The 79th Assembly District seat in the California State Legislature will now be occupied by Dr. Akilah Weber. With over 300,000 registered voters in the district, there was only an 18.4 percent voter turnout. There were a total of 55,578 ballots cast. With 269 polling sites, only 1648 ballots were cast at those sites in total; 53,930 ballots were cast by mail. Weber, a Democrat, beat out four other opponents, one of whom was Republican, Marco Contreras, who got 18,428 votes compared to Weber’s 28,8834. Since Weber got 52.14 percent of the votes cast, there will be no runoff. The lowest number of votes went to Aeiramique Glass Blake, the only other African American on the ballot. She received 624 votes in total. Dr. Alikah Weber, an obstetrician/ gynecologist physician at Rady Children’s Hospital, ran on a platform of the need for more doctors in the legislature during this health pandemic. She said there was only one other physician in the legislature. She replaced her mother, Dr. Shirley Weber, in the Assembly. Dr. Shirley Weber resigned from her assembly position to become the first African American woman appointed

Battlelines are being drawn across the country between those who oppose the voter suppression tactics exemplified by the Georgia legislature and voting and Civil Rights activists fighting against these draconian measures.

In the California Legislature, there are a few bills being proposed that aim to specify qualifications for those who take the oath to maintain public safety.

Last week, 72 Black executives signed an open letter challenging their corporate counterparts across the country to join the fight against a Republican-led campaign to pass a slate of laws that would restrict voting access in as many as 47 states. Kenneth Chenault, managing director and chairman of General Catalyst, a venture capital company and former CEO of American Express, said in a CNBC interview that what he and his Black colleagues had heard from corporations was what he characterized as “general statements about their support for voting rights and against voter suppression.” “But now we’re asking, put those words into action,” said Chenault, one of the organizers of the executive letter. “Corporations have to stand up – there is no middle ground,” he and his colleagues said in the letter. “This is about all Americans having the right to vote. But we need to recognize the special history of the denial of a right to vote for Black Americans. And we will not be silent.” In interviews on CNN and CNBC, Chenault went further: “Fundamentally, if you can’t oppose this legislation – that’s the lifeblood for Black Americans, the right to vote. We can’t be silent, and corporate America can’t be

silent. And if they can’t speak out on this issue, what can they speak out on?” he said. Corporations have been awakened. Last Friday, April 2, executives from about 200 companies stepped up to support the effort to protect voting, not just in Georgia but in the other states trying to suppress and manipulate the vote. The companies released a statement that said in part: “… our elections are not improved when lawmakers impose barriers that result in longer lines at the polls or that reduce access to secure ballot drop boxes … there are hundreds of bills threatening to make voting more difficult in dozens of states nationwide,” said the statement by ViacomCBS, Target, Salesforce, Dow, HP and Estee Lauder among others. “We call on elected leaders in every state See FORCED page 2

One such bill is Senate Bill (SB) 271, also known as the Sheriff Democracy and Diversity Act, authored by Sen. Scott Wiener (D-San Francisco) and Sen. Nancy Skinner (D-Berkeley). It would allow any registered voter to be eligible to be voted county sheriff in California. “We want to reimagine a sheriff’s department that is accountable to the community they are supposed to serve, and the only way that happens is if we the people have the ability to run a diverse group of candidates, candidates that are concerned with taking care of our communities and not dominating, incarcerating and dehumanizing them,” said Cat Brooks, executive director of the Justice Teams Network, an organization committed to eliminating “state violence.” As it currently stands in California, only individuals who possess Peace Officer Standards and See BILLS page 2

When President Biden signed the country’s third federal COVID-19 stimulus package with direct payments to individuals into law on March 11, it extended the increased unemployment benefits that first went into effect with the CARES Act a year prior. Supporters of the legislation say, with hundreds of thousands of new unemployment claims being filed

across the country, unemployment aid is still a necessary part of pandemic relief. The American Rescue Plan Act extends both the Pandemic Emergency Unemployment Compensation (PEUC) and the Pandemic Unemployment Assistance (PUA) programs through Sept. 6, 2021. This requirement went into effect in 1989, making Michael Hennessey, the longest serving sheriff of San Francisco, the last civilian in California to be elected to the office in 1980. “Since 1988, California voters have come to accept that only individuals with a law enforcement background can competently perform the job of a sheriff. SB 271 puts an end to that myth,” said Judge LaDoris Cordell, former Independent Police Auditor for the city of San Jose. Cordell went on to explain why she believes needing law enforcement experience to properly run the office of the county sheriff is a myth. “In 2015, I chaired a Blue Ribbon commission that was convened to evaluate the county’s jails in the aftermath of the beating death of Michael Tyree, a mentally ill inmate who was beaten to death by three guards,” Cordell said. “What our commission found was a jail system that was horribly mismanaged. We also encountered tremendous resistance from the sheriff and her command staff to providing transparency into the jail operation … so much for law enforcement experience.” In California’s long history, there has never been a Black person elected to the office of the county sheriff. Both Wiener and Cordell believe that SB 271 could change that. “SB 271 returns our state to pre-1988 standards while also bringing us into the 21st century with a populace that is exhausted with the status quo and wants a voice and choice in who sits in one of the most powerful positions in our county,” Cordell said. According to the text of the bill, “Many current Sheriffs lack mental health or de-escalation training. As recent COVID-19 outbreaks in our jails demonstrates, the skills Sheriffs need to protect public safety include strong management, leadership, and the ability to move quickly and make difficult decisions, rather than the ability to fire a weapon.” SB 271 has passed the Senate’s Public Safety Committee with a 4-1 vote. It is now being reviewed by the Governance and Finance Committee. A hearing was been set for March 16. In the lower house of the state Legislature,

Assemblymember Jim Cooper (D-Sacramento) is proposing Assembly Bill (AB) 60. It would disqualify individuals who have been subjected to a military tribunal for any offense that would have been a felony in California from becoming peace officers in the state. “The bill would also disqualify any person who has been certified as a peace officer by the Commission on Peace Officer Standards and Training and has had that certification revoked by the commission,” the bill’s text reads. On March 17, AB 60 was referred to the Assembly committee on Public Safety. In the same vein, Assembly Bill (AB) 17, also introduced by Cooper, would disqualify an individual from serving as a peace officer if they have been discharged from the military for an offense that would have been a felony in California. As it stands now, these conditions would not legally bar a person from being hired at a law enforcement agency. “Existing law makes the personnel records of peace officers and custodial officers and specified other records confidential and limits the disclosure of those records except in investigations or proceedings concerning the conduct of peace officers or custodial officers, or an agency or department that employs those officers, conducted by a grand jury, a district attorney’s office or the Attorney General’s office,” the bill’s text reads. Assembly Bill (AB) 89, introduced by Assemblymember Reggie Jones-Sawyer (D-Los Angeles), would increase the qualification standards to become a peace officer. The Assembly Public Safety committee is currently reviewing AB 17. AB 89 would raise the minimum age to become a peace officer from 18 to 25, with the exception of individuals under 25 with advanced degrees.

For many, it has brought back memories of the disturbing video of Floyd’s last moments as he gasped for breath with Chauvin’s knee on his neck. The video galvanized protests in cities across the U.S. and the world, as the words “Black Lives Matter” took hold. “I had to mute the TV,’’ said Lisa Harris, 51, of Redford Township, just west of Detroit. “Hearing Mr. Floyd continue to say he can’t breathe and call for his mother _ it was a lot. It’s been a lot to watch.” Steven Thompson remembers closely watching the 2013 trial of George Zimmerman in the shooting death of 17-yearold Trayvon Martin in Florida and feeling blindsided. Zimmerman, who identifies as Hispanic, was acquitted on all counts in the unarmed Black teen’s death, including second-degree murder. “I didn’t expect that outcome,’’ Thompson, 35, said. “But I’m a lot less ignorant now.’’

Chauvin, 45, who was eventually fired from the police force, is accused of killing a handcuffed Floyd last May by pinning his knee on the 46-year-old Black man’s neck for 9 minutes, 29 seconds, as he lay facedown. Floyd had been accused of passing a counterfeit $20 bill at a neighborhood market. The first week of the trial has included emotional testimonies from several people who witnessed Floyd’s death: The young woman, a teenager at the time, who filmed Floyd’s last moments and told the courtroom she stays “up nights apologizing to George Floyd;’’ the 61-year-old man who sobbed on the stand, compelling the judge to order a 10-minute recess; the firefighter who begged officers to let her check Floyd’s pulse as he gasped for air, saying, “I was desperate to help.’’ The grief and trauma of these witnesses has been on full display, filling in details from new perspectives to create a fuller picture of the scene that people around the world watched over cellphone video last May.

“I definitely have a fear of being let down. And instead of investing my time and energy into it now, knowing how these things go, I’d rather be pleasantly surprised,’’ the Los Angeles resident said.

Floyd’s death was traumatizing enough for Walker, but seeing conversations about the trial on Twitter this week brought back a flood of emotions she has grappled with over the course of the last year.

Marlene Gillings-Gayle said she had planned not to watch the trial to preserve her peace of mind. But she’s found herself watching almost all of it. She’s had to force herself to go outside and take walks, or risk watching the trial all day and feeling upset.

“I had a moment where I just felt broken and I started thinking about Ahmaud Arbery and Breonna Taylor and how in such a short time frame, it was like one Black death after the other, without a break,’’ she said. It has made her feel paranoid at times for her 11-year-old Black son anytime he leaves home.

The retired high school teacher who lives in New York City describes herself as a political person who likes to stay aware of current events and vocalize her opinions. “I’m trying not to be pissed, because we’ve been here and done that too many times,’’ she said, referring to other police officers acquitted in the deaths of unarmed Black people. She’s watching the trial with

The pressure on corporations has ratcheted up since Kemp signed into law a raft of measures that has significantly increased restrictions on Georgia voters. The laws restrict absentee and early voting and restricts the ability of African Americans and other people of color to vote. Among the law’s provisions are the imposition of new limitations on ballot drop boxes that limits their widespread deployment and allows for them to be placed in voting sites; requires voters to submit their driver’s license or state ID number as part of their vote-by-mail application. If they have neither, they must submit a photocopy or electronic image of an acceptable form of

identification such as a passport); and criminalizing the act of providing food and/or water to voters waiting in line to vote. But the most alarming part of the law, activists and advocates say, is the provision that gives state officials the authority to override county election board officials and allow Republicans to potentially disqualify voters in Democratic-dominated areas. Kemp and his GOP counterparts have been defiant as criticism and actions against them increases. In addition to the prospective boycotts of Home Depot, Delta and Coca Cola, comes the announcement that Major League Baseball brass is moving the All-Star game to another venue this summer. According to one tourism official, the state stands to lose as much as $100 million because of what Kemp and other Republicans call “cancel culture.” “I want to be clear, I will not be backing down from this fight,” he said at a press conference to strike back at his critics. “We will not be intimidated, and we will not be silenced. T h e Black Vo t e s Matter project in the State of Georgia has demonstrated once again the connection between politics and the dollar. This project has approached corporate America in the person of Coca Cola, Delta, Home Depot, UPS and others, demanding that they take a position against the voter suppression laws enacted by the Georgia legislature. The idea is that corporate America funds elected officials, and those officials legislating against the public interest in terms of voting rights must not receive funding in terms of political contributions. We know that money is the life blood of politics; that withholding dollars from those legislating against voting rights represents a nuclear weapon that is capable of reversing voter suppression. We know that 43 states now have more than 561 bills pending in their state legislatures to reverse and constrict voting rights. We know that the State of Texas is one such state and that corporate giants like AT&T, Pepsi and American Airlines, corporate giants in the state of Texas, are now speaking out against the state’s pending voter suppression laws. The reason Corporate America

is speaking out is that many remember that companies do not want boycotts or public demand that we not spend money with them. Black Votes Matter has placed a dollar value on voter suppression. More and more state legislators will have to choose between dollars or suppressing voter rights. It would appear that each of us now can play a part in the fight against voter suppression. We know that it is the Republican members in control of state legislatures that have introduced these 560 bills aimed at limiting the right to vote through a variety of proposals. We must look at the state in which we live, look at the members pushing voter suppression bills and then bring pressure on those corporations such as AT&T, Delta, Dell, Pepsi, Southwest Airlines, American Airlines, Home Depot and others that depend on our dollars. The nasty word, “boycott”, of corporations doing business in South Africa, ended South African apartheid and returned democracy to the people. The politics of how we spend and who we spend our dollars with has now become as important as our right to vote. Each of us must examine what role we can play in making sure that those we spend with support our right to vote. So far. So good. Let’s keep up the pressure.

And that would not have happened without voters putting Joe Biden and Kamala Harris in the White House and giving Democrats a majority in the Senate.

One hundred years ago, there were more than 925,000 Black-run farms. By 2017, that number had dropped by more than 95 percent. Today less than two percent of farmers in the U.S. are Black, and 98 percent of farmland is owned by white landowners. Part of the problem is state laws that often force the sale of inherited farmland for pennies on the dollar. But this is not a problem confined to the Confederate states or the Jim Crow era. This is largely a problem of intentional discrimination by employees of the federal government.

istration, the Department of Agriculture halted debt collection and foreclosure for thousands of farmers behind in federal loan payments, many of them Black. Newly elected Sen. Raphael Warno ck—thank you, Georgia voters —introduced the Emergency Relief for Farmers of Color Act, which became part of the COVID relief legislation known as the American Rescue Plan. That measure, passed by Congress and signed into law by President Biden includes $10 billion to support agriculture. About half of that is set aside to help Black farmers through debt relief, education, training, and land acquisition. The law includes $4 billion in direct aid to get farmers out of debt. And it includes $1 billion to create and fund a commission to deal with the longstanding discrimination and inequity in USDA programs. These long-overdue steps toward reversing generations of wrongdoing are not just the result of a single election. They are the fruit of decades of organizing by Black farmers and their advocates to document and challenge racist discrimination and injustice. And to get Black people and their allies to vote. Organizing and elections can change the world. Together we are making— and remaking—history.

Teacher Hesitancy Led to Safer School Reopening Plans By Joe W. Bowers Jr. California Black Media

A year ago, K-12 education was closed across California as part of an effort to mitigate the spread of the COVID -19 virus. At that time, it was assumed that children could be a primary driver of the virus like they are Influenza A. It took a few months, but health officials determined that COVID -19 is not a pediatric driven pandemic. Young kids can get the virus, but they are not significant transmitters. Many school districts including Los Angeles Unified and San Diego Unified have recently announced plans to make in-person instruction available to students who want it. President Biden has been pushing for all K-8 schools to open by May 1 which is the 100th day of his administration. As part of the push to safely reopen schools the Biden administration is allocating about $125 Billion for K-12 education as part of the American Rescue Plan.

Students and parents are anxious for schools to safely open for in-person instruction. In general, Black and Latino children have struggled more academically than their Asian and White peers. Keeping up with schoolwork has been complicated by not having access to technology and reliable internet. Concentrating on studies has been more difficult when they live in communities that have been disproportionately affected by COVID-19. For many families remote learning created a childcare crisis, forcing some parents to leave their jobs. Many parents became frustrated with balancing jobs and supervising their children’s lessons. The power to restart in-class instruction is vested in local school boards. It’s their responsibility to develop a plan for the safe opening of their schools relying on direction from the governor and

Legislature and following safety protocols provided by the CDC and state and local public health directives. Black and Latino parents, while wanting their children to return to school, have experienced the inequitable impact of Covid-19

and are concerned about exposing their children to the virus in a school setting and bringing it home. While these parents understand their children are not faring well academically and mentally with distance learning they are not

willing to risk their safety. Contributing to the unease that Black and Latino parents have about school reopening classrooms has been their children’s teachers expressing their hesitancy to returning to school without all teachers and staff having the opportunity to be vaccinated. Studies show that transmission in schools appears to be primarily from teacher to teacher, then from teacher to student, but almost never from student to teacher. So vaccinating teachers is important to everyone’s school safety. While the stance that the teachers took may have delayed in-school learning, Newsom decided that 10 % of vaccines a week would be reserved for teachers and other school staff. Although AB 86 and CDC guidelines have not included vaccinating teachers in the strategy for safe school reopening, school districts have included it as part

of their teacher union agreements. In addition, regular testing of students and staff is another strategy being adopted by school districts to detect virus on campus before it can spread. While zero risk of COVID-19 infection is not possible, results from hundreds of school districts opened across the county and the world show virtually no communal spread of the virus, if safety protocols are followed. By listening to the concerns expressed by teachers, school districts have made in-person instruction safer for students and given parents more confidence to send their kids back to school. Joe W. First Lady, Sister MARY ALICE FOWLER was born in El Dorado, Arkansas on April 9, 1946 to parents Avery & Hubert Springer and was the ninth child of ten children. She moved to San Diego, California at the young age of 10. She attended and graduated from San Diego High School in 1962. Her continued education and professional career in the medical field extending for thirty-two years. She began working as a licensed rehabilitation nurse, aiding and assisting brain injury and stroke patients. Her nursing education and experience led her to work at one of the largest healthcare systems in the country, Sharp Memorial Hospital in San Diego, California. She worked as a rehabilitation nurse for the remainder of her professional career. Along with her God given gift to care and show compassion to all she came in contact with, her single most important accomplishment, she expressed two weeks ago today was, “THE ONLY THING THAT MATTERS IN LIFE IS GOD AND FAMILY” (words she expressed to her family at her hospital bedside). The Lord called our First Lady, Sister Mary Alice Fowler home on the evening of March 23, 2021, at 10:06 PM. Her husband and General Overseer of the Free Churches of God in Christ in Jesus Name, Inc., Bishop Stephen Fowler was a strong source of encouragement for the First Lady during her adult life and until her final breath on this earth. General Overseer Bishop Stephen Fowler was her spiritual leader, soulmate, best friend, and the absolute love of her Life. For those who knew her best without hesitation can attest that she was a strong woman of Faith, spiritually sound in all things, a caring and supportive wife, mother, grandmother, and great-grandmother. Our beloved First Lady, Sister Mary Alice Fowler served as State Supervisor for the Women’s department in California. She was instrumental in raising thousands of dollars for the organization winning national awards every year for Noah’s Temple Church in San Diego, California. First Lady, Sister Mary Alice Fowler will be desperately missed every moment of the day for the rest of our lives. Our beloved First Lady leaves behind to celebrate her home going and to keep the faith and finish the race, her husband & General Overseer, Bishop Stephen Fowler Sr., daughter Astrid Clark, Granddaughters Kiana Clark, Michelle Clark, and great-grandson Kai Clark. Final arrangements were entrusted to AndersonRagsdale Mortuary. MARY ANN ZACHARY was born to the union of Ezekiel Freeman and Catherine Mayzck Freeman on April 7, 1935 in Mt. Pleasant, South Carolina. Mary was the second of seven children. She was affectionately known as “Sis” by her family members, and attended Olive Branch AME in Mt. Pleasant, South Carolina where she received Jesus Christ as her Lord and Savior at an early age. Mary received her formal education and graduated from Laing High School in Mt. Pleasant, South Carolina where she sang in the Glee Club. Mary met the love of her life Roosevelt Zachary, Sr. On May 23, 1957, Mary married her sweetheart, Roosevelt. As a newly U.S. Army wife, they moved to Alabama, France and California. The Lord blessed the union of Roosevelt and Mary with four children. In 1977, she joined and was baptized at New Home Missionary Baptist Church in Sacramento, CA under the leadership of the late Pastor Moses Gipson. She served as a Deaconess President, Choir Member President, Mission President, and Sunday School Teacher. Mary worked as a sales person in department stores and as a teacher’s assistant at American Legion High School. She attended American River Community College. In 2005, she joined the Mt. Erie Baptist Church under the leadership of Pastor Walter G. Wells was an active member in the Mission Department, Sunday School, and Women 2 Women Retreats. Mary enjoyed sewing, traveling, crafts and maintaining her heritage art form of sewing South Carolina Sweetgrass baskets. With a love of the outdoors, she enjoyed camping and fishing with the family. In San Diego, she enjoyed the fun of attending Padre baseball games. As an adventurous traveler, she added to her international agenda Luxembourg, England, Switzerland, Austria, Mexico, Bahamas and Jamaica. As a supporter of Colonel Allensworth State Historic Park, which she participated in the Sacramento chapter, contributed to the Foundation and attended their annual events. As a seamstress, she would sew many wardrobes of clothing over the years. Every Sunday morning, one would see Mary wearing one of her beautiful hats- she loved wearing hats. She cherished celebrating her milestone birthdays with family, and friends. Mary was preceded in death by her parents- Ezekiel and Catherine Freeman, husband, Roosevelt Zachary, Sr., daughter Paulette Zachary, sons Keith Zachary, Sr., Kenneth Zachary and brother Ezekiel Freeman, Jr.

She moved to San Diego, CA in 1958. It was in CA, where she joined Community Baptist Church and was a member at the time of passing. Residing in San Diego CA the place she loved. Tommie accepted Christ at an early age in her life. She was an active member of the Community Church for over 60 years. She was committed to the faith, becoming involved in the Eastern Star Sorority and other organizations with full devotion. Her greatest joy was her Daughter (Beverly), Family, and a host of Friends. She nourished and cared for each of her family members with an open heart. Her friends were a constant part of her daily life. She transitioned on March 5, 2021 at 5:45 p.m. surrounded by her family and loved ones. She was preceded in death by her father and mother, Herman & Pauline and 5 siblings: Dan, Neila Bell, James, Amy and Laura Mae. She leaves behind Her only daughter Beverly (Husband Boyzie), 4 grandchildren: Mikeena, Robin, AntoniqueNichole (Shawn) and Boyzie III (Ashley); 7 great grandchildren her sisters and brother Mary, Annie and Jimmy, and a host of nieces and nephews: A close loving and caring family. She had a special and long-lasting relationship with Charlotte Lathamn who she considered as her bonus daughter Tommie is loved and adored by many and was committed to her calling, her love for Christ. She met and married George B. Lindsay, his military service led them to settle in San Diego, California, where she raised her 5 children, including 5 older sons. Her children blessed her with a total of 26 grandchildren and a host of great grandchildren. She would go on to continue her career as a dry cleanest, a skill she acquired from the family dry cleaning business during her youth. Retiring from the Naval Training Center in San Diego. Lula Mae loved being with family, bus trips to Las Vegas and her all-time favorite playing bingo. When she was not travelling with friends, cooking was another joy, with some of her specialties of ribs, baked beans, yams, collard greens and her famous peach cobbler. She was truly loved and surrounded by her children when God called her home on March 29, 2021.

Public Forum Held on

Rise in Hate Crimes By Cori Zaragoza Contributing Writer

On March 31st, the Humanity Movement held a virtual forum to discuss the recent rise in hate crimes experienced by marginalized groups across the city. Moderating the forum were five top San Diego leaders: Executive Director for San Diego LGBT Pride, Fernando Z. Lopez; City Attorney, Mara Elliott; Deputy City Attorney, Jennifer Nelson; City Council President, Dr. Jen Campbell; and City Mayor Todd Gloria. For an hour and a half, the group listened and answered questions by

constituents, providing legal and even emotional counsel at times.

Bradley Machado, a caller, recalled his first of two experiences involving a hate crime. In March 2019 he was assaulted and called a derogatory slur while with his husband in Ocean Beach. He says his experience with the court system left him frustrated, since his assaulter was able to drop the charge of hate crime and only had to serve community service. “I was very active in participating in the case. I showed up to every court scheduled

hearing he had and it just kept getting kicked down the road. We dealt with three different judges and I felt like I did absolutely everything I could,” said Machado. “That case was so clear cut [a hate crime], that if something like that is not prosecuted...then what else could I have possibly done? What will it take for [the courts] to believe that the motivation behind a violent crime was homophobia, or racism, or whatever else?” he said. Another caller, John, was also a victim of two separate hate crimes. His story is much like Bradley

Machado’s. In 2020 he was chased, hit, and called a homophobic slur while walking through the heart of Hillcrest. Unlike Machado, however, John’s case was never recorded or even brought to court, despite the fact that he called the police and reported the incident that night. It wasn’t until he was the target of another similar crime in 2021 did he realize that the police officer never filed a report about the original 2020 incident.

“I had the detective follow up on that and he said there is no record of that...the biggest travesty of that was that I felt very unheard from that officer that came to take my report, he was very dismissive and said nothing was going to happen,” John said. When asked by a different caller how they can convince marginalized groups to report hate crimes despite being historically ignored, Mayor Todd Gloria admitted

that it was a ‘tough but fair’ question. While not having a specific answer, he said he hopes the creation of the Office of Race and Equity can be the first step towards real change. The forum was touted as being about ‘general’ hate crimes related to the AAPI/Black communities, but there wasn’t much discussion of that beyond mentioning the intersectionality between BIPOC and the LGBT community.

CALIFORNIA COURT:

Sports organizations must protect athletes By Brian Melley Associated Press Sports governing organizations such as those for swimming and gymnastics have a duty to protect young athletes from sexual and other abuse and can be legally liable if they don’t, the California Supreme Court ruled last Thursday. In a case involving girls aspiring to be Olympians who were molested by their martial arts coach for years, the court held that USA Taekwondo could be held liable. But the court cleared the U.S. Olympic and Paralympic Committee

from liability because it did not have a relationship with the coach or athletes. The decision clarifies legal standards in California cases after numerous sex abuse scandals have rocked the highest levels of amateur sport since the doctor for USA Gymnastics was accused — and later convicted — of molesting scores of girls. Attorney Stephen Estey, who represents the former taekwondo competitors, was disappointed the Olympic committee would not face liability and said the ruling could insulate other large

umbrella organizations such as the National Collegiate Athletic Association, which filed a brief supporting the USOPC. But Estey said the ruling would better protect young athletes from sexual abuse — from youth sports to college and the 61 national governing bodies for aspiring Olympians — by holding organizations responsible. “The thing that’s been frustrating over the years is that these entities make money off the backs of all these athletes,” Estey said. “They make millions of dollars on these athletes, but they do nothing to protect them. They want all the benefit and none of the burden.”

The ruling came in a Los Angeles lawsuit by three women taekwondo athletes who had been abused as minors for years by a coach who later went to prison. The three won a $60 million judgment against convicted coach Marc Gitelman in 2017 but the trial court threw out claims against USA Taekwondo, the governing body for the sport, and the USOPC. The women appealed those dismissals, alleging USOPC and USA Taekwondo failed to protect them. An appellate court ruled that USA Taekwondo could be held liable, but not the USOPC because it did not have a close enough relationship with the

coach or the athletes. The unanimous Supreme Court ruling upheld the lower appellate decision, which revives the claims against USA Taekwondo. The suit was brought by Yasmin Brown, Kendra Gatt and Brianna Bordon. The Associated Press typically doesn’t publish names of sex abuse victims, but all three agreed to let their names be used publicly. The three competed at a high level of the sport and at tournaments sanctioned by USOPC and USA Taekwondo. Brown and Bordon said they were assaulted by Gitelman in Olympic Training Center dorms.

The women no longer compete in the sport, Estey said. Gitelman, a top-ranked Las Vegas instructor known as “Master G,” was sentenced to more than four years in prison for sexually abusing the girls. He abused the girls from 2007 to 2014, often after giving them alcohol in hotel rooms while traveling to competitions, the lawsuit said. Although they were awarded $60 million after Gitelman failed to properly respond to the lawsuit filed in 2015, they have not received a dime, Estey said. He expects Gitelman will never be able to pay the money.

The American Rescue Plan also extended the Mixed Income Unemployment Compensation (MEUC) program, which was signed into law in December 2020 for workers who were earning both traditional W-2 and self-employment income before they became unemployed. Unemployment Insurance (UI) recipients who qualify for MEUC will receive an extra $100 weekly through Sept. 6. To qualify for MEUC, claimants have to receive at least $1 per week from UI and have reported at least $5,000 in self-employment income in 2019. The relief legislation also waives federal taxes on an

individual’s first $10,200 of unemployment benefits collected in 2020, or on the first $20,400 for a married couple’s joint tax return. The tax break applies to individuals and married couples who made less than $150,000 in adjusted gross income in 2020. It also applies to benefits from both UI and PUA. The tax break does not apply to benefits paid out after Dec. 31, 2020. For unemployment recipients who have already filed their 2020 taxes and paid taxes on their first $10,200 of benefits, the IRS announced Mar. 31 that they will automatically refund the difference beginning in May. Claimants do not have to send in an amended return. In California, after a year of claim payment delays and other challenges including rampant fraud, the eyes of many in the Golden State are closely watching the Employment Development Department (EDD). Concerned unemployed Californians and their advocates say they want to see whether there would be delays in updating the EDD processes to comply with the new provisions in

the American Rescue Plan, including the unemployment program extensions. The end of their benefit year is coming up for many UI recipients. On March 26, EDD announced details about the upcoming extensions. The department verified that PUA and PEUC benefits for Californians will be automatically extended without the need to file new claims. The department also said that regular UI claimants whose benefits ran out within their benefit year will need to file a new claim, and that they will inform the claimants of their need to reapply through their online platform, mail or text message. People on the FED-ED program, a California safety net that provides up to 20 weeks of benefit payments during times of high unemployment, is available to those who have used all their PEUC benefits. FED-ED recipients will have their benefits automatically extended as well. On March 26, EDD also released their extended online dashboard with data on unemployment claims, claim payments

and call center activity, along with other data. The release complied with a recommendation from the California State Auditor. Two audits have confirmed EDD’s mismanagement of claims during the COVID19 pandemic. As of April 4, there were over 150,000 unprocessed claims waiting in the department’s queue for over 21 days. COVID-19 UPDATES The 4-1-1 on Vaccines By A.L. Haynes SDV&V Staff Let’s talk about vaccines. There’s tons of information out there, and most of it reads like a textbook. With CoVid-19 vaccine stories filling the news and new strains of the virus appearing globally, a simple explanation is overdue.

The most important thing to realize is that a vaccine is NOT a cure. A vaccine is something that teaches your body to fight a disease. It does this by showing your immune system what a disease looks like. There are three different categories of vaccines: whole-microbe, subunit, genetic/nucleic acid.

By Voice & Viewpoint Staff Writer Last week, Southeastern San Diego experienced a real booster shot in its fight against Covid-19. The Educational Cultural Complex (ECC) opened as a vaccination site with hundreds of people showing up and waiting in lines to be vaccinated. The Total Deliverance Worship Center, located at 28th and L Street, opened a walk-up and drive thru testing site. It was launched with visits from Dr. Wilma Wooten, San Diego County Public Health Officer. She was joined at this press conference by Bishop William A. Benson, Pastor of Total Deliverance Worship Center; Rev. Gerald Agee, Statewide Director for COVID-19, Tabernacle Community Development Corporation; as well as Rev. Judi Wortham of the same Community Development Corporation. The effort was to establish 150 church testing sites in the state by June 30th. This is an effort of the African American Community Empowerment Council seeking to create 30 of those 150 sites. In addition, on Saturday, the Church of Hope International (COHI) was the location for the administration of 1000 doses of the Johnson & Johnson vaccine, which requires only one dose. The NAACP and a number of volunteers were on hand for both walk-up and drive thru vaccinations. According to Dr. Suzanne Offlalo and Mrs. Francine Maxwell, President of the NAACP, the event was such a success that at least 200 people were forwarded to the Jackie Robinson YMCA site of this week’s vaccine distribution. A number of Afrcan Americans indicated that they had been waiting for the Johnson & Johnson single dose. As teachers, students and children are added, things are beginning to look up for California, if people would only wear the mask and social distance just a little longer.

The OG’s held their annual Easter celebration for the 11-and-under kids in the community of Southeast San Diego. The Northside parking lot of Mountain View Park was decorated with some very colorful Easter décor. Participants of the Easter egg drive-thru celebration were able to stay in their cars and grab a goodie-bag full of treats provided by the OG organization. “I always look forward to putting smiles on kids’ faces,” said the Easter Bunny, aka Michael Watkins. “We want the kids of our community to see people doing something positive and being kind to them, and that’s it’s ok to give,” he said. ”Whatever the Easter Bunny said, that’s how I feel about today’s event,” shared Tina Meals. The OG leaders had to make adjustments in order to stay safe and continue their annual Easter Egg Hunt turned drive –thru and they did. “We had to do some compromising to put this together. I think it could have been a bigger turnout but we had to make some last minute changes,” OG President Aaron Gibson shared. “This was definitely a challenging experience, however, we made it work if the kids were happy, so are we,” he said.

All persons are to remain in their homes or at their place of residence, except for employees or customers traveling to and from essential businesses or a State authorized sector as defined in sections 10 and 11, below, or to participate in individual or family outdoor activity as allowed by this Order. 2. All “gatherings,” as defined in the November 13, 2020 CDPH Guidance for the Prevention of COVID-19 Transmission for Gatherings found at https:// www.cdph.ca.gov/Programs/ CID/DCDC/Pages/COVID-19/ Guidance-for-the-Preventionof-COVID-19-Transmissionfor-Gatherings-November-2020. aspx shall comply with said guidance. A written, worksite-specific COVID-19 prevention plan as stated in their applicable state guidance may be used by schools and institutions of higher education in lieu of a Social Distancing and Sanitation Protocol or Safe Reopening Plan. b. All school districts, charter schools, and private schools serving grades TK – 12 inclusive, shall report the following to the San Diego County Office of Education (SDCOE) on or before the second and fourth Monday of each month, in a format designated by SDCOE: i. Number of students participating in full-time in-person

learning, by school site and school district, if applicable. ii. Number of students participating in hybrid learning (a mix of in-person and distance learning) by school site and school district, if applicable. iii.   Number of students participating in distance learning by school site and school district, if applicable. iv. Number of school employees who work onsite at a school, by school site and school district, if applicable. v. The name, email, mailing address, and phone number of the person responsible for responding to complaints regarding COVID-19 prevention, by school site and school district, if applicable. SDCOE shall report this information to the County of San Diego by the end of business on the following day (Tuesday) and shall post this information on its publicly facing website. c. All school districts, charter schools, and private schools serving grades TK – 12 inclusive, as required in the most recent COVID -19 Industry Guidance: Schools and School-Based Programs, shall notify local health officials immediately of any positive case of COVID-19, and exposed staff and families, as relevant, while maintaining confidentiality as required by state and federal laws. 4. Child daycare and child care providers shall operate in compliance with the measures set forth in State COVID-19 Updated Guidance: Child Care Programs and Providers and shall prepare and post a Safe Reopening Plan pursuant to section 11c, below. 5. “Non-essential personnel,” as defined in section 15a below, are prohibited from entry into any hospital or long-term care facility. All essential personnel who are COVID-19 positive or show any potential signs or symptoms of COVID-19 are strictly prohibited from entry into hospitals or long-term care facilities. Notwithstanding the foregoing, individuals requiring medical care for COVID-19 or related conditions may be admitted to hospitals or other medical facilities if the hospital or medical facility is appropriate for treating COVID-19 and has adequate precautions in place to protect its patients, medical personnel and staff. 6. Hospitals and healthcare providers, including dentists shall: a. Take measures to preserve and prioritize resources; and,

b. May authorize and perform non-emergent or elective surgeries or procedures based on their determination of clinical need and supply capacity, and where consistent with State guidance. c. Nothing in this Order shall prevent physicians and other healthcare providers from conducting routine preventive care provided it conforms to any applicable State guidance. d. Nothing in this Order shall prevent dentists or dental hygienists from conducting routine preventive care provided it conforms to any applicable State guidance. 7. Hospitals, healthcare providers, pharmacies, commercial testing laboratories, and any other setting conducting testing shall report all positive and non-positive (i.e., negative, indeterminate, and specimen unsatisfactory) test results from nucleic acid amplification tests, antibody tests, and antigen diagnostic tests for SARSCoV-2 to the Public Health Officer immediately after such results are received. 8. Face coverings shall be worn as described and required in California Department of Public Health Face Covering Guidance issued on November 16, 2020, (available at: https://www. cdph.ca.gov/Programs/CID/ DCDC/Pages/COVID-19/guidance-for-face-coverings.aspx ). 9. All businesses not meeting the definition of essential business or State authorized sector in section 10 and 11 below are referred to in this Order as “non-essential businesses” and shall be and remain closed for the duration of this Order. All essential businesses and businesses and entities in State authorized sectors must comply with the requirements of this Order. Notwithstanding the foregoing, any business may remain open if its employees and owners can provide its services from home, including by telecommuting, without direct contact with the public. 10. ESSENTIAL BUSINESSES a. “Essential business” is any business or activity (or a business/ activity that employs/utilizes workers) designated by the State Public Health Officer as “Essential Critical Infrastructure Workers” set forth in: https:// covid19.ca.gov/img/Essential CriticalInfrastructureWorkers. pdf) as that list may be updated from time-to-time, and referenced in Executive Order N-3320 issued by the Governor of the State of California. b. All essential businesses that allow members of the public to enter a facility must prepare

and post a “Social Distancing and Sanitation Protocol” on the form available at: https:// www.sandiegocounty.gov/content/dam/sdc/hhsa/programs/ phs/Epidemiology/covid19/SOCIAL_DISTANCING_AND_ SANITATION_PROTOCOL_04022020_V1.pdf), or on a form required by another governmental entity requiring substantially similar information, for each of their facilities open to the public in the county. The Social Distancing and Sanitation Protocol must be posted at or near the entrance of the relevant facility, and shall be easily viewable by the public and employees. A copy of the Social Distancing and Sanitation Protocol must also be provided to each employee performing work at the facility. All essential businesses shall implement the Social Distancing and Sanitation Protocol and provide evidence of its implementation to any authority enforcing this Order upon demand. The Social Distancing and Sanitation Protocol must describe all measures required in section c below. Any business that fails to prepare and successfully implement a Social Distancing and Sanitation Protocol shall immediately close. c. When the State of California has issued an industry guidance, or any subsequent amendments thereto, with mandatory or suggested restrictions and/ or measures to be implemented by a particular sector of essential business, every essential business in that sector must comply with the guidance and shall include in its Social Distancing and Sanitation Protocol (prepared pursuant to section b, above) all of the measures listed in the industry guidance. Any mandatory measures required by this Order must also be included in a Social Distancing and Sanitation Protocol. 11. STATE AUTHORIZED SECTORS a. A “State authorized sector” is a type of business or activity that is not an essential business as defined in section 10a above, and is operating in conformance with the State of California’s Plan for Reducing COVID-19 and Adjusting Permitted Sector Activities to Keep Californians Healthy and Safe {available at: https://www.cdph. ca.gov/Programs/CID/DCDC/ CDPH%20Document%20Library/COVID-19/8-28-20_ Order-Plan-Reducing-COVID19-Adjusting-Permitted-Sectors-Signed.pdf}, and the Blueprint for a Safer Economy framework {available at: https://www.cdph.ca.gov/ Programs/CID/DCDC/Pages/ COVID-19/COVID19CountyMonitoringOverview.aspx}.

Provide notice of the exposure to any employees, and contractors (who regularly work at the workplace), who may have been exposed to COVID-19, as stated in the State’s COVID-19 Employer Playbook for a Safe Reopening, available at {https:// files.covid19.ca.gov/pdf/employer-playbook-for-safe-reopening--en.pdf}. 13. OUTDOOR RECREATION a. Each public park and recreation area or facility, shall operate in compliance with the measures set forth in the State COVID-19 Industry Guidance: Campgrounds, RV Parks and Outdoor Recreation. The operator of the park shall prepare a Safe Reopening Plan pursuant to section 11, above, indicating how the park or recreation facility will implement the required measures. Any park or recreation area/facility at which the Protocol requirements cannot be effectively implemented may be required to close. b. Outdoor recreation instruction and day camps that comply with the State COVID-19 Industry Guidance: Day Camps, may be conducted in park and recreation areas/facilities. c. Recreational boating may occur in compliance with applicable State guidance: https:// files.covid19.ca.gov/pdf/guidance-campgrounds.pdf. d. Outdoor playgrounds may operate in compliance with the State guidance Outdoor Playgrounds and other Outdoor Recreational Facilities, available at: https:// www.cdph.ca.gov/Programs/ CID/DCDC/Pages/COVID-19/ Outdoor%20Playgrounds%20 and%20other%20Outdoor%20 Recreational%20Facilities.aspx. 14. Persons who have been diagnosed with COVID-19, or who are likely to have COVID-19, shall comply with the Order of the Health Officer titled: “Isolation of All Persons with or Likely to have COVID-19”, or as subsequently amended. Persons who have a close contact with a person who either has COVID-19, or is likely to have COVID-19, shall comply with the Order of the Health Officer titled: “Quarantine of Persons Exposed to COVID-19,” or as subsequently

If a more specific isolation or quarantine order is issued to a person, that order shall be followed. 15. For purposes of this Order: a. “Non-essential personnel” are employees, contractors, or members of the public who do not perform treatment, maintenance, support, or administrative tasks deemed essential to the healthcare mission of the long-term care facility or hospital. Non-essential personnel do not include first responders, nor State, federal, or local officials, investigators, or medical personnel carrying out lawful duties. Non-essential personnel do not include visitors to hospitals and long-term care facilities who are granted entry by the facility’s director, or designee, because they are family or friends who are visiting a resident in an end of life or similar situation, are parents or guardians visiting a child who is a patient, or because of any other circumstances deemed appropriate by the facility director, or designee, and where appropriate precautions by the facility that follow federal, State, and local public health guidance regarding COVID-19 are followed. b. “Social distancing” is maintaining a six-foot separation from all persons except for household members, first responders and medical providers or employees conducting temperature screenings. 16. This Order is issued as a result of the World Health Organization’s declaration of a worldwide pandemic of COVID-19 disease, also known as “novel coronavirus.” 17. This Order is issued based on scientific evidence regarding the most effective approaches to slow the transmission of communicable diseases generally and COVID-19 specifically, as well as best practices as currently known and available to protect vulnerable members of the public from avoidable risk of serious illness or death resulting from exposure to COVID-19. The age, condition, and health of a significant portion of the population of the county places it at risk for serious health complications, including death, from COVID-19. Although most individuals who contract COVID-19 do not become seriously ill, persons with mild symptoms and asymptomatic persons with COVID-19 may place other vulnerable members of the public—such as older adults, and those with underlying health conditions—at significant risk. 18. The actions required by this Order are necessary to reduce the number of individuals who will

be exposed to COVID-19, and will thereby slow the spread of COVID-19 in the county. By reducing the spread of COVID-19, this Order will help preserve critical and limited healthcare capacity in the county and will save lives.

This Order comes after the release of substantial guidance from the Health Officer, the California Department of Public Health, the CDC, and other public health officials throughout the United States and around the world. 24. How Ready is SDUSD? Voice & Viewpoint Staff Writer Many parents may be wondering just how ready SDUSD is to welcome their children back to on-campus learning. Well, the district’s own COVID-19 Dashboard, published on their website, suggests that, at least in terms of low test positivity rates, and the district’s self-reported district readiness metrics, SDUSD seems poised to return to a modicum of ‘normal.’ All district staff have had vaccines

made available to them since early March. COVID testing is expected to begin at all sites this month, including weekly testing on high school campuses. Districts throughout California were infused with $6.6 billion to help with the statewide reopening effort. $2 billion funded safety measures to support in-person instruction, such as PPE, ventilation upgrades and COVID-19 testing; $4.6 billion to fund summer school, tutoring, mental health services, and other expanded learning opportunities.
