News from the President September 21st, 2012
A
hhh September – it’s hard to believe we’re creeping into that cooler breezes, campfires and football time of year already. I love this time of year, mainly for the high school football season (Go Mayo Spartans!), but also for the Fall Showcase of Homes, the Remodelers Showcase and Home Show planning. The Fall Showcase and Remodelers Showcase both have more entries than 2011 and will most likely act as our stepping stone into another great season of homebuilding and remodeling. Each of these unique properties gives a person the chance to see what they might like in a new home or what they could do to their existing home. Last weekend, I had the pleasure of being a judge for the Showcase and what an amazing time it was! We viewed 6 beautiful homes that were either ready for buyers, or had been built for someone. In them, I noticed warm cherry cabinetry, granite counter tops and neutral walls – all very inviting spaces. All of the builders we spoke with were excited about the Showcase and pleased with the traffic – I wish all of our participants another exciting weekend! My first letter as President was about our annual Home Show and 9 months later I’m already revisiting the subject but we have exciting news… The Home Show committee has decided to bring in adult entertainment this year. Yes, I did say adult entertainment but not “that” type – call this “adult” entertainment for those of us addicted to HGTV and the DIY network! Nicole Curtis, who hosts the popular show “Rehab Addict”, will join us Saturday, February 9, 2013 for 3 presentations. Do you have a booth in our Home Show? Did you know this is one of the best ways to advertise to customers? They can see you, talk with you and sign up for an appointment all in one fell swoop! So if you don’t have that booth yet – head right over to the RAB office and snap one up cause they’ll be goin’ fast! Best regards for an outstanding fall!

Join us at the September General Membership Meeting Tuesday, September 25th, 5:00 - 7:30 pm
at the Ramada Hotel & Conference Center 1517 16th St SW September is typically known as our Candidate Forum, but this year we’re doing things a little differently. We will be inviting candidates from the city, county and state levels to join us at this meeting, however, we will not be having a panel this year. Instead, each candidate will have their own table along the perimeter of the room where you will be able to meet with them personally and ask them your questions. Think of it as your opportunity to give them a “Job Interview.” In place of a formal dinner, there will be appetizers throughout the evening and extended time for networking.

The Department of Labor and Industry (DLI) launched a new Subcontractor Registration Pilot Program as of July 15. The program was put into place during the 2012 Minnesota Legislative Session and became effective July 1, 2012. While DLI is calling it a contractor registration program, it’s actually for subcontractors. This does not change the current licensure requirements for builders and remodelers. This registration program is for subcontractors, meaning all general residential building contractors not already licensed by DLI must register. If you are a contractor performing any construction work for which a license, certification, or separate registration is required under Minnesota Statute Chapter 326B (i.e. residential building contractor or boiler, electrical, elevator, HPP, or plumbing contractor) then you must apply for a license and may not submit a contractor registration. This pertains to both commercial and residential construction. All subs must be registered by September 15, 2012 to avoid enforcement penalties. Enforcement begins September 15, and there are significant potential fines for general contractors employing subcontractors that are not registered. Registration is free and can be done online at: www.dli.mn.gov/register. BAM has put together a page with all the information and links available as well as a handout that can be given to subcontractors. Both are found at: www.bamn.org/education. The page includes a letter received from DLI, a one-page explanation of the program, a three-page frequently asked questions section, and links to information provided by DLI online. For more information about contractor registration: Visit: www.dli.mn.gov/CCLD/register.asp Call: (651) 284-5074 Email: dli.register@state.mn.us Frequently Asked Questions Q: Who has to register? A: An individual or business entity that performs building construction or improvement services must register with DLI unless they: • Have a current license, certificate or registration issued by DLI; • Have a current independent contractor exemption certificate; • Are an employee of a business performing construction services; or • Are exempt from licensing under Minnesota Statutes 326B.805, subd. 6 (5) or excluded from registration requirements under Minnesota Statutes 181.723, subd. 4a. Contractors who hire unregistered subcontractors, misclassify workers and fail to register are in violation of the law, which can result in civil penalties. Q: If I am a builder or remodeler, which means a license is required, do I have to register? A: The answer is no. If contractors are performing any construction work for which a license, certification or separate registration is required under Minn. Stat. chapter 326B (i.e. Boiler, Electrical, Elevator, HPP, Plumbing or Residential Building Contractor), they must apply for a license and may not submit a Contractor Registration. Contact DLI’s Construction Codes and Licensing Division (CCLD)'s Licensing Services at (651) 284-5031 (personal licenses) or (651) 284-5034 (business licenses) for more information. Q: How do I register? A: Registration is an online process and can be done at: www.dli.mn.gov/register Q: How do I verify registration? A: Available on the DLI License Lookup link found on the DLI homepage (www.dli.mn.gov) and at the following address: https://secure.doli.state.mn.us/lookup/licensing.aspx. A registered contactor can be found quickly by clicking on “business” and then typing any portion of the contractor’s name into the search field.

ers Association of Minnesota (BAM) Executive Committee accepted the resignation of Pamela Perri, BAM’s Executive Vice President, at the BAM Board of Directors meeting Wednesday, September 6. Her last day with the association is October 1.
Perri has led BAM through the most dramatic decade in the history of the U.S. home building industry. She has been instrumental in keeping the agenda of the residential construction industry viable at the State Capitol and at the State regulatory agencies. There is no doubt, if you worked with Pam and her staff, you know their passion and energy for our industry is boundless. She will be missed. While we are sorry to see her go, we share her excitement as she accepts a new job opportunity near her family in Chicago, Illinois. BAM intends to give Perri a proper send off, so stay tuned for details. During the BAM Board of Directors meeting, BAM President Keith Kylmala expressed how grateful the members are to Pam, yet at the same time, change means opportunity. BAM is well-positioned for the future and the Board is committed to keeping BAM at the heart of the industry’s political operations. Kylmala appointed Mike Gohman (2010 BAM President) to head up the search committee to find Perri’s successor.
PUBLIC WORKS DEPARTMENT NEWS Contributed by: Megan Duffey, Storm Water Educator, Rochester Public Works Department Rochester Public Works Department, 201 4th Street SE, Room 108, Rochester, MN 55904, 507-328-2440
Winter Preparations in October? You Betcha! As the construction season nears the winter months, preparing sites for winter is a top priority. It is crucial to prepare your site before the ground freezes and snow arrives. Since our winters are unpredictable, it is best to take these steps sooner rather than later. Exposed sediments and malfunctioning storm water controls will lead to sediment laden runoff during winter rains and the spring snow melt. If this runoff is able to leave your construction site, you will be contributing to water pollution and in violation of your construction permit! Add these site preparations to your checklist to make your site winter-ready:
Plant seed and mulch in late fall for spring growth
Cover slopes and dirt stockpiles with mulch
Install Sod
Inspect silt fences and other storm water BMPs to be certain they are in place and in good condition
Stabilize soil with mats and mulches
Clean dirt out of drainage ditches, sediment basins and storm water inlets
Following these tips will help reduce site erosion and protect our waterways throughout the upcoming winter and spring thaw. For more information visit the following websites: • Minnesota Pollution Control Agency – www.pca.state.mn.us/water/stormwater • City of Rochester Storm Water Management – www.rochesterstormwater.com Thank you for helping to Keep It Clean! Committee Updates AWARDS COMMITTEE CHAIRPERSON: Mike Larson, Knutson Construction Services This committee is currently meeting to look for “special” members to recognize for their achievements to the Association in 2012. They will choose a Rising Star - a member who has been very active in their first three years of membership, The Cornerstone Award – a company who has supported the association, as well as nominating builders and associates to receive the Builder & Associate of the Year Award. In this month’s newsletter you have the opportunity to nominate someone whom you have noticed working extra hard for RAB. Please find the form, fill it out, and return it to the RAB office. EDUCATION COMMITTEE CHAIRPERSON: Kathy Einck, Maplewood Homes, LLC This committee is in the process of finalizing the plans for our education seminars for this winter. This year they will be held in January and February. There will be a day of classes on January 30 and February 28 here in Rochester plus a day of classes in Winona on February 13. Registration forms will be mailed to all members and to all licensed builders in our eight county area later this fall. There is also a class specific to Remodeling Contractors on January 23 in Rochester.
PROGRAM COMMITTEE CHAIRPERSON: Barb Brown, PrimeLending This month our General Membership Meeting returns to a Program Evening after a summer of Networking Nights. The meeting will again be held at the Ramada Hotel & Conference Center. It will start with a social time at 5:00 P.M. The program will be a Legislative Forum with candidates for Rochester City Council, Olmsted County Commissioners and State Representatives and Senators. The format is different from previous years. This year is a “Candidate Fair.” The candidates for the various offices will have tables set up around the room, allowing them and our members more one on one. Be sure to come and let the various candidates know the concerns of the construction industry! The members who make it around to speak with all the candidates will be entered into a special drawing. The meeting will conclude at 7 p.m. Have you marked your calendar for December 7th? That’s the date of the Christmas Party. This year it will be held at the Double Tree in Downtown Rochester (a great place to be!). The committee’s hard at work to plan a great experience for you; so you won’t want to miss this “hypnotic” event!

We had lots of great donations from RAB members, staff, and friends. A special thank you goes to the committee who worked very hard to make sure all the details were taken care of Carl Fugleberg, Prime Time Painting – Chair; Norm Autry, Superior Mechanical, Vice Chair; Tony Kunz, Hiller’s Flooring America; and Tom Walsky, Habitat Restore Winona. Of course the sale wouldn’t have been possible without the wonderful volunteers who worked at the event along with the committee, helped with clean up, and pricing all the times: Tom Walsky, Habitat ReStore; Carl Fugleberg & Deb Fugleberg. Prime Time Painting of Rochester, LLC.; Tony Kunz, Hiller’s Flooring America; Norm Autry, Superior Mechanical; Jerry & Kim Jensen, HiMEC at Home; Kevin Reckinger, Bricewood, LLC; Jim Busciglio, HiMEC at Home; Kevin Kruger, Kruger Electric, Inc.; Rick Hampel, Merit Contracting, Inc.; Bob Rohweder, Warners’ Stellian Appliance Company; Diane Quinn, Beyond Kitchens, LLC.; Alex Nahvi, Ferguson Enterprises;
Harlan Hanson, DreamMaker Bath & Kitchen; Derrick Hansen, United Products Corporation; Sam Peyton, Kings Flooring . We would also like to thank Troop 102 for helping with set up early Saturday morning. Thank you Jay Burke – Heartwood Homes, for lining up the scouts. Three other companies who helped to make the sale possible were Viet Disposal Systems who donated the dumpster and Home Improvement Professionals who donated our 2 tents. We especially want to thank Instant Warehouse who donated the rental for the storage unit. Without their cooperation the sale wouldn’t have been nearly as profitable. Please remember them if you are looking for storage units for your company. The money that is made from the sale is used by the Council to advertise their members to the public, to provide scholarships to students, and to support community projects. Thank You!
July Summer Networking Night Thank you to all who attended Membership Appreciation Night at the Rochester Area Builders’ office on July 31st! It was a beautiful summer evening, the band was great (thanks Lost and Found and bass player Alex Nahvi with Ferguson), and the grill was hot! Thank you Home Federal for sponsoring the beverages, United Rentals for providing the tables and chairs, and Home Improvement Professionals for the tents. It was great having Sandy Friend back in the house as she accepted her induction into the Builders Association of Minnesota Hall of Fame and honorary membership in RAB.
GIVE AWAY’S Jan Throndson, Rochester Council President Candidate won the free dinner compliments of Laurel Schacht and the Post-Bulletin. Enjoy your dinner, Jan.

August Summer Networking Night Thank you to Haley Comfort Systems for hosting the August Summer Networking Night. Their new showroom is a fantastic facility! The food was great, the weather was perfect to enjoy a fire pit outside, and they gave away lots of door prizes. Thanks to Tom Haley and his crew for planning all the details, with a special shout out to Tracy Lauritzen for working with us to coordinate everything. Thanks, Haley Comfort Systems for your support of the Builders Association – it was a great party!
