Spitting Image?
Miranda Marshall, Director, Hayes + Storr There is a long held stereotype of judges being old-fashioned. Judge James Pickles became a household name in the 1960s when he asked ‘Who are The Beatles?’ The reality is that the Law Courts are open to scientific developments to help them achieve justice. The Courts have always had to address the question of parentage. It was the stuff of tabloid newspapers in days past. Today, as DNA testing becomes more accessible, the Courts now have to consider how to balance the benefits of DNA testing against the rights of the individual.
Jordan Rogers, a care worker, inherited a large country estate, after proving through DNA testing that he was the son of an aristocrat. That ‘rags to riches’ tale came two years after the exhuming of the body of the Spanish artist Salvador Dali for paternity testing.
The two most frequent uses are to prove or, conversely, to disprove, that someone is biologically related to a person who has died; usually, but not always, because there is an inheritance at stake.
Arguments have been put to the Court, by someone refusing to submit to DNA testing, that it is interference with their human rights. In response the Judge held
that the interference was a proportionate means of protecting the public interest in the accurate resolution of inheritance disputes.
Another case revolved on whether DNA evidence extracted from the deceased for medical purposes could be released to determine parentage. There, not to do so would have led to injustice, and so, the Judge gave permission for the DNA testing. Where there are sound medical reasons, such as the treatment or prevention of inherited disorders or diseases, for the testing of paternity, and a medical sample is readily available following death, the Court can also order testing.
It has also been held that there is no infringement of a third party’s human rights by DNA testing, even if they find out that they have an additional grandchild. The appellant’s rights must be weighed against the respondent’s rights. Here, there is a slant in favour of the respondent, so as to err on the side of preserving the status quo. The Court is able to order directions where there is reluctance to cooperate.
In cases where there is doubt as to parentage, the only way that an executor of an estate can be certain that they are distributing the estate of a deceased
person accurately, is to ascertain all the beneficiaries.
The improved ability to determine parentage through genetic testing is impacting on the law. A paternity test is generally cheap and painless and can be done using a hair or saliva sample; no blood or needles required! It is much cheaper than the production of witness statements and other evidence. Its great advantage is that it is both definitive and can help parties reach a settlement at an early stage.

Graham Allen Award Winners 2019 New Visitor Centre on Iconic North Norfolk Estate Wins Annual Design Award The Lookout, on Holkham Estate, has been presented with North Norfolk District Council’s Graham Allen Award, an esteemed award given each year to the project considered to have made the most significant contribution to the built environment within the district.
The new visitor centre forms a striking circular arrival to the Holkham National Nature Reserve. The building comprises of a small cafĂŠ, orientation exhibition and conveniences for visitors through its distinctive timber cladded finishes and open, inviting layout. With the
nature reserve attracting approximately 800,000 visitors per year, this stunning new gateway promises to offer a unique visitor experience for years to come. James Bracey, General Manager at Holkham Estate, said “We feel extremely honoured to be recognised for this award.

The award has been running for the last 38 years to celebrate the best practice in design and conservation in North Norfolk. The results of the awards were announced yesterday, November 7, at a ceremony at North Norfolk District Council’s offices in Cromer. Phillip Rowson, North Norfolk District Council’s Head of Planning, said “The Lookout is a fantastic new focal point for visitors exploring the nature reserve and will encourage understanding of its sensitive habitats and wildlife. The centre offers incredible views of the surrounding landscape and it’s the relationship with its setting which makes it so special. The quality of this year’s entries and subsequent shortlist for judging was exceptionally high, so this year’s winners can be incredibly proud of their achievement.�
The Lookout was not the only winner on the day. The prize for Highly Commended went to The Shambles CafĂŠ. The project saw the repair and conversion of a derelict Grade II Listed building in the heart of North Walsham. The building, which dates back to the 16th Century, is one of the oldest in the town and had fallen into a serious state of disrepair. The historic building has now been lovingly restored and is a popular local enterprise which has transformed the vitality of the area. Fakenham also enjoyed the spotlight when The Mews on Barons Hall Lane won the Commended prize. The project saw the creation of 10 high quality new homes formed in a contemporary terrace.
The People’s Choice Award, voted for members of the public at North Norfolk District Council’s Greenbuild event, went to the refurbishment of Little Regents Hall in Sheringham. The historic community hall has been cleverly restored into a Bed and Breakfast.

In the Advanced section there were more than 30 entries – images that ranged from Natural History to Landscapes and everything in between!
Judged the winner was Paul Richards with ‘Barn Owl – Snow Delays Hunting’. This subtle image of a snow-storm showing a barn owl just about making its way through the downpour! Second was Lizzie Wallis with ‘Brown Hare after the Blizzard’ – snow again, this time a hare in the snow with fur matted with snow. Third – Nick Akers’ ‘Dirty Work’ which was a portrait of a bearded man standing in front of a steam engine.

The 2019-2020 Club season continued on 6 November when North Norfolk Photographic Society held their first competition for printed pictures with judge Andy Swain.
There were the usual two sections – one for novice photographers and the other for the more advanced. There were nine entries in the Novice section which was won by Lauren Griffiths, whose picture ‘Chillin’ showed a seal chilling out and looking totally relaxed!
Second was Cheryl Howell’s ‘Window of Light’ – a dazzling stained glass window and third Lauren Griffiths (again) with ‘Neko Harbour – Antarctica’.

Northrepps 'Poppyland' Branch of Royal British Legion
Destination was Northrepps Village Hall on 2 November, when Branch members from North Walsham, Southrepps, Wymondham, Dereham, King's Lynn, Middleton, Cromer Womens' Section, and ex Servicemen from Cromer travelled to join our Branch members and guests to celebrate the formation of our Branch some 70 years ago.
We were also joined by Brigadier Max Marriner and Councillor John Toye from North Norfolk District Council. Descendents of founder members, poppy sellers, our Poppy co-ordinator and community organisations which we work with were amongst our guests.
A very moving Thanksgiving for our Branch was given by Miss Janet Payne. We were honoured to receive messages of congratulations from Her Majesty the Queen who is our Patron, our Norfolk County Patron General, Lord Dannatt and his wife, who is Lord
Lieutenent of Norfolk, congratulating us on all the support we have given to our Ex Servicemen and Women over the seven decades and wishing us every success for the future. Our National Chairman Una Cleminson also congratulated us, and will be visiting our Branch in the New Year. This was, indeed, a milestone within our Branch, with memories of the past captured in photographs on show, and music right across the seven decades.
A special 'thank you' to Catherine Smith for presenting us with two celebration cakes.
We would like to thank everyone who helped us make this a great success and as we are now fast approaching Remembrance Time, there could be no greater tribute to each life lost in conflict from the Great War to the present day, than to have a 21st century Branch of the Royal British Legion, carrying forward the support which is needed for all ex Service personnel and their families, remembering that they

gave us our freedom to do this, and it is an honour in their memory.
On Friday 8 November we were honoured and delighted to join the pupils, staff and parents of Northrepps Primary School at their Remembrance, with our Standard Bearer and Mr Ted Briggs who played The Last Post. We were honoured to join with our village and members from our neighbouring communities on Sunday for our Service of Remembrance. A very full Programme for 2020 will see us very involved within our community, with one very big event on 27 June 2020, Armed Forces Day very appropriately right here in Poppyland.

Happisburgh Lifeboat Station Barrington Farm is a unique independent day services centre for adults with learning difficulties, based at Walcott, which has come to the aid of Happisburgh RNLI volunteers by raising £440.05 for the station to save lives at sea. Amanda Colman has been running a drama group at Barrington Farm for about two years. Amanda said ‘we became interested in the history of the coastal area around Walcott and the idea of making a show about smugglers, lifeboat crews and the beauty and joy of our Norfolk Coast was created. The cast were particularly interested in learning about lifeboat crews and their daring rescues.

Creating our recent show Beside the Sea has given the cast a voice; we were busy in the art barn leading up to the production making the set and costumes plus rehearsing two days per week. The performers were inspired to be raising money for the RNLI and are quite rightly very, very proud of their achievement.
We naturally suffered from an after show slump (which is very common!) before deciding to cobble together another show in time for Christmas which we are presently working on - it’s called A Partridge on a Settee and will be on 18 December’.
Volunteers from Happisburgh went along to meet the cast and hear their stories, the cast then presented a cheque to the RNLI.
We believe that theatre should be free and accessible to all and decided that we would “pass the hat” around at the end of the show and donate the proceeds to the RNLI. The show was a success and

Worstead Festival Grants Money to Educate Build and Save
Worstead Festival trustees have distributed £10k to benefit seven groups.
The children at the Worstead CoE Primary School will now have shelter so that play can flow inside and out, even in bad weather. Head Teacher, Nick Read said “That’s brilliant news. This will make a huge difference to the children here at Worstead School.”
It’s higher tech for the younger kids at the Worstead Pre School. Three laptops will be paid for so that observations can be recorded. It’s a curriculum requirement. The box pews at St Mary’s Church, Worstead CoE Primary School Worstead, can now be lowered to improve sight-lines. The vicar, Paul Cubitt, says the work should be finished by the end of May. Plans will also be drawn up for kitchen and toilet facilities. The Cromer and District Food Bank will have banners made. Project Manager, Tim Morton said “We rely on grants to enable us to meet operational costs, but it is also vital to raise our profile and these banners will help.”

Training for the trainers can now be paid for by the Sea Palling Independent Lifeboat. Three courses are required by the Royal Yacht Association. Once the volunteer passes these tests they can give training to up to 30 others.

Cromer and Sheringham Brass Band
dangerous in the wrong hands, you certainly wouldn’t want to stand too close to an excited energetic trombonist playing a prestissimo (very fast) piece of music.
Don t worry, they re not as tough as they would like you to think. They might give the impression they are mobsters from the 1920s Chicago Mafiosi but really they are just pussy cats. And while you might think the case contains a Thompson Submachine gun well, it holds nothing more than another trombone and some slide oil.
However although trombones aren’t
There was a time when, in marching bands, trombones would be in the second row, behind the cornets or trumpets. Until, in the 1920 s a horse, frightened probably by a discordant band, bolted across the path of the cornets causing them to stop suddenly. Alas the trombones lacked the same sense of urgency. The injuries at the scene were horrific and the band had to fork out for three new trombones.
To avoid such disasters today, trombone players are positioned at the front of the band where they can
do no harm, and with adequate seating space in brass and wind bands. In large orchestras you will see, if you watch the Proms, that the bones are sometimes segregated, almost off-stage, to avoid concern to other musicians and to cause as little worry to the conductor as possible.
Cromer and Sheringham Brass Band may be seen and heard playing festive music during December including at Upper Sheringham Church on Sunday 8th at 3pm, St Peters Church, Sheringham on Saturday 14th at 7.30 pm, at Aldborough Community Centre on Sunday 15th at 11am and at Felbrigg Hall Courtyard on Sunday 22nd at 3pm. MUNDESLEY’S PAGEANT RETURNS The “Brilliant and Wonderful” Christmas Pageant comes back to Mundesley this year on Saturday 22 December at 4.45pm.
The story of the first Christmas will be told through the streets of the village with the action starting at the Bowls Club Car Park and ending with Mary and her new baby inside the Coronation Hall.
The Mundesley Pageant is a tradition that was started back 2010 when Jo Berry first put the idea together. After being rested for a while, this free event has returned in the hands of Director Bev Reynolds and the Entertainments Committee of Mundesley Parish Council. Georgia Pearce as Mary
The costumed actors and choir will be parading through the village inviting you to sing along with the carols and watch as the story unfolds.
Actors Georgia Pearce and Ole Francis play this year’s Mary and Joseph. The Angel Gabriel is Di Reeves and Paul Reynolds becomes the Roman Centurion. Gerry Robins is
the slightly evil King Herod who it’s best not to upset as he can turn rather nasty if crossed. The new script is by Nigel Holmes who is renowned for writing pantomimes that are performed all over the world, so expect the unexpected and occasional twist.
Local children are involved as the usual nativity animals and traditional characters so watch out for any small sheep drifting from the fold.
The Pageant will wend its way from the Bowls Club down the High Street to the village Christmas tree, then continuing via the entrance to Gold Park and onward up Beach Road to the Coronation Hall.
Everyone is invited into the hall to watch the final scene where traditional refreshments will be available.

Norfolk families to be wowed by ‘wildly imaginative’ festive show
A ‘wildly imaginative’ play is set to wow families this Christmas. Much loved Norfolk-based fEAST Theatre in partnership with Wells Maltings will be bringing their very special show to the recently refurbished Wells theatre this Christmas. Not another panto, and more than just a musical, ‘Twas the Night Before Christmas’ promises something new in festive entertainment.
This play will provide gasps and laughs aplenty for audiences of all ages, but will also leave its showdown ending in the hands of its audience. The play begins in a prison for story-book villains. One of the inmates, the notorious baddie Elderberry Yacht, is serving time for trying to destroy Christmas twenty years earlier. Now, as the festive season approaches once again, he’s demanding to be released. He will make his case to Emily who, as a plucky child, saved Christmas all those years ago and, in the process, helped get Elderberry banged up. Emily and Elderberry will together tell the hilarious story of that
extraordinary Christmas crime and at the end of the show the audience will decide if our villain should be released.
‘Twas the Night Before Christmas’ is a fast-moving story full of absurd jokes, memorable songs and host of colourful characters all played by the talented (and incredibly adaptable) Amy Lunn and Marcus Churchill. Previously a smash hit for Hull Truck, Nick Lane’s action-packed play has been adapted by the author for its Norfolk setting and given a new score by its original composer Tristan Parkes.
fEAST Theatre were last at Wells Maltings with their sell-out show Into Thin Air. Artistic director Dawn Finnerty says of this new production, “We promise it will be a Christmas show with a difference – short, punchy and peppered with humour for all ages. We very much hope that regulars and newcomers to fEAST shows will come along and bring their children or grandchildren with them.”

Aylsham Chess Club is starting a local chess group for people who are interested in playing chess in a relaxed, not overlycompetitive, environment. The group will meet in Aylsham Library on the last Wednesday of every month (starting Wednesday 29 January 2020), from 9.30am to 12.30pm. All players will need an active library card with Open Library Access to use the library outside of staffed hours. Thirty-eight chess players took part in the two-day County Chess Championships held in Horstead Tithe Barn. The overall winners were Phil Bonafont (Norwich Dons) in the Championship Section (with a score of 4 out of 5) and John N Bradley (Dunmow Chess Club) in the Challengers Section (also with a score of 4 out of 5). Phil Bonafont becomes County Champion for 2019-20. Chris Tuffin (Aylsham Chess Club) ended the tournament in joint second place in the Challengers Section (with a score of 3.5 out of 5). Chris also won a prize for being the best performing player with a grade of Under 150.

North Norfolk Vikings were in action last month at the November meet held at the UEA Sports Park in Norwich.
The Vikings had a small team of 3 boys and 7 girls and over the weekend competed in 69 individual events from which the team came away with 46 personal best times and one gold, 10 silver and six bronze medals.

Little Lucky was found on 9 November wandering down Hall Lane in North Walsham in the middle of the day. She could so easily have been run over. At 170grms she was very cold and had to be gently warmed before being offered food. She was very poorly but is doing ok at the moment. With so many coming into care, I now have 66 in total. These hungry hogs eat their way through six tins of cat food a night - that's without the dishes of dry food mix! There will be a fund raising Christmas Prize Bingo on Saturday 7 December in St Benet’s Hall North Walsham, 6.45pm for 7.15pm start. It's usually a fun evening so do come along and join us!
FLYING HIGH AT THE BRISTON ORGAN SHOW!
Music lovers always flock to the series of Briston Organ Shows during the year, when top artists play the best live music on the latest digital instruments. However, for one meeting each year, the show takes on a different format, as the lovely people who help at the shows take to the stage and put on a super evening of home-grown music and laughter entertainment for a worthy cause - and the one they support is the amazing ORBIS Flying Eye Hospital. Over the last few years the group and their lovely audiences have raised several thousand pounds for this great cause, and a few days after this coming Christmas they are about to do it all again!

Mince pie ice-cream As another year draws to a close it’s the perfect time for a little note to say thank you to everyone who’s continued to support us throughout 2019. It’s been a very busy and successful period and we are very grateful to the happy customers we have had through the door. We wanted to leave you with a festive special and what could be better than this absolutely wonderful and ingenious way to finish any Christmas meal. See you in 2020! Ingredients 250 millilitres double cream 750 millilitres single cream 8 egg yolks 200 grams caster sugar teaspoon salt 2 large mince pies, blended so pastry is a coarse crumb
Method Pour the double cream and single cream into a heavy saucepan, place over medium-low heat and heat until barely simmering, stirring frequently. Turn the heat down to low. Whisk together the egg yolks, sugar and salt in a large bowl until thoroughly combined. Slowly pour about 125ml hot cream mixture into the egg yolk mixture, whisking constantly. Repeat three times more, whisking thoroughly before adding each additional 125ml hot cream to the egg yolk mixture. Pour the egg yolk mixture back into the saucepan with the remaining hot cream and whisk constantly over medium-low heat until the mixture thickens and will coat the back of a spoon, 5 to 8 minutes.
Do not let mixture boil. Pour into a bowl and allow to cool for about 20 minutes; place in refrigerator and chill overnight. The next day add the mince pie crumb , pour into an ice cream maker and freeze according to the manufacturer's directions. Remove the ice cream, pack into a covered container and freeze for 2 hours or overnight before serving.
Financial Settlement on Divorce - what rights do I have?
Whilst obtaining a divorce is often straightforward, agreeing what is going to happen to the family finances is usually more complicated. Although the divorce and finances are technically two separate sets of proceedings, they are usually looked at alongside one another. By the nature of being married, spouses have financial claims against one another until they are formally dismissed by the Court. It is important for parties to understand their rights and entitlements in advance as it can help in managing expectations and often speed up the process. It is hoped that at this stage, former spouses can really begin to think about the future, putting any conflict behind them.
When looking at the finances, the first step is to ascertain what is in the family pot. This will include matrimonial assets. These are assets that were built up during the period of the marriage. These could include, but are not limited to, the family home, other properties, pensions, savings, investments, business assets and vehicles. Sometimes there are also nonmatrimonial assets. These are financial assets which were acquired before or after the relationship, inheritances and gifts. There is scope for non-matrimonial assets to be treated differently, and potentially excluded, but it will depend on the individual circumstances of the case and often the party’s needs.
There is no hard and fast rule for calculating the financial settlement. Each case is judged on its own merits. The law focuses on achieving a fair outcome which can be very different from one family to the next, and whilst the starting point is 50/50, this doesn’t necessarily mean half and half. There will often be a range of different ways
in which the assets can be divided and the advantages and disadvantages of those will need to be explored. It is also important for you to consider what your preferred option would be and the practicalities of that.
The Court’s first consideration is any minor children. The Court will want details about where and whom any children will be living so that this can be taken into account when looking at the type of housing required to meet their needs. The length of the marriage is also a key consideration. If the parties lived together prior to the marriage then this can be taken into account provided that it “flows seamlessly into marriage”. Age is also a factor along with income and earning capacity. For example, if one party is better equipped to “regenerate” their finances or meet their needs from their income then there may be an argument to say that they should receive less. The Court will also consider contributions made by the parties to the marriage. There is often a misconception that this simply relates to financial contributions. It is wider than that. It takes into account contributions to the family as a whole. For example, caring for children is clearly a vital and equal contribution.
One asset that often causes confusion is pensions and how they should be dealt with on a divorce. A survey recently carried out by Shoosmiths found that a third of married couples do not know about pension sharing on divorce. This is a worrying statistic, particular for women who separate after taking a career break to start a family, as this can have a huge impact when it comes to long term financial security. The research shows that on the whole, pensions are often overlooked with the

focus being on physical assets.
When it comes to pensions on divorce there are different options but the most common are pension sharing and pension offsetting. Pension sharing is where one party’s pension is split and a percentage transferred to the other spouse to “top up” their pot, usually either to equalise pension values or income upon retirement. Pension offsetting is the idea that cash is received now instead of a pension share. Pensions can be complex assets and it is important that you seek specialist advice. However, the take away point is that former spouses may be entitled to a proportion of their spouse’s pension if they split up.
It is hoped that former spouses are able to come to an agreement about how the family finances are split, whether that is achieved by them discussing it directly, going to mediation or having negotiations through solicitors. However, if former spouses cannot agree then they can ask the Court to make a decision, although this should be viewed as the last resort.
