On With T Ian Muller he FynArts festival gave us at Whale Coast FM, (Community radio) the opportunity to get involved with the arts. This has been the first time and by far not the last time that we will be involved. It has also been my privilege to be a part of this wonderful opportunity to highlight the various artist. As part of the “audience” this is an excellent opportunity to be exposed to the various art forms available on our doorstep.

Beautiful Hélène Truter

W

hen Percy and I took the plunge ten years ago and sold everything to move to Onrus, I had my doubts. I was a city girl, I loved the buzz and energy of Johannesburg. Our young daughter, Jana was not impressed with the move. “Why so many old people? There’s nothing to do in this place.” How things have changed… Once again we are fortunate enough to host the annual FynArts Festival. And visitors from all over will come and enjoy the Arts in all its shapes and forms. Find a convenient parking spot and you can literally walk from the one fabulous offering to the next. I’ve always maintained that humans need to be surrounded by beauty in order to flourish. Which is one of the reasons why Amulet still exists in spite of tough economic times. As I write this, I’m in Johannesburg. The economic hub of Africa they claim. Wow, how this place has changed. It’s a Sunday afternoon and I head off to the Rosebank Rooftop Market. I’m always looking for new suppliers and inspiration. On the way there I notice how deserted the streets are. Where is everyone? Have they all moved south? Or are they hiding? As I drive through the suburbs I become aware of the even higher walls, electric fencing and guard huts on every corner. Security companies are flourishing. Not so much beauty here. The Rosebank Mall is a letdown – same old same old - chain stores you find everywhere… The traders at the Rooftop Market are equally uninspiring. The shoppers look listless… aimlessly wandering around. Desperate for something creative to perk me up, I decide to pop in at the Cresta Mall. I’m faced with exactly the same stores as seen in Rosebank and shopping malls all over South Africa. Which is fine if you want to be or look just like everyone else, but unfortunately I’m not much of a conformist. Somehow I was hoping to find a few interesting shops with unusual/ quirky items, or at least something different; but alas, I leave empty-handed. As I drive home, I hear a disturbing news report on the local radio station. Apparently a store in the Cresta Mall has just been held up by armed men. The third attack in the past month. Luckily the place that I booked through AirBNB is as beautiful as the photos on the website. This will keep me sane during my stay – I simply can’t do ugly. I decide to explore the suburb of Emmarentia (my place of birth) on foot during my spare time. Quite an interesting experience. Everyone knows how dangerous the streets in the City of Gold are. I am quite literally the only white person treading the uneven and overgrown pavements. The JHB traffic comes rushing past, perilously close as I sometimes have no choice but to step off the pavement because of some huge obstacle. The other pedestrians, mostly black workers, greet me warmly. I stroll down to a small group of shops that serves the local community and I find that

missing something that I’ve been searching for. An old fashioned Greengrocer, an authentic Chinese reflexologist, a paint store that sells much more than just paint, small enterprises run by their individual owners. People who chat to you, give you advice and remember you when you come back the next day. Very much like the Old Town in Hermanus which I’m missing like crazy at the moment. I’m kept in the loop by Facebook and a local WhatsApp group about the unrest in the Overberg. Just before I left for JHB, the riots had already started so I’m well aware that many of the hysterical reactions are mostly not a true reflection of what is actually going on. Yes, there were days that is was safer for us and our staff to keep the shop closed. A first for us in eight years. But what was even more upsetting to me were the hateful comments that were posted on social media. By people that I knew. Or thought I knew… And in the meantime the long-awaited rain came. Not much gratitude expressed on FB. Residents were too busy moaning and playing the blame game. I have yet to read a positive suggestion to improve the situation. There are two sides to every story… Why not work towards a solution instead of spewing hatred and negativity? If that’s what you put out, that’s what you will receive… The universe will comply. Today six people, including children were beheaded in Mozambique. Hardly got a mention… Puts our problems into perspective, doesn’t it? ………………………………………………… By the time you read this I will be back in my beloved shop. I’m actually suffering from withdrawal symptoms! I plan to spoil the man in my life on the 17th – If you’re a regular you will know exactly who he is – that very charming man with the blue eyes that bakes the best carrot cake in South Africa. Not to mention his amazing cappuccinos. Feel free to pop in on your way to an art exhibition or a musical event. Or just pop in anyway. A visit to Hermanus is not complete without a visit to the prettiest shop in town. We do art as well, in fact we specialize in ‘useful’ art. Curious? Come and see for yourself. I have to warm you though, you may end up staying longer than planned, so plan your day accordingly. We look forward to welcoming you… Because we are carrying on - regardless of tough times and riots and pessimists… Throughout the ages it has been proven that the human race can only survive if it is prepared to evolve. Innovation is the key. I’m always up for a challenge. In fact I thrive on it. I look forward to re-inventing Amulet – but rest assured, beauty will always be at the core of our business. And if we can help you forget about your daily stress and feed your soul, then our job has been done. Beautifully.

Los jy net so graag jou opinie daarop?

Hoopvolle groete.

Through a series of serendipitous events in the early 90’s in the small wine making town of Stellenbosch, Arno Carstens, Theo Crous, Adriaan Brand, Arno Blumer and Francious Kruger became the Springbok Nude Girls. Little did they know that they would go on to become one of the most loved rock bands South Africa has ever seen, known for their high energy stage shows and unique musical sound which combines Punk, Reggae, Metal, Funk and Jazz. They played their first gig in September 1994 in a small bar in Stellenbosch and released their first album, “Neanderthal 1” the following year. Since then, this platinum selling, award winning band have gone on to record albums that contain some of our country’s most beloved anthems. They have headlined every major South African music festival, and performed at some of the most auspicious international festivals in Europe. Twenty four years after their first show, and two decades after the release of “Blue Eyes”, the song that redirected the trajectory of the band, 2018 marks the year where it all comes full circle. During their successful and powerful nation-wide tour in 2017, the Springbok Nude Girls found that their fans were as hungry as ever for their music. It felt like a natural progression to write new material.

SPLASH 6

“It is 10 years after our last album and 20 years since we wrote Blue Eyes; all signs, I guess. With a band like us who has been together for so long... when the feeling takes hold, you go with it. You never know if it’s your last. For us making an album these days is not about relevance or making some inflated statement. It’s about 5 guys doing what they do best and having too much fun with it. Hopefully the end result will reflect this,” says Arno Carstens, lead singer of Springbok Nude Girls.

The band went back to their roots, and are releasing their music independently. The first single of 2018, Beautiful Evolution, was released on a limited edition signed 7” vinyl during the super successful Beautiful Evolution Tour which kicked off at the end of April 2018. This vinyl packs a punch with the savage sounding Best Friends, Best Enemies exploding onto the B-side. Only 60 of these vinyl were made available to the public and quickly sold out. The two tracks on the vinyl were digitally released on all the major online platforms on 27th April 2018. Springbok Nude Girls will release a full length album later this year. More details will be announced in the months to come, but expect the Springbok Nude Girls to be unpolluted, powerful, real and rampant as ever.

“The vibe I have gathered from this album is that it is unpretentiously light-hearted good fun, riddled with great energy with some punk undertones and, of course, some big Nude Girl classic rock songs,” says Arno Carstens.

Lighting Matches by Tom Grennan

Grennan will be releasing his debut album in March 2018. He dropped a new single, Royal Highness 21 September 2017. This soulful singer/songwriter was singing in pubs in Britain when he landed himself a deal with a record label who just happened hear his gig. His genre has been classified as Alternative/Indie. His breakthrough came with a feature on Chase & Status’ single All Goes Wrong, Tom’s raspy vocals seems to have had an effect on audiences as he continues to play sell out gigs.

Wonderful Wonderful by The Killers

Texoma Shore by Blake Shelton

Spirit by Depeche Mode

Carnival of Rust by Poets of The Fall

September 2017 saw the fifth studio album by this American Rock Band. They enlisted Mark Knopfler of Dire Straits for some guitar parts on this album. BBC News’ Mark Savage called it “The Killers most vital album since Sam’s Town in 2006. The Editor for AllMusic claimed that “By this point, Flowers’ (vocalist/songwriter) obsessions and signatures are so idiosyncratic” and “the record charms because its ridiculousness is sincere and his sincerity ridiculous”. If you are a fan, you will no doubt enjoy the album.

This is their 14th Album. Depeche Mode are one of the most popular synthpop acts that emerged from the UK post-punk scene around three decades ago. Since 1993 they dropped the pop angle. Nearly every song laments the death of human decency and they’ve added a hard-line political stance into the mix. Over solemn piano chords and electro, front man Dave Gahan, in his golden throated baritone asks “When is it going to trickle down” and “Where’s the Revolution” in an effort to get the masses to wake up.

Released 3 November 2017. This American Country singer/songwriter, actor and television personality has just been voted Sexiest Man Alive by People Magazine. This is his eleventh studio album. The album’s first single “I’ll Name The Dogs” is a back to basics country sound. Shelton embodies a sound that is grounded and down to earth, and his charm comes through in his music. He has sold over 30 million records to date and is one of the Country genre’s modern day staples.

They are currently working on their eighth album to be released in October. This is a Finnish Alternative Rock Band consisting of six members. Their genres also include post-grunge, Indie Rock and Progressive Rock. The band was founded in April of 2003 and have been the recipients of numerous awards since then. They gained attention when their music was used in several Video Games. Their music is available on digital music retailers’ iTunes, Spotify, streaming services and select record stores.

AUTUMN LEAVES, RED, GOLD AND BROWN, SWIRLING, FALLING, DRIFTING DOWN … Our European swallows have flown. Autumn leaves are falling.....winter woolies are out. We cuddle up to a warm fire, resting. It’s been a long “season” in Hermanus and our little village seems to get busier and busier. Now is OUR time to rest, recuperate and....REFINE.

Winter is a great time to catch up with ourselves and get done what we never have time to do. There are many aesthetic treatments which take time to reach best results and for good reason. The skin cycle is 8 weeks. During each skin cycle the body regenerates a whole new skin. From the basal layer all the way up to the waxy keratin cells. It is a great opportunity to rectify sun damage, over a skin cycle, during the winter months. Skin needling is ideally done in combination with a peel, targeted to treat different problem areas, with different peel solutions. The pixel peel package is four treatments done every two weeks for 8 weeks. It is a good treatment to do when the sun is not strong, so that the skin can recover fully in the safety of the Winter Sun. Laser, stimulates collagen, tightens and lifts. Laser is a heat treatment and though it is not strictly only done in winter, winter is the perfect time to do heat treatments so that your skin does not pigment in response to heat. Collagen also takes time to build up in the skin, which is why best results are seen from 6 weeks to 3 months. If treatments are done in June, your results, which are long lasting, will be best seen in a few months, just in time for Spring.

Leg Vein treatments by Dr Michelle, should be done over three sessions, one month apart. Schlerotherapy or leg vein treatments are done by a series of painless injections into the veins. Veins from the size of a fine thread up to wide thick meandering varicose veins can be treated by leg vein injections. After each treatment the legs are bandaged for three to five days depending on the width of the vein. Full length elastic stockings can also be used. One can appreciate that cool winter weather is a much better time to cover up legs. It also gives the patients’ legs time to recover completely, just in time for summer shorts and long walks on the beach. Hair stimulating treatments have been in the news recently. It is very easy to stimulate hair growth after excluding medical conditions which may preclude growth. The doctor will ensure that health is optimized and causes of hair loss such as hormones, thyroid, low iron levels are corrected before implementing treatment. In a stepwise treatment plan we can start with hair growth shampoos. If these don’t work, Dr Michelle will prescribe minoxidil hair foam which is massaged into the hair daily. This foam switches off the testosterone receptors, which are responsible for hair loss. Thus, when suppressed, the body can freely produce hair again. We are having excellent results with inclinic hair stimulation procedures. This treatment consists of alternating hair serum injections with platelet injections. Injectable serums are carefully placed deep in the scalp. The serum has growth factors, amino acids and minerals which create an ideal growth milieu for hair. It replenishes factors which may be missing or depleted. Platelet therapy also known as PRP, is a treatment whereby the doctor draws blood which is then spun in a centrifuge, to separate blood cells from platelets and blood serum. The platelet rich plasma(PRP), is then injected back into the patient’s scalp. Platelets contain phenomenal concentrations of growth factors and stimulating proteins. Like stem cells, they can be used to stimulate growth, second to no other treatment. LPG Endermology(LIpomassage), is another treatment which happens over a period of time and in several sessions for best results. Clinical research shows that 6-12 sessions are ideal. LPG is used to rid the body of toxins, stimulate lymph drainage as well as slimming, toning and smoothing cellulite. If you want a summer body....you got to make it in winter. This winter...NOW. Winter Blues can sometimes result in a buildup of lazy fat! That’s why we’ve chosen to launch our Winter Weight Loss Program, “Weight Control Clinic Hermanus(WCCH)”. Dr Michelle has partnered with Dr Arien VD Merwe and Sports Scientist Anri Van Rooyen to bring a revolutionary, natural, non-hormonal weight loss program to Hermanus. Science, support and a balanced mindful approach to food, is the key to the success of this program. The program utilizes the scientifically proven Inbody scanner to accurately assess the body’s protein, bone mineral and fat content. One can thus use a focused approach to decrease dangerous body fat and increase protein/lean muscle mass. Winter is the perfect time to get that Summer Body. Contact Dr Michelle for more details.

The Humble Sock!

Imagine going to school without socks or going to bed with cold feet…trying to keep warm, but your feet are frozen all day and all night.

Odd Socks came about one day whilst driving home from the airport and being cold all day from not wearing socks. An advertisement for a charity collecting blankets came on the radio and so the idea of Odd Socks was born. Deciding to go big with the idea, we immediately spread the word via Facebook and Twitter to get the ball rolling. The response was incredible! We all have loads of single socks lying around at home. Odd Socks will take them off your ‘hands’ and pair them up for charity! We’re collecting clean single socks (and pairs) to donate to those less fortunate who don’t have anything to keep their feet warm this winter. It’s been 5 years since we last collected socks to warm a couple of cold toes in Cape Town and now it’s time to start this drive up again and see if we can make the winter a little shorter and more comfortable for a few people. This year we’ve decided to focus on the Onrus/ Hermanus area with the help of a few generous friends, and I cannot wait to see the outcome.

Taken for granted, often missing its partner or forgotten on Sock Island!

Collection will be through April and May. We are hoping to distribute the socks in June. It’s a short drive this time around (with winter upon us), but I’m sure you’ve got a few single socks at home, that missed the trip to sock island. Old, new, plain, stripy, spotty or patterned or even perfectly matched pairs, Odd Socks wants your Odd Socks! We are collecting all shapes and sizes for the next 2 months so that we can distribute these as soon as possible. How does it work? All you need to do is collect your single/odd socks and send us a message on our Facebook group and we will try to arrange collection. You are also more than welcome to drop your socks at our friends at Whale Coast FM as well as the Splash! Magazine office.

In Which Legal Entity Should You Purchase Property?

PAM SNYMAN

Once a property has been selected as the most appropriate for the purchaser, he/she needs to choose a vehicle that will hold the property. There are different entities in which the property can be registered. The choice will rely mainly on the objective for which it is required. Before purchasing a property, consider the best structure to use. Factors to consider when making a choice of entity would include costs of purchase and of ownership, personal estate planning, security of ownership, taxation when acquiring, future disposal taxes, possible future creditor claims, etc. The possible entities include individual owners, joint ownership, partnerships, private companies, close corporations and trusts. 1 An individual. A property can be registered in an individual’s name alone who is then solely responsible for all payments, rights and duties in respect of the purchase and sole ownership. 2 Joint Owners. In the event of more than one person acquiring a property jointly, they will have collective pro rata liability for payment of the purchase price and will own the property jointly in undivided shares. This means that the title deed as registered in the Deeds Office will show each joint owner as holding an undivided share in the property. Many problems can arise when joint or co-ownership is decided on and it is advisable that the joint parties enter into a written agreement signed by the parties setting out issues like: a each owner’s ownership portion, i.e. 50/50 or 60/40 or in accordance with their contribution towards the purchase price. b payment of transfer costs, municipal services, rates and taxes, bond instalments, improvements to the property, insurance premiums, etc c the sharing of possible rental income, or occupation in the event of a holiday home d if a life partnership couple are purchasing jointly, there must be a co-habitation agreement in place that speaks to co-ownership e in the event that one joint owner wants to sell his/her undivided share he/she is entitled to do so without consent of the other owner/s unless a written agreement to the contrary exists, and f how they intend handling the situation if one joint owner goes insolvent or dies 3 A partnership. A partnership is not a legal person. This means that the rights and duties of the partnership are those of the individual partners. As long as the partnership exists, the partners are joint debtors. This means that they can be held liable collectively for the partnership debts. Should the partnership dissolve or the estate of one of the partners be sequestrated on insolvency, this rule falls away and the partners will be held jointly and severally liable for all debts incurred during the partnership. South African law allows for a maximum of 20 partners in a partnership. 4 A private company. A private company exists perpetually and separately from its shareholders. The company owns its assets and any liabilities are binding on the company, in other words only the company can be sued for payment of the debts it incurs, its shareholders are not liable individually. A company cannot enter into a contract personally, but can do so through its ‘duly authorised representative’. The contract must clearly state that the individual is entering into the agreement for and on behalf of the company. A sale to an unincorporated company is void. An agreement SPLASH 12

can, however, be entered into on behalf of a company to be formed by a nominee purchaser. This can, however, incur liability for transfer duty by the company, once ratified as well as the individual signing the purchase agreement on behalf of the nominee purchaser. Once the company is incorporated, the purchase of the property can be ratified or adopted by the company. A private company may have a minimum of 1 and a maximum of 50 shareholders. 5 A close corporation. Since 1 May 2011, it has been impossible to incorporate a new close corporation in South Africa. There are, however, still hundreds of thousands of close corporations in existence. They are regulated chiefly by the Close Corporations Act. A close corporation is a juristic person distinct from its members. A close corporation enjoys the same benefits of limited liability and perpetual succession as a company. There are no shares in a CC, each member’s interest is expressed as a percentage. A close corporation may have no more than 10 members who, as a general rule, must all be natural persons. It is important to note that CCs that were already in existence as at 30 April 2011 can be converted into private companies but it is not compulsory for this to take place. 6 A trust. When purchasing a property, many purchasers are in two minds as to whether a trust is the best entity in which to purchase. Trusts have been very popular vehicles as holders of property ownership in the past. What, if anything, has changed and should be considered? Should the decision be taken to purchase in a trust, an inter vivos trust will have to be set up by its founder which can be to his/her advantage or disadvantage depending on the actual circumstance of the purchaser. Advantages: • As a trust has perpetual existence, no estate duty should be payable on assets owned by the Trust when the founder of the Trust passes away. Estate duty is currently taxed at 20% on the dutiable amount and 25% on the dutiable amount of estates exceeding R30m, so this can bring about a substantial saving. • The other benefit of purchasing a property in Trust is that the Trust’s assets are not owned by the beneficiaries and so the creditors of the beneficiaries do not have any claim in respect of the Trust’s assets.

• Another benefit is that the beneficiaries of the Trust can continue to enjoy the benefit of the Trust’s assets (i.e. the property) on the death of a Trustee. Disadvantages: • Setting up a trust can be costly • If property is being transferred from an individual or other entity to the Trust, Transfer Duty, conveyancer’s fees and disbursements need to be paid and the founders of the Trust may also be liable to pay Donations Tax at a flat rate of 20% of the property’s value and 25% for properties worth R30m or more. • Should it be found that Trustees have not acted with the necessary care, skill and diligence resulting in the Trust suffering a financial loss, the Trustees can be held personally liable for those losses. This also applies if one Trustee has authority to act on behalf of the Trust, and makes a poor decision, then he/she can bind all the Trustees as being negligent. • As the Trust’s assets belong to the Trust and not the founder of the Trust, the founder must ensure that he/she always performs in the best interest of the Trust and its beneficiaries only, or else the Trust may be viewed as the founder’s alter ego which could result in the Trust’s assets being included in creditor’s claims aimed at the founder. • Income Tax: The earnings from the assets in the Trust are taxed at 45%, and interest exemptions do not apply to Trusts. • Capital Gains Tax: CGT for an inter vivos trust is 36% The answer to the initial question pertaining to which legal entity one should purchase a property in therefor lies therein that each individual must weigh up the above and make a decision based on his/her personal preferences and position. A good tax consultant should be consulted if the answer is not obvious to you. RASSIE

AND HIS 43 SPRINGBOKS

– Dawie Snyman

If there are 43 Springboks in South Africa, I would like to see them. In the good old days…and I know it wasn’t utopia, BUT what I need to remind you of is that the Springboks stood for the best in the country, in other words the first 15. And they beat New Zealand more often than they beat us. Believe me, they were not always the best in the country, but that was the perception of that time.

In the countries of our opponents everything has always been the same, but here in SA everything has changed. We now actually have access to all our players and we are in a position to make our selections on merit. We have made a huge move in the right direction and should now be able to demolish everything in our way. When I say everything has changed, I am not talking politics. I mean player material. Those that play rugby and can play with aplomb. So where is the first problem? Dr Craven taught me that if you want to fix something, you must go to the source of the problem. And here I simply mean: administration. All committees under the South African Rugby Union are SARU sub-committees and the responsibility lies with them. If the team loses, it is not the coach’s fault, no it is that of SARU. If the referees don’t perform well or badly, it is not the individual, but SARU that should own up. They determine the standards and somewhere someone must own up and take responsibility and be accountable. Full stop. It is so simple and in some instances as difficult as that. All this ‘spinning’ when they encounter a problem is just too much to digest. Talk, talk, talk. We can never move forward with this approach and attitude. The more you stir the pot of soup, the less you can make out in terms of what is meat and what are vegetables. I am the first one to admit that our situation is more complex than in the rest of the world, but I am also the first one to say that we possess more talent than any other country in the world. I was in the fortunate position to view the match between Grey College Bloemfontein and Afrikaans Boys High in Pretoria. What a privilege and a game I shall not easily forget! Quality all round. There was healthy competition in all the sport disciplines and both schools can be extremely proud of their achievements. Harry Viljoen visited Argentinia with 41 Springboks and it was a fiasco! Both on and off the field. Does that mean that Harry’s intentions were wrong? Not at all. Let’s look at the game… What you do on the field is not nearly as important as how you execute. How you do something determines the effectiveness of what you have done. If it is effective, there are positive results (with the benefit going to your team). If what you are doing is ineffective, you are just participating in the activities! And so one weekend my friend, Schalk Burger, and I were sitting here in Hermanus in front of the TV watching the Stormers vs the Chiefs. The Stormers kick off with a weak and plan less kick. How do you start a match without a SPLASH 14

plan? Chiefs kick the ball back into the Stomers’ territory and they begin to attack and play…frantically. Attacking to the left and to the right. Short side and open side. The tempo is faster than fast…the commentator can hardly keep up. Twelve and a half minutes later the game comes to a halt for the first time. There is a turnaround and with the Chiefs in possession they also play their hearts out. The Stormers regain possession and the tempo is once again frantic. When the whistle blows for the first scrum, the players still find themselves on the 10 metre line of the Stormers. The whole game up until then only took place between the 22 metre and 10 metre lines in the Stormers’ territory. I looked at Schalk and remarked: “Wow, after these first 13 minutes I am dead tired and nothing has happened!” Why did they not just kick the ball into the corner of the Chiefs 22 at the kick-off and put up camp? Had they played at that tempo in their 22 they would have had an excellent chance of scoring some points. This is something that Naas Botha was a master at. It is actually so simple…don’t take those risks in your own half. It just does not make any sense. Back to Rassie. The question is: which of those 43 players are the Springboks, because there are only fifteen. Without the players asking for this state of affairs, there are questions that remain unanswered and doubts can only lead to nonperformance. Doubt is the biggest enemy of performance. Trust breeds success and doubt undermines it. The second question is whether it is a switch that you can put on and off and the answer is negative. The world of sporting performance is not so simple or that easy to obtain. The management of self-belief is very delicate and must be managed extremely carefully. It may very well be that I am wrong about Rassie and will be proven wrong in the end. I see that Schalk Britz has the opposite opinion to mine and has ample trust in the team. I hope that I am wrong and that the Sprinkboks move on to the next world cup as victors under Rassie. I will be the first one to say that my worries were totally subjective and without substance.

Enjoy watching the games…
