shop floor technician and technical and development engineer before moving into management 35 years ago. He spent more than 20 years as a foundries manager and was technical director of a medium-sized iron foundry to expand into new markets and increase its manufacturing capabilities as technical manager, before becoming the joint owner and technical director of an iron foundry in West Yorkshire, which he has continued to advise after selling his stake in the business.
GREG DYKE KICKS OFF £1M APPEAL TO BUSINESS APPEAL A £1m appeal to business leaders to boost world leading cancer services in Sheffield has been kicked off by FA chairman Greg Dyke. The Weston Park 2020 for Business campaign aims to engage businesses across the Sheffield City Region with Weston Park Hospital Cancer Charity to raise an additional £1 million for local cancer services over the next five years. Companies are being asked to make a minimum donation of £1,000 a year for the next five years, which will be invested in projects that will enable Weston Park Hospital to remain at the forefront of cancer care. Ensure personal and professional identities are kept separate and check your privacy and security settings regularly. 5 Take security seriously Smart businesses can gain a competitive advantage by demonstrating that security is taken seriously and treated as a valuable asset. Identify critical information and assess the kinds of risks it could be exposed to. Are there legal or compliance requirements that the business is subject to? 4 Install strong barriers Fraudsters target different types and sizes of businesses to exploit weaknesses. Prevent your business from becoming a victim of online fraud by installing and updating reputable anti-virus software and a firewall.
7 Supply the technology Be aware of the risks of ‘bring your own device’. Research suggests small businesses have experienced security breaches due to staff bringing their own
devices to work. While there can be advantages to this, the importance of employees being aware of cyber threats must be regularly reinforced. Employees intending to take new gadgets to work require guidance on how to do this without compromising systems and data.
8 Property mark your devices It’s recommened that businesses mark and photograph all valuable items, including computer equipment. This will act as a deterrent to thieves and make it easier for items to be returned if recovered after being stolen. There are a range of quick and easy techniques available including UV marking - use the building number or name and postcode.
9 Review measures regularly Most online attacks can be prevented or detected using basic security practices, but these need to be reviewed regularly. Manage changes in the levels of risk to IT equipment, services and information, remove software or equipment that is no longer required and manage changes such as the deletion of accounts for staff leaving. 10 Back up your data Data can be lost for many reasons, including theft. Implement automated backup schedules, back up your files, applications and systems and keep backups off-site. Test your backups – don’t wait until disaster strikes to see if they work.
