The City is making a concerted effort to provide practical solutions that will better serve the transitory lodging community and residents alike.

appreciate our community’s desire to become engaged in solving safety issues, protecting property values and preserving the quality of life of San Clemente specifically with regard to the rising number of group homes that have altered the character of some neighborhoods. Though most group homes comply with City ordinances, there are some that do not. Further, it is important to remember that the individuals who utilize the resources in the various types of group homes, are considered a protected class under state and federal anti-discrimination laws. Due to issues associated with the “bad actor” group homes, the City Council adopted an Urgency Ordinance on July 7, 2015, imposing a temporary moratorium on permitting or establishment in residential zones of (1) sober living homes and (2) large alcoholism or drug abuse recovery or treatment facilities, subject to reasonable accommodation, to allow time for consideration of appropriate amendments to the City’s Municipal Code. The Residential Moratorium was initiated because the City’s Municipal Code did not appropriately regulate the external impacts of sober-living homes and unlicensed and large licensed recovery or treatment facilities in residential zones. The Municipal Code did not expressly identify or allow these uses. Rather, the Code only specified residential uses in general terms, seemingly permitting a wide range of uses to occupy residentially-zoned properties without the type of zoning review that would be typical of similar uses that the Code does specifically address. Upon further investigation, the City realized that the most troubling external impacts that sometimes accompany these uses are characteristic of a broader category of uses that the City was also trying to better regulate and integrate into the City, namely, transitory-lodging uses, which had begun to proliferate throughout residential neighborhoods in the City with the advent of web services such as AirBnB.com and VRBO.com and which had become a source of escalating nuisance complaints. The City therefore drafted amendments to the Municipal Code to ensure that these transitory-lodging uses (including traditional vacation rentals, boarding houses, sober-living homes, and large or unlicensed residential treatment facilities) are compatible with the character and purpose and intent of the City’s residential zoning districts. On February 16, 2016, the City Council adopted Ordinance No. 1617, which amended the Municipal Code to establish new regulations related to shortterm lodgings, general noise standards and enforcement, and loud and unruly gatherings, as well as establish a repeat nuisance service-call fee. The following month, on April 6, 2016, the Planning Commission adopted Resolution No. PC 16-007, recommending that the City Council approve a zoning amendment and specific-plan amendment to regulate transitory-lodging uses. On May 3, 2016, the City Council reviewed and adopted the Planning Commission recommended amendments as Ordinance Nos. 1622, 1623, and 1624.

New Organics Waste Collection Program

Organics = Green Waste & Food Waste The City of San Clemente in partnership with CR&R have implemented a new program in order to meet State mandates regarding diversion of organics from landfills. Californians overall throw away more than 5 million tons of organics each year. San Clemente residents and businesses collectively have done well to exceed State diversion requirements, however our community will not be able to meet new State requirements unless more is done to divert and recycle green waste and food waste (i.e. organics). Residents and businesses now have the ability to recycle organics. For Residents, in addition to placing green waste into the existing green waste carts, food waste can now also be placed in the green cart and no new cart is needed. Residents that don’t have a green cart can request one for a nominal increase to their solid waste monthly rate. The food and green waste will be picked up on the normal collection day and then sent to a recycling facility and turned into compost, fertilizer and natural gas used to fuel the collection vehicles. Commercial customers can participate in organics recycling by requesting a change to their service to include an organics bin or cart. Reminder that State law requires businesses that generate eight cubic yards or more of organic waste per week, to recycle their organics. In the near future even more businesses will be required to recycle organics. Also, multi-family residential dwellings of five or more unit are required to participate in an organic waste recycling program. To request an organics recycling bin or cart, please contact CR&R at (877) 728.0446. How the Program Works • Black Trash Cart No change, except place organic waste in the green cart • Brown or Blue Recycle Cart No change • Green Waste Cart Your current green cart can now be used to discard all organic materials including yard waste and food waste. From the yard: • Grass clippings, leaves, weeds, flowers, and other yard waste are accepted organics. NO palm fronds. From the kitchen: • Fruit, bread, fish, meat, vegetables, dairy, bones and FOG (fats, oil, and grease) are accepted organics. • Compostable bags are optional, 100% recyclable and available at local retailers. Other types of plastic bags are not accepted. You may also line your cart with newspaper or paper bags. On May 2, 2016 Kora was found by one of our Animal Control Officers after receiving multiple reports from residents of a very thin, sickly coyote seen roaming the area. When the Animal Control Officer arrived on the scene, she observed a cowering, frightened but very sweet female German Shepherd that was too weak to stand. Her emaciated frame, and patchy gray coat was mistaken as a coyote in the dark of night. She was immediately taken to a Vet so that they could assess the damage done by inexcusable neglect. She is fighting chronic flea infestation and skin infections which has led to hair loss; lack of an adequate diet which has left her approximately 25-30 pounds underweight; and general muscle loss due to the extent of her poor care. Her recovery will be slow, but no doubt steady, as she has already shown a great recovery in her personality and a ravenous appetite here at the shelter. She is recuperating at the San Clemente-Dana Point Animal Shelter and hopefully will find her forever home very soon! City moves to a Level 2 Water Alert We thank you, our customers, for doing a tremendous job saving water in response to California’s historic drought. While our agency no longer has a specific statemandated conservation standard, we urge everyone to continue using water efficiently. It’s a way a life in California. A Level 2 Water Alert actively promotes 10-20% water conservation. What does the Level 2 mean for you? • Three (3) days of irrigation per week, permitted through November 30. • Leak must be repaired in 24 hours. • Irrigation is not allowed between 9 a.m. and 6 p.m. The following restrictions are being lifted: • Removal of excess water use penalties. • Removal of the prohibition on planting new material and establishing turf. • Prohibition on charity car washes. • Hosing or washing down structures. Now is a Great Time to be Outdoors and Plant Right!

New railroad crossing system brings enhanced safety and train horn relief

Saving water doesn’t have to involve the cost and inconvenience of tearing up your yard to install a new irrigation system. It’s easy to save water and reduce your utility bills with simple changes to your landscaping and gardening routine: • Landscape to suit your lot. Choose grass or plants that have low water requirements and will thrive in your local climate. Consider your lot’s exact features, including sun and shade, dry and damp areas, plant size, and how you plan to use each section of your yard. • Keep soil healthy. Aerating your lawn and around trees at least once a year helps improve water penetration. When planting, turn and cultivate the soil and add compost or fertilizer to improve moisture retention and grow healthier plants that need less water to stay strong. • Mulch well around plants, bushes and trees. Using 2 to 4 inches of mulch reduces evaporation, moderates spikes and lows in soil temperatures, improves water penetration and helps control weeds that compete for water. • “Hydro-zone” your yard. Grouping plants with similar moisture needs in the same area makes it easier to make sure they get the water they need without overwatering. Separate plants from grassy areas, which have different water requirements. • Plant in spring or fall. Avoid summer, when hotter temperatures mean plants need more water to become established. • Save grass for functional areas. Plant grass in play zones and other areas where it will be used and enjoyed. Instead of planting turf on sleep slopes or other hard-to-water spaces, consider ground cover, perimeter plants or mulch. • Plant shade trees. The shade they cast creates natural “airconditioning,” lowering air and soil temperatures and reducing soil moisture loss. • Maintain your yard regularly. A well-maintained yard requires less water, so weed, prune and mow as needed.

The requirement for train engineers to routinely sound the train horns throughout San Clemente officially ended at midnight on June 24th, resulting in a quieter experience for residents and visitors to the beach. Construction of safety improvements at all train crossings in Orange County took place three years ago, which included the 9 crossings in San Clemente. The Audible Warning System (AWS) was a significant part of the crossing safety upgrades, which after appealing to the Federal Railroad Administration for a waiver, can be used at the pedestrian crossings along the coastal trail in San Clemente. An AWS is a system that warns pedestrians and bicyclists of trains approaching railroad crossings installed for pedestrian and bicycle use. The warning sound comes from a stationary horn installed at the crossing rather than from a horn on the train’s locomotive. The horn is activated in conjunction with railroad crossing warning system. Metrolink encourages everyone who interacts with our trains and tracks to do so safely. Rules to keep you safe: • It is important that pedestrians remain on the trail at all times. Pedestrians are prohibited from trespassing into the rail corridor. • Never walk or play along the tracks. It is illegal and could result in serious injury or death. • Use approved (and safe!) crossing points. Cross safely! Look both ways and listen before crossing train tracks. • Don’t be distracted. Refrain from using your cell phone. Phone calls, music and texting can be deadly distractions near crossings. • Always wait until the crossing lights and bells are no longer active before crossing the tracks.

Prevent Drowning: Never Swim Alone While drowning is the number one cause of accidental death in children under the age of five, adults comprise nearly 60% of fatal drowning related incidents. Seniors 65 years and older are the most at risk age group for drowning incidents and have the highest drowning incident death rate. Drowning is 100% preventable, and yet there were 118 total drowning incidents in Orange County in 2015. Drowning prevention and water safety need to be practiced year round! The Orange County Fire Authority offers free drowning prevention and water safety programs to San Clemente residents. By participating in these programs and learning water safety tips, together, we can reduce needless drowning tragedies. Continued from page 2 → external impacts that sometimes accompany these recovery-related uses in residential zones are not unique to recovery-related uses but are common to transitory-lodging uses generally, so the City decided to focus on transitorylodging uses as a whole, an effort that was already underway, and identify areas appropriate for transitory-lodging uses so that they are located near complementary uses, such as higher-density housing, public-transportation facilities, and commercial amenities. These code amendments include: • Creating a new “boarding house” use category, which encompasses any residential use that involves a dwelling unit with two or more short-term (29 or fewer days) rentals or four or more long-term rentals. Boarding houses are conditionally permitted in the Residential High, Residential Medium, and Mixed-Use 5 zones. Additionally, “boarding house” uses (e.g., some group homes, hostels, fraternity houses) are generally more similar to higher-density residential uses due to the multiple, individual rental contracts that speak to the independent nature of the residents. These uses also typically cater to populations that need public transportation and convenient commercial facilities, and by allowing boarding houses only in these zones, the guests’ and the public’s health, safety and welfare are protected. • Renaming the previously established “STLU permit” in the transientoccupancy-tax part of the Municipal Code as an “STLU operating license.” • Creating a new “short-term lodging unit” or “STLU” zoning definition, which describes the short-term rental of a dwelling unit under one lease or rental agreement. The amendments establish regulations to improve STLU compatibility with neighborhoods that were developed for longterm residents. • Providing increased enforcement capabilities of the City’s Noise Ordinance in Title 8, Health and Safety. • Clarifying the definition of “loud or unruly gathering.” • Creating a repeat nuisance service-call fee in Title 9, Public Peace, Morals, and Welfare. These code amendments adequately address the nuisance issues originally identified in the Residential Moratorium. With this work complete, the City no longer has the need for the moratorium and the moratorium has now been lifted. Moving forward it is important for our citizens to be diligent in reporting issues that arise from these residential uses. When violations are observed, reporting them in a timely manner is essential for staff to identify the violation. Once a violation has been verified steps are taken to notify the owner and obtain compliance. If properties become repeat violators citations can be issued and further steps can be taken to revoke their permitted use. Instructor Spotlight Karen Lucy's School of Dance Congratulations to Miss Karen on her 35 years of teaching and service with the City of San Clemente! Karen Lucy is no stranger to the dance studio. Since 1981 Karen has been a staple in the City's Recreation dance program. Over the years Karen has taught thousands of young dance stars and watched generations of families walk through the studio. From a young age Karen danced her way into the hearts of those around her. Growing up in Long Island, New York, she attended the Margaret Pearsall School of Dance and the Luigi Jazz School. In high school Karen was captain of the Dance Team, a Pom Pom Girl, and choreographer of school plays. Following high school she was a dancer at the Martha Graham Modern Dance School, New York Academy of Ballet, and instructor at the Norma

School of Dance. Her love and passion for dancing has held a lasting impact on the San Clemente community. She instills confidence, grace, and poise in her students by creating a safe environment that allows each young dancer to feel welcome and secure. It is through Karen's unique ability to connect to every child and grow with each family that has allowed her to find success year after year. Each June Karen Lucy hosts two sold out performances for Karen Lucy’s School of Dance Spring Recital held at the Community Center. At these shows you will see a stage filled with dancers ages 5-20 years in beautiful costumes and glowing smiles. Today, Karen offers dance opportunities ranging from parent and me to jazz, tap, and ballet. Lifeguard Corner EMPLOYEE SPOTLIGHT & OCEAN SAFETY TIPS When swimming during the fall, the primary thing to remember is that although the water can still be very warm and the weather is very nice; lifeguard staffing is at a minimum with the majority of part time lifeguards back in school. Therefore, it’s imperative that you take extra precautions to watch out for yourself and others. Prior to coming to the beach, please take time to check conditions. For beach weather and surf conditions, call (949) 492-1011 or visit our web site for conditions at san-clemente.org/sc/inf/Weather/ Beach/BeachReport.aspx When you get to the beach, try to find a location with a lifeguard on duty. In San Clemente this means near either side of the pier, since the pier tower is open every o help ensure that you have a safe day at the beach, Rod would like to offer the day, year-round. Next, please always swim with a partner – someone who can watch following ocean safety tips. These fall ocean safety tips are brought to you by Marine Safety Lieutenant Rod Mellott. Rod began his lifeguarding career at the age of 20 and has proudly served San Clemente for 27 seasons at our local beaches. As the Lieutenant, he is primarily responsible for overseeing the day-to-day lifeguard operations, recruitment and training of staff. He also oversees the Prevention/Education Program, including Junior Lifeguard and the School Outreach Program.

You can identify a rip because the water becomes choppy, brown, and a murky color. If you are caught in a rip current, don’t fight it by trying to swim directly to shore. Instead, swim parallel to shore until you feel the current relax, and then try swimming to shore. Whatever you do, don’t panic and don’t fight the current. These are just a few tips to help make sure you and your family stay safe. ADULT PROGRAMS Aqua Physical Therapy This is a beneficial form of therapy that is useful for a variety of medical conditions. Aquatic therapy uses the physical properties of water to assist in patient healing and exercise performance. While submerged in water, buoyancy assists in supporting the weight of the patient. This aspect of aquatic therapy is especially useful for patients with arthritis, healing fractured bones and other disabilities or for special needs participants. SC Open Skate Contest

Carnival Colossal

September 10, 8:00am-3:00pm at Ralph’s Skate Court

October 6-9 at Vista Hermosa Sports Park

Skateboarders of all ages will have the opportunity to grind their way to the top of the competition showcasing their best run and tricks. Participants will receive an event shirt and goodie bag with the registration fee. Skaters must wear pads. Skateboard & Action Sports vendors are invited to participate, please contact the Foundation for details. Register at san-clemente.org/recreation
