Under ideal conditions, members take their leadership seriously and oversee the physical and financial safety of the structure and people living in it within - during routine and emergency time - and the well-being of their shared common areas. While no single template works, there are certain issues board members should consider to be diligent and prepared in advance. Here are seven key tips: Insure the Board To protect board members from legal challenges, be sure to have directors’ and officers’ insurance, which the building or HOA should purchase, says Michael M. Silverman of Gloron Agency, an insurance brokerage in New York. Get Lawyer-Drafted Bylaws Most boards and HOAs have authority to react and spend funds within certain guidelines when time is a factor. Matt Zifrony, a real estate attorney with Tripp Scott in Fort Lauderdale, Fla., who’s also president of his HOA, agrees, noting that in his own community of 3,000 homes, he has authority as president to spend money to save lives and prevent health and safety disasters. But it’s important, he says, that rules are legal for the state, as statutes vary. Also important are meetings with the building’s attorney, accountant, and real estate appraiser, so adequate insurance is carried and appropriate reserves set aside. Secure Finances Board members need to be familiar with the building or association’s operating expenses, insurance coverage for shared areas, and reserves, so the latter are adequate for routine repairs and maintenance and emergencies, which helps avoid levying special assessments. Some buildings like to keep 3 percent to 5 percent of the budget in a cash reserve, says Zifrony. Have a Bank in Your Corner Most buildings and HOAs deal with significant operating and reserve funds, but it’s smart to have a bank line of credit for an emergency, says Alan S. Chesler, founder of Alan James Insurance, a brokerage in Sunrise, Fla. Consider a Property Manager Many buildings and communities have enough of a financial net worth and also are large enough that they want someone more skilled than those on their board to manage the goings-on of the

building. The solution: Hire a professional manager.Find certified managers from the National Board of Certification for Community Association Managers at www.nbccam.org. Board members also can glean information from the Community Associations Institute, an organization that provides resources to volunteer homeowners, at www.cairf.org. Have a Natural Disaster Plan Advance planning is best to avoid delaying getting help, since the problem may worsen and materials and work crews might not be available, says Chesler. “This is very different from when a roof may need repair, and members can shop around for bids,” he says. An evacuation plan also needs to be firmed up and disseminated to homeowners. Keep Owners In the Know Besides having an annual meeting to update owners about the state of their building or homes, shared finances, and upcoming needs, the board should have a well-thought out way to keep everyone informed throughout the year. A property manager or board member may send out regular notices and post them in a central spot, and they may institute a phone tree for emergencies. “It’s easy these days to keep in touch via texting and Twitter, but email addresses and phone numbers should be gathered in advance,” says Zifrony.

Nine Tips to Avoid Getting Scammed by Rogue Movers (Family Features) Each year, about 15 million American households move, and in the current challenging economy, many may be tempted to choose a mover based on the price alone. Unfortunately, disreputable movers make a business out of baiting customers with very low estimates and then adding on unreasonable charges or even holding the customer’s household goods hostage for exorbitant ransom. Taking the time to choose a mover wisely is well worth it. “Anyone with a website can claim to be a mover,” said Carl Walter, vice president of Mayflower, one of the oldest moving companies in the country. “It’s important to do some homework to avoid falling victim to a scam that could add thousands of dollars to the price of a move. There are a number of red flags that make disreputable movers stand out, but to recognize them you have to know what to look for ahead of time. The best way to know if a prospective mover is doing something wrong is to know the right way from the start.” By planning ahead and doing some simple research, people can reduce their risk of falling victim to disreputable movers. Mayflower offers the following tips for people who are planning a move: • Go with a name you know - Find three moving companies that

have offices in your area and have been in business for at least 10 years. • Get a referral - Word of mouth is the strong indicator of reliability ask friends, family, neighbors and colleagues. • Ask for an in-home estimate - Transportation charges are based not only on the distance of the move, but also on the weight of the items being moved. To ensure that your estimate is accurate, have the moving company come and look at the items you need to move. • Don’t be hooked by the lowest price - Disreputable movers often lure customers with lowball prices and then hit them with unreasonable charges or, in extreme cases, even hold their belongings for ransom. Get three estimates - if one is much lower than the others, that is a red flag. • Be sure the company is who it says - Some disreputable movers try to lure customers in by using names that are very similar to reputable companies. Check the reputable company’s website to make sure the local agent is affiliated with the brand name it is claiming. • Don’t pay up front - Typically you should not be required to pay a deposit to have your items moved. Did You Know? A credit score is a number generated by a mathematical formula, or algorithm, based on information in each individual’s credit report. Lenders use different scoring models to determine if an applicant is worthy of credit, and these different models are why we have three different credit scores. Each of these models rely heavily on an individual’s credit report. Two of the most influential factors in determining an individual’s credit score are payment history and the amount of money owed. Payment history includes history of payment on credit cards, retail accounts, installment loans, and mortgages, among other things. Adverse public records, including bankruptcies, liens and wage attachments are also factors. A credit score takes into consideration the amount owed, including amount owed on certain types of accounts and the number of accounts with balances. In addition to payment history and amounts owed, the algorithm used to determine a credit score also considers an individual’s length of credit history, any new credit accounts they have opened and the types of credit they have used. The higher a person’s credit score, the better interest rate that person is likely to receive from a lender.

Does My Job Affect My Mortgage? QUESTION:
Out of nowhere my company has decided to downsize. I will go from 40 hours a week with benefits and frequent overtime to 32 hours per week with far fewer benefits and no overtime. How does this impact my mortgage?

The lender is looking for a monthly payment that’s made on time and in full. The change in your income and job status only becomes a mortgage issue if payments are late or not complete.
Given your sudden loss of income you may actually qualify for a mortgage modification. Check out the Home Affordable Modification Program at MakingHomeAffordable.gov. Did your employer reduce hours so everyone would still have a job? If yes, fewer hours may be a tough - but better - option than no hours. A caution: Some people may suggest that you purposely miss a payment to qualify for a mortgage modification. If you do, your credit will take a hit and you may not qualify for the best-available modification options. Be sure to make your payments.

We’ve sold our house, and settlement is in six weeks. We’re happy to have sold, but is there anyway we can delay closing for another month?

ANSWER:
Your buyers bought with the expectation that they will get the keys in six weeks. No less important, if settlement is delayed they could lose their mortgage lock and possibly 30 years of low-cost payments. Also, they may have sold their property or ended their lease based on the closing date. If you really need additional time ask the purchasers if they can defer closing. Maybe a post-settlement occupancy agreement is possible - that is, closing as planned and then you rent back the property for a short period. There are a lot of complications and cautions here and a written agreement will be necessary. The buyers will need to check with their lender, broker and attorney for specifics.
