hen designing a home, color is one of the most powerful tools to add life to a space, says Genevieve Gorder, one of television’s best known interior designers.

For example, if I put the vivacious Valspar Luscious Green 6010-7 (one of my personal favorites) onto a wall, I would break up those big planes of color with enough highlights (whites and creams) and grounding colors (grays and blacks) so that it isn’t overwhelming. But Taxed?

QUESTION: I read an article that stated the Health Bill includes a provision whereby, after 2012, a 3.8-percent sales tax will be imposed on the sale of all houses. Any truth to this?

ANSWER: A tax on all home sales? No. A tax on a small number of upper-income home sales?

Yes. According to the National Association of Realtors, “this WILL NOT not be imposed on all real estate transactions, a common misconception. Rather, when the legislation becomes e?ective in 2013, it may impose a

3.8-percent tax on some (but not all) income from interest, dividends, rents (less expenses) and capital gains (less capital losses). The tax will fall only on individuals with an adjusted gross income (AGI) above $200,000 and couples filing a joint return with more than $250,000 AGI.” According to the IRS, in 2008 it received 142.4 million tax returns. Of these, 3.1 percent were from filers with an AGI of more than $200,000. Of these high-income filers, 27,399 paid no federal income tax, and few will pay the new 3.8-percent tax.

The tax itself does not apply to earned income from paychecks but may instead be applied to interest, dividends, rents and capital gains. These are forms of income on which individuals do not pay Social Security taxes.

The NAR provides an example of how the tax might work: A couple has an income of $350,000 after all deductions.

They sell their home and have a $525,000 profit. The first $500,000 in profit from the sale of a prime residence by a married couple is tax-free. That means $25,000 can be taxed.

Their tax increases under the new rule by $950 ($25,000 x 3.8 percent).

So, would this tax apply to you or me? Not likely. According to the U.S. Census Bureau, real median household income totaled $49,445 in 2010 – that’s a 7.1-percent decline from 2001. For specifics, see a tax professional.

Short Sale Solution Is a short sale the way to a silver lining on your mortgage?

C

an’t afford to pay your home mortgage any longer? Tried loan modification efforts but struck out? Want to avoid the hassles and shame of a foreclosure? A short sale could alleviate your mortgage woes – provided you understand what’s needed to complete one successfully.

The short sale is a process through which a property is sold for less than the amount owed on a mortgage, and the lender agrees to reduce the loan balance. They are becoming increasingly popular; data from RealtyTrac, a real estate website that specializes in foreclosures and bank-owned properties, indicated that there were 35,000 short sales in January 2012, an increase of 33 percent compared to January 2011.

Why are short sales appealing? They are less traumatic and damaging than a foreclosure, which will stay on your credit report for at least 10 years. On the other hand, there are some disadvantages. In a short sale, you’ll still be forced to move, your credit rating will be negatively affected and you may still be obligated to pay back some or all of the loan balance.

The process is not simple, either; a short sale can take anywhere from six to 12 months.

For those who wish to pursue a short sale, follow these steps.

• Enlist the right agent or broker. “Make sure you are listing with an agent who specializes in short sales and is highly experienced in successfully obtaining approvals [from lenders],” says Leslie Carver, broker and sales associate, Prudential Americana Group Realtors, Henderson, Nev. It’s possible for a borrower to obtain short sale approval without help, but a listing agent can expedite this process.

“Many [real estate professionals] have no clue what they’re doing and do not have the bank contacts needed to get it done,” says Anthony Lamacchia, broker and owner of McGeough Lamacchia Realty, Inc., Boston.

• Get your financial house in order. Prepare all financial documentation to prove you cannot afford the home, including bank statements, tax returns, pay stubs and a hardship letter. Review these documents with an agent prior to listing your home.

Additionally, “talk to an accountant about any tax liability for debt forgiveness,” Carver says.

• Understand the repercussions. Develop a plan B strategy in case the short sale falls through. Also, make sure to comply with any laws in your state to safeguard against your lender filing a deficiency judgment against

you. Some states allow for personal liability when a borrower defaults on a promissory note, which means you could legally owe the lender a deficiency – the difference between the principal balance due and the amount received. Conduct an initial title search to be sure any fines, liens or code violations are removed before completing the short sale.

“Discuss your situation with a reputable attorney who is familiar with short sales, market conditions, tax implications and other legal outcomes,” says Robert Shiller, senior vice president of enhanced servicing, at Wingspan Portfolio Advisors in Dallas.

Conduct an initial title search to be sure any fines, liens or code violations are removed before completing the short sale.
