Loan approval leverage QUESTION: If I get a pre-approval letter from a lender, doesn’t that tell a seller how much I can really afford and undermine my bargaining position? ANSWER: Maybe, but there are several considerations. First, you want a seller to know that you’re qualified to purchase the property; otherwise the owner has no incentive to accept an offer that may not reach closing. Second, you don’t have to tell the seller the absolute maximum loan amount you can afford, just that you can pay the amount you’re Peter G. Miller prepared to offer. CTW Features Here’s an example: A lender reviews your paperwork and feels you can afford a $250,000 mortgage. That’s great, but you don’t have to borrow that much. Then you find a property that will require a $190,000 mortgage. The lender gives you a letter saying you can afford a $190,000 loan. That’s a statement that is entirely true, and yet does not say you could possibly bid more. QUESTION: I own a property in California and lived there for three years. I then rented the property for a year, and now I plan to sell it. Will I be subject to capital gains? ANSWER: In general, if you sell a personal residence, you can protect as much as $500,000 in capital gains if you’re married, $250,000 if you’re single. A big question here is whether the property is a principal residence or an investment for tax purposes. You may be able to avoid capital gains from the sale of a property. The IRS website indicates that “if you used and owned the property as your principal residence for 2 years of the 5 year period ending on the date of sale, you have met the ownership and use tests for the exclusion,” even if the property was rental property (for a maximum of 3 years) before the date of the sale. As is always the case with taxes, the complete rule is complex. Please see a tax professional for specifics.

mericans are in love with remodeling. Television networks such as HGTV and DIY run 24 hours a day with shows like “BATHtastic” and “Design Star.” Magazines, websites and blogs feature happy home owners gushing over perfect room makeovers. And with the continuing challenging economy, more home owners have decided to stay in their current home longer, which has created higher demand for remodeling. A survey released by the National Association of Home Builders (NAHB) in 2012 shows that common remodeling projects have increased, compared to a similar survey from 2010. And nearly 50 percent of remodelers report seeing an increase in the number of home owners who undertake remodels to avoid moving, compared to the 2010 findings. Bathroom and kitchen remodeling remain the two most common types of jobs, as they have been consistently since 2001. After 2009, however, bathroom and kitchen remodeling switched places – bathrooms became the most frequent type of job for professional remodelers. Seventy-eight percent of the survey respondents cited bathroom remodeling as one of the most common jobs, an all-time high. Homeowners are
frequently asking for a high-end spa feel to their new bathrooms, with features and materials such as television screens built into mirrors, exotic wood finishes, recycled glass tiles and sophisticated lighting systems. Other popular features include those that enable a homeowner to stay in their home as they age; including stepin tubs and shower stall benches and rails. Both kitchen and bathroom remodeling projects were up 17 percent from two years ago. Other popular jobs were window and door replacements, room additions, handyman services and whole house remodeling, although whole house remodeling is down significantly from its peak in the mid-2000s. The motivation behind many home owners’ decision to remodel has changed as well. The top two reasons for remodeling were the need to repair or replace old or outdated components and the desire for better and newer amenities. More than 50 percent of remodelers said that these two reasons for remodeling have become more common over the past two years. In contrast, more than 20 percent of remodelers said there was a decrease in customers remodeling to increase home values as an investment or to prepare for a sale (whether distressed or not). Remodeling to accommodate a change in the number of people living in the home also received low scores. Whether they are inspired by the amazing makeovers shown on television shows, or their changing lifestyle necessitates repurposing spaces to make more

Yet, another survey from Rent.com, the country’s leading Internet rental listing site, finds that parents are divided on location but united about the importance of neighborhood safety. Among Rent.com’s findings is that 42 percent of parents say they’ve always lived in the city and are raising children there, but a close 41.5 percent prefer the suburbs. Perhaps more important is that 46 percent of suburban parents say they’d make their same choice again, while only 34 percent of city parents would. Real-estate saleswoman Donna Mercier, affiliated with a suburban Chicago office of Coldwell Banker, says many parents with kids find the North Shore suburbs appealing for the ease of getting around, finding parking, networking with families and enjoying community activities and good schools. But once many become empty nesters, they return to the city, Mercier says. In contrast, David Staples, director of sales at 2 Midtown, a mixed-use condominium in midtown Miami that offers rentals, says that parents with kids are attracted to urban life because of the convenience of living close to work and gaining a range of cultural activities. When picking a home, he says they’re most concerned about security, green spaces for kids to play and to walk dogs and nearby shopping. The bottom line, according to April Masini, a relationship expert who writes an advice column called “Ask April,” is that a family can make a good life in either place. “The age of the child may be a good determining factor. Young children can easily play in a yard and go to friends’ homes, but if you have teenagers and want them exposed to culture or get a part-time job, a city might offer a bigger advantage,” she says.
