How to avoid buying a home with hidden hazards
rospective buyer beware: that home for sale you’re eyeing could be a ticking time bomb – perhaps a termite headquarters, lead-based paint mecca, former meth lab site, or environmentally polluted property. And you won’t know for sure unless you do your homework, say the experts. Alarmingly, a new ATTOM Data Solutions report reveals that 17.3 million single-family homes and condos worth a collective $4.9 trillion in estimated market value are located in zip codes with high or very high risk for at least one of four environmental hazards: poor air quality, industrial pollution, Superfunds (categorized by the EPA as being contaminated with hazardous waste), or brownfields (a property that may contain a hazardous substance, contaminant, or pollutant). These homes represent 25 percent of the 68.1 million total residences evaluated in the report. The study indicated that, in general, properties within higher environmental hazard risk areas suffered from lower home price appreciation, decreased home values, and increased rates of underwater mortgages. “These findings suggest that, in addition to being better for your 4
family’s health and safety, buying a home in an area with low risk for environmental hazards can be a smart investment decision,” says Daren Blomquist, senior vice president for ATTOM Data Solutions in Irvine, Calif. “The major takeaway here is that it’s important to go into a home purchase with eyes wide open about all the benefits and risks that come with that purchase, including environmental hazard risk, which can potentially negatively impact not only your health but also your wealth.” Blomquist warns that, while some environmental hazards are required to be disclosed before you purchase a home, they often won’t be disclosed until the closing process, “which could be at the last minute when you’re buried in a mountain of paperwork you’re signing at the closing table. That means it’s in your best interest to perform what we call a ‘pre-diligence’ of homes you are considering to buy early on in the buying process – well before you reach the closing table.” The first step is to hire an independent property inspector whom you select carefully instead of blindly trusting in a home inspection done by your mortgage company.
“Buyers should always make sure to have a careful home inspection performed by someone they trust to reveal the good, bad and ugly about a home,” Blomquist says. Cheryl Reed, director of external communication for Angie’s List in Indianapolis, recommends testing the home for radon, lead, mold, asbestos and meth production. “It’s really important to test for meth these days, because you don’t know if a previous owner produced math on the premises but was never caught,” says Reed, who says meth test kits cost around $50. “If you find evidence of any contaminant, don’t hire the inspector to correct it –enlist a qualified, reputable mediator.” John Risvold, attorney with The Collins Law Firm P.C. In Naperville, Ill., recommends learning all you can about your property’s water source. “Ensure that the water is safe to drink and free of chemicals. Be aware that toxins from Superfund and brownfield areas can also seep into soil and groundwater and infiltrate your home through a process called vapor intrusion, resulting in serious health hazards,” says Risvold. founding principal of Wayne, Pa.-based Reidenbach & Associates LLC, says prospective buyers can negotiate for additional time to perform due diligence either before going under contract or during. “During this time, look for nearby manufacturing or chemical operations that could be polluting the air or ground water or that would create quite a mess if they were to catch fire or have an accident. Water runoff and storm water issues are huge concerns, too, as is noise pollution,” says Reidenbach. “Walk the community yourself and talk to neighbors who have lived in the area for years.” Additionally, you should visit the local municipal records building or village hall to request public records for the home and nearby area. You can also find valuable information online about the home you are considering buying; visit the EPA’s MyEnvironment site (www3.epa.gov/enviro/myenviro), the EPA’s Brownfields site (epa. gov/brownfields), and ATTOM’s HomeDisclosure.com, which provides environmental hazard information for many for-sale properties.

Tripped Up Question:
We went on a trip and to assure our mortgage was paid, we sent the lender two checks, one for the current month and one for the next month when we would be out of town. When we returned they claimed we only made one payment and that we missed the second payment, owed them a late fee and on top of everything reported the “missing payment” to the credit bureaus. What went wrong and what can we do about it?
Answer:
Each month you send in a payment coupon, which shows such basic information as the loan number, the current payment due, the total payment due and how much will be owed with a late payment if you do not pay by a certain date. In addition there will typically be several other

lines for such things as additional principal, late charges, other charges and additional escrow. Unfortunately the betting here is that one of several things happened: First, the lender somehow did not cash the second check. Speak with your bank to make sure both checks were cashed. If that’s the case, get copies of the front and back of both checks so you can show them to the lender. Second, if both checks were cashed then you have to wonder what the lender did with the money. It has to show up somewhere. If the payment form was not properly filled out or there were no instructions, it’s probable that the lender regarded the second check as an additional principal or escrow payment. It will appear that you made the first monthly payment as well as a significant addition for principal or escrow. Lenders handle millions and millions of mortgage transactions every month and it follows that in some cases mistakes are made. The best approach in the situation is to call the loan servicer, and ask if someone can help you. Explain – nicely – that a mistake has been made and ask how it can be corrected.

If their records incorrectly show that they did not cash the second check and your bank has evidence that it was in fact cashed you can present them with the check copies that you have. In the future, call the lender and explain that you would like to make two payments, one for the current month and one for following month because you will be traveling. However, if the lender cannot accept the payment in advance, write out the check, make sure it indicates that it’s for payment for the second month, stick it in an envelope with the right payment coupon, and ask a responsible friend or family member to mail it for you on a given date.

B
uilding a prefabricated home requires a separate land purchase, which can often be found through the help of a real estate agent. Many prefab builders have agents that are familiar with the process, to which they can refer buyers. Some builders also have pre-existing relationships with lenders that are familiar with how these homes are built and their unique process. “You need a lender that’s comfortable and able to run the right comps for the projects,” says Brian Stevens, former principal of ClearSpace Modular Homes in Austin, Texas. This can be the most difficult aspect of financing your prefab home, since lenders rely on or comparable sales, or “comps,” to accurately determine a home’s value. If you live in a market where there are not many prefab. homes, it may be trickier to find a comparable sale. Some homes are financed the same as traditional site-built homes because their projects use a permanent foundation and all the walls and

panels are erected on site. Because the prefab. construction process varies from builder to builder, so does its financing. “There is no traditional lending mechanism for true prefab. homes,” Stevens says. Much of the financing process depends on the company’s relationship and history with the banks it does business with, he says. Jason Blenker, president of Blenker Building Systems in Amherst, Wis., says financial institutions have not treated his company’s projects any differently than site-built homes. In some cases, the stability of his prefab company and its product have actually bettered relationships with lenders and eased the financing process. But, as more companies develop solid working relationships with banks, Stevens foresees the establishment of partnerships with financial institutions, which will simplify the financing process for buyers.
