Box 365, Valley Center, CA 92082 08 October 2010 To: All San Pasqual Contractors, Subcontractors & Employers Re: 1% TERO Fee on Contracts with San Pasqual Please be advised that Tribal Government is implementing new procedures to assist in the enforcement of the Tribe’s Tribal Employee Rights Ordinance (TERO) Fee. This ordinance requirement applies to all contractors, subcontractors and employers doing business with the San Pasqual Band of Mission Indians. Attached you will find a TERO Fee checklist which should be completed by you, signed and returned to the Procurement Agent to be kept on file for future reference. Please return the checklist to the attention of “Elena Esparza, Procurement Agent – P.O. Box 365 – Valley Center, CA. 92082. Construction contractors and subcontractors (all those doing work with a Contractor’s License) must complete Part A; all other employers must complete Part B. If all of the boxes are marked “yes”, then the TERO fee applies. IF the TERO fee applies, all contractors, subcontractors and other employers affected by this ordinance will be given the opportunity to amend their current contract(s) to add the required 1% TERO fee. Please keep in mind that the Tribe’s TERO Officer may challenge a claim that the fee does not apply in any particular circumstances. In such a case, perhaps a provision in the contract should be added which would add the particular TERO fee to the contract price should the TERO officer prevail. The checklist will determine, at least initially, whether the TERO fee is to be applied.
