Lock You Out of Remodeling EPA Lead Renovator Refresher & Training Courses For: REMODELERS, GENERAL CONTRACTORS, SPECIALTY CONTRACTORS, PAINTERS, PLUMBERS, ELECTRICIANS, MECHANICAL CONTRACTORS, WATER & FIRE RESTORATION COMPANIES, OR ANYONE DISTURBING LEAD PAINT. Rochester Area Builders in partnership with the University of North Dakota Environmental Training Institute is offering four-hour EPA lead renovator refresher courses and an eight hour lead renovator initial course. EPA lead certification and/or recertification is required for any renovation that disturbs more than six square feet of interior or 20 square feet of exterior lead paint in residential or child-occupied facilities built before 1978. The EPA has the ability to fine up to $37,500 per offense, per day to anyone who is not compliant. More details available at www.epa.gov/lead These courses qualify for Minnesota Department of Labor & Industry continuing education credits. EPA-Certified Trainers will teach these classes.

FEELING LAZY ABOUT ESC? Leverage the most protection with these practices Erosion and sediment control (ESC) best management practices (BMPs) are a “clean water must” for construction sites with a Minnesota Pollution Control Agency Construction Stormwater Permit. Of the full suite of ESC BMPs, here are our votes for the “Top Six” things you can do to help keep you out of compliance hot water and prevent water pollution. 1.) Think Before You Construct • Highlight the ESC BMPs on the approved grading plan; give copies to the guys who move dirt. • Make a “site directions” map and send it to your material suppliers with a friendly reminder to use the stabilized vehicle entrance that you have noted on the map. • Install all the critical BMPs before any dirt is moved. 2.) Perimeter Control • Follow the instructions for perimeter control placement shown on the grading plan. Perimeter control BMPs shown may be silt fence, sod, a wood mulch berm, or a large vegetated buffer. • If “real life” conditions trump the planned perimeter control (i.e., soil is leaving the site), be prepared to install more, but first consult with the site’s design engineer for direction. • Show your workers where the ESC BMPs are and ask for their help in keeping them functional.

3.) Catch Basin and Inlet Protection • Prevent sediment from entering catch basins and other storm sewer system inlets, whether at the curb or in the back lot. • Choose an inlet protection option that best meet your site’s needs; consider how often you will need to remove sediment and whether or not you want to reuse it on your next site. • Once sediment is in the storm sewers, it will get into our receiving waters – please don’t be a reason for our river impairments.
Good example of inlet protection and stabilized rock entrance 4.) Stabilized Vehicle Entrance (SVE) • A well-maintained SVE is a good way to reduce citizen complaints that trigger City inspections. • Set a site goal of eliminating street tracking and expensive street sweeping.

Debris and Litter Control • Create a proper containment area at the beginning of the project and tell all your subcontractors and suppliers to use it to control their waste. • Don’t wait until waste is flowing out the top before you call for pick-up! 6.) Inspect and Maintain • Walk your site each week and after each significant rainfall event to check all your ESC BMPs, making sure they are still installed correctly and free of accumulated sediment and debris. • Maintain failing BMPs. Repeat: maintain failing BMPs. • Observe the neighbors’ property and the streets to make sure sediment and debris are not leaving your site. Follow these basics and you won’t be the contractor responsible for sediment, nitrogen and phosphorus water pollution or costly dredging projects.

of Minnesota (BAM) and West Central Builders Association (WCBA) successfully stopped the increase of building permit fees by the Willmar City Council in August.
The Willmar City Council put increased building permit fees on their agenda for its August 18 meeting. Ironically, not only did the City not have evidence that it needed to increase fees to cover the cost of services rendered, the City also had not reported its construction and development fees in four years. Minnesota law requires building permit fees be used only for the purpose for which they are collected. In response, BAM and WCBA wrote a letter to the Willmar mayor, council members, City administrator and City attorney providing a reminder that Minnesota law requires all construction and development related fees be reported and that the law prohibits the use of building permit revenue for purposes other than which they are collected. The letter urged the City to carefully review the revenue and expenditures related to its building permit fees, and then, and only then, should it consider an increase if it’s clearly necessary to support the services for which they are collected. The letter referenced BAM’s successful case against both the Cities of Shakopee and Elk River for diverting building permit revenues to other uses. The City Council unanimously voted the increase down. This is an example of the advocacy support BAM can provide members when issues come up with local municipalities. Ask the builders in Willmar and they will assure you this is a true benefit of membership. These kinds of issues come up statewide, and BAM is here to help. If your local association doesn’t have designated government affairs staff, track down and read your city council agendas. If an issue comes up give BAM a call and we’ll lend a hand. BAM members Mike Gohman, Tama Theis, Dale Gruber, Chad Kompelien, CMBA’s Jane DeAustin and BAM’s Remi Stone met with Colin Peterson last Friday asking for his help on the federal EPA’s wetlands and waters of the United States regulatory overreach. Congressman Peterson is one of the leaders in moving legislation to stop this government grab and he supports the industry on this serious environmental issue. The proposed rule would significantly expand the definition of “waters of the U.S.” under the Clean Water Act, and would inappropriately extend federal power and place more top-down regulatory burdens on all types of land use activities. Minnesota is actively engaged in protecting and improving water quality, and the EPA’s implication that only federal government is capable of protecting small bodies of water is not supported by science or fact. In addition to government overreach, the proposed rule would increase regulatory roadblocks and make it more difficult or impossible to farm, build homes, or make other changes to land in many areas. BAM joined the Farm Bureau, Chamber of Commerce and 20 other organizations requesting Minnesota’s entire Congressional Delegation to support these efforts. The Good News is that on September 9, 2014 the U.S. House passed H.R. 5078, the Waters of the United States Regulatory Overreach Protection Act, by a vote of 262 to 152. In total, 227 Republicans joined with 35 Democrats to pass the bill. See how your member of Congress voted by following this link: http://clerk.house.gov/evs/2014/roll489. xml This provision in H.R. 5078 will halt the EPA and Army Corps of Engineers proposed rule on “waters of the U.S.” and force the agencies to go back to the drawing board to craft a balanced rule that respects both congressional intent and Supreme Court precedent. Following this strong, bipartisan vote, the industry and its peers now turn to the US Senate to urge them to consider the House-passed bill and slow down the EPA’s flow of bad water regulation.

The National Debt: + + + + + + + + + + +
Growing but More Slowly+ + + + + + + + +
Elliot Eisenberg, Ph.D. + + + + + + + + + + + + + + + + + + The federal debt routinely captures headlines and continually grows but is there a crisis? Should congress fix the debt immediately, or have we made enough progress? Turns out, in the short-run we are fine, but there is heavy lifting that must yet be done if we are to get to a sustainable path. While the debt is huge, it’s the ratio of debt to GDP that matters. Ignoring debt held by government agencies (such as the $5 trillion in IOUs held by the Social Security Administration), and focusing on debt held by households, firms and foreigners and upon which the treasury pays interest, the total amount of money the government has borrowed equals, $12.6 trillion, close to 75% of GDP. To give some perspective, before the Great Recession the debt was 35% of GDP and it was projected to gradually rise to 50% of GDP by 2018 as more Baby Boomers became eligible for Social Security and Medicare and as healthcare cost rose. Then came the Great Recession which resulted in more borrowing as tax receipts fell and more had to be spent on countercyclical social programs including unemployment benefits and food stamps. As a result, debt rapidly rose to 50% of GDP and was projected to rise to 70% within a decade. Then to fight the Great Recession, President Obama persuaded Congress to pass the American Recovery and Reinvestment Act (aka “The Stimulus”) an $800 billion package of tax cuts and spending increases. That along with the weak recovery pushed the debt to 70% of GDP by 2011 and it was projected to rise toward 100% of GDP by 2021 as the economy returned to health and interest rates rose towards normal levels. At that point things looked grim. Then came some big changes that dramatically improved things.
Congress raised taxes on upper income families, cut discretionary spending, and the rate of increase in government spending on healthcare, particularly on Medicare, unexpectedly slowed by 2.25%/year. That improved the projected trajectory of the debt. Now, it is forecast to climb from 75% of GDP today to 80% of GDP by 2024 and it’s projected to climb higher after that. While the debt is high by historical standards, at least it’s getting worse more slowly, at least in the short-run. The good news, outside of Social Security and Medicare, projected revenues and spending are balanced. The key to balancing the budget is closing the gap between promised future Medicare and Social Security benefits that are actuarially higher than future taxes earmarked for those programs. This can be done by cutting benefits, raising taxes or ideally some of both. Moreover, the earlier these changes are made, the less painful they will be. A second way to fix the budget; pass pro-growth legislation. This would include reducing tariff and non-tariff barriers via trade reform, reducing marginal corporate and personal income tax rates via tax reform, and enabling illegal immigrants to fully participate in the economy via immigration reform. Collectively these policies would raise annual GDP growth by $80 billion, or 0.5%, which when compounded over time is a huge amount. Our budget problems now lie largely in the future. That, however, must not distract us from grappling with them soon as time passes all too fast. Moreover, assuring markets that we are solving future budget problems should help promote the current economic recovery.
