While most people would run away from such an encounter, Baird and Clark bought the home for $1 more than its opening bid. “Someone asked me what I was going to do with the house, and I simply said I’m going to clean it up and sell it,” Baird says. It’s nothing new for these Utah-based real estate investors, who have made a living turning foreclosed properties into profit. In addition to Baird’s success,

Markets Luring Landlords Rental demand for singlefamily homes is high, but there’s plenty for owners to learn before they can profit.

Optimistic investors are drawn to silver linings. With the outlook for home sales still dark, investors - as well as frustrated home sellers - are focusing on a bright spot: more demand to rent single-family homes. Indeed, market forecaster Local Market Monitor and cash homebuyer HomeVestors of America recently listed metro areas that are rental “sweet spots” where rental charges for are rising even as home prices fall. But not every property will bring landlords a profit. Even in those “sweet” rental areas, like Grand Rapids, Mich., Rochester, N.Y., and Houston, “you can make bad

investments,” notes Ingo Winzer, real estate analyst and founder of Local Market Monitor. Like buyers, renters want homes in neighborhoods with good schools and near vibrant downtowns, says Jim McClelland, president of Tinley Park, Ill.-based MACK Companies, which rents single family homes. Moreover, areas where home prices have sunk especially low, such as Detroit and Las Vegas, may have cheap properties that attract investors, but their weak labor markets translate into low rental demands. If there’s one lesson this painful economy has taught, it’s that there’s no sure thing. Even desperate home sellers who look to rent temporarily to cover heavy mortgage bills should examine the strategy. Here, experts advise how to examine this bright

spot without blinders on: Squeeze Play Lots more investors are buying single-family homes to rent out, but ordinary owners are reluctant to leave their home and let tenants move in, notes Tony Geraci, broker-owner of Century 21 HomeStar, Cleveland. “If someone just want to downsize or get another home, they are not looking to rent,” he says. Rather, “it’s the people who have to move” and seek renters to relieve the pressure of paying for two residence. It’s wise for homeowners to rent reluctantly, says Carol Friedhoff, a financial planner in Dublin, Ohio. For one thing, you may miss a buyer while the home is being leased. Moreover, “tenants may not care for the home, and when it is time to put it on the market, they may not be cooperative,” Friedhoff says. It may be impossible for some owners to rent if their homeowner’s association forbids it, adds Geraci. And, owners of single-family homes may be required to register their intent to rent with their municipality, which may then inspect the property for health and safety, and you’ll also have to upgrade your homeowner’s insurance, he adds. Professional Help

Although sellers are motivated by a cash squeeze to rent, they should sacrifice part of their rental income to a management association, says Geraci. “There are lots of people looking to rent, some might have bad credit because of a single issue like a medical problem and will be good tenants,” he says. For a set fee, many rental management companies will find a tenant and help owners screen creditworthiness, says Jim Evans, president of the Institute of Real Estate Management. Such management companies also offer a variety of services like dealing with tenant questions and collecting rents. The market for potential tenants and the probable rental income can be difficult for ordinary owners to discern. Management companies can provide advice. Not Just a Quick Buck Just as only certain sellers should turn to renting, individual investors should be very careful about putting their savings into buying rental property, cautions Steven Weydert, an Irvine, Calif., financial planner. “The best candidates for real estate investment are already on solid financial footing, are looking to diversify, can afford to take on the additional risk and potential increased return of a concentrated position - which is what real estate is, “ Weydert explains.

ith super-low mortgage rates and an abundance of steals in the home market, even the most entrenched renters may be feeling the urge to finally become a homeowner. Unfortunately, finding that dream home - and then navigating the purchase process - can leave anyone with a new-homebuyer headache. Picking the right agent can make all the difference in feeling calm and

confident throughout the homehunting journey. Hire Some Help There are many benefits to enlisting an expert. Realtors - agents who are members of the National Association of Realtors and adhere to its Code of Ethics and Standards of Practice - are versed in which homes are a good value in the current market, what locations are most desirable, and how real estate

laws and contracts work. “If a buyer doesn’t have extensive knowledge of all the aspects of a real estate transaction - such as negotiating price terms and conditions of purchase - they can easily be taken advantage of,” says Mark Minnis, a broker/owner and buyer’s agent with InSight Real Estate in Portland, Ore. “But a Realtor is obligated by law to protect your interests.” Retaining an agent usually requires

no out-of-pocket expense on the part of the buyer, adds Brady Moore, a Dallas-based Realtor with Dave Perry-Miller and Associates. An agent’s commission will depend upon the listing and the contract. To find a licensed agent, your best bet is to start with referrals from friends or family, says Minnis, especially if they are located where you are looking. If new to a city, use the “Find a REALTOR” function at Realtor.org. Sometimes new buyers are tempted to call the listing agents for properties they like, but be cautious. Working with an agent who represents the seller may not be in your best interest as a buyer.

Consider finding a buyer’s agent and have that person help you find properties, Moore says. Make Sure You Mesh To ensure this process goes smoothly, the experts agree that it’s important to find someone who is a good personality fit. “Buying a house is probably the biggest financial transaction most people will make in their lives,” says Moore. “You should do it with someone you can trust [and] enjoy spending time with.” A good way to find that out is by interviewing potential agents in person. Ask about their areas of expertise, the neighborhoods in

which the majority of their sales occur, if they own any real estate themselves and how long they’ve been in the business. Keep in mind that some agents may require you to sign an exclusive-representation agreement, says Moore, the details of which can vary. In addition to reading over the contract yourself, have a friend who understands real estate read it over. Know that a good agent will work hard to meet your needs. They won’t get paid until the sale, so when they see you are committed, they know they can dedicate their effort to helping you find your dream home.

Clark’s Equity Capital Group and Clark Venture Capital have purchased nearly $50 million in property. The pair acquires most homes sight unseen, and they never know what’s behind that door. In one episode, the home was previously used as a meth lab; in another, they found squatters living in a home littered with sexual paraphernalia. Typically the homes are abandoned, but some have included squatters, gang members, dead animals and more. Back at the home that needed ground beef removal, the men are armed in hazmat suits and, with the help of a 30-yard dumpster, they removed the meat and cleaned out the house. “The smell was so bad that the police showed up and made me guarantee that I would remove it by 5pm because it was so hazardous for the community.” After cleanup, the duo made a $17,000 profit on selling the home. The men agree that the goal of a successful foreclosure purchase is to make sure you do not get emotional about the sale. “We buy foreclosures because they are the lowest price, and you can instantly buy three or four products in one day,” says Clark. “Otherwise you become emotional about one house that’s taking a really long time to buy.” That’s also hard to do when every home comes with a story. The pair recognized this and started telling their stories about the homes on video and putting them on YouTube. Clark remembers one purchase where they found that the previous owner had built a shrine to himself. “There were thumbnail prints and within any five-inch section of wall, there was a picture of himself,” says Clark. “He traveled the world and would put his picture on thousands of postcards. We don’t get to meet these people, but we feel like detectives seeing how people lived.” 8

That’s when they were discovered and given their own show. On the first season, the cheapest house they purchased was for $39,000 and the most expensive was $1.6 million, with 14,000 square feet, two theaters and a gunroom. “We put $220,000 into improvements,” says Baird. “It also shows that this isn’t just a low income problem, everybody is being affected by this. The economy questions the value of our home, job and relationships. Finding the greater purpose in the monetary value is the key to our success. We’re trying to restore pride of ownership in the neighborhood.” “We see as many as we can, but we avoid things to, such as weird looking homes or busy streets,” says Clark. “Inside the home, we don’t have any idea what it looks like until we buy it, but we ask ourselves if we would be proud to raise our children there and if they took care of it.”

How did our loan get there? QUESTION:

We are being foreclosed but wonder how this is possible. Our mortgage was with Lender A, then with Lender B and then onto Lenders C and D. We have no agreement with Lender D, so how can they foreclose? Isn’t this an example of robo-signing, and if so what we can we do about it?

ANSWER:

To homeowners a mortgage is a debt, but to lenders a mortgage is an asset that can be bought and sold. In your case the

loan was originated by the first lender - A - and then sold to Lender B. Lender B sold it to Lender C. Lender C itself was sold to Lender D, and along with branches and vaults Lender D then obtained your mortgage - and many others - when it bought Lender C. Robo-signing is different. In a foreclosure, where court approval is required, a representative of the lender signs an affidavit swearing to the court that the lender owns the loan and that the borrower has not made payments. With robo-signing, the affidavit is signed by someone who does not actually know anything about loan ownership or repayments - they are simply clerks signing documents, sometimes hundreds or even thousands per day. agreed that it could be sold and re-sold that was part of the vast pile of paperwork you found at closing. There are, however, rules that impact mortgage sales and protect borrowers. For instance, the new lender cannot change the terms of your loan and if the payment address is moved you must receive notice and adequate time to make the change so your credit standing is not unfairly damaged. If you believe the foreclosure claim is wrong then you must get a local attorney to fight the lender in court. An attorney will look into the issue of whether the lender has its paperwork right and also if there’s an alternative available, such as a loan modification.
