Celebrating a decade of
EDUCATIONAL SERVICES
in Hermanus
Hermanus Math and Reading Centre was envisioned by Murison and Rhoda Kotzé upon their return from teaching in South Korea and Taiwan. During the month of May 2009 the couple identified the need for an education centre in Hermanus and decided to open a math and reading facility that would address various numeracy and literacy needs school going learners might have. Their initial focus was on providing lessons in Maths, English, Afrikaans, spelling, phonics and reading with comprehension! Currently their teaching portfolio also includes Science and Accounting, short courses in study skills as well as parenting and teaching skills through the Love & Logic® institute. During those early days, the education centre quickly expanded from operating from a double garage at the Overberg Therapy Centre, to their current premises in Mitchell Street where they have nine teachers consulting for them on a weekly basis. The education centre also has helped over a thousand learners improve their marks, confidence and skills during the past decade. They initially started out as part of a franchise, but parted ways after a couple of years due to the couple’s holistic vision for education. They shared a strategic dream of positioning themselves in education. Their vision for education remains to be the same as when they once started off; to make a difference where it is most needed … by implementing sound mathematical and language skills. Their individualised teaching approach and methodologies places them a cut above the rest as they believe that you need to be the change you wish to see in the world! M&R also offers three day short courses in junior and senior study skills which are presented during the school holidays. Learners are taught how to study smart, not hard. These specific courses are all about teaching practical and do-able methods to improve studying. While learners have loads of fun learning how to study, they also have the opportunity to learn so much more about themselves, their strengths and weaknesses, their learning styles and how not to procrastinate! Another well received course offered at M&R is parenting with Love & Logic®. This course offers skills and tools to all parents as it provides much needed support to the community of Hermanus because it takes a village to raise a child. Eight groups of parents have successfully completed the course since the launch in 2017. The next stepping stone for M&R is to make a difference in the teaching community through presenting a teaching course. All local teachers wanting to put the fun back in teaching again are welcome to attend this course in June (follow our facebook page for course details) You can visit www.m-n-r.co.za to read what parents and students are saying about the centre. As part of our 10 year celebration campaign we offer a 10% discount on our enrolment fee when you quote: “#itaddsup” and to our existing parents, 10% off your next tuition fee if you refer a parent to enrol at Hermanus Math and Reading Centre! THE BEST OF… OR MAYBE…
THE WORST OF…?
W
hen a band has been around for a long time and they’re kind of reaching their sell-buy date they invariably come out with a THE BEST OF Album. The fact that I’m contemplating a BEST OF Amulet, doesn’t mean that I’m on my last legs. Au contraire, my dear… As I approach my sixth decade… (still a couple of years away I may add) it’s time to take stock. We’ve come a long way from the naïve JHB Actress cum writer/director who talked her husband into buying a shop just because it was pretty. Trust me it was not smooth sailing. We soon realised that we had paid a ridiculous price for a business that wasn’t doing well at all. We’ve since turned that around, basically by not really knowing what we were doing but simply going on instinct and pushing personality. “Ek het my geskenk van-my- aan-my gekry. Ek gaan haar beslis probeer ontmoet. So ontmoet ek wonderlike mense in my winkel. Dankie dat julle my lewe kom verryk. How boring life would be. Ek het nog nie by THE BEST OF uitgekom nie… The more things change the more they stay the same.
SPLASH 4
Brace yourself, darling, according to TV news, economists, Facebook and the hordes of pessimists that inhabit the third rock from the sun, 2017 is going to be the worst year ever! And we all know that whatever you read on Facebook must be true. Let’s face it; 2016 was not our proudest moment in history and it finally proved one thing: the world is run by idiots. No thanks, I’m so not interested in the job. Besides I’m a tad overqualified. For starters I have a brain. And a conscience… And it follows that everyone who allowed these infamous leaders to come into power are idiots as well. And that of course includes the millions of voters…. That to me is the saddest revelation of all – the most intelligent species on the planet is actually everything but. It’s all doom and gloom, brethren. Ah… NOW I have your attention… It’s a known fact that humans thrive on bad news and tragedy… Ooops. Maybe you’ll lose interest when I tell you that my Super Power is that I can spot that feeble flickering light at the end of the crumbling tunnel. Because the good news is: Not everyone is an idiot. Ah. What a relief. The rest my friend, is up to you. It is up to you to choose NOT to be an idiot. You must seek out other non-idiots. That is this year’s challenge. You don’t have to listen to the hatred spouted by idiots. Move on, turn up the music, switch off the TV, unfriend the person. Stay far away… the condition is contagious. Trust me… spend enough time with the Idiot and his idiotic followers and soon you too will become one. It’s not easy being the odd one out… It takes courage. I have a fabulous little whale soap in Amulet: At the back it reads: if you were lucky enough to be born different, please don’t ever change. I just love that. Jy wat my foto vir ander mense gaan wys. I don’t do ugly. Kyk maar net na my winkel. Ugly maak my depressed. Soos ek hier sit en skryf is ek in Johannesburg

vir ‘n nuwe TV reeks waaraan ek skiet. Ek het my houding teenoor JHB verander.
Ek hoop jy vind daai ietsie spesiaal in jou lewe. Jy is enige tyd welkom. Inspirasie is nog steeds gratis.

WOMEN’S HEALTH: Focus on Natural Menopause T
he hormone replacement therapy (to do or not to do!) debacle has been raging for many years. Hormone replacement therapy (HRT) was regarded as a panacea to prolong youth, cure symptoms of menopause and prevent heart disease and osteoporosis. For many decades, women were convinced to take HRT as soon as the first sign of menopause appeared and to continue using them indefinitely. Now we know it’s not as simple as that! Some of us simply do not do well with HRT, and some do not ever want to use it, because of associated health risks or previous side effects from contraceptives. Now, genetic screening (available from our office) can identify whether your enzymes can break down HRT effectively and quickly enough to prevent accumulation for later health risks to manifest. If you have a constant concern about whether to use it or not, please listen to your intuition and come find out the many natural therapies to support your body through this life transition period, by gently guiding your physiology throughout perimenopause, menopause and post menopause. A billion-dollar scientific study that was conducted by the American Women’s Health Initiative (WHI), confirmed a while ago that using HRT for longer than 5 years increases a woman’s risk for breast cancer, heart disease, stroke and pulmonary embolism. The trials were actually halted three years early as the increased risks outweighed any benefit the continuation of the study might have provided. What is a woman supposed to do? • Many trials have been conducted to prove the efficacy and safety of plant hormones. Natural alternatives to HRT have all of the same benefits as HRT, but very few side effects because they are only 1 in 1000 to 1 in 10 000 as strong as HRT. • General health and wellbeing will improve by following natural guidelines. It is especially important for women to have a thorough heart health risk evaluation as part of an annual preventative medical examination, whether or not you have symptoms or a positive history. These include the usual blood screening tests, but be sure to request a complete thyroid and lipid profile incl. homocysteine, fasting glucose and insulin, C-reactive protein, and an exertion ECG. Heart related symptoms differ in women: • Chest pain or discomfort. Chest pain is the most common heart attack symptom, but some women may experience it differently than men, such as uncomfortable pressure, squeezing, fullness or pain in the center of your chest. It lasts more than a few minutes, or goes away and comes back. • Pain in one or both arms, back, neck, jaw, or stomach • Stomach pain • Shortness of breath, nausea, or light headedness, with or without chest discomfort • Sweating…breaking out in cold sweat • Unusual fatigue.
We always associate chest pain with heart attacks, and for good reason, but it’s not the whole story — especially for women. While chest pain is the most common symptom of a heart attack, women can have symptoms that aren’t related to chest pain at all. They need to be on the lookout for other, subtler symptoms, as these are seldom as dramatic as you might think (pain thresholds differ among us), and it can feel like pressure or heart burn that comes on over time. A natural approach to the menopause: There are many ways to ensure a smooth journey through menopause while simultaneously protecting your bones and heart by deciding on a natural approach. Here are some examples, all specific combinations formulated by myself and available from our offices and also online: • Suitable food supplements: • Antioxidant combination with vitamins A, E, C, B-complex, mixed carotenes, Co-enzyme Q10, minerals zinc, selenium and copper. Also include iron if your periods are heavy. (e.g. Heart Brain Body Support & Antioxidant and Female Balance). • Chromium to ensure constant blood sugar levels (in Appetrol and Heart Brain Body Support) • Calcium, magnesium, boron – in an amino acid chelated form in the correct ratio and vitamin C and D to prevent osteoporosis and improve bone density. All of these work together in the metabolic processes and bone mineralization, so look for a supplement containing all of them. (e.g. Calcium and Magnesium Balance) • Essential fatty acids (Omega 3, 6, 9) – needed in most body functions and SPLASH 8
important for female hormonal balance and health (e.g. Super Omega caps) • Low impact weight bearing exercise such as yoga (the sun salute, cat, lion, cobra, thunderbolt, child or hare positions), dancing, walking, swimming. Refer to Anri’s FitSmart online 15 minute exercise guide)
Dr. Arien van der Merwe
• Some well researched and effective herbal remedies (the correct ratio of ingredients is available in Female Balance in combination with Heart Brain Body Support & Antioxidant, topped up by specific single herbal remedies for symptom support): • Herbs that alleviate menopausal symptoms will also help for PMS, painful periods and irregular periods: black cohosh (Cimicifuga racemosa), the isoflavones genistein and daidzein found in soy beans food, wild yam (Dioscorea species), Angelica sinensis (Dong quai) and chastetree berry (Vitex agnus castus). • St John’s wort and Ginkgo biloba for brain fog, to improve concentration and mood, diminish palpitations and improve mild to moderate depression • Angelica sinensis (Dong quai) balances female hormones • Ginseng species, Ashwaganda and liquorice root as part of an adaptogen combination to support the body through stressful times • Sage and black cohosh (Cimicifuga racemosa) for hot flushes • Daily relaxation and stress management techniques – at least 20 minutes every day of becoming quiet, focusing on your Inner Being or soul, the connection to your Source of Wellbeing; relaxing, breathing, contemplating, writing in a special journal and reflecting on your life, it’s ongoing purpose and the changing function in your roles as woman, that is a natural part of this life transition period. (My Stress Solutions relaxation CD will support you if you’re a beginner to meditation). This is a time to pay attention to your soul needs, your life’s meaning and purpose and finding inner peace and happiness. The soul loves beauty: surround yourself with fragrant oils, flowers, silky colourful cloth, a special sacred space adorned with crystals, special symbols, pictures of loved ones, etc. Write down your life’s journey so far, and give thanks for the strengths that brought you to where you are. Consider your soul purpose, what you still have to do, or want to do with the rest of your time on earth. • Eating guidelines for daily use (refer our EatSmart Guide for more info): • Low in refined sugar and saturated fat • Low in salt • Steer clear of too spicy food, hot drinks, too much alcohol • Increase daily intake of vegetables (3 portions, different varieties), fruit (2 portions) and a mixed salad • Lower intake of red meat to once or twice a week • Increase intake of fatty fish and poultry • Increase intake of legumes, nuts, seeds, beans, peas, lentils, chickpeas, linseeds, soy – at least 3 times a week, preferably every day • Include 250ml of full cream dairy products, soy milk, yoghurt, etc. • Increase use of cold pressed linseed, olive, grapeseed, canola oils • Drink 250ml water for every 10kg in body weight every day Peri-menopause: Some women go through a peri-menopausal period many years before the menopause actually starts. There can be a period of heavier bleeding, more painful periods and/or emotional upsets, even while the periods still occur fairly regularly. And finally, we have to approach the transition into menopause in an integrative way. Managing menopause is about managing your entire lifestyle (including controlling fat accumulation in some of us), understanding that this is a natural life transition period into the wisdom years, surrendering and letting go of old emotional baggage, deeply connecting with your soul-self, using the correct food supplements, daily relaxation and healing herbs to gently assist you through the before, during and after-burn of menopause. Why do
children need
Pilates? Pilates teaches the discipline of body, mind and soul. That is why Pilates can lead children to a stronger body and calmer mind. When their bodies are strengthened, it increases a child’s self-esteem, stamina, abdominal strength and improves their sleep. The aim will be to focus on the breathing techniques which will contribute to a much more serene and less stressful outlook. Nowadays the modern child is exposed to eating fast food, watching TV and playing video / cellphone games. Statistics by the Medicine of the National Academy of Sciences indicate that approximately 30 % of children between the ages of 6 to 11 are overweight and 15 % are obese. And these statistics are on the increase as I type. There is, however, no reason to get young children involved in demanding forms of exercise programs with more aerobic-oriented
SPLASH 10
or cardiovascular exercises. Keep in mind that the delicate skeletal frame is still in its developing phase. As children grow, their bodies are in a constant state of change and development. Therefore, Pilates can, just like for adults, also benefit children. Improved posture and spinal alignment are realized as exercise increases the strength and flexibility of the abdominal and inner muscles of the body (the core). Through Pilates, children can gain awareness of their body, and learn how to move efficiently and gracefully. Posture is the position of the body, the way they walk, the way they sit, the way they bend over, etc. Pilates can help establish correct principles of movement that children will use for the rest of their lives. It can also reduce the potential for injury.
of
Anneke Theron
Apart from physical fitness, having a strong core can open up other benefits for children like improved concentration while learning. When core stability is absent, sitting and standing for extended periods in school can be difficult. If children are expected to focus and maintain stability throughout the day, their stamina for homework and other after school activities may be depleted. Drome
en deure ...
E
Daar is so paar dinge in die lewe waaroor ek redelik vocal is.
SPLASH 11

RASSIE’S DILEMMA
2019
All the South African teams are really performing poorly and are extremely inconsequent in this year’s super championship against the Australian and New Zealand teams. It is a big source of concern for South African rugby with the World Cup championship that is at hand. In actual fact, Rassie’s hands are tied because if he selects experience he will be criticized for not giving younger players a chance and if he selects the younger players, he will be criticized for not utilizing existing experience.
T
he fact of the matter is that the senior players are not performing well in any of the Super Rugby teams and are not leading by example. There is no leadership by our senior players setting an example for the junior players. NONE whatsoever.
Secondly, there are no junior players that are lifting their heads and saying ‘this is where we are now so let us do something about it!’ NONE whatsoever. The result is simple…stalemate! And that is surely what we are currently seeing on the field. We need players with personality and courage to enable change. One of the most fundamental aspects of education/training/ coaching is no doubt to add knowledge and even more importantly is to unlock potential. Only then can positive change be brought about. The current methodology of coaches, of whom there are now about 5 or 6 with every team, of adding knowledge must be admired. They have many modern aids whereby solutions to questions and uncertainties can be sought from different angles. This can unfortunately, lead to confusion when not utilized sparingly and with insight. Should each of the 6 coaches provide each individual player with 3 solutions after each game, the player will have 18 issues
SPLASH 14
to think about and work on. After 3 games, he will have 54 issues to address. Not that everything will be new each week, but the fact that the individual’s attention in relation to his game is so fragmented cognitively where he actually should be capable of instinctively making decisions in a fraction of a second, just has to be confusing. Over-loading brings about confusion and doubt which both are negative destructors of team cohesion. Then each player plays just for himself and tries to survive in his own right. And this is exactly what we see happening week for week. The other side of the coin is a methodology of developing each player’s potential. This is a much more circumspect method of coaching where the coach does not bombard the player with his (the coach’s) knowledge of the game, but leads the player to the self-discovery of the next level of knowledge that he requires to play effectively at the level of the game where he is playing. The player then actually finds the answers to his own needs that arise as soon as he reaches the next level. If the player does not find the answers himself, it is an open question to the coach whether the player is ready to play at that level. This method is equally applicable in the context of a maths
class. If the learner does not possess the potential to do grade 12 maths, there is no point in forcing him to do so. He simply will not succeed. One thing is certain, and that is that everyone who plays rugby is not a Springbok. This is also good and how it should be. Springboks stand on the shoulders of those that did not make it to the top. The stronger the base of the pyramid, the better our rugby is. The base of the pyramid determines its height. That is why it is extremely important for our coaches to understand this concept. Without this understanding, the results will show them up. That is a given.
“You do not have to change. Survival is not mandatory.” W. EDWARD DEMING
Enjoy the rugby!

Jim Adams
F
ifty years ago this month, the world held its collective breath, as Neil Armstrong and Buzz Aldrin descended in the Apollo Lunar Module to the surface of the Moon, while Mike Collins orbited in the Command Module above. It was a daring feat that marked a change in history and became the source of many new references. Soon, phrases like “Moon shot” or “Apollo moment” or “Space Age” were ubiquitous and used in casual conversation to describe almost anything new or challenging. But today the phrases themselves are slowly receding into our history, replaced by words like Google and Amazon. We barely recall the idea of Space Age, let alone the trials and determination it took to accomplish such an amazing achievement. As a lifelong rocket scientist and former NASA employee I would love to continue recalling the past, but we must move forward as a culture and as humanity. Lest you think I would ignore the Apollo landing, let me say I think it’s important to recall, reflect and celebrate, so that we can move forward, building on our past accomplishments. The late 1950’s and the 1960’s were competitive times. The Soviet Union had lofted Sputnik and Uri Gagarin into orbit, the US had responded with Explorer 1 and Alan Shepard, touching off a space race that was steeped in as much fear as it was technological advancement. In the 1960’s space was a frontier that was viewed as a place where one nation might be able to dominate another. But Apollo 11 changed that. It brought an end to the race and as we decided what was next, slowly the world began to see space as a destination that would be best explored in collaboration and for the benefit of all mankind. So today we not only celebrate the 50th anniversary of the first human landing on the Moon but we recognize that, in its wake, no less than 15 nations have joined together to establish a permanent presence in space. The International Space Station overflies most of the globe and has been established as a place for peaceful collaborative science and research.
As an aside, South Africa played a significant role in enabling the Apollo missions, and many others, via the Deep Space Network communication station at Hartbeesthoek which linked back radio data from both the unmanned precursors and the manned space flights to the Moon. You can still visit that antenna today, it’s part of the HartRAO radio astronomy complex, just outside Johannesburg. Humanity has only yet dipped our toes in the possibilities of space. Today because of Armstrong and Aldrin, and the ISS, the world enjoys a $350B (USD) commercial space industry ranging from research and communication to tourism and, eventually, mining. The potential is only limited by our imaginations. Mark Shuttleworth, the world’s first space tourist, said “I don't expect my flight to produce a generation of astronauts and cosmonauts back home, but I hope it will encourage people to pursue their dreams.” I dream of moving our permanent presence from Earth’s low altitude orbit to the Moon and Mars… in my lifetime. And then to the stars as Humanity becomes interstellar. To do this we need a generation of visionaries, of engineers, of scientists and explorers from more than just 15 nations, but rather, from around the globe, all seeking to move us forward and outward. One might ask, “But don’t we have enough problems here at home?” Yes, we do. I believe a common bodacious goal, like establishing residency on both the Moon and Mars will unite us and empower us. And along the way we will find solutions to the issues here on Earth. As Nelson Mandela said, “It always seems impossible until it’s done.” Let’s go do it. SPLASH 11

Ek het my opleiding as klassieke sanger ontvang by die groot maestra dr.
Toe vra hy vir my of ek die aand sal behartig.

My definisie was; “Only a mere miniscule of musicality lies in hitting notes correctly, true musicality is hidden in the spaces between the notes.”

David Bowie D
avid Bowie was born David Robert Jones on January 8, 1947, in Brixton, London to Margaret Mary "Peggy" Jones, a cinema usherette, and Haywood Stenton "John" Jones, a publicity director for an orphanage. Haywood helped organize charity shows in the '50s and introduced his son to all the stars, giving David an early look into the entertainment industry. David changed his name in 1966 to avoid confusion with Davy Jones of The Monkees. He told Rolling Stone the name comes from the Bowie knife: "I was into a kind of heavy philosophy thing when I was 16 years old, and I wanted a truism about cutting through the lies and all that." He sparked off a minor media frenzy when, on a promotional visit to the US, he opted for woman’s clothing. The Bowie-ina-dress outcry that forced one album to be withdrawn and resleeved, was just a warm-up for his Melody Maker interview in early 1972 when he told the world that he was bisexual. Yet,

despite such publicity, his early Seventies albums failed to stir the public as much as they did the critics.
David had UK number ones with the 1980 single ‘Ashes to Ashes’, its parent album Scary Monsters (and Super Creeps), and ‘Under Pressure’, a 1981 collaboration with Queen. He reached his commercial peak in 1983 with Let's Dance; the album's title track topped both UK and US charts. Throughout the 1990s and 2000s, he continued to experiment with musical styles, including industrial and jungle. Hy het sy film debuut in die 1976 rolprent, The Man Who Fell to Earth, gemaak. Jack Celliers vertolk. It is a myth that David had two different colored eyes. In fact, they were both blue, but the pupil of his left eye became enlarged and frozen after a fist fight with his best friend, George Underwood, in school over a girl. He and George stayed friends and played in a band together as teens. In 2004
during a concert in Norway, a lollipop was hurled on stage and wedged itself in his left eye. Thankfully, he escaped serious injury. David is op 24 April 1992 supermodel Iman. In Junie in Italië getrou omdat hulle Switserland wettig was. Die in 2000 gebore.

In 2003, David turned down a knighthood from the Queen. He said: “I would never have any intention of accepting anything like that. I seriously don’t know what it’s for. It’s not what I spent my life working for”. David died from liver cancer at his New York apartment on January 10, 2016, two days after the release of his Blackstar album. After his passing, his family revealed that he had been diagnosed 18 months earlier. The day following his death, fans flocked to VEVO and streamed his music videos a total of 51 million times in 24 hours. In doing so, David became the artist to achieve the most amount of streams on the VEVO platform during a 24hour period. Adele previously held the record with a total of 36 million views across her catalog on VEVO within a 24-hour period.

Some interesting facts relating to owning your property in a trust Having been involved in property sales for more than 33 years, it is very interesting to look back at property ownership and how purchasing in different entities has evolved. The possible entities include individual owners, joint ownership, partnerships, private companies, close corporations and trusts. Purchasing in a trust is currently the popular choice for different reasons, so let’s have a look at what it actually entails and means to the property purchaser and what the consequences are or can be. It is important to remember that a ‘trust to be formed’ cannot enter into an agreement to purchase a property and must therefore already exist when a property is purchased. The trust only exists legally when the trustees have been appointed by the Master of the High Court who is the legal custodian of all trusts.
The trust founder
Should the decision be taken to purchase in a trust, an inter vivos trust will have to be set up by its founder in order to purchase and transfer the ownership of the property into the trust. An inter vivos trust is one that is set up during the lifetime of the founder. (A testamentary trust is one that comes into existence on the death of a person in terms of his/her will). But, it is also important to take note that as the property belongs to the trust and not the founder of the trust, the founder must ensure that he/she always performs in the best interest of the trust and its beneficiaries only, or else the trust may be viewed as the founder’s alter ego which could result in the trust’s assets being included in creditors’ claims against the founder. The main advantage of purchasing a property in a trust would be the optimal management of the purchaser’s assets when the founder of the trust passes away. It is however important to take note that the setting up of the trust could be quite costly.
The trust beneficiaries
The founder of the trust needs to name the beneficiaries of the trust in the trust deed and can be amended by the trustees from time to time in terms of the trust’s stipulations as set by the founder. Beneficiaries are the only people who can benefit from a trust and an inter vivos trust is regarded as a contract between two parties - the founder and the trustees - for the benefit of the beneficiary/ies. The main benefit that the beneficiaries of a trust have, is that they can still continue to enjoy owning the property when the founder passes away and the property cannot normally be attached by creditors of the trust’s beneficiaries.
The trustees
All trustees are accountable to both the Master of the High Court as well as to the trust beneficiaries. They are the guardians of the trust’s assets and have a fiduciary duty to manage these assets in the best interests of the beneficiaries, as set out in the trust deed. All the trustees are required to act jointly. Even when the trust deed stipulates that the majority of trustees can make a decision, the resolutions must be signed by all trustees. To simplify: a trust is an arrangement that allows SPLASH 22
a person or persons to hold assets (without owning them) for the benefit of the trust beneficiaries. This definition makes it clear that someone sets up a trust for the benefit of beneficiaries (not only for yourself, as one of the beneficiaries), transfers assets into a trust, and the appointed trustees manage the trust’s assets on behalf of the chosen beneficiaries. In terms of property it is interesting to note that it is viewed by the courts that the nature of the ownership thereof is deemed to be that of joint-ownership by the trustees. (The names of the trustees appear on the title deed as the owners of the property in the trust.) A trust is recognised by its registration number and not by its name. Since joint-owners must act jointly, trustees must also act jointly… which means that the alienation of the property requires that all the trustees must agree on the sale and if there is unanimous agreement, they all need to sign the relevant sale documents. Should it be found that trustees have not acted with the necessary care, skill and diligence during their term as trustees which in turn results in the trust suffering a financial loss, they can be held personally liable. This also applies if one trustee has authority to act on behalf of the trust, and makes a poor decision, then he/she can bind all the trustees as being negligent.
Can a trust be sued?
A trust itself cannot be sued because it is not recognised as a legal person. However, the trustees, in their capacity as such, can be sued. Trustees cannot be indemnified in the trust deed from their duties in terms of managing the trust with care, skill and diligence. Criminal liability may be imposed upon a trustee for example fraud, theft or any other illegal conduct. Trustees can also be sued for damages by beneficiaries if the trustee/s have acted negligently, whether the trustee/s had been acting intentionally or in good faith.
Pam Snyman
Who is liable in the case of a damages claim against the trust?
The trustees are jointly and severally liable for damages incurred by the beneficiaries or third parties like creditors, who have suffered a loss as a result of breach of trust who are then entitled to bring a claim for damages against the trustees. An innocent trustee who was not involved in any specific wrongdoing may be held liable for the actions of any of the other trustees. Remember they are meant to act jointly!
