What is carbon monoxide?
hat is the new Carbon Monoxide Detector Requirement for Landlords?
By January 1, 2013, carbon monoxide alarms must be installed in existing rental dwellings, single-family residential rental units where an attached garage or fuel-fired heat source is present, sleeping units in hotels, motels, and apartments. Owner-occupied single-family residences legally occupied before July 26, 2010 are exempt from these requirements. As of last January 1, 2011, carbon monoxide alarms must have been installed in all new residential construction where an attached garage or fuel-fired heat source is present. This means that landlords, property managers, and all rental property owners must have installed a carbon monoxide in all their rental units by Tuesday, January 1, 2013. The CO detector may be separate or in the same device as the smoke detector. And it is strongly recommended that a Carbon Monoxide Detector Addendum be signed by the tenant at the time the CO Detector is installed. If there is already a CO Detector, the addendum should be signed by January 1, 2013 to protect property and fire insurance on the property, and to inform the tenant(s) of their responsibilities regarding the CO Detector. What if I have all electric heat? This rule is not dependant upon what type of heating is in the rental unit. The type of heat is not the issue. The issue is what type of alternative heating source a tenant brings into the rental unit without a landlord’s knowledge! The CO rule was created due to tenant practices and to protect rental property owners from having their tenants become ill or die due to CO. There have always been tenants who turn down the thermostat to save money on the bill from the utility company. However, they then bring in alternative heating sources into the rental unit, often without knowing how to use those heating sources or what dangers they may entail. There have been instances of tenants bringing in hibachis, pellet stoves, charcoal grills, even small wood stoves, but do not use proper ventilation or completely put out the fire prior to falling asleep. This can result in CO levels high enough to cause serious illness or death, and sometimes wrongful death lawsuits toward the landlord. The CO detector and the CO Detector Addendum together informs tenants about their obligations, responsibilities, and limits the landlord’s liabilities. Why is this important to landlords? The death of a tenant is a traumatic event to the tenant’s family, the landlord, and to all concerned, since it is a preventable circumstance. The loss of life is, of course, tragic. Beyond the emotional impact, here are also the more practical issues that can range from financial loss to any surviving tenants and potentially some financial loss to the landlord. Although not common as of yet, the specter of a lawsuit could hang over the landlord. Also, as of January 1, 2013, not having a CO Detector in all residential rental dwellings is a violation of the law, which has penalties. Do not place the detector right next to or over a fireplace or flameproducing appliance. Keep it out of the way of pets and children. Also, make certain that the alarm is loud enough to wake anyone who is sleeping. (It was previously thought that a CO detector should be placed lower to the floor because most of the sources of CO were at floor level, but that is no longer advised.) Where should the CO detector be placed? Because carbon monoxide is just slightly lighter than air, and also because it may be found in warm rising air, CO detectors should be placed on a wall at least 5 feet above the floor. It may even be placed on the ceiling. Detectors closer to the floor can be accessible to children, pets, furniture being moved about, and other activities that could break or disable the device. There should be one on each level of a house. Apartments and studios should have one close to the sleeping area. What prompted these requirements? There has been a very long history of severe brain damage and death in America due to CO poisoning, going back to Colonial times, and before that in Europe for as long as people used fire inside their dwellings. As more and more appliances were invented and used, more such death occurred. In modern times, there has been a steadily increasing number of deaths each decade. But the past twenty years has seen an even sharper upturn, and the storms that struck Washington State in December, 2006, resulted in over 1,000 people in the state reporting to emergency rooms due to CO poisoning, many of whom died. It is the intent of CO Detector requirements to prevent or greatly reduce similar tragedies from occurring in the future. Since CO is odorless, tasteless, and invisible, only a CO detector can accomplish this. Also, during the recession, there has been a substantial increase in tenants using space heaters, grills, and other heating devices inside the rental unit to save on heating costs. Of course, a landlord doesn’t usually know this is occurring or if the heaters are in good working condition or unsafe. Since it’s difficult to change human behaviors,
Carbon monoxide is an odorless, tasteless, invisible gas. Carbon monoxide results from the incomplete combustion of fossil fuels, such as wood, kerosene, gasoline, charcoal, propane, natural gas, and oil. The chemical abbreviation for carbon monoxide is CO (meaning one carbon molecule and one oxygen molecule). Where is it found? Carbon monoxide is present in very low levels in the air. In the home, it is formed from incomplete combustion from any flamefueled (that is, not electric) device, including ranges, ovens, clothes dryers, furnaces, fireplaces, grills, space heaters, vehicles, portable generators, car and truck engines, and water heaters. Furnaces and water heaters may be sources of CO, but if they are vented properly, the carbon monoxide will escape to the outside. Open flames from ovens and ranges are the most common source or carbon monoxide. Vehicles are the most common cause of carbon monoxide poisoning. Why is carbon monoxide dangerous? When CO is inhaled, it passes from the lungs into the hemoglobin molecules on the red blood cell. Hemoglobin is a cell that has a small dent or curve on its surface that carries oxygen to all parts of the body. But CO binds directly onto the red blood cell and takes up all the room that oxygen would ordinarily use and prevents oxygen transportation. The result is that the body becomes oxygen-starved and results in tissue damage, and ultimately death. Low levels of CO poisoning cause symptoms similar to those of flu or a cold, including shortness of breath on mild exertion, mild headaches, and nausea. Higher levels of poisoning lead to dizziness, mental confusion, severe headache, nausea, and fainting. Longer exposure to CO can result in unconsciousness, permanent brain damage, and death. Carbon monoxide poses a special risk to fetuses and a significant reproductive risk is also linked to CO. How do CO detectors work? Carbon monoxide detectors trigger an alarm based on an accumulation of CO over time. Detectors may be based on a chemical reaction causing a color change, an electrochemical reaction that produces current to trigger an alarm, or a semiconductor sensor that changes it electrical resistance in the presence of CO. Most CO detectors require a continuous power supply, so if the power cuts off, the alarm becomes ineffective. Models are available that offer back-up battery power. Carbon monoxide can harm humans and pets if they exposed to a high level over a short period of time, or to lower levels over a long period of time, so there are different types of detectors, depending on how the level of CO is measured. What if the alarm sounds? First of all, don’t ignore the alarm!! It explicitly designed to sound before a person is experiencing symptoms. So even though you do not “feel” anything, the alarm means there is an unsafe level of CO in the air and everyone must evacuate. Silence the alarm, get all members of the household to fresh air, and determine if anyone is experiencing symptoms. If so, call 911. It isn’t advised to drive anywhere, even to the emergency room, since onset of such symptoms such as dizziness, lack of coordination, blurry vision, etc. could occur. If no one has symptoms, ventilate the building, identify and remedy the source of the carbon monoxide before returning inside, and have appliances of chimneys checked by a professional as soon as possible. How to install a CO detector Some units can simply be plugged into a convenient outlet that fits the location specifications. Ensure that the outlet is not controlled by a switch! Be sure the detector is out of reach of young children and pets. Other detectors need to be wired into the dwelling directly. That can be done by the person that performs the other maintenance on your rentals, by a local electrician, or sometimes you can arrange installation through the store if you buy it at Home Depot, Lowes, or other building supply outlets. Mounting brackets are usually included in the package the detector comes in. Check before you purchase it to see if additional parts are necessary to make that particular model either function or for installation. Once the detector has been installed and turned on, test it by pressing the unit’s test button. Since weekly tests are recommended to ensure the detector is functioning property, using a CO Detector Addendum with that language or instructions in it is a good idea. The Landlord Association is in the process of copyrighting and making available to our members a CO Detector Addendum that will have all the information necessary for the tenant, and which will reduce liability to the landlord or property manager. Installing CO detectors will be the law on January 1, 2013. QUESTION: We are now refinancing a loan. We spoke with several closing providers, and the closing fee for the exact same work differed by $400. Is there any reason to pay more?
ANSWER: “Settlement,” “closing” and “escrow” are the terms used in local areas to describe the last step in a real estate sale or refinancing situation. The best way to think of such events is to look at the real estate contract or refinancing agreement as the script for a play. Closing simply follows the script under the direction of a neutral third party – the closing provider. The party that conducts closing is an agent of the settlement process. “In all cases,” says attorney John Reilly in his standard guide, “The Language of Real Estate” (Dearborn Real Estate Education), “the escrow holder acts as a fiduciary and retains documents and entrusted assets until specified conditions are fulfilled. The holder is the special impartial agent for both parties and acts in accordance with the escrow instructions given by both.” Depending on where you are located, closing can be conducted by an attorney, title company, escrow company, lender or a real estate broker. However, regardless of who does the work, the settlement provider must follow the precise instructions laid out by the contract or refinancing documents. If there is a dispute at closing between the parties, the escrow agent, being impartial, cannot be the advocate for one side or another. A real estate transaction involves many charges at closing. One cost to consider is the settlement fee to be paid to the closing agent. Another is the title insurance sold by the settlement provider. If your property has been sold or refinanced in the past several years, you may be entitled to a title insurance “re–issue” rate that will cut your closing costs significantly. As with any service, shop around and ask questions. Ask brokers and lenders for their recommendations and choose what’s in your best interest.
