hopping. Baking. Decorating. Life gets hectic during the holidays. But whatever else you have on that ‘to-do’ list put this first: childproof the house! Children, especially those under the age of five, see Christmas trees, Menorahs, ornaments and candles as mysterious and magical things. They want to touch, chew and play with them. But if children get a hold of the wrong objects, they can be seriously injured. Don’t spend your holidays in the emergency room. Take a few precautionary steps now to protect your children so they, too, can enjoy the season. When your kids smell the aroma of baking cookies, fruitcakes and Yule logs, they naturally want to be in the kitchen. But unless you can supervise them carefully, keep them out. ❄ Keep hot foods and beverages away from the edges of counters and tables and don’t place them on top of tablecloths or placemats. ❄ Unplug the beater or other electrical appliances, wrap up the cords and put them away. Your children should not have access to any ‘live’ electrical appliance cords. Also, place covers over all electrical outlets. Both cords and outlets are sources of electric shock. ❄ Use back burners and turn pot handles toward the back of the stove when cooking. As you know, children can get hurt in any room of the house, not just the kitchen. So for their protection … ❄ Don’t let children under four have hard candies, nuts or similar seasonal foods. Hard, round foods such as candies, nuts, grapes, popcorn, raw carrots and even raisins can get lodged in children’s throats and block the passage of air through their windpipes. ❄ Don’t display any decoration that can easily break or has sharp edges. Place glass ornaments, for example, far out of the reach of small children. They could grab, drop, break them and then cut themselves on the shattered pieces. Also, don’t use decorations with tiny pieces that can be swallowed. And avoid trimmings that look like candy or food because a child might try to eat them. ❄ Place your Christmas tree in a sturdy stand and anchor it down so your children cannot knock it over. ❄ Keep children away from tree lights and other electrical decorations. These items can shock or electrocute curious kids. Lights are also a fire hazard, so keep them away from gifts, paper ornaments, curtains and drapes. ❄ Keep Menorahs and other candle holders and candle decorations well out of the reach of children. Flickering flames fascinate young ones, and they can easily burn themselves or start fires. ❄ Keep holly and mistletoe out of the reach of children. They are poisonous and can be fatal to a small child. Poinsettia leaves are not fatal if swallowed, but can cause a skin rash and severe upset stomachs. If a child ingests any of these holiday plants, call 911 immediately. ❄ Keep alcoholic beverages out of the reach of your children. A child does not have to drink much to get alcohol poisoning. Remember to clean-up half-empty glasses after a party. Following these precautionary steps will ensure that you and your family have a safe and happy Holiday Season. E

ach change of seasons brings its own concerns, and although they don’t change much from year to year, it’s human nature to procrastinate. So a reminder here and there doesn’t do any harm and can be just the nudge needed to set aside the time to get with it. Ice and Snow Liability Since most of Washington State has at least some ice and snow during winter months, landlords and tenants need to know what their responsibilities are. Washington State allows for landlords with four or fewer rental properties to write into the lease that the tenant is responsible for ice and snow removal (except the roof), and for yard care, watering, weed removal or other lawn maintenance. But it has to be included in the lease or a lease addendum, and it must be specific. There should be language such as …. “Removal of snow over 2 inches once snowfall has stopped,” or other such specific requirements. Whether it’s ice and snow or lawn care, if the requirement is not specific, it cannot be understood by the tenant or enforced by the landlord. If the rental unit is a single family house or duplex, a landlord is legally allowed to add a clause to the lease about snow removal obligations or write their own “Ice and Snow Addendum” in which the tenant agrees, as part of renting your unit, to keep the walkways shoveled of snow and free of ice. Check with your landlord attorney, an experienced landlord, or one of the Landlord Association mentors if you have questions about wording or for preparation of the addendum. Landlords should know their properties well and walk through each one to scout for spots that could be dangerous in any number of ways, especially as it relates to ice and snow. Look especially for anywhere water drains, whether a downspout, leaky eave, crevice or depression that cuts through the yard or walkway edges. These are places that your tenants can slip or fall on the ice and places that need attention when snow falls. If there is no lease obligation for the tenant to remove ice and snow, a landlord can be held liable if a tenant or visitor slips and falls due to unremoved ice or snow. If there are hazards, either because there is no way to clear it all up or because there is too much snow to haul off, put barricades around the hazardous ice places or piles of snow. Also, give tenants warning of the dangerous situation in writing with the date and address on it, keeping the original copy for yourself. Ice: The obvious things to look for are places where downspouts have

come loose or leak and leave pools of water. As soon as temperatures drop below 32 degrees, you will have sheets of ice instead of pools of water. These can result in falls causing broken bones, back injuries, and other injuries. It is especially dangerous if these pools extend across sidewalks or driveways or onto parking spaces or into parking lots. Most of the time, reattaching a downspout or sealing the leak takes only a couple of minutes. Make certain the water is turned off to outside spigots to protect them from freezing. Neglecting to do that may result not only in sheets of ice from the broken water pipe, but also in a huge plumbing bill. Snow: Removing snow is an entirely different problem. When and how well you do this determines your liability. Most localities do not require snow removal unit it stops snowing. Up to that point, the burden of care falls on the person who is walking on it. But non-residential landlords and property managers are not obliged to awake in the middle of the night and shovel snow if the snowfall stops during the night. One court has ruled that a landlord has to know that the snow has stopped before he or she is responsible for removing it. If you are an out-of-town landlord or absorbed in other activities, it is helpful to have the tenant or someone in the location of your rental advise you of this, unless the tenant has agreed to take care of the snow removal. Then be cautious that if you do it yourself, that you do it well. A property owner can be held liable if the snow was removed negligently or in a way that causes more hazards. It is better not to remove the snow than to do it in a way that causes more slips and falls. Usually snow is a fairly stable walking surface until it melts and refreezes, especially compared to the ice that will form if one does a poor job of getting up the snow. Using salt compounds or other snow dissolving products and reduce your liability greatly. Question: I’ve been prepaying varied amounts on my fixed rate 5.125 percent, 15-year mortgage. I’m thinking that as of today, my effective rate is a lot lower than 5.125 percent, and this makes refinancing less attractive. Is there a formula I can use to find my real interest rate on the remaining balance, whether or not it includes the amounts I’ve already prepaid?

Answer: A fixed-rate mortgage is a thing of financial beauty. You pay interest on the outstanding loan amount, so if you make prepayments, the length of the loan is cut. With less money outstanding, the interest cost is lowered – but the rate is unchanged. Imagine that you owe $100,000 at 5.25 percent over 15 years. The monthly cost for principal and interest is $804 over 180 months. The potential interest cost over the life of the loan is $44,698. If you pay an additional $100 per month, the interest rate remains the same but the loan term is reduced from 180 months to 152 months. The estimated lifetime interest cost is $37,119. Today, interest rates for fixed-rate 30-year mortgages are below 3.5 percent for well-qualified borrowers – and under 3 percent for fixed-rate 15-year loans. Let’s say the cost of refinancing is $2,500 – a sum added to your loan balance with a “no-cost” refinance (meaning you bring no cash to closing, not that there really is no expense to refinance). Is this worthwhile in your situation? How long will it take to recapture your refinancing costs in the form of lower monthly payments? If you have little time remaining on your present loan or a small balance, then the closing costs for replacement financing may be better spent paying off the current debt. Sometimes this is a financing-andnumbers issue, but sometimes it’s also a question of personal preferences, the option that makes you most comfortable. For specifics, speak with lenders and run the numbers with an amortization calculator.

any foreclosure victims now have a referee to turn to for help – the federal banking agencies’ Independent Foreclosure Review program. Borrowers who believe they suffered financial losses due to errors in a foreclosure process on their homes, occurring between January 1, 2009 and December 31, 2010, can apply for a free review by an IFR consultant – but only until December 31. Applicants can check their eligibility, submit a request for review form online and get full details at IndependentForeclosureReview.com. If the third-party auditor determines that the lender was responsible for errors, deficiencies or misrepresentations in the foreclosure process, homeowners may be entitled to: • recoup from $500 to $125,000 (plus equity), • have the foreclosure suspended or rescinded, • receive a loan modification or other loss-mitigation assistance and/or • have their credit reports and records corrected. “If your case meets the provided criteria and you can prove it, then there is a good chance you will receive payment,” says Kory Kavanewsky, CMG Mortgage, Inc., Coronado, Calif. “However, don’t expect to receive more than a few thousand dollars unless you have a more extreme case. Those who were financially injured in more than one way can expect the largest payments.” Examples of financial injury can include fees charged or mortgage payments that were inaccurately calculated, processed or applied; a foreclosure action that occurred despite bankruptcy protection; a higher mortgage balance at the time of the foreclosure action than was actually owed; and a foreclosure sale that occurred despite complying with everything the modification agreement required. “Consider this program to be a classaction suit against the nation’s largest mortgage lenders and services,” Kavanewsky says. “The voices of those who have been wrongfully foreclosed upon have been heard. This program provides these folks the best chance of receiving any sort of refund without having to battle in court one-on-one with some of the country’s largest corporations.”
