Chris Terry, Knutson Construction Services December Meeting Join us and hear “lessons learned” from members of the project team who collaborated on the LEED Platinum Cascade Meadow Wetlands & Environmental Science Center. You will hear perspectives from the Designer (LHB), General Contractor (Alvin E. Benike, Inc.), and Building Tenant (Rochester Public Utilities) on what worked well with the project, and what could use improvement. Each presenter will share their insights from their individual points of view in an effort to help project teams with their future endeavors. “Lessons” will come from

all project phases including pre-design, design, construction, and occupancy. Team members will discuss the role of LEED, including the differences between Platinum certification and other levels of certification. Challenges with implementation of onsite renewable energy systems (both solar and wind) will be explored. Learn from the guidance and experience of one project team, in an effort to utilize similar best practices and avoid similar mistakes on future projects.

����������������������� The Minnesota Department of Labor and Industry released draft versions of their recommended Minnesota amendments for the 2012 International Residential Code and the 2012 International Energy Conservation Code the first week of October. Both code drafts include disappointing amendments for our industry and Minnesota homeowners. The proposed 2012 IRC would require fire sprinklers in all single-family homes with a floor area of 4,500 square feet. The floor area includes all floors and basements whether finished or not, but excludes garages. Of course this is unacceptable to our industry and we will be challenging this amendment as part of an Administrative Law Judge hearing. Next Steps Now that a draft code has been published by DLI the Construction Codes Advisory Council is the next to discuss it October 19th. Kathe Ostrom (BATC) represents BAM and the industry on this committee. Ostrom, BAM staff, and the BAM Codes Committee will prepare for that meeting at which BAM will make its case. The CCAC does not have the power to make much change to the residential building code. The CCAC’s purview, as stated by DLI, is: • •

Review laws, codes, rules, standards, and licensing requirements relating to building construction. Make recommendations on ways to eliminate inconsistencies, streamline construction regulation and construction procedures, and improve procedures within and among jurisdictions. Review and comment on current and proposed laws and rules to promote coordination and consistency. Advise agencies on possible changes in rules to make them easier to understand and apply, and also promote the coordination, within each jurisdiction, of the administration and enforcement of construction codes.

CCAC review is the first step the department must take before publishing their final draft of each code in the Minnesota State Register, which triggers the next steps in the march toward an Administrative Law Judge hearing. At that point BAM will have 30 days to submit 25 letters to DLI to initiate an Administrative Law Judge (ALJ) Hearing. Once the letters are received DLI will schedule the ALJ and BAM will present its testimony and data before the judge. We will need your help in the coming weeks and months as BAM staff prepares for the ALJ hearing on fire sprinklers. BAM Director of Codes and Research, Karen Linner may be calling on you to send data or to testify at the hearing. In the meantime, BAM is organizing a Fire Sprinkler ALJ Public Relations Task Force and we’d like a representative from each local association to contribute. The meetings will be available via conference calls so our longer distance members can participate. ��������������������� This year’s election saw change here in Minnesota, but nationally the balance of power stayed the same. Nationally, most swing states went blue, and the coalition put together by democrats in 2008 including minority voters, young adults, education professionals, and women held, for the most part, assisting President Obama in winning reelection. In Minnesota, Obama won by nine points. On a state election level, the Minnesota senate DFL had a net gain of 8 seats of which they needed 4 to take the majority. The senate balance went from 37 republicans and 30 democrats to 28 republicans and 39 democrats. In the House, democrats had a net gain of 11. They needed six to regain the majority. The makeup of the House went from 72 republicans and 61 democrats to 61 republicans and 73 democrats. The two bodies have chosen their leadership. Senator Tom Bakk is the Senate Majority Leader and Representative Paul Thissen is the new Speaker of the House. BAM put together a list of housing friendly candidates on both sides of the aisle and targeted those individuals for BAM-PAC donations. We are happy to report that 31 of our 37 candidates were elected putting us at an 84% success rate. What This Means For BAM Over the last couple of years we’ve expanded and intensified our relationship with democrats and republicans, rural and metro legislators, across the state. We have strong relationships with legislators that understand our priorities, and that is going to be especially important now that we have a DFL majority in both the house and senate. In the coming months and during session we will need to keep our message clear – a healthy housing industry means a healthy economy and jobs. In the time leading up to session, please be sure to introduce yourself to your legislators. With several new legislators at the Capitol it’s especially important that we educate them about our issues. It will also be important to have a big showing at Builder Day at the Capitol January 30th. Please mark your calendars and plan to attend.

Construction Site Inspections Saving You Time & Saving You Money Inspections are an opportunity for you to save yourself time and money in the long run. A quick, simple weekly site inspection will allow you to identify and fix a small issue well before it turns into a big problem. Here is how you can perform a weekly inspection and not lose time on the job: Follow the Grading Plan and Review the Site Before breaking ground, review the approved Grading Plan for your site to verify grades on your lot and on adjacent properties (if you have questions on the Grading Plan please contact the Public Works Department at 328-2400). After reviewing the lots’ approved Grading Plan, make sure that drainage easements, ditches, slopes, water conveyance areas, and emergency overflow areas have correct grades, positive drainage, and properly installed BMPS where they are necessary. Following the Grading Plan can prevent future costly erosion problems from occurring in a rainfall event. Understanding the SWPPP The Storm Water Pollution Prevention Plan (SWPP) is your guide to a clean site and reducing enforcement issues. A well organized and planned out SWPPP will assist in the prevention of unnecessary permit violations and save the owner and contractor time, money and effort over the course of the project. It is your guide to managing erosion, sediments, and waste both during construction and post construction. Planning ahead is the most effective way to minimize erosion and sedimentation during construction and reduce project costs. Additional tips: • Name the contractor in the SWPPP and the Construction Storm Water Permit • Keep the document on site, a simple mailbox on a post labeled SWPP can suffice as storage for all documentation • Visit www.pca.state.mn.us and search “Construction Stormwater” for more information Train your staff Understanding the importance of storm water management and how to utilize BMPs onsite will allow your staff to help you keep your site up to code. Knowledgeable staff can notice and address potential problems quickly. A site that is up to code will not have to spend time or money rectifying problems and bringing things back into compliance. Additional tips: • Make all staff aware of who is responsible for ensuring compliance so they can direct concerns to the appropriate person. Discuss this during the Pre-con/safety mtg. • Have certified personnel refresh worker’s knowledge of concerns and practices that are relevant at particular times of the year. • Document all training sessions that have occurred and the individuals in attendance. Keep these documents with the SWPPP. Weekly Inspections & Make Corrections Performing weekly inspections will generate confidence that your site is in compliance with the SWPPP. Make necessary corrections to the site as soon as they are identified. Fixing problems early will greatly minimize erosion and sediment risk, as well as keeping the site dry and workable after a storm. Additional tips: • Create an inspection sheet that is simple and convenient. • Document every inspection and correction made. Keep these records with the SWPPP. Inspections within 24 hours after ½ inch or greater of rainfall Water is incredibly powerful and can wreak havoc on even the best erosion control measures. To ensure your measures are working as intended – and are ready for the next rain event - it is important to check your site after a rain event totaling more than ½ inch, and clean-up the mess. As you drive around, look at how other project sites make use of these tips and you will see how these little housekeeping measures really make a difference in how efficient and smooth an operation can be. The goal of the SWPPP is not to complicate your life – it is to inform all construction operators working on your site as to their responsibilities for storm water management. Maintaining erosion control measures and BMPs will save money and time by allowing your crew to focus on construction rather than rectifying permit violations.
