A bumper year for Cromer Carnival
Covering Cromer, Mundesley, the Runtons and surrounding villages in association with the North Walsham Times and Sheringham Independent
This year’s Cromer Carnival has been hailed as one of the most successful for many years with bumper crowds taking part in over 120 events across the three week event which this year celebrated its 45th year. On the opening day of the Carnival over 100 carbooters set up on the Carnival field alongside a Craft Fair, Antiques Valuation and the start of the Mini Beer Festival which saw 15 ales and ciders on tap in the Carnival marquee.
Sunday saw the Crowning of Miss Cromer, Hayley Massingham by Seaside Special favourites Paul Eastwood and Adam Daye in front of a crowded Pier Forecourt. The Carnival Royal Family arrived in three steam powered vintage cars and were entertained, along with the crowds, by The Castaways before a host of comedy from Seaside Special duo.

CROMER IN BLOOM
Cromer in Bloom held their Annual Presentations in the garden at North Lodge Park on Thursday 7th August. Judge Charlotte Phillcox gave a short talk on her experiences judging the competition. She praised all the gardens but said she would like to see more sustainable planting with more emphasis on attracting wildlife also more use of water buts. She very much enjoyed the judging and hoped that more people would enter next year. Cromer Mayor Tony Nash then presented the Certificates, Trophies and Vouchers. A raffle which raised £68.00 together with a Donation of £25.00 in aid of the East Anglian Air Ambulance was received by Jamie Edghill who said a few words on the funding for the Air Ambulance. Other guests included About With Friends who look after a garden on the Norwich Road on behalf of Cromer in Bloom.

I would appreciate hearing from relatives in the Norfolk area, with any information. My Great Grandmother, Jessie Griffiths, began the Australian line of the family. Her father was Raymond Griffiths, born 1822, medical chest cabinetmaker, of London. Please email: coralshaw7@optusnet.com.au

Cromer Times 453 September 6th 2014
What a great summer it’s been – we’ve not stopped since Whitsun and the restaurant is still extremely busy as we move into September.
Our Christmas party menu is out and of course the Grove is a wonderful venue for your seasonal get-togethers; please call us quickly to book as we do fill up rapidly!
Out of all our dishes on the a la carte this year the most popular and best-reviewed is undoubtedly our fabulous Cromer lobster. We get ours directly from John Davies and to keep them as fresh as possible they are on 24-hour order only, but if you are adventurous they are good fun to prepare yourself – and they are great with our own garlic and chilli sauce.
John and Ann Graveling grow our chillis for us in the greenhouse, ranging from mild to, shall we say, intense. One of our kitchen porters was feeling brave and took on a whole red chilli last week and nearly had to dash across to Cromer Hospital for emergency treatment…!
Do come in and see us for the best local seafood and the finest garden produce (including spicy hot chillis!)
Cromer Lobster with Sweet Chilli and Garlic
Chilli sauce 1 red pepper (deseeded) 2 red chilli peppers (deseeded) 100ml white wine vinegar 100g caster sugar 100ml water
Bake in the oven gas mark 5 for 10-15 minutes. Feel free to eat with your fingers!
The Grove 95 Overstrand Road Cromer NR270DJ 01263512412 enquiries@thegrovecromer.co.uk
Place all the ingredients in a pan, bring to the boil and simmer for ten minutes until the liquid turns pinkish.
Cool, then place in a food processor and blend until smooth. Return to the pan and cook for twenty minutes until sticky.
Using a sharp knife, cut the lobster in half lengthways (you may need some force!)
Remove all the brownish-grey interior and discard.
Take the rest of the meat out of the shell, brush inside of the shell with chilli sauce and replace the superb tail meat in the shell.
Crack open the claws and remove the meat; place in the shell too.
Spread garlic butter on the lobster, then coat with chilli sauce.

Members’ and Shareholders’ Day at North Norfolk Railway Full details have been announced for the North Norfolk Railway’s fifth annual Members' and Shareholders’ Day, which will take place on Saturday 4 October. Members' Day is our way of saying thank you to all 3000 members of the M&GN Joint Railway Society and all NNR shareholders, with free travel all day to supporters. A special intensive timetable will be in place for the day, which will see as many Society
engines and items of rolling stock in service as possible. B12 8572 and Class 31 D5631 will be in traffic, as will our Quad-Art Set No.74. Wissington, which will be visiting from the Mid-Suffolk Light Railway, is due to haul the Vintage Set.

1940s Weekend - Enigma and the Secret World of Code Breaking Don’t forget to book your tickets for Saturday 20 September to hear the epic tale of the ENIGMA, one of the most powerful weapons of World War 2, an apparently unbreakable code used to transmit German military intelligence.
Dr James Grime, from Cambridge University, will illuminate the brilliant insights and innovative thinking of Alan Turing, best known for his role in breaking the Enigma, as well as presenting the fascinating history and mathematics of codes and code breaking - from ancient Greece to the present day. The event will also include a wonderful opportunity to see a demonstration with an original World War 2 Enigma Machine.
There are two events at 11am and 2pm at Sheringham High School - suitable for both adults and children. Tickets £5 can be purchased from Maisie’s Baby Boutique in Sheringham or by phoning Paula Popham on 01263 823546. Not to be missed! 8
The focus of the day will be on working to top up the remainder of the Y14:2014 Appeal, which currently stands 30% short of the target. We must raise these funds in order to steam our J15/Y14, on which much work has
already taken place for the most full and comprehensive overhaul the engine has ever received since being built.
The Society shop at Weybourne will be open, as will be the Muddle and Go Nowhere Real Ale Bar Car.
We hope to also offer visitors shed tours of the rapidly expanding Weybourne works, subject to ongoing construction works being in a safe condition.
We encourage visitors to join the M&GN Joint Railway Society on the day, to obtain free travel and to enjoy the benefits of membership, which include quarter-rate fares on normal service days and our quarterly magazine Joint Line.
Remimba the maremba? Or should that be remember the marimba!
By popular demand, Eri Kaishima and Michaela Stapleton (The Cocora Duo) return to St Andrew’s Church on 25 October at 6.30pm. If you missed Eri playing marimba and Michaela on saxophone last November, you have another chance to experience this delight. This concert, arranged by FALCON (Festival of Arts and Literature for Children in Norfolk) in association with St Andrew’s Church is the last one this year so do come along and join us.
St Andrew’s Church provides a welcoming venue, with wine and soft drinks available before the concert and during the interval. No booking is necessary, donations are invited to support FALCON and the St Andrew’s Church fund.

Miramar Carnival Dog Show
Many thanks to everyone that attended our Dog show on 2nd August. We were delighted with the turn out.
The have-a-go agility course proved very popular as did temptation alley with the temptations being just too tasty for most of the participants, while Gismo took a shine to the toys!
Winners included Phoebe for the fastest run down temptation alley and best sausage catcher.
Bracken and Merlin, two lovely labs won best rescues with their life stories. Best veteran was won by the oldest attendant at the show - Rioja.
Best ASBO was awarded to Snoop for running riot in the agility arena and the overall winner went to Gismo who kept us entertained throughout the afternoon with his fantastic personality! He then continued to entertain us with his new toy! Well done Gismo.
Indie won the fastest sit while best six legs was won by Poppy and her owner.
Hope to see you all next year!

Dear Margaret,
Re : Cabbell Park I understand that North Norfolk District Council is still pursuing their takeover of Cabbell Park, Cromer. They are claiming ownership of the land as successors of Cromer Urban District Council. They are reputed to have a legal opinion supporting this. This has not been contested in Court. No one connected with the Park has the money to fund a contest. NNDC may have a right in Local Government legislation but the Town has at least a moral right. The Indenture could read in a different way. Nowhere in the Indenture is there a direct conveyance to councils. Their claim, I feel, is pure legal manipulation ignoring the basic intention. The land is conveyed to the Trustees (see below ‘x’) Extracts from the Indenture are as follows ; 1. Preamble : the Indenture appoints a group of Trustees 2. Preamble : ‘… the settlor desirous of benefitting the Town of Cromer and as a Memorial to those of the inhabitants who died for their Country in the Great War is minded to make such a settlement of the said hereditaments …’ (x) 3. Clause 1 : ‘… grants and conveys unto the Trustees All That piece of land …’ 4. Clause 6 (1) : ‘The Trustees shall in relation to the trust property have all the powers of absolute owners … ‘ 5. Clause 3 : ‘Until the appointed day … permit the Football Club’ There is no time limit to the Trustees ownership of the Park in the Indenture. The time limit (the appointed delay) which is talked about appears in Clause 3 which deals with the benefits of the Football Club. This land as it stands has provided much pleasure and benefit to the Town. 1. It has provided recreation to thousands of young people and pleasure to their supporters. 2. By holding Car Boot sales it has provided income for the Club and Stallholders and provided entertainment etc for thousands of holidaymakers and Townspeople. One of the uses claimed to be necessary for the NNDC taking over the land is to provide land for a new surgery. Is there no alternative to this site? Most definitely THERE IS. There is the old Sutherland House playing field. It is a designated Playing Field on the Town Plan. It has been lying desolate and unused for years and unlikely ever to be used as a playing field again. It has a steep gradient making the field difficult for modern sport yet the NNDC has resolutely maintained its Playing Field status. NB NNDC changed the designation of Cabbell Park, which is and was in full use as a playing field, FROM a playing field. It is clear to me (a layman) that Mrs Bond Cabbell intended that the land be conveyed to Cromer Town with the Trustees overseeing the running of the Park in perpetuity, with the Football Club having a time limited right to use the Park. I feel that NNDC should (1) withdraw and negotiate with the owners of the Sutherland land site to secure their needs – with good will on both sides this should be possible – (2) let the Trustees carry on and (3) the Trustees and the Football Club negotiate the future use of the football field. Putting aside all the claims of the Trustees and the Football Club, why is this land in existence in its present form? It is a WAR MEMORIAL. It may not be a stone edifice (it is more useful than that) and it may not be maintained by a Council (it has not cost the Council anything). Why in this year of all years is NNDC proposing to vandalise a TOWN WAR MEMORIAL? Bob Richards

Dear Margaret,
I would like, through the Cromer Times, to give my extreme thanks and appreciation to Keith Broom, Andreas Yiasimi and Sammi Gray for participating in a sponsored 66 mile coastal walk from Sandringham to Cromer over 3 days (3 - 5 August) and between them raising an amazing £1129 for Halsey House amenity fund.
I would like to thank all the sponsors and the local businesses that have supported us. I have some truly wonderful volunteers and staff helpers who throughout the year plan and help put on events to raise money to give our residents those little extras that enhance their quality of life.
In these hard times when many charities are asking for support the residents and I can’t thank them enough! Thank you and kind Regards, Sally Mills Homes Manager

Mayday call from yacht alerts Cromer RNLI
At 8.47am on Monday 18 August a mayday call was received by Humber Coastguard from a 22 foot yacht. The Cavina was reported to be taking on water, the engine had failed and the sails shredded. Cromer RNLI immediately launched their all-weather boat Lester to give assistance.
Conditions were difficult with the wind gusting at force 7 and expected to increase to gale force later. So conditions were difficult as the position was 28 mile North by East of Cromer. The yacht a Bermudian rigged type had one person on board who needed the expertise of the highly trained RNLI crew to assist him.

A search and rescue helicopter was also alerted and made its way to the yacht and later winched the sailor aboard and transferred him to hospital.
John Davies, Coxswain of Cromer RNLI said ‘Conditions were extremely difficult, but the training that we get from the RNLI means we are always prepared for whatever the sea throws at us!’
Unfortunately the extremely rough seas meant that the all-weather boat Lester was unable to return to Cromer RNLI’s boathouse and had to take temporary refuge along the coast at Lowestoft. In association with www.cromerdeals.co.uk

On Wednesday 13 August a prehistoric elephant again walked along West Runton beach.
This was a replica of the mammoth discovered on West Runton beach in 1990 by Margaret and Harold Hems and was designed and built by plane maker and restorer Jeremy Moore.
Being caught in an emergency can be scary. Whether it’s severe weather, flooding or a power cut it’s good to know what to do to help yourself and those around you.
Every year the Norfolk Resilience Forum runs Norfolk Prepared Week to demonstrate the kinds of simple measures we can all take to make sure we’re ready for emergencies. This year’s theme is to ‘Be Prepared and Stay Safe’.
Norfolk Prepared Week 2014 kicks off at the Forum in Norwich on the 20th September 10am to 4pm with a whole range of interesting events, demonstrations, activities and competitions with some cool prizes.
During the day you’ll be able to pick up top tips on everything from fire safety to First Aid, online safety, flood protection and more. There will also be some live demonstrations including car cutting from the Emergency Services and the launch of our App.
And of course you’ll be able to meet someone who’s always ready for an emergency….Ready Eddy the Emergency Teddy!

The idea to build "Hugh Mungus", as the replica has been named, came from Susie Lay the Event Co-ordinator at Great Yarmouth Time and Tide Museum.

Norfolk-based charity grows Young Ambassador Scheme
Norfolk based Beat, the UK’s leading charity supporting anyone affected by eating disorders or difficulties with food, weight and shape, will be expanding their team of local Young Ambassadors in the coming months.
1.6 million people across the UK are affected by eating disorders and Beat’s Young Ambassador scheme sees young people aged 14-25 use their personal experience of an eating disorder, raising awareness of these serious mental illnesses that claim the lives of one in five of the most seriously affected. Much of the Young Ambassadors role sees them representing Beat at events, holding talks at local schools or community groups, attending professional healthcare training among other activities to reduce stigma and educate others about eating disorders.
Laura, a current Young Ambassador based in Norfolk, said “Becoming a Young Ambassador for Beat is definitely one of the best decisions I have ever made. The position has made me gain confidence and grow as a person. I am now able to do things that I would have never thought possible before. I have been given some truly fantastic opportunities which have enabled me to use my knowledge of an eating disorder in a positive way!”

Next up was the Waiters and Waitresses Race where competitors had to race along a route featuring chicanes with a tray full of four drinks which they first had to open and pour out. With a time limit of three minutes competitors had to be quick and complete the course with as little spillage as possible. This ever-popular event saw roars of
support and laughter from the crowds and competitors alike. After many rounds and the finals the waitress race was won by Sarah Daniels from Sea Marge Hotel and the waiters race by Dean Smith from The Red Lion.
Tuesday saw the Carnival Family Fun Day at the Carnival field with hundreds of visitors enjoying displays in the arena after a drizzly start to the day. Highlights included the Wildcat Aerobatic Display Team, The Joseph Pearce Fire Stunt Show and the Newfoundland Working Dog Display Team as well as numerous events in the marquee and around the arena.
Across the week every evening saw a host of events playing to hundreds of people including Family Night, Wrestling Night, Wine Tasting Evening, Carnival Quiz Evening, Race Night and Carnival Bingo.
Carnival Day proved one of the most popular yet with crowds flocking onto the carnival field to take part in the festivities and watch some of the stunt-defying acts in the arena including the Bolddog lings FMX Tea and Gerard Naprous’ Devil’s Horsemen. The sun-soaked day saw thousands of people turning out to line the carnival field, cliff tops and promenade to see the welcome return of Carnival favourites The Red Arrows in their 50th display season.

Cromer Times 453 September 6th 2014
From 5pm the entrants for the Carnival Parade began gathering on the Carnival field prior to the parade. Over 40 entries formed the parade in a 90 minute procession through the streets of Cromer.
Carnival Chairman Tony Shipp said “It was a very good procession, a high standard of entries and lots of variety, which stretched all the way round town. We had really good support and perfect weather – we couldn’t really ask for more”.
Overall winner was a pirate ship and its crew from Cromer Parish Church. Other entries included Noah’s Ark complete with costumed animals, a sumptuous seaside themed entry by Cromer Hospital Dialysis Unit and a Meerkat Caravan.
OVERSTRAND The Strand Club
Organisers praised the efforts of people taking part in the parade and the high level that the floats and entries had been made to which helped create a real party atmosphere in the town.
On Thursday the day got off to a leisurely start with the Party on the Lawns where families were entertained by Punch and Judy, Razz the Clown and Trix ‘n’ Stix Drum Group.
In the evening the Illuminated Parade, led by the Romford Drum and Trumpet Corps, snaked its way through Cromer up to the Carnival Field to watch the spectacular Grand Firework Display.
marquee to the sounds of Drop The Clutch. The sold out event saw 900 people in the marquee with the usual array of unique, topical and entertaining fancy dress.
Chairman Tony Shipp said “it has been a fabulous week, the sun has shone on the carnival and people have turned out in their thousands to enjoy the carnival and take part in all the events that have been planned by the Carnival team”.
On the last day of what has been a very successful Cromer Carnival, entrants took part in the Children’s Talent Competition which washeld in the Pavilion Theatre on Cromer Pier.
Although there was no meeting for members in August, the committee decided to hold one to bring ourselves up to date on one or two items.
We decided to be casual about it and so met in the White Horse at lunchtime. Present were Jackie, Jean, Josie, Glo, Chris, Viv, Pam, Peggy plus three special guests, the dogs belonging to Glo, Jackie and Viv who behaved perfectly throughout. In fact the rest of us forgot they were there, sitting so nicely under the table.
We were told how well Overstrand Together has done with their various fundraising enterprises, including the cake stall at the Fete which was supported by the Strand Club.
The Strand Club's next meeting will be our annual cream tea held on 10 September in the Methodist Church as usual and at the normal time of 2.30pm. This is a members' only meeting but visitors will be most welcome to try us out on 8 October when James Begley (Overstrand First Responder) will give a talk entitled Message in a Bottle. The entrance fee to visitors is £1.50 which includes tea or coffee, biscuits and a raffle ticket.
Any queries may be aimed at Glo Begley on 576539 or Chris Wood on 579433.

The organisers would like to thank all the Carnival sponsors, supporters, helpers, volunteers and above all, the thousands of people, both locals and visitors alike, who take part in the Carnival and make it the celebration that it is.

There is no denying that patients today are choosing minimally invasive or non-invasive options where possible. In the past there has been a degree of scepticism about benefits of such treatments. How can a beam of light replace a surgeon’s knife? Is this too good to be true? Not any more.
Today non-invasive methods are replacing surgery at a very fast rate. So much so that NICE -The National Institute of Clinical Excellence has updated it’s guidelines on the treatment of varicose veins. It has recommended Endovenous laser treatment as the preferred option, foam injections second and surgery where the first two options are not suitable or declined.
How is EVLT or endovenous laser treatment for varicose veins performed? Endovenous laser therapy involves the insertion of an ultrasound-guided laser fibre directly into the faulty vein. Laser energy heats the vein from within, causing it to shrink, collapse and seal shut. Patients experience minimal discomfort, and they can return to normal activities the same day. Because there are many veins in the leg, the blood that would have flowed through the closed vein simply flows through other healthy veins after the laser therapy. What about thread and spider veins on the legs? Thread and spider veins can be like tips of an iceberg. There can be hidden Varicose Veins that need to be ruled out before undertaking treatments for these veins. This usually means an ultrasound scan. It is irresponsible to start firing a laser at thread veins without first undertaking a thorough clinical and ideally an ultrasound evaluation. It is not a great idea to see a non-doctor with a laser as this is a dangerous tool in the wrong hands. We have seen patients with deep laser burns resulting from inappropriate treatments carried out elsewhere. Usually
microscerotherapy or microinjections into thread veins work well. For tiny veins we have a range of lasers that can be used. It is important to choose a clinic with a range of lasers as one laser is never suitable for everybody.
How do you treat veins on the face? Sclerotherapy is very valuable for treatment of leg veins but laser and IPL treatment is safer and better for facial veins. Facial redness and spider veins are a common cosmetic and medical complaint. These are particularly common in rosacea suffers. Common associations are seen with sun damage, a fair complexion, stress, spicy foods and fluctuations in temperature which exacerbate rosacea symptoms. As with many conditions, genetics plays a role too. Numerous treatments are available but laser and light based treatments are the gold-standard treatment options. We have a comprehensive range of lasers to treat these very successfully. Usually a few sessions are required for best results.
What are venous lakes and can you treat these? Venous lakes a common condition but unfortunately there is a lack of awareness even amongst the health professionals. Venous lakes are dark blue to violet compressible small swelling caused by swelling of venules. These are common on sun-exposed skin. They also commonly occur on lips and are uncommon before 50 years of age. We have patients travelling from all over the country to see us and so far we have managed to clear all of these in just one or two sessions.
What other vein related conditions can you treat? We can treat veins and blemishes such as angiomas, spider naevi, birthmarks and lumps and bumps anywhere on the body. With hand veins and blue veins on the temples it is better to disguise these veins by using fillers or fat injections rather than remove or zap these with the lasers as these may be normal veins which have started to become visible due to loss of volume.

Like father, like daughter? Leon Bunnewell & Ruth Bunnewell
Summer exhibition at The Gallery Norfolk, Cromer 6th-27th September
The Gallery Norfolk in Cromer is spotlighting two Norfolk artists for its second annual summer exhibition: Leon Bunnewell, whose solo show a year ago made him one of the gallery’s most sought-after painters, and his daughter Ruth Bunnewell, also a well-established name, but exhibiting at the gallery for the first time.
together, and a fascinating feature of the show will be six works painted at the special request of The Gallery Norfolk’s owner Polly Miller. Here, Leon and Ruth have both painted the same three subjects, so visitors to the exhibition will be able to compare and contrast the work of the two artists. An example is
The artistic line in the Bunnewell family runs from Leon’s father, Leonard – a keen painter who in the 1960s established an annual exhibition for amateur artists in Great Yarmouth – and both Leon and Ruth excel at landscapes and favour oils as their medium, but the distinctive personalities of father and daughter shine out in their work.
Leon, who is largely self-taught, creates highly-coloured canvases, painted on location in a single session, and often alive with motion, while Ruth, who trained at the Norwich School of Art and Design, takes a more reflective and structured approach, working in the studio from photographs; she captures a specific, remembered moment, combining stillness with dramatic use of strong lines and vibrant pigments.
This will be the first time they have exhibited
daughter, but different in so many ways as painters” says Polly Miller. “Leon paints outdoors, as quickly as possible. Spontaneity is vital to him, and he doesn’t like to think too much about or rationalise what he is doing. Ruth works in a much more measured style, but she too seeks a sense of unconscious spontaneity: as she paints, she will listen to an audio book or a play on Radio 4 so that her mind is occupied with something other than what her brush is doing... There is an air of mystery in her work, a tantalising sense of a moment captured when something has just happened – or is maybe just about to happen. Leon’s work, by contrast, is very much of the moment.
“Each of them admires what the other one does. They obviously take an informed view, but they don’t believe in attempting to exert influence on each other, or to critique each other’s work. But I’m sure that visitors to the exhibition will find plenty to stimulate discussion.”
a tree-lined road near Heydon: rising up to meet the viewer, Leon’s wide-angle view bristles with cool and acid greens, lavender and sky blue, while Ruth’s tighter, more graphic composition counterpoints expanses of lime green with deep, calm greys and arresting streaks of red in the broad Norfolk sky.
“Leon and Ruth are very close as father and
There will be more than 25 paintings on show – including one on view only by Leon’s pace-setting father Leonard – ranging in size from just 30cm square to epically scaled canvases over a metre in length; prices will start at £250, rising to £2000.
Gallery Norfolk also offers an expert in-house framing service with a superb selection of mouldings and mounts.

Advice
Southrepps community to benefit from North Norfolk where parents and carers can meet up and The Big Society Fund award Big Society Fund grant has contributed to Southrepps watch their children play in a safe and fun
Southrepps children and their families can now enjoy new play equipment thanks to a grant from North Norfolk District Council’s (NNDC) Big Society Fund.
Two very popular ‘nest swings’ have been installed - suspended from large timber frames the nest swings provide great swinging fun for lots of children to enjoy all at the same time! The swings were funded by a £5176 grant from NNDC’s Big Society Fund which has awarded grants totalling almost £900,000 to over eight community groups in the last two years for a range of projects that have been making a significant difference to the people of North Norfolk.
Hayes + Storr – All you’ll ever need!
Parish Council’s fantastic fundraising efforts which have enabled them to provide £47,000 worth of play equipment, together with fencing and signage, creating a safe, welcoming and fun environment for the local community to enjoy.
North Norfolk District Council Leader, Tom FitzPatrick, said “I am delighted that North Norfolk District Council has been able to play a part in supporting the tremendous efforts of Southrepps Parish Council in their quest to improve play facilities within their community by awarding a grant from the Big Society Fund.
“Play areas are vital part of a local community

environment, and I hope that with the addition of the new equipment, they will be able to enjoy them for many years to come.”
Southrepps Parish Clerk, Elaine Pugh, said, “This is a monumental achievement for a small parish council. It is through the sheer determination of everyone that has been involved, and the support of those who have funded the £47,000 project, including NNDC’s Big Society Fund, the Edith Murphy Foundation, The Big Lottery – Awards for All, Southrepps Support Scheme and Parish Council funding that our children and their families can enjoy the fantastic new play area.

Financial Advisors: Who to trust? Written by Helen Batten – Solicitor at Hayes + Storr At Hayes + Storr, we are increasingly being contacted by clients for legal advice in relation to loss of confidence in their financial advisors. As in all professions, including the legal sector, there are good and bad people, but what should clients do when they believe the advice given is inadequate, not tailored to their circumstances or just plain wrong?
Complaint to Financial Conduct Authority Firms and individuals can only conduct regulated financial activities in the UK if they are registered or authorised by the Financial Conduct Authority (FCA) to do so. When engaging a financial advisor, always check their status in the FCA register, which can be found on the organisation’s website.
If you have already engaged a financial advisor regulated by the FCA and are unhappy with their conduct or services, then the FCA provides a service resolving disputes. You may wish to engage a solicitor to assist you in bringing your complaint to the attention of the FCA. The first step is to put your complaint in writing to the financial advisor concerned and ask for the matter to be investigated and for a written response. The financial advisor will have a maximum time period of eight weeks to respond. If not response is received or you are unhappy with the response, you can then contact the Financial Ombudsman Service (FOS) for investigate the complaint on your behalf. A complaint to the FOS is a free and independent service that aims to resolve disputes between clients and their financial advisors, but it is not suitable for every case. If you and your solicitor decide to make a complaint, the FOS will consider its content and ask the financial advisor for their version of events before making a decision. However, you should be aware that the parties do not have to accept the

decision made by the FOS. Depending on the circumstances of the complaint, it may be more appropriate to make a civil claim in the County Court to recover your losses. Negligence Claims in the County Court. A claim to the County Court is likely to be made on the basis of a financial advisor negligently advising a client to make an unsuitable investment, which has caused loss. The Court will consider whether the advice given by the financial advisor was negligent based on a strict legal test. The Court will want to ensure that the loss caused to the client was directly attributable to the poor advice given. The Court, with assistance from experts, will then calculate the value of the loss suffered. The aim is to put the client back in the situation they would have been in had the poor advice not been given. The solicitors at Hayes + Storr are available to provide advice on the conduct of financial advisors and where their advice may give rise to either a complaint or a County Court claim. Discussing the matter with our legal professionals often assists in clarifying your concerns and working out a plan of action going forward.
“This article aims to supply general information, but it is not intended to constitute advice. Every effort is made to ensure that the law referred to is correct at the date of publication and to avoid any statement which may mislead. However no duty of care is assumed to any person and no liability is accepted for any omission or inaccuracy. Always seek our specific advice.”
If you require advice on this matter please contact our Litigation Team here at Hayes + Storr on 01692 503081. If you require advice on any other legal matter please telephone or email law@hayes-storr.com.

The Carnival Day Australian Pairs competition organised by Captain Graham was also very successful. He had a ‘call off’ on the morning of the event but a ‘phone call to Richard Airs and the numbers were made up. Richard then proceeded to win the bottle of whisky by getting his bowl closest to the jack in the Spider. Don’t ask what that is!! And then with Bernard Crow went on to be the winners of the competition, so well done to both of them. The gift for the pair that were Best Tryers or the Nearly Boys of the afternoon went to Bob Blogg and Alan McDowell. I did notice an occasional wrong bias that afternoon. It must have been the pressure of not really understanding the rules. In the afternoon after bacon rolls, tea coffee and some alcohol we had the target bowls on the green aimed at holidaymakers walking along the footpath into town from the car park. That proved very successful thanks to Bob Allard encouraging the passers-by. Earlier in the year we had a visit from ‘Straight Bowl’ Charlie McHugh, from Glasgow. Well he turned up again over the Carnival period but his pal Eddie was not with him. It was good to see him in the clubhouse but he will keep telling us the same old stories and even if you can understand what he is saying they are still not too funny! We look forward to his next visit when Neil will be in Benidorm and John will stock up on Martini.
Our friendly games finish on 2nd September, before this edition is available so nothing to put on the list. Our club finals are scheduled for the weekend of 12th – 14th September and morning roll ups are available to anyone who would like to come along and have a try for a small fee at this game of ours. It looks quite easy but in reality it is somewhat more difficult. Thank you for your interest this year as this may be the last report for 2014. The club will be looking forward to Friday night social evenings with a number of quizzes promised and a pie and mash evening at the end of September to look forward to. With a coffee morning and Christmas Party in December we do try and keep the camaraderie and fellowship of the club fairly high. These events are open to all our playing and social members, so don’t forget Yvonne, and although April 2015 may seem a long way away at this moment over the winter months plans for next year will soon be being made by our enthusiastic Management Committee and club members.
