s we creep into the midst of summer, the building community has experienced some great highs and lows. June marked the passing of a great friend of the Association and the Rochester building community – Denny Hanson. The first time I served on the RAB board, Denny was also serving a term – I learned quickly what a great asset he was to our Association, and also how distracting it was to sit next to him at meetings! That man could talk and gossip like no other. In fact, after one particularly chatty board meeting, I told Denny that I wasn’t sitting next to him any longer because he was too naughty! I will greatly miss his behind the scenes speeches at our networking nights, giving us the up-to-date info on the city!

July General Membership

June and July have also held some positively great news – an upswing in new residential building permits. I think we can all say that this makes each aspect of the building industry feel a little bit better. It gives us a spring in our step, and that little boost of confidence we’re all needing. Are we feeling “normal” yet? Probably not, but we’re bidding projects and signing contracts, which is just one step further along in the rebuilding process.

As a lead up to the Sporting Clay Shoot this year, we’re running a 5 Stand League this summer! This event is open to RAB members, their spouses, and/or children 12 years or older who have passed hunter safety. You can sign up for as many or as few dates as you want! Participating in the league is not required to participate in the September 6th Sporting Clay Shoot, but if you love to shoot, we encourage you to participate in both! The League will be held at the Gamehaven Boy Scout Camp located at 5015 Simpson Rd SE Rochester, MN 55904. The House and Senate have been controlled by the Republicans the past few years, but the new redistricting lines could upset the leadership balance. Additionally, Governor Mark Dayton has proven to be insensitive to the cost of housing in Minnesota by vetoing legislation to reduce the cost of housing for all Minnesotans, twice. For these reasons, the Builders Association of Minnesota has created the Building MN Homes – Building MN Jobs 2012 Election Fund as a way to work together to ensure we elect candidates that support our industry. It is imperative that the members of BAM work to make sure we have a voice in the 2013 legislative session as we continue our work on issues like building codes, workers compensation and licensing. BAM is seeking a group of 50 members to step up and lead the effort and commit $500 from their business to support this effort. 50 member companies at $500 each, with the goal of $25,000 in 50 days. Each day starting June 18 and ending August 24 BAM will announce a new contributor to the Building MN Homes – Building MN Jobs 2012 Election Fund stepping up to the plate for this political effort. The Building MN Homes – Building MN Jobs fund is a soft money PAC (political action committee) to support candidates running for the Minnesota legislature in the fall 2012 election. Funds raised by BAM members will be used to support candidates that support the residential construction industry. Where will the money go? Funds will be spent on advertising (print and/or radio) depending on the legislative district we target. Who decides? YOU! Decisions on who to support or defeat will be based on your relationships with members of the legislature and their connection to your local association as well as your incumbent legislators’ voting record on BAM’s key issues. Independent Contractor Rule in Effect as of July 1, 2012 [Government Relations Section] Starting July 1, 2012 the Minnesota Department of Labor and Industry (DLI) will be phasing in a new two-year pilot program registration system that replaces the ICEC and 2% withholding requirements. Circuit ruled June 22, 2012 that the decision by the Environmental Protection Agency (EPA) to remove the “opt-out” provision from its lead rule is legal. The EPA included the opt-out provision in the original 2008 Lead: Renovation, Repair and Painting Program Rule (LRRP Rule), but agreed in 2010 to remove the provision to resolve a legal challenge against the rule. The removal of the optout provision more than doubled the number of homes subject to the LRRP Rule. According to NAHB, “The agency estimates that this will add

more than $500 million per year to the cost of the regulation.” A coalition of industry trade groups led by NAHB filed a petition for review in the D.C. Circuit Court of Appeals challenging the removal of the opt-out. The court issued its decision in favor of the EPA, finding that federal agencies may change existing regulations so long as the amended rule is allowed by the statute and the agency acknowledges the change in course. With regard to the opt-out, NAHB states, “The court ruled that since the EPA was not obligated to include an opt-out provision in the LRRP Rule, it could remove the provision without offering new information to justify its removal.” For More Visit: http://bamn.org/mnbuilderblog/nahb Facts on Rumored 3.8% Sales Tax on Homes [NAHB Section] NAHB has been tracking a set of emails that falsely claim that the 2010 health care reform legislation imposed a 3.8% sales tax or transfer fee on all home sales in 2013. NAHB states the 3.8% tax is not in any way a sales tax paid against the sales price of the home for either the home seller or home buyer. Nor is it an additional business income tax for home builders selling a new home out of inventory. A Proactive Approach to the Reduction of Nutrient Pollution Nitrogen and phosphorus pollution (aka “nutrient pollution”) threatens waters used for drinking, fishing, swimming, and other recreational purposes. It can hurt the tourism industry, decimate people’s home and property values, and cause illness. –Environmental Protection Agency1 Regardless of the distance between your construction site and a waterway, your actions impact water quality. Using best management practices during the construction phase will lessen your impact today, while planning for the future will lessen the potential for nutrient pollution from the property in the years to come. Nutrient pollution is one of America’s most widespread, costly and challenging environmental problems.2 Even though nitrogen and phosphorus are essential to life, when they are present in the air and water in great amounts they become toxic. 30 percent of streams and almost 20 percent of lakes across the country have high levels of nitrogen or phosphorus.3 The impacts of excess nutrients include: fish kills and algal blooms, human health problems including swimmers ear and diarrhea, and losses close to $1 billion each year to the US tourism industry.4 The primary sources of nutrient pollution are fertilizer on the landscape, animal waste, car emissions, failing septic tanks, and untreated storm water runoff. The good news is that choices can be made to reduce nutrient pollution, even during development and construction. The following actions will minimize the runoff of nutrients from the property, both at present and years into the future: 1. Erosion and sediment control measures will prevent sediments and any attached nutrients from being washed to the nearest waterway in a rain event. 2. Vegetation encourages rainwater to soak into the ground rather than runoff. Planting long-rooted native plants, shrubs and trees will help prevent pollution while beautifying the landscape and providing food and habitat for wildlife. 3. For clients that prefer a grassy landscape, encourage the planting of native fescues. Not only do these grasses look like a traditional yard, they save your clients time and money as they are drought resistant, rarely need fertilization, and require less maintenance than common turf grasses. 4. Local soils are naturally high in phosphorus. Test soils before fertilizing to prevent adding unnecessary nutrients to the landscape. Also, follow the instructions on the product to avoid over application of the product. 5. Pervious pavers and pavement allow water to soak into the ground are a great option for walkways and low traffic areas. 6. Consider adding best management practices to capture and treat storm water runoff on-site. Options include: raingardens, rain barrels, grassy swales, and buffer strips.

Permits – There were 29 single family permits pulled in April 2012, with a total of 87 for the year, as compared to 74 through the same time period in 2011. Permits – There were 32 single family permits pulled in June 2012, with a total of 138 for the year, as compared to 94 through the same time period in 2011. Boulevard Tree Ordinance – RAB staff has received a memo from the Parks Department outlining potential options for boulevard tree planting in relation to new commercial signage. Staff and members that have reviewed the information agree that discussions are on the right track. The compiled information will soon be sent to the City Council for their consideration. Historic Preservation Ordinance – A proposed historic preservation ordinance was presented to the Rochester City Council at a Committee of the Whole meeting on July 16th for discussion. The RAB Government Affairs Committee met with several proponents in the early stages of the ordinance discussions. The Government Affairs Committee and Board were supportive of historic preservation, but felt that the ordinance in its current form would complicate the permitting process and restrict the rights of property owners. The City Council ultimately moved the issue forward to a public hearing but in the mean time requested that all groups reconvene to further discuss the ordinance and see if a compromise can be reached.

BAM Wins Lawsuit, Upholds State Building Code From BAM News Update – A decision was issued on July 23rd by the Minnesota Court of Appeals, in favor of the Builders Association of Minnesota (BAM), with a huge impact on residential construction in Minnesota. Without this ruling, any municipality in Minnesota would have been able to create a policy and use it to override the state building code; diluting the power of the code. BAM filed suit against the City of Saint Paul in response to their egress window policy which exceeded the State Building Code. The case dates back to November 22, 2010 when BAM sent a cease and desist letter to the City of St. Paul. BAM filed suit when the City of St. Paul did not respond. BAM lost in District Court, brought the case to the Court of Appeals, and ruled in favor of BAM the week of July 23rd. Read the Star Tribune story HERE

Builders Tell Congress Inefficient Regulations Harm Housing, the Economy From NAHB’s Washington Update – NAHB Chairman

Barry Rutenberg told Congress this week that an unwieldy federal regulatory process is hampering the housing and economic recovery. Testifying on July 19 before the House Committee on Oversight and Government Reform, Rutenberg said that “housing serves as a great example of an industry that would benefit from smarter and more sensible regulation.” For example, the Dodd-Frank Act required significant changes to mortgage lending practices, including an “ability to pay” provision that requires lenders to establish that home buyers have a reasonable chance of paying back the loan at the time that a mortgage is written. The law states that certain high-quality, low-cost loans known as qualified mortgages (QM) are presumed to meet this standard. The new QM standard, which is currently being developed by the Consumer Financial Protection Bureau, will define the mortgage market for years to come, Rutenberg said. For that reason, NAHB supports regulatory changes aimed at more rational lending practices, greater lender accountability and improved borrower safeguards. “However, it is critical that such reforms are implemented in a manner that causes minimum disruption to the mortgage lending process,” he cautioned. “New reforms should not limit consumer financing options, increase the cost of financing or reduce the availability of mortgage credit.” Overly restrictive rules for the forthcoming QM standard will prevent creditworthy borrowers from entering the housing market even as owning a home remains an essential part of the American dream, added Rutenberg. Another key factor in housing’s current depressed state has been an ongoing lack of acquisition, development and construction lending. “Our members are caught in an ‘argument’ between banks and federal regulators, who take turns pointing fingers at one another when we try to determine who is to blame for the serious lack of lending to the construction sector,” said Rutenberg. Regardless of who is at fault, with many housing markets now showing signs of recovery, Rutenberg said it is essential that Congress works with regulators and financial institutions to encourage banks to provide sound construction loans so that builders can construct viable home building projects in communities across the land that want and need them. “Restoring the flow of credit to home builders will not only help to put America back to work, it will help provide badly needed tax revenues that local governments need to fund schools, police, firefighters and other public services,” said Rutenberg. Meanwhile, changes to the Environmental Protection Agency’s Lead: Renovation, Repair and Painting (RRP) rule have constrained small businesses in the home building and remodeling industry. The final rule, which went into effect on April 22, 2010, requires renovation work that disturbs more than six square feet in a home built before 1978 to follow new lead-safe work practices supervised by an EPA-certified renovator and performed by an EPA-certified renovation firm. “Poor development and implementation by the EPA has resulted in excessive compliance costs and has hindered both job growth and energy efficiency upgrades,” said Rutenberg. In 2010, the EPA removed the “opt-out” provision in the RRP rule that allowed remodelers working in a home built prior to 1978 to forego more expensive work practices according to the owner’s wish if no children under the age of six or pregnant women were living in the home. By removing the opt-out provision, the EPA more than doubled the number of homes subject to the RRP, and the agency has estimated this will add more than $500 million in compliance costs to the remodeling community in the first year alone, without making young children any safer. Moreover, the EPA has not approved reliable lead testing kits, and in many cases consumers are needlessly paying additional costs for work practices that are unnecessary, he added.
