hether you’re a buyer or a seller, you want to succeed in the Real Estate marketplace. That’s natural and reasonable, but what are the steps you need to triumph? Negotiation is a complex matter and all transactions are unique. Both sides – buyer and seller – want to feel that the outcome favors them, or at least represents a fair balance of interests. In the usual case there is a bit of bluff, some give-and-take, and neither party gets everything they want. 2. Who Has Leverage? If you’re on the front page of the local paper because your business went bust – and the buyer knows it – you have little clout in the bargaining process. Alternatively, if you’re among six buyers clamoring for that one special property, forget about dictating an agreement – the owner can sit back and pick the offer which represents the highest price and best terms.

For instance, one owner may have agreed to paint the property, replace the roof, purchase a new kitchen refrigerator, and pay the first $5,000 of the buyer’s closing costs. 4. What About Financing? Real estate transactions involve a trade – houses for money. We know the house is there, but what

about financing? There are several factors that impact the money issue: Has the buyer been prequalified or pre-approved by a lender? Meeting with a lender before looking at homes does not usually guarantee that financing is absolutely, unquestionably available – a loan application can be declined because of appraisal problems, title issues, survey findings, and other reasons.

But, buyers who are “pre-qualified” or “preapproved” (these terms do not have a standard meaning around the country) at least have some idea of their ability to finance a home and know that they are likely to qualify for certain loan programs. The result is that prequalified buyers represent less risk to owners than a purchaser who has never met with a lender. If the seller accepts an offer from a buyer with unknown financial strength, it’s possible that the transaction could fail because the buyer can’t get a loan. Meanwhile, the owner may have lost the opportunity to sell to a qualified buyer. The lower the interest rate, the larger the pool of potential buyers. More buyers equal more potential demand, good news for sellers. Alternatively, high rates or even rising rates may drive buyers from the marketplace – and that’s

not good for anyone. It used to be that down payments were not a major financing hurdle … but not anymore. For those with even good credit, loans with 15 percent down or less are

similar in configuration, age and location to the home you want to buy. Use the data from the most recently sold sales, and don’t look beyond six months because appraisers won’t. Ask your agent for a trend report covering the last six months. Look up

the prices of the homes as they were listed and compare them to the prices that have sold. Ask how much is the gap? Are homes selling over list price or under? If under list price, by which percentage? If many homes are selling at 2% under list price, for example, that percentage could indicate the price the seller will or should accept. First, understand that smaller homes are priced higher per square foot and larger homes are priced less per square foot. You cannot take the average square-foot cost and multiple it by the square footage of the home you want to buy to come up with a reasonable price to offer. But you can check the trends to determine if the square-foot cost averages are on the rise or declining and use that information to your advantage. Sometimes agents take listings off the market

and resubmit them as a new listing. Find out if the home was an expired listing and then re-listed. The Days On Market are important, because if homes have been on the market longer than 60 days, the sellers might be more motivated to wheel and deal.

5. Who Has Expertise? Imagine you’re in a fight. The other guy has black belts in 12 martial arts – and you don’t. Who’s going to win? Brokers have long represented sellers, and now buyer brokerage is entirely common too. In a transaction where one side has representation and the other does not, who has the advantage at the bargaining table? Make sure that each party has representation and that the representation is a highly-skilled, knowledgeable and reputable

Realtor® who is acting in the best interests of their own clients. In closing, try not to become emotionally attached to the “I win- they lose” of buying before your offer to purchase is accepted. Prepare yourself for a counter offer as the seller is attempting to accomplish his/her own goals too. The art of a good negotiation is that each party must feel a “win” for a successful outcome. There's comfort in worn furniture. Or, should I say “distressed� furniture? By definition, “distressed� means “damaged� or “used,� yet “distressed� is what so many people desire and are willing to pay extra for.

ometimes age succeeds, sometimes it fails. It depends on you.� ...Ravensara Noite What is it that we find so comforting and appealing in damaged and used? It's that decades of use

have given life to those things. A life that is created with every ding, every layer of paint and every stain or watermark. Oddly enough, it's the damaged and used part that makes a piece of furniture distinc-

tive and gives it a unique character. It's a random aging process that naturally happens over time and is, creatively speaking, very hard to duplicate or re-create. Distressed features are unique to each

and every piece, yet there are the common signs of aging that we can be inspired by when trying to add a few years to some of our newer pieces. Layers of paint – Paint your piece with various colored layers of paint, at least two or three. You can play up the color combinations that were signature to different time periods – it's also a great way to use up leftover house paint. Don't rely on just

a brush or roller to apply paint. Try using a palette knife or painting spatula to apply one of the layers. This enhances the random breaks in the color when you sand it down. Sanding – Sand layers using a power palm sander. Experiment with the different grits of sandpaper for various effects. Even a worn-out piece of sandpaper can give you interesting results. Vary the

pressure you apply to the sander and the way you position it. Sand down to the bare wood here and there for an additional spot of color.

Stripping – Use a liquid paint stripper that you can control pouring over your piece. Let it puddle up where desired; tip the piece to allow for drips. Experiment with how long you leave the stripper on before you remove it to

HUD proposes a new good faith estimate

G

etting a mortgage can be confusing and frustrating. To make it less so, the federal housing department has proposed an overhaul of the mortgage process, from application to closing.

he proposed regulatory changes are designed to do a number of things: make it easier

to compare mortgage offers while shopping, force lenders to estimate closing costs more accurately,

and ensure that borrowers know the terms of their loans. For consumers, the

most visible change would be on the top page of the four-page good faith estimate. The proposed document is less cluttered than today's good faith estimates. The top page of the revised estimate would summarize the costs in two categories: those charged directly by the lender, and those imposed by third parties, such as credit bureaus, appraisers, title insurers, homeowner insurance companies, condo associations, and the county recorder. Summarizing the costs this way could confuse consumers and make it harder to compare offers because some of these charges vary, depending on the date of closing. One lender could offer a better deal, based on closing the loan on the fifth of the month, and another lender could offer an inferior deal based on closing on the 25th of the month, making the latter deal appear less expensive because less money would be set aside to pay for property taxes and homeowner insurance.

The Department of Housing and Urban Development, or HUD, says the proposed estimate lumps all the third-party fees and taxes together to keep things simple and to "reduce any incentive for loan originators and others to establish a myriad of 'junk fees' and provide them in a long list in order to increase their profits." However, it does not separate recurring expenses from one-time fees and taxes. Under the proposal, lenders would have to give accurate estimates. Once the rate is locked, the lender would not be allowed to increase its service charge "absent unforeseeable circumstances." Government recording and transfer charges would have to be spot-on, too. All third-party charges, combined, would not be allowed to rise more than 10 percent from the good faith estimate. For example, if the title insurance, appraisal, credit report and survey total $3,000,

fter nearly two decades of living with off-white sofas, I was ready to spin the color wheel and welcome some brighter, bolder hues to my living room when I reupholstered some furnishings this spring. ut the closer I got to embracing a rainbow of color, the more I squirmed. would be read aloud and, in HUD's words, "would compare the loan terms and settlement charges estimated on the GFE with those on the HUD-1" and describe the loan in detail. These proposed changes concentrate heavily on disclosing fees and making sure that the estimated

costs are accurate. There's less emphasis on making sure that borrowers understand how high the payments can rise on adjustable-rate mortgages. "This is the critical piece of information," says Susan Wachter, professor of real estate at the Wharton School of Business and a

former assistant secretary of HUD for policy development. "Ask not only what the mortgage payment is today, but ask what it is in the future -- three years, five years, 10 years." The proposed GFE omits a couple of key pieces of information: the loan-to-value ratio and

the monthly payments as a percentage of the borrower's income. Alex Pollock, a fellow at the American Enterprise Institute think tank, has tried to interest lawmakers in a one-page mortgage summary that would strongly emphasize the amount of the house pay-
