XPERIENCE SCWA 2024 – concluded this month sending attendees into 2024 on an exciting and enthusiastic high! The gathering of successful car wash operators and suppliers from around the country is always a thrilling experience. From the popular SCWA EXPO to premier education to nationally recognized speakers, it was three days of quality networking; ideas; solutions and strong energy.
I hope you were able to join us to EXPERIENCE SCWA 2024 - and take advantage of the new ideas, solutions and strategies plus see the innovations in the car wash industry.
We have received so many wonderful emails including words like: “awesome show”; “journey to the spectacular”; “WOW - so much positive energy”. The SCWA Board believes that coming together and uniting our efforts and ideas as a community will help all of us continue to grow and build successful car wash businesses.

• Our convention concluded with an outstanding panel discussion – “Operational Excellence – Best Practices for 2024” with Carl Howard, Gary Dennis and Bill Martin. The session was moderated by Rich DiPaolo, Professional Car Washing & Detailing Magazine.

DOL FINALIZES CONTROVERSIAL NEW INDEPENDENT CONTRACTOR RULE
If you have multiple checking or savings accounts, consider consolidating to one of each, preferably at the same bank-more accounts mean higher odds of overdrafts. Especially troublesome are accounts with automated withdrawals or payments-easily overdrawn if no one is paying close attention. If there are lots of CDs, savings accounts and/ or moneymarket accounts at different institutions, some could be easily overlooked.
DFINAL RESULTS
oes your company use independent contractors? Can the government or a judge conclude that your contractors are your employees and are entitled to overtime pay? Yes, it’s a possibility with the new “employee-friendly” Department of Labor (“DOL”) final rule that goes into effect on March 11. This final rule explains when a worker will be classified as an employee or independent contractor under the Fair Labor Standards Act (“FLSA”).
If maintained correctly, the final results provided by closed-loop carwashing should rival conventional wash quality, the NWI team states. The path to achieve this quality is not without some increased maintenance requirements and equipment costs. But, these factors should be weighed against the savings of reduced water and sewer costs to determine the feasibility and profitability of closed-loop operation.
The new DOL rule shifts to a totality-of-the-circumstances analysis in determining whether an individual should be considered an employee or an independent contractor. The final rule relies on six (6) economic reality factors. No factor is given more weight than another and should be applied equally. These six (6) factors include:
Ideally, a closed-loop wash is using completely biodegradable chemicals, operating a true restoration system that removes chemicals from the water and following the manufacturer’s required maintenance, Gibney concludes. If so, customers will not be able to tell any difference in wash quality compared to the use of fresh water.

Stick with paper statements. It's perfectly fine for you to access your accounts online, but it's easy for someone else to overlook or be shut out of your online only accounts, which may be difficult to access. Bills and statements that arrive in the mail provide a wonderful fail-safe. That's true even if the financial agent doesn't live near you-your mail can be forwarded to that person by the post office or a trusted neighbor.

Could someone step in and successfully manage your financial affairs if you are unable to do so yourself? Of course, you could execute a "financial power of attorney'' designating someone as a "financial agent" to act on your behalf in financial matters if you're incapacitated. But just drafting that document with an attorney, which you should do, doesn't guarantee that this relative, friend or adviser will know what to do. The issue isn't so much whether he/ she lacks financial savvy-it's that figuring out someone else's finances on the fly is a massive challenge.

Having a financial plan in place for health emergencies is especially on many people's minds now because of the coronavirus pandemic, but an incapacitating emergency could come up at any time. Here's how to prepare finances for an emergency handoff…
SIMPLIFY IN ADVANCE
Consolidate credit cards and bank accounts. Missed credit card payments are among the most common missteps when someone takes over your finances. The more cards you use, the greater the odds that there will be a problem. Cut back to only two, if possible.
Misclassifying employees as independent contractors will continue to be a headache for employers relying on independent contractors to support their business model. Employers must reevaluate their business models to avoid legal exposure triggered by a DOL investigation or a wage and hour lawsuit. If an independent contractor is deemed an employee, the individual will be entitled to overtime pay for at least the past two (2) years. The employer may also be liable for additional damages and attorney’s fees.

Afederal judge just ruled that the Corporate Transparency Act is unconstitutional, marking the end of a 16-month legal battle.
SCWA has long supported these efforts to strike down the CTA.
By way of background, the CTA is a sprawling new data collection regime that would have required more than 32 million entities – including virtually every small business in America – to hand over their sensitive private data to the government.
We’ve written about the statute extensively, but the bottom line is that the CTA would have saddled law-abiding citizens and companies with compliance headaches and criminal penalties, while doing virtually nothing to combat illicit activity.
Recognizing that the federal government went far beyond
their enumerated powers in enacting and implementing the law, the National Small Business Association filed a legal challenge back in 2022, alleging that it violates a laundry list of constitutional protections.
As it turns out, presiding Federal District Court Judge Liles Burke agrees with our concerns. In his ruling issued, he wrote:
When Congress passed the 2021 National Defense Authorization Act, it included a bill called the Corporate Transparency Act (“CTA”). Although the CTA made up just over 21 pages of the NDAA’s nearly 1,500-page total, the law packs a significant regulatory punch, requiring most entities incorporated under State law to disclose personal stakeholder information to the Treasury Department’s criminal enforcement arm.
By requiring these disclosures, Congress aimed to prevent financial crimes like money laundering and
tax evasion, which are often committed through shell corporations. Broadly defined, a shell corporation is a legal entity with no (or minimal) employees, customers, business, or assets.
Although shell corporations serve many legitimate purposes, it’s also possible to disguise the identity of interested individuals and the flow of money by layering shell companies on top of each other, “such that each time an investigator obtains ownership records for a domestic or foreign entity, the newly identified entity is yet another corporate entity, necessitating a repeat of the same process[.]” Pub. L. 116-283 § 6402(4).
Yet corporate formation includes far more than forprofit enterprise. Each year, the States grant formal status to millions of entities that can and do serve “any lawful purpose,” including benefit corporations, nonprofits, holding companies, political organizations, and everything in between.
With that in mind, this case presents a deceptively simple question: Does the Constitution give Congress the power to regulate those millions of entities and their stakeholders the moment they obtain a formal corporate status from a State? The Government thinks so. While it acknowledges that Congress “can exercise only the powers granted to it,” the Government says that the CTA is within Congress’ broad powers to regulate commerce, oversee foreign affairs and national security, and impose taxes and related regulations.
The Government’s arguments are not supported by precedent. Because the CTA exceeds the Constitution’s limits on the legislative branch and lacks a sufficient nexus to any enumerated power to be a necessary or proper means of achieving Congress’ policy goals, the Plaintiffs are entitled to judgment as a matter of law.
As a result, the Court GRANTS the Plaintiffs’ motion for summary judgment and DENIES the Government’s motion to dismiss and alternative cross-motion for summary judgment.
So for now, millions of small business owners can stop navigating FinCEN’s website and go back to running their businesses.
The Department of Justice is almost certain to appeal the ruling, so the court challenge is far from over.
But whichever way it goes, the ruling will help focus the attention of the public, the media, and lawmakers as to the threat the CTA and other laws like it pose to the privacy of law-abiding Americans, and it will help us in our efforts to ultimately fight these laws in Congress.
The decision issued is a big win for millions of law-abiding businesses nationwide.

Initial appeals often are denied because the Assessor hasn’t had time to consider the property. Appealing typically triggers an in-person hearing.
Ask the Assessor’s office, “Which comps will you be using at the hearing?”
If this list is long, ask which three to five they expect to focus on. Research these properties to determine why they’re more valuable than your home. Does your property share a boundary with a rail line, while the comp abuts a golf course? Has a comp been renovated recently? Is your home in a flood zone or in need of repairs? A real estate agent can help you obtain MLS listings for the comp properties.
Weigh the Assessor’s offers.
Assessors often offer a lower assessment prior to a hearing. You can accept the offer (called a stipulation), and the protest is over…or refuse the offer and try to get a further reduction at a hearing.
Attend another homeowner’s hearing.
Sit in on at least one so you know what to expect at your own hearing.
At your hearing, explain why your comps are better fits than the Assessor’s.
Present properties that are like yours but that have lower sold prices…and explain why the comparable properties the Assessor cites are more valuable. Lead with the amount you believe the property is worth. Face the hearing officer when you speak, not the Assessor.
If you lose your in-person appeal, consider appealing again.
Further appeals often occur at the state level and require the Assessor’s office to hire an attorney. Assessors sometimes offer to compromise to avoid that expense.

he 2024 edition of the Southwest Car Wash Association Convention & EXPO recently concluded bringing together about 2700 car washers from 45 different states plus Mexico; Canada; Finland and Germany at the Fort Worth Convention Center.
According to SCWA President Frank Nuchereno, “I am always amazed to see the excitement and enthusiasm of all the attendees and exhibitors. As the first big car wash event of the year, the SCWA Convention & EXPO is a wonderful opportunity bringing the greater car wash community together to start the year with great anticipation.”
The Convention was highlighted by two nationally recognized speakers. First, Stu Crum, CEO of True Blue Car Wash kicked off the popular CEO Forum on Wednesday giving his insights on the car wash industry now and heading into the next several years. Then on Thursday, attendees enjoyed the inspirational message from Convention Keynote Emmitt Smith. Smith offered motivational stories on his career along with insights
encouraging attendees to fill their lives with passion and pride.
The 2024 SCWA event included a record EXPO area with more than 435 booths and over 100,000 square feet of eyepopping exhibits; the popular EXPO Quick Talks Stage; plus premier education sessions including the Car Wash Academy.

Another advantage controllers enable is to-the-inch application of chemicals. This precise application means operators can effectively control their washes’ chemical costs. When set up correctly, equipment only sprays the vehicle, not the gap between vehicles, Davy notes. This to-the-inch application continues through the entire tunnel and applies to such services as ceramic coatings, wax applications and other necessary chemistry. This universal control not only saves on chemistry costs, but it also provides customers a better wash experience.

Best way to defog a windshield in cold weather. Turn on the heat and the air conditioning. Point the blower at the windshield at full blast...turn the heat to the hottest setting... once the heat is raised, turn on the air conditioning...and turn off recirculation. Some cars have a single control to do all these things at once. Why it works: Heat prevents fogging, and air conditioning dries up fog that is already present. Turning off recirculation helps pull in drier outside air instead of recirculating the humid inside air. Tip: Keeping the inside of your windshield clean will reduce fogging.
TEnergy efficiency can be another advantage. “Your tunnel controller also helps you save electricity by driving each piece of machinery in the tunnel, activating your vehicle frequency-driven devices and controlling signage and lighting around your facility,” Davy continues. “Additionally, your tunnel controller can help conserve energy by leaving your dryers on when multiple cars are in the tunnel, avoiding costly start-ups of the dryer system. Without wasting chemical or electricity, you are better able to control your per-car costs and make each service more profitable.”
Bath points to efficient look-ahead features in a carwash tunnel that can include the controller keeping the blowers running for the following vehicle. Again, this step saves energy and creates cost savings. “There are many features that can help operators save power, water, etc. When you understand all these modern-day features, your process will benefit as well as your cost savings,” Bath says.
