SAME-SEX MARRIAGE AND REAL ESTATE Question: The Supreme Court has ruled that same-sex marriages are legal. How will that impact local real estate markets?

Answer: With the Supreme Court’s 5-4 Obergefell decision gay and lesbian couples can now be certain that their marriage vows will have the same legal standing as all other couples’. In practice this means that some 1,100 laws protecting married couples will be equally available to all. In terms of real estate, the Obergefell case will be important in many local markets for a number of reasons. First, a study by the Federal Reserve Bank of

Atlanta estimates that some 800,000 expected households per year were not created after the financial meltdown. One result is that we now have substantially fewer first-time homebuyers entering the housing market. That’s a problem because firsttime buyers are needed to purchase homes so that existing owners can sell and move. The Obergefell decision will result in the creation of additional households, and, as a result, more first-time buyers will be part of the marketplace. All things being equal, a larger pool of buyers means more home sales and more demand – and more demand can result in pressure to increase home values. That’s good news for sellers. Second, the homebuying process will be greatly simplified for same-sex couples because they can now own property as a married couple. With marital status available a lot of complex paperwork – and a lot of expensive legal costs – can be avoided. “Estate planning is important for everyone,” explained GLAD.org in 2014, before the Obergefell decision, “but it is even more important for people in same-sex relationships because these relationships are generally not recognized by the

legal system. In the absence of documents stating otherwise, your partner may have no rights vis-à-vis your property or in making an important medical decision on your behalf.” Third, while the term “mortgage” does not appear in Justice Kennedy’s majority opinion, Obergefell resolves an important financing issue for same-sex couples. As the Huffington Post explains, prior to Obergefell “veterans in same-sex marriages who live in states that don’t honor their marriage receive smaller monthly disability payments and aren’t eligible to qualify for a [Veterans Administration] home loan with their spouse.” Now, post-Obergefell, all states must recognize same-sex marriages, so all VA-qualified borrowers will get the same benefits for their service.

Own a Dog? It might make your housing options harder to find – and more expensive.

I

t’s a dog-eat-dog world out there when it comes to real estate – especially if you you’re a dog owner who’s looking to rent. Recently published data from rental site Redfin found that dog-friendly units cost 6 percent more than the average cost among all rentals, based on 116 analyzed markets. Further, rental properties that allow dogs also are harder to find; on average, just 16.5 percent of rentals in the studied cities accept dogs. Nela Richardson, chief economist for Washington, D.C.headquartered Redfin, says pooch-permitting leases typically cost more largely due to supply and demand. “Landlords can get away with charging more because people are willing to pay. In Dallas and Chicago, for example, where 48 percent and 38 percent of the rentals, respectively, are dog-friendly, these rentals actually cost 20 and 16 percent more than rentals that don’t allow dogs,” says Richardson. In addition, the traits that make a residence dog friendly are ones that make a residence valuable to non-pet owners, too. “For instance, outdoor space, proximity to parks, and extra square footage are amenities that landlords can charge more for whether the renter own a pet or not,” Richardson adds. To further understand why leased

properties that allow dogs are rarer and charge more, consider things from the landlord’s perspective: Pets can damage property, leave messes and garner complaints from other tenants or neighbors. “My (property) insurance also went up when I rented to people with dogs,” says Joan Fradella, who owns several rental properties in Lake Worth, Florida. “On my large multi-family rental, I couldn’t even find an insurance company that would allow any dogs at all. These insurers are mostly concerned with lawsuits caused by dog bites.” Fradella adds that some careless owners may be contributing to the rarity and higher cost of dog-allowing rentals. “Landlords have to go after renters who don’t clean up after dogs in common areas, which creates additional costs,” she says. To find the right canine-friendly rental, Richardson cautions that owners may need to do extra homework and make some sacrifices when it comes to the rental location or amenities. “It may take longer to find a dogfriendly rental, so start early,” Richardson says. “Also, make sure that pets are specifically allowed in your lease – don’t just take the property manager’s word for it. The costs for any extra pet rent or deposits should also be clearly outlined, so that your right to keep the pet will be protected if the building is sold to

another person or company.” Lastly, keep in mind that, while landlords are free to decide if they wish to allow pets or not, federal laws may require them to permit it you have a disability, says Ron Leshnower, an attorney and real estate author. “For example, if a prospective tenant who is deaf, or has another qualifying disability under the Fair Housing Act, is considering renting an apartment in a building that bans pets, she may request an accommodation to the no-pets policy so that she may keep a guide dog,” Leshnower says.
