A step by step guide to buying property in Spain. Complete at the Notary
Buying a Property in Choosing the Property Serious thought may be required to first identify clearly in your own mind the type of property you need and the area where you would like to buy. Once armed with this information you would well be advised to contact several agents in the area of your choice to establish what is available and the price you are likely to pay. You should also check property websites, property magazines and newspapers to complete your overall picture of the market.
Using an Agent An agent can be very helpful to a buyer. He will provide a wide selection of properties, and local information. He may also help you to seek out the perfect property even though he does not have it listed already. Care should be taken in selecting an agent who will provide the experience to answer all your questions and guide you through the negotiations and sometimes complex procedures to the completion of your purchase.
Make an offer When you have decided on the property the first step is to make a verbal offer either directly to the owner or through an agent. Negotiations will then proceed until a price is agreed when you should appoint a lawyer to formalize the agreement.
Appoint a Lawyer The Lawyer, who should be fluent in your language, will carry out the necessary checks on the property and complete 10 Spanishmove

the legal requirements of the sale. The first check is normally to obtain from the Property Registry a “Nota Simple” which will identify the registered owner and provide details of mortgages or embargos on the property. You should obtain from the seller receipts for payment of IBI (Impuestos Sobre Bienes Inmuebles), the annual real estate tax. These will show the “Valor Catastral”, the assessed value of the property on which your property income tax will be based. If you are buying a new property ask to see the “Declaration de Alteracion de Bienes Naturaleza Urbana”. Where there is a community involved ask for receipts for community charges and obtain minutes of meetings from the president to identify any problems. A chat with the neighbours would also be a good idea.
Holding Deposit After the price is agreed and the “Nota Simple” has been checked you may wish to pay a small holding deposit to take the property off the market and reserve it until you can make completion. Your lawyer will prepare a formal offer and agreement for this purpose.
Exchange Private Contracts The exchange of private contracts or the signing of an option to buy would normally take place about two weeks after the formal acceptance of an offer, when the lawyer would have completed his searches. The contract would set out all the agreed terms and state a date for completion. It is usual for the buyer to pay 10% deposit at this stage which is non-refundable.
On the assigned day buyer and seller (or their authorised representatives) will attend the office of the Notary to sign the “Escritura de Compraventa” (the title deed) which should state that the property is sold free of charges, mortgages, and tenants. The notary does not check the terms but solely certifies that the parties have agreed them. At this point the balance of payment is made and possession passes to the buyer. Your lawyer will arrange payment of taxes and fees, and register your title deed at the Property Registry. This should be done promptly. Don’t forget to have the property insured.
The Costs There are three fees to be paid, Lawyers fees, Notary fees and Property Registry fees. Also there are two taxes, Transfer Tax (ITP) and “Plus Valia” Lawyers fees: usually about 1% of the purchase price plus 21% IVA. Notary fees: usually about 0.5% - 1% of the purchase price. Registry fees: allow about 1% of the purchase price.. Transfer tax: 8% of the purchse price but this increases to 9% when the purchase price exceeds 400.000€ and 10% for prices greater than 700.000€. When buying from a developer the purchase tax is replaced by 10% IVA plus 1.5% stamp duty. When buying commercial property or land 21% IVA will be added. Plus Valia: this is a local municipal tax and is based on the officially assessed increase in the value of the land since the last time the property changed hands. It can vary considerably and you should find out the exact amount from the town hall. Note that charges may vary in different regions.
Who Pay’s What? It is normal practice for the buyer to pay the above fees and taxes with the possible exception of the “Plus Valia”, but everything is negotiable and should be stipulated in the contracts. The vendor will pay his own Capital Gains Tax and the estate agents fees.

Greece on the Brink Should Greece exit, contagion to countries such as Spain and Italy becomes a concern adding to the effects on the Euro.
T
he ongoing Greek saga still remains closely watched by FX analysts this month, with Greece having notified the International Monetary Fund (IMF) it plans to bundle its loan repayments into one payment of around €1.6bn due 30th June. Greece had four loan repayments due to the IMF this month, on June 5, 12, 16 and 19 but has instead suggested it will pay all by the end of the month. If it fails to make the bundled payment, it risks having to leave the Eurozone and possibly also the EU. Delaying the payments mean Greeks get more time to negotiate with their creditors, but the European Commission (EC), the IMF and the ECB are unwilling to unlock bailout funds until Greece agrees to reforms. They want Greece to implement a series of economic changes in areas such as pensions, VAT and on the budget deficit before releasing €7.2bn of funds, which have been delayed since February. Analysts have pointed towards three potential outcomes for Greek debt crisis. The first outcome suggests that there will be no deal and Greece will default on its IMF and ECB repayments. In this instance, the ECB will likely pull the plug on emergency bank assistance leading to a run on Greek banks, capital controls and a potential Greek exit from the Eurozone (Grexit). Outcome two would result in Greece agreeing to reform deals with creditors at the last minute; avoiding default, staying in the Eurozone. We may see the Euro gain strength off the back of this result, in line with its recently strong economic data publications. The last outcome pointed to by analysts would be that no deal is reached, but both Greece and European officials paper over the cracks and Greece stays in the Eurozone for now. Whatever the outcome of the current Greek debt crisis, the main cause for concern is uncertainty. The biggest negative for any currency is uncertainty, and it is likely that no-one is willing to inward invest under any large risk umbrella. Additionally should Greece exit, contagion to coun-

tries such as Spain and Italy becomes a concern adding to the effects on the Euro. As the deadline approaches and financial markets grow ever more desperate for certainty, choppy trading activity is likely to persist and we may see the Euro no longer flirting with 1.40-level. On the other hand, despite the persisting Greek saga, the Euro hasn’t weakened from where we were a month ago. Still trading around the 1.40handle, this pair seems to have already priced in the thought of a Greek default and now it is simply waiting for the thought to turn into reality. Greece’s economy is relatively small and positive economic data from ‘powerhouse’ Germany can easily overshadow their current debt crisis. German economic data published towards the start of the month was very positive and largely exceeded expectations, helping the Euro gain strength in the short term. Across the Channel, UK GDP growth failed to be revised upward, staying around the previous 0.3%, down from 0.9% in the same period of 2014. This failure to improve hit the Pound, as it is now the fourth quarter in a row where the pace of growth has declined. Eurozone GDP growth is moving upward, despite the challenges, the Eurozone’s growth curve passed Britain’s in Q1 this year. Some analysts have pointed to Eurozone’s economic data being put back in the spotlight once the Greek saga ends with expectations for the common currency to move back around its 5-year average price of 1.25 against Sterling. The Pound’s prospects were lifted by evidence of a rebound in inflation when May’s Consumer Price Index result was on expectations at +0.1% monthover-month. This was a welcome recovery from the April deflationary print of -0.1%. Additionally, Wages Growth in the UK outpaced the consensus forecast of +2.1%, reading +2.7%. This supports the argument that inflationary pressures are building in Britain and that Bank of England (BoE) is justified in considering hikes to the local benchmark lending
rate. The combination of strong UK data and Greek nervousness has pushed GBPEUR up to 1-month highs and has put the 8-year high in the 1.42 handle in focus. As the Greek deadline approaches the probability of retesting those levels grows. Should any kind of 11th hour resolution be reached a relief rally in the common currency could be swift. Earlier this month, we saw GBPEUR push back to 1.3550, near levels we saw around the time of the UK General Election. At this rate, the cost of a €200,000 house would outweigh the cost of buying the same house now (rate near 1.40) by around £5,000! It is not uncommon for currency pairs to see swings of 4% or more within any calendar month, adding risk and uncertainty. However, there are tools that can be offered that can protect clients from currency movements, avoiding unexpected costs. Cambridge Global Payments can fix the exchange rate now for use in the future using forward contracts. Fixing the rate of exchange at the time of agreeing to buying a property and locking the rate for completion enables you to establish the cost of that property, with no fluctuations in the price. Whether the rate goes up or down during this period, your exchange rate is fixed at the level you specify. This means that if you lock in at 1.40 and the rate goes to 1.45, you have lost out, but if it goes to 1.30, you have gained. The purpose of a forward contract here is not to speculate on which way you think the rate will go; it is to remove this risk entirely, and to accept the rate at its current level. You wouldn’t buy a house in England without knowing how much it is going to cost – why take a gamble when buying in a foreign country where there may be unknown complexities in a system you are not experienced with? alon Varietes is a charming theatre hidden away in the back streets of Fuengirola. Here, over the last 30 years, a group of volunteers, keen amateurs and ex-professionals, have combined to produce shows, plays, and musicals of the highest quality, to entertain residents and holiday makers alike. Last month to celebrate their 30th anniversary they staged a 3 hour spectacular in the beautiful open air arena next to the bullring in Mijas Pueblo. The cast of 90 performed to a sell-out audience of over 900 people and those lucky enough to obtain tickets enjoyed a fantastic evening. The idea of a grand anniversary show was conceived by Val Williams, who is president of FOTA (Friends of the Theatre) and has been a very industrious supporter of the theatre over the years. The production was ably directed by John Gale (Johnny G) who also compared the show, along with Ricky Lavazzi, and Alexandra Avery who also expertly choreographed the many elaborate dance routines. The unenviable task of making sure everything ran smoothly on the night went to Stage Manager, Sarah-Jane Gale (better known as Box Office Sarah). The evening primarily comprised excerpts from the shows and musicals performed during the current season at the Salon Varietes Theatre and featured many fine individual performances. The evening came to a crescendo after mid-night when the whole cast took to the stage for a grand finale of song and dance. This was undoubtedly one of the best shows of the year - Well done Salon Varietes!
