Answer:
With sufficient equity and other mortgage qualifiers — good credit, relatively low debts, an ability to repay the debt, etc. — getting cash out should not be a challenge. One option is a Home Equity Line of Credit (HELOC) with few up-front costs. A HELOC functions like a credit card allowing you to borrow up to a given amount. Compared to a credit card, a HELOC has two distinctions. First, your home secures it so the interest rate is lower. Second, your ability to withdraw money varies according to its age. In the draw period, you can take out and put back

cash up to the limit. The draw period might last five, 10 or 15 years. During the repayment period, you cannot take out additional cash. At this point, you must pay off the HELOC debt, which can be problematic not because of interest rate or amount borrowed but because of short amount of time remaining on term, say 10 or 20 years. A short repayment period could mean hefty monthly payments. Example: At the end of the draw period you owe $40,000. At six percent interest over 10 years the monthly payment for principal and interest will be $444. Over 20 years the monthly bill is $287. If you don’t pay the property can be foreclosed. s the saying goes, you can’t take it with you. And that’s true of real estate. Which, begs the question: What will happen to your home after you’re gone? Do you have a plan in place to ease the transfer of your property to your heirs? If not, there’s no time like the present to do some careful estate planning that can ease the burden on your beneficiaries. But wait, you think: I’ve got lots of years left in me. Why bother with this hassle now? Because if you become incapacitated because of injury or illness or suddenly succumb to an accident, your estate could get tied up in court — a costly and time-consuming process for your surviving loved ones. “Without proper planning ahead of time, an illness, for example, could require that your house be sold to pay for the cost of your care or result in a lien against it. Tips to ensure your real estate transfers easily when you’ve passed or become sick or become incapacitated, your heirs could not sell it — even if you had a will in place — until the property went through probate court and the court appoints an executor or administrator. And if your heirs don’t get along, the probate process can cause a significant delay, added costs and bitter litigation,” says attorney Marcus O’Toole-Gelo with Genser Cona Elder Law in Melville, New York. Ponder that probate can be a major hassle. “In Illinois, the best case probate scenario usually involves at least $5,000 in fees and court costs and an eightmonth delay in distributing the
estate assets,” notes Ernie Rose, probate/real estate attorney with Drost Kivlahan McMahon & O’Connor, a law firm in the Chicago area. For these and other reasons, establishing a will, notary and advanced directives and transferring your property to a family trust are smart moves. Each option should be discussed and explored with an attorney. “In property transfer, a family trust is needed to avoid the property going to probate after your death,” explains Los Angeles-based Realtor Kristina Buckner. “A revocable trust allows the trust’s creator to end it or change its terms
while an irrevocable trust’s creator cannot change the terms or regain the property once he or she has donated it.” O’Toole-Gelo agrees that an irrevocable trust is often best. “This ensures your home will pass smoothly to your heirs and protect the home during your life. The trust can preserve your heirs’ right to live in the home and preserve income tax benefits. The home can still be sold while you’re alive if they choose, and the proceeds can be used to buy something else or be invested,” adds O’TooleGelo. “Or, after your death, the home can be sold, and the proceeds distributed, or your heirs can keep the house — all without having to go through probate.” Another option to explore is a beneficiary deed. “Over the last few years, states have rolled out deeds that act as transfer or payable on death orders, like you would have on bank accounts

and life insurance policies,” says estate planning attorney Josh Bryant in Rogers, Arkansas. “This can prevent your heirs from paying capital gains taxes on the property. But beneficiary deeds have not been as tested by the courts, so there’s less certainty about how a court would rule if something went wrong.” Your worst option is transferring your home to your children by adding their names to your property’s deed. “This exposes the property to your children’s creditors, and spouses if they divorce, and it may have negative tax consequences once your children eventually sell the property,” Rose says. Make no mistake: Estate planning gets complicated. That’s why it’s always best to enlist an experienced attorney who can guide you through your choices and help develop the best property transfer plan that works for you and your inheritors.
