Responses to Public Comment at Commission Meeting on March 8, 2012
Commenter Stephen Cashman, resident at 666 Ellis, criticized the recent recall election of the Citywide Council for Senior Disabled (CCSD). Mr. Cashman stated that the attorney for CCSD did not allow Dorothy Raimey, former president of CCSD, the right to speak and didn’t abide by any HUD rules. Staff Response: SFHA staff has hired an independent investigator to conduct an investigation into the CCSD recall election and will inform the board and take any appropriate steps once the investigation is complete. Commenter Helani Ting indicated that she is concerned that Park Merced Property Management and Park Merced Owners are targeting low income tenants for eviction due to an upcoming redevelopment of the property. She suggested that the Authority pay attention to this matter. Staff Response: Management of the Authority met with Park Merced Management on Tuesday, March 6, 2012 and will meet again on Friday, March 16, 2012 to review Ms. Ting’s file and to confirm with the Management of Park Merced the status of Ms. Ting’s residency. Park Merced claims that Ms. Ting has a $7,000 rent credit in her account and is in no danger of eviction. Staff met with Ms. Ting and she believes the rent credit should be higher. Staff continues to work to resolve the matter. During the meeting on March 6, staff spoke with Park Merced management about the allegations that low income and Section 8 residents are being targeted for eviction. Park Merced denies this allegation and made assurances that the current redevelopment plan will not result in the eviction of any residents.

Commenter John Dorcy stated that he thinks the Budget Presentations for the Housing Authority are confusing. Staff Response: SFHA Management has endeavored to streamline Commission Budget Presentations in an effort to provide a more effective overview of the Authority’s financial circumstances. To the extent that Mr. Dorsey requires additional assistance regarding the details of the SFHA budget SFHA staff can provide him more information and respond to his questions. Commenter Rita Lark indicated that she was notified of the availability of a unit however said unit was not ready for occupancy. She stated that she would like to be offered a unit that is ready for move in. Staff Response: Management of the SFHA has offered Ms. Lark a unit and, which will be “move-in” ready by the end of the month.

Commenter, Stephen Cashman, resident at 666 Ellis Street complained that there was confusion and lack of communication regarding the recall elections for CCSD. Mr. Cashman stated that the attorney for CCSD did not allow Dorothy Raimey, former president of CCSD, the right to speak and didn’t abide by any HUD rules. Mr. Cashman suggested that the rules should be followed and serious changes should be made. Commenter, Healani Ting, resident at Park Merced, claimed that many low income, disabled and SSI residents of Park Merced were targeted for eviction because Park Merced wants to demolish those properties. Ms. Ting suggested that there should be someone to speak for (represent) the residents of Park Merced regarding this matter.

Commenter, John Dorcy, expressed that he does not understand the details of the Housing Authority Budget remarks. Commenter, Rita Lark, stated that she received an invitation to view a unit but, upon arrival, found out the unit was not ready for move-in. Ms. Lark requested a unit that she can move into immediately. Item 4:
Secretary’s Report The Secretary reported that on March 16th, he will be meeting with the Assistant Secretary of the Department of Public Housing, Sandra Henriquez, to discuss more resources for the Housing Authority. Further, the Secretary would be returning to Washington D.C. to discuss the same topics with the National Congressional Delegation.

Citywide Council Senior Disabled (CCSD) Beverly Saba, President of Resident Advisory Board, requested that any concerns that arise pertaining to the recall nominations be expedited as soon as possible. Ms. Saba announced that there was an election at 330 Clementina and it now has a full board. Ms. Saba announced that on Monday, March 12th CCSD will have its general meeting and that Anthony Ihejeto, Florence Cheng, Tm Larsen and Barbara Smith have agreed to be present to discuss resident concerns. 2. SUMMARY The Public Housing Annual Plan is a comprehensive guide to public housing agency policies, programs, operations, and strategies for meeting local housing needs and goals. Section 511 of the Quality Housing and Work Responsibility Act (QHWRA) of 1998 created the Public Housing Agency (PHA) Annual Plan requirement. Information contained in the PHA Plan covers the period beginning with the PHA’s upcoming fiscal year. The PHA can report policies and activities that they expect to employ but may not yet have in place. BACKGROUND The San Francisco Housing Authority began the Annual Plan Process in November of 2011 when staff began meeting to review the current Admissions and Continued Occupancy Policy and Housing Choice Voucher Administrative Plan. The result of the internal meetings is the proposed policy and plan that is presently being discussed within the community. Meetings with the Resident Advisory Boards for the Conventional Public Housing Department and the Housing Choice Voucher Program and the Community Partners commenced on March 13, 2012 and will continue through May 2012. SUMMARY: The attached resolution authorizes the Executive Director to enter into a construction contract between the Authority and Nicole’s Work Inc. in the amount of $408,899. This contract is the last phase of the 350 Ellis Housing Development fire damage restoration services. The fire was caused from an over-use of outlets on December 10th, 2011 inside apartment 5A. BACKGROUND 350 Ellis consists of 96 apartments of concrete and steel construction that was built in 1970. Phase I fire damage scope included dehumidifier installations, cleaning and removal of mold, fire alarm and emergency scaffolding. This Phase II restoration scope includes electric power restoration to the 5 th floor; structural deck repairs to the 6th floor, removal of fire damaged walls, and new windows, new kitchens and new bathrooms at Apartments 5A and 5B. Construction Contract with Nicole’s Work Inc. March 22, 2012 Page 2 The Housing Development & Modernization Department (HD&Mod) developed the scope of work for Fire Damage Restoration Services Phase II and the Authority’s Insurance carrier was invited and participated in finalizing the scope of work. Work under this contract will generally include, but not be limited to, the following tasks: a. b. c. d. e. f. g. h.
Survey and mobilize on site; Asbestos abatement of fire proofing and fire damaged walls; Remove emergency scaffolding and erect new steel under apartments 6A and 6B; Re-establish electrical distribution to 5th floor, fire alarm and smoke detectors; Re-build kitchens and bathrooms that were removed as a result fire damage; Re-install four new exterior windows; Replace any damaged doors, ceilings and floor tiles; and Provide a 2 year warranty.
The above fire damage restoration will allow damaged vacant apartments that were generated by this fire to be made ready for rentals. These repairs will benefit the Authority’s real property assets by safeguarding the structure and add longevity to the Development. This project will provide employment for public housing residents under the resident hiring requirements. By hiring residents, Nicole’s Work Inc. will help create a pool of qualified residents for future work on similar construction projects.
Analysis HD&Mod developed the Invitation for Bid documents, Plans, and Specifications based on master procurement documents furnished by the Procurement Department and construction documents (drawings and technical specifications) that were provided by the Authority’s consultants. The documents were reviewed and approved by Procurement prior to the start of the bid process (see Attachment 1). On the closing date for the solicitation on February 23, 2012, the Authority received bids from seven (7) construction contractor firms.
Per HUD-5369 Instructions to Bidders, the contract award is based on the lowest, responsive, and responsible bidder. Based on the above, the lowest responsive and responsible bidder is Nicole’s Work Inc. with a bid that is thirteen (13%) percent under the Independent Cost Estimate. The bid was analyzed and considered to be fair and reasonable.

March 22, 2012 Page 3 According to reference checks on past projects performed by Nicole’s Work Inc., the firm is a responsible contractor with a good record and has similar construction experience with other public agencies. Nicole’s Work Inc. has performed well on similar projects and has a good history of minimizing contractor initiated change orders. A debarment check was made with California Department of Industrial Relationship and California State License Board and Nicole’s Work Inc. is not debarred from Federal Procurement and Non-Procurement work. Nicole’s Work Inc. will provide a two-year guarantee for materials and workmanship in compliance with Authority standards.
Resident Hiring Nicole’s Work Inc. is pursuing one laborer position to meet and exceed the 25% resident hiring contract requirements. Nicole’s Work Inc. has experience in resident hiring and has satisfied this requirement on past construction contracts.
MBE/WBE Participation Nicole’s Work Inc. is a Minority owned business.
Budget Considerations The Fire Damage Restoration Services Phase II at CAL 1-27 350 Ellis Housing Development is presently funded in the Year 2012 of the Authority’s maintenance budget. Scope of work and costs were reviewed by Authority’s property Insurance and reimbursements are being arranged.
Staff Recommendation Staff recommends adoption of this Resolution.

The Authority issued Solicitation No. 12-620-IFB-0003 on February 1, 2012, following review and approval of the solicitation by the Legal/Procurement Department. The procurement process for the action covered by this resolution meets the procurement standards of 24 CFR 85.36 “Procurement”, HUD Handbook 7460.8 REV 2, “Procurement Handbook for Public Housing Agencies and Indian Housing Authorities”, the San Francisco Housing Authority Procurement Policy Manual, and the State of California, and local laws. The Invitation for Bid advertisement refers potential bidders to www.sfha.org where the Plans and Specifications are available for free viewing and downloading through the NAHRO’s website. Forty-Five (45) potential bidders requested the Invitation for Bid documents and Plans & Specifications that were issued by HD&Mod. The on-site bid walk was conducted by HD&Mod on February 9, 2012 and in attendance were twenty-eight (28) contractors along with the Authority’s consultants and HD&Mod project manager.

On the closing date of the solicitation on February 23, 2012, the Authority received bids from seven (7) construction contractors. The bid documents were publicly opened and read aloud.
