Property Partnering Pitfalls
How to avoid problems when buying a home while living together
F
alling in love with a property at the same time you’re falling in love with a partner? Be careful before jumping into a home purchase with a boyfriend or girlfriend, say the experts. That combination could end up breaking your heart and your wallet if you’re not well prepared. The idea of owning a home with a significant other offers some tantalizing perks. You may be able to land a better mortgage rate and terms if one partner has better credit. You can split the monthly mortgage payments and ownership costs. You can share upkeep duties. And, of course, you won’t be lonely in a house by yourself. But if you break up, dividing up the home and the funds put into it can be a lot messier for non-married couples, especially those who have both names on the mortgage or title. “If the relationship fails and you move out, you may both be stuck on 4
the mortgage of a house in which you no longer live. If one partner defaults on the mortgage payments, credit ratings for both parties would suffer. Also, absent a court order, it may be hard convincing one person to sign themselves off the title,” says Shaolaine Loving, attorney with Loving Law Ltd., Las Vegas. “Furthermore, your state’s laws on marriage and divorces may not apply to unmarried couples, so how the court will divide your interest in the house is less certain than if you were married. And even if the court orders you both to sell the house, selling it may be a challenge – depending on the market.” Mary Catchur, president of Tampa, Florida-based Marimark Mortgage LLC, notes that “the only way to remove one of the parties from the mortgage is to refinance. But if the party keeping the home is not able to qualify for a mortgage on their own, the couple may have
to sell the home.” If, on the other hand, only one partner’s name is on the mortgage, consider that the other person cannot claim any mortgage interest tax deductions – unlike a joint return if you were married. Additionally, if only one partner’s name is on the title, that person has the explicit advantage of claiming ownership to the house, unless a written agreement or court order spell out the other person’s interest. For these and other reasons, Brian Davis, director of education for Philadelphia-based SparkRental, recommends that romantic couples refrain from buying real estate together before tying the knot. “Usually, one partner has to buy the other partner out at a mutually agreeable price, or the property has to be sold. And considering how emotional most breakups are, disentangling from such large and illiquid assets becomes much

harder,” Davis says. “Instead, unmarried people should buy real estate singularly. Before I married, I bought a house by myself. My girlfriend moved in, she paid me rent, and once we were married I added her to the deed, which can be done quickly and cheaply. We set up a joint bank account and used it to pay for housing costs together.” Allison Goodhart DuShuttle, agent with the Goodhart Group at McEnearney Associates in Alexandria, Virginia, says it also pays to wait until after a wedding to purchase, because wedding planning is stressful enough and you can put monetary wedding gifts toward your down payment. “Be sure to pay cash for items like a wedding ring, reception or the honeymoon, as racking up high credit card bills can affect your ability to obtain mortgage financing or cause you to be denied for your loan,” DuShuttle says. If you are still determined to proceed with a real estate partnership minus the matrimony, Loving recommends taking legal precautions. Draft out a written agreement that clearly outlines what each person will pay toward the property, including mortgage, taxes, insurance, utilities and maintenance. The agreement should also detail each party’s responsibilities and how disputes should be settled. Once completed, a notary public can sign the agreement. To be even safer, consult with a lawyer. “Whichever partner is truly okay absorbing the house in the event of a split should be the only one on the title – ideally the same person who is on the mortgage. The other partner can go under a tenant arrangement and pay rent,” says Loving, who also suggests keeping separate accounts. September 23, 2016

Why is this house stuck on the market? Question:
How long should homes remain on the market? In our area we have noticed a number of houses that have been for sale for several years, some for five years and maybe longer. These homes are vacant, but they could be sold if the owners lowered the price. What is the reason to keep holding on?
Answer:
We know that around the country home prices have risen with great consistency. The National Association of Realtors says existing home values have increased 52 months in a row as of June. This is very good news, but it’s not all the news – home prices are not up everywhere. NAR also reports that as of the first quarter real estate values actually fell in 24 metro areas, information largely overlooked and overshadowed because prices rose in 154 areas. To make matters more complicated, we also
know that generally rising home values often mask cases where values are actually falling. For instance, you might have an incorporated city or IP code where prices are up, but within these areas there are pockets where values down. For example, last year Weiss Residential Research found that, while prices seemed to be increasing in most areas, a closer look at the data showed that values were up for roughly for 30 million homes but down for 12 million. If you’re a seller and look at all the positive pricing information you may not see that rising values are not universal. Your neighborhood, your type of home (say a colonial but not a rambler), your price range, or your home’s condition may be less desirable than other properties. This is a harsh reality for many homeowners for several reasons: First, we naturally want the highest price and best terms for our property. A lower price does not satisfy the natural desire to do well. Second, if a house is underwater it may not be possible to sell without a short sale or paying cash to a lender at closing. For such owners there is a strong need to sell for a higher price than may now be available. RealtyTrac estimates that 6.7 million homes were “seriously underwater” at the end of the first quarter, meaning the loan-to-value ratio was 125 percent or more.

Third, a home is not just bricks and pipes. It represents deep psychological values. A home reflects our ego and status, and it says how far we have come in the world. If a home has less than optimum value, then it may mean we’re also less valuable. That’s not a good feeling. When the values seen by owners and market values differ there can be big problems. For some owners the solution is to wait for the market to catch up, an option which can sometimes work. However, keeping a home on the market for a very long time does not guarantee a higher price. It’s also possible for prices to fall. Moreover, holding out has real financial costs such as ongoing mortgage payments, utility expenses and maintenance. Owners may have reasons we don’t see for keeping homes on the market for years on end without a price cut, but such a strategy has real costs that make holding out unlikely to be justified in the end.

Land. They’re not making more of it. But that may not matter much to many of today’s homebuyers or owners. U.S. Census figures peg the median lot size for a new single-family detached home at 8,600 square feet, a record low. (An acre is 43,560 square feet.) Significant regional differences in lot sizes exist, however, according to a report from the National Association of Home Builders. “In general, where land is expensive, it makes sense to squeeze as much home as possible on the smallest lot,” observes Svenja Gudell, economist for Zillow. The small trend will grow, predicts Gudell, but lot size can’t shrink indefinitely “since there are laws that regulate the distance between homes.” One reason Americans are willing to sacrifice on lawn is because they want to be close to stores, schools and other destinations. Indeed, real estate firm Redfin has developed a “Walk Score” that give higher scores to homes near or in cities. Homes with relatively large lots in high walk score neighborhoods often are older, built before neighboring properties, notes Vickie Melin, Redfin agent in Orange County, California. Sometimes, when those home sell, they are “teardowns” where builders construct multiple homes.

But it’s a mistake to assume that lot size isn’t important to all buyers, Melin says. An older home with a big lot in a walkable neighborhood, for instance, might also be sold at a premium if it’s been renovated and improved. Research shows consumers also put a high value on “outdoor living”, a trend that may seem as conflicting with smaller lots, says Paul Foresman of Design Basics, Omaha. But builders and owners have adapted. For instance, notes Foresman, zoning regulations often count covered decks as encroaching upon open lot size requirements, but not uncovered decks or patios, so the latter is popular for outdoor eating and entertaining. 9
