Keys

to Renting Lost keys: A matter of safety By Joy Peck, Executive Director Landlord Association of the Inland NW

W

hat should a landlord or property manager do when a resident loses an apartment or house key? Although the quick and simple solution is to hand a duplicate key to the tenant instead of changing the lock, that might not be the safest way to handle the situation and leave the owners very, very exposed to some serious liabilities. The biggest liability is that is that lost key falls into the wrong hands, the resident could be burgled or attacked by someone entering with that key, and then suing for negligence. It can feel like an inconvenience for the resident who swears the key is at the bottom of the ocean or somewhere else where no one can find it, to have to pay for re-keying the lock, but nevertheless extremely important that all landlords and property managers have a written key policy that protects the safety of residents and owners, and then follow that policy to the letter. But lost keys are no small matter. There can be great liability involved. If you have questions, be sure you contact your attorney and insurance broker to decide what type of lost key policy is best for your business and which would protect you from the most liability. One of the most common mistakes landlords make is thinking that a particular problem or situation will never happen to them just because it has not happened to them in the past. The two most common policies for dealing with lost keys are: 1. Require all keys to be replaced without exceptions. 2. Make an exception only when a resident is certain that no one can find the lost key, and have the resident sign an acknowledgement stating that he/she has requested that the lock not be replaced. Policy #1: Replace Locks without Exception. Unaccounted keys pose too great a security risk, say many landlords and property managers, and most agree that it just isn’t worth taking a chance. It is far too easy for keys to be taken, copied, then replaced in desks, purses, bookbags, etc. by acquaintances and strangers to believe that one’s keys are always safe from being copied or stolen by someone who knows where the resident lives. A missing key is stressful enough, but key chains may also have some other item that can identify the tenant and lead to the rental unit. As mentioned above, the tenant may sue for not replacing the lock when the risk was known by the property manager or landlord. Residents who do not want to pay for a new lock may not understand the danger they might be in. They may think the landlord could make a profit from the money charged for re-keying the lock, so it is important to convince the tenant by explaining the risks. A landlord or property manager can replace the lock cylinder quickly and inexpensively and with little inconvenience to the tenant. Most locksmiths are able to work on short notice and it can take less than a half an hour, at most. But what about calls in the middle of the night? Let the tenant in with a duplicate key and change the lock in the morning – or call a 24-hour locksmith. Lost items happen to everyone, but the burden of the problem, after all, does rest on the person who lost the key, not the property manager. To cover the cost, charge only a reasonable fee, though, usually $25 to $30 for the first offense. And be certain that your key policy

is in writing in your lease or rental agreement, posted in the rental office (if you have one), and a reminder of the key policy is included with each lease renewal, rent increase notice, or on some other annual or regular basis. This encourages residents to be mindful of the safety issues and costs of lost keys. Policy #2: Giving a Duplicate Key. If the resident is “absolutely” certain the key is lost for good and irretrievable, for instance, down a sewer or lost in a lake while fishing, some landlords will give a duplicate key. Even so, still go through the process of explaining the risks and have the tenant sign the acknowledgement that the landlord or property manager recommended re-keying the lock and that the resident assumes all liabilities. Again, it can be very important to speak with your attorney about specific wording. Exceptions have Drawbacks A resident who has lost keys in the past may already know the process and not be truthful about the key’s whereabouts, since they may be hoping to avoid paying the lock replacement fee. Even if the tenant is completely sincere, they may not know that they are about to be the victim of someone who took the key to perpetrate a break-in or to sell to someone else for an illegal purpose. So remember, if a crime later occurs, and an assault or death results, a generic waiver or release that might be good enough to cover liability in the case of a simple burglary, might not stand up against a more serious outcome. Courts have declared that landlords are professionals, regardless of the number of units they rent out, and know or should know of the dangers. So Get the Resident’s Written Acknowledgement For a property manager or landlord to protect their business from a lawsuit, require the resident to sign an acknowledgement form which should include: • Acknowledge that the landlord/property manager strongly recommended replacing the lock • Acknowledge that it was explained that the risks of not replacing the lock could include a break-in, property loss, and even physical danger, and the resident still declined a re-keying • A release of the landlord, property manager, and all staff from any liability because of the resident’s decision not to re-key the lock. Keep in mind that no release is air-tight, so have that conversation with your attorney about the wording and effect of such a release in Washington State, or the state in which your rental property is located. Make certain that you or the staff person getting the release fills in his or her name completely, and your complete name as well as who it was that advised the resident. If the lease is in more that one resident’s name, then each resident on the lease must sign the form. This might be inconvenient, but again, the process might lead to better key security by that tenant in the future. Keep the signed form in the resident’s file so that, in the event an incident occurs, you will have proof that a re-keying was strongly recommended and documenting the refusal. “Keys to Renting” content is for informational purposes only and not meant as a substitute for legal advice. hen you first move into your new home, you wonder how you are going to fill up the large, empty space. Pretty soon life takes over – and before you know it, you are wondering where all of that space went. If you find yourself struggling to find room to store everything you’ve accumulated over the years, see if these storage options might work for you. Do an Audit Before you invest a lot of time deciding where things should go, look through your closet, files and drawers to determine what can be thrown or given away. For clothes, it is a good rule of thumb to get rid of items that you have not worn in more than 12 months. A lot of your household financial documents and papers may be available online through the provider company’s Web site. If that is the case, discard old financial statements or bills that you can more easily access electronically. Invest in a paper shredder for these documents to protect your identity and accounts. It is very easy to allow cabinets and drawers to become cluttered over time, especially when you have to do a quick cleaning of your home when you have surprise visitors. Declutter those drawers periodically to keep from accumulating outdated flyers, menus, magazines and newspapers. This will open them up so you can store more day-to-day items that you need to quickly reach. Buy Furniture That Doubles as Storage If you are looking to replace old, worn-out furniture in your home, buy pieces that also can serve as storage. Consider a coffee table that has drawers or an ottoman that can open up and double as a spot to store your blankets. Make Use of Wasted Square Footage In closets and in the kitchen, use all of the space that is available to you. Often home owners are giving up valuable square footage if they don’t install cabinets or shelves that go up to the ceiling. Store items that are either out of season or that are rarely accessed – such as holiday decorations – on the higher shelves where they are out of the way. This will free up the lower shelves to allow you to get to the things that you use on a regular basis. Bed Risers By simply raising the height of your bed a few more inches, you can gain a lot more storage space that is also hidden away. Bed risers can be found in home design and improvement stores in different shapes, styles, textures and colors to complement your current bedroom furniture. They are inexpensive and not only give you added storage space, but will also give your bedroom a new look. Question: Our daughter has a five-percent fixed-rate mortgage and would like to refinance. She and her husband have had a sharp reversal of fortune, paid a few days late several times and had a 2009 corporate bankruptcy with some bills still outstanding. They jointly make $63,000 a year and have credit scores in the mid 600s (him) and mid 700s (her). They also have $100,000 in equity, big credit card bills and little in savings. Their monthly payment is $1,800. How can they refinance at today’s rates?

Answer: Late payments aren’t the problem here – only payments that are late 30 days or more show up on credit reports. The bigger problem is likely debt-to-income ratios – that is, how much debt their income can support within lender guidelines. Right now, 34 percent of your daughter’s household income is used for housing costs – too high for many loan programs. Your daughter and her husband must lower their debt level or raise their income. The quickest strategy is a period of strict budgeting and debt reduction. Still, having late payments – and paying late fees – is a bad idea. It seems like the money is available, since you say the payments are being made and credit scores are within reason. Perhaps the household budget needs to be rearranged to get on track. If the late fee is $90, then that’s money better spent paying down bills. Another option, since there is equity, is selling the house. That would end big monthly payments, especially if the family could move back in with Mom and Dad for a time. The money not paid for housing could be saved to bulk-up cash and build credit. First, however, contact an attorney to see if the bankruptcy creditors could get access to any sale profits. As to mortgages, speak with a variety of lenders. See if your state participates in the federal Hardest Hit Fund program and check the plans offered under the federal government’s Making Home Affordable programs.
