Fran Young lives in Springfield, Mo., and has purchased seven properties at auction, including a duplex, four small homes, a 10-acre plot of land and her current home.

“The land prices are more reasonable,” says Young, who purchased one of those homes for $13,000. “Besides the great number of availability of places, you can go to open houses and really inspect the place, so you’re saving.”

Young is a proponent of real estate auctions, in which a home is sold to the highest bidder. They take place at courthouses and other locations, even online. Foreclosure auctions are held by bank-hired trustees. All types of properties (single family, multi-family, condos, commercial property, luxury property) are sold at auction.

But before you fantasize about buying a home with the slam of a gavel, consider the pros and cons of real estate auctions.

For instance, not all auctioned houses are open to viewing for the public – Young was lucky to attend an open house, but in other auctions, buyers have never seen the inside of the house for sale.

“Deferred maintenance may have caused significant damage which you need to repair,” says Elena Rivkin Franz, a real estate attorney with The Mlnarik Law Group, Inc., in San Francisco.

Buyers willing to take this gamble are rewarded with lower prices.

“The lenders [at real estate auctions] are generally selling the properties at or below the amount of their mortgage note,” Franz says. “A buyer can get a great deal. Many times, even if the goskagit.com/reweekly

home had several loans on it amounting to something beyond the current fair market value of the property, the first mortgage loan is below the existing market value.”

“Auction prices generally reflect the seller’s motivation,” says Diana Peterson, executive vice president of Chicago-based Auctions by ATG, which offers residential and commercial properties through live and on-line auctions. “Auctions eliminate high seller carrying costs because they take less time than other selling methods.”

Properties are generally sold “as is” with no financing contingencies. “A buyer may be allowed to seek financing, but contracts generally are not contingent upon the buyer getting financing,” Peterson says.

Real estate auctions usually have closing dates of 30 days or less.

Another pitfall is lack of disclosure.

Franz says, “There may be no disclosures from the lender and there may be things you are unaware of, such as disputes between the former homeowner and the lender.”

For example, if the former owner and lender are involved in a litigation dispute, the buyer may unwittingly be dragged into it. “Unbeknownst to a client of mine, the former owner disputed the validity of the foreclosure process and the lender’s right to sell the property via an auction,” Franz recalls. The problem became a legal nightmare, and it was unavoidable.

Buyers typically hire bidders to bid on their behalf. Most auction companies charge the winning bidder a buyer’s premium, from 2 to 10 percent of the winning bid amount. “Factor this additional charge” into your calculations before deciding on a maximum bid, Peterson says. tional closing costs or property transfer taxes.

Most importantly, though it may seem obvious, “Make sure you want the property before bidding. If you win and fail to perform under the Auction Real Estate Contract terms, you risk losing the funds you presented,” Peterson warns.

Here are a few more tips for buying a home at auction: • Research the property: “Conduct a title search, seek title insurance if possible and conduct a search of the lawsuits and county records involving the property,” attorney Franz says.

• Read the fine print. “Before bidding, read the auction terms and conditions carefully with your attorney and the Auction Real Estate Contract,” Peterson says. “Consult a real estate broker to determine the property’s estimated fair market value. Review sales comparables for similar properties that have sold in the same area in the past three to six months.”

• Register your bid in advance. “You will need to register and present proof of funds and financial statements before being allowed to bid,” Peterson says. “Bring the required amount of certified funds to the auction.”

• If you cannot attend the live auction, register to bid online or ask the auctioneer to submit an absentee bid or send a proxy bidder to the auction to bid on your behalf.

• Ask for help if you don’t understand the auctioneer.

m o rtg a g e s The failure of the mortgage system began during the period from 2000 to 2005. Most major financial institutions are regulated in part by the Federal Reserve, and at that time it adopted a hands-off oversight policy.

The theory was that lenders would not make risky mortgages because risky loans produce losses, and, therefore, lenders as a matter of self-interest would not offer such financing. As a result, government regulation should be as minimal as possible. The Fed could have prevented the mess; under the Home Ownership Equity Protection Act of 1994, the Fed has the authority to stop mortgage products and practices that it

Had the Federal Reserve said “no” to option ARMs, no-doc loan applications and interest-only residential financing, millions of problem mortgages would never have been originated. Today there would be far fewer foreclosures, and home values would be stronger.

So why did so many people and institutions accept the increased use of toxic loan products? Money. Increasing the pool of potential buyers through the use of nontraditional loan products meant more people could buy real estate and also that people with a given income could borrow more. The result was a quick increase in home values and millions of people suddenly

seemed richer – as did lenders, brokers, appraisers, lawyers and title companies.

But home prices cannot rise eternally no matter how the system is fudged because it requires income to make payments -- and incomes have been going down. According to the U.S. Census Bureau, real median household income was $49,445 in 2010, down from $52,587 in 1999.

Slow and steady long-term mortgages protected families during tough times in the past. Now millions of traditional mortgages had been replaced with toxic financing. We now face a financial crisis that was preventable. It was caused not by a lack of regulation but by the failure to use the rules we had in place.

Older Americans Face Foreclosures

The rate of foreclosures for those more than 50 years old has increased faster than the under-50 population from 2007 to 2011.

Young homeowners who were caught in the housing bubble in 2007 might perceive that it’s much harder for them than more established homeowners.

However, according to a study released July 2012 by the AARP Public Policy Institute, the foreclosure rate for the over-50 population has increased more than that of under-50 homeowners.

The study, titled “Nightmare on Main Street: Older Americans and the Mortgage Market Crisis,” reveals that in December 2011, about 3.5 million over50 Americans were underwater on their loans. That means they owe more than their homes are worth. “Between 2007 and 2011, more than 1.5 million older Americans lost their homes as a result of the mortgage crisis,” the study’s author, Lori Trawinski, writes.

The overall serious delinquency rate of those under 50 is still higher than the over-50 group, but the relative increase in foreclosures shows that the older generation was not immune to the housing bubble.

Additionally, the AARP report shows that middle-income borrowers (incomes from $50,000 to $124,999) in the over-50 category suffered the most.

In the older age group, minorities were much more likely to face foreclosure than white borrowers.

The report suggests that further policy changes are needed to alleviate foreclosure and housing problems for all Americans. While many programs are directed to first-time homebuyers and younger homeowners, older Americans also need assistance to refinance their loans and get above water on their homes.

Such programs would include easy access to housing counseling, principal reduction and short-term financial assistance programs.

Make the most of end-of-summer cleanup Though spring cleaning might have the name recognition, many homeowners spend just as much time cleaning their homes in the fall as they do in the spring. • Clean seasonal items before storing them away. When summer has ended, homeowners must place all the items reminiscent of summer, including the grill, patio furniture and lawn and garden equipment, in storage.

While fireplaces are largely ignored during the summer months, there’s nothing quite like gathering around the fireplace with family and friends once winter weather has arrived.
