ot knowing the Landlord Tenant Laws of your state. This is the most important mistake to avoid! Get out your copy of the Residential Rental Laws and just review a few pages or a small section every few days as you have time. Each new member packet comes with one and the LLA office has copies, if you need one. Being a successful landlord requires lots of practical know-how, business moxie, and familiarity with landlord tenant laws. Not knowing the rules can land you in some very difficult situations that are costly to get out of.

Using generic or outdated Lease Forms.

Most landlords know it’s important to have a written lease or rental agreement. But using the wrong form can get you into trouble.

So-called “standard� forms that are sold everywhere are probably not in compliance with the laws in Washington State or the state your property is in. Some standard forms actually impose greater obligations and restrictions on the landlord than the state laws do. One form that is sold in stationery stores most places requires landlords to return security deposits within ten day, which NO state requires. And some of those generic forms omit some of the tenant’s rights that could leave you on the losing end of a legal battle or with an unenforceable clause.

Asking the wrong questions during applicant screening. Thorough tenant screening is the most important part of your business!! And since the tenant pays the costs of the screening, unless you are skilled at the process, it’s best to get a screening company to handle this part for you. However, there are mistakes that you have to avoid during the application process. Many landlords don’t realize that well-meaning questions can be illegal forms of discrimination ‌ such as asking a disabled person about his disability or asking if a couple is married. The LLA office has hand-outs and computer discs that detail Fair Housing laws and the rules about avoiding discrimination. If a question is asked that can interpreted as discriminatory and the applicant doesn’t get the rental, that disappointed tenant has ammunition for a fair housing complaint, even though the rejection had nothing to do with the offending question or it’s answer.

Making promises that you don’t deliver on. Its fine to be enthusiastic about the benefits of your property, and it’s necessary to do so in competitive markets, but understand that your enthusiastic promises will become binding if applicants rely on them when deciding to rent. For example, you may have to follow through if you assure an applicant of a parking space, satellite service, or a new paint job. A tenant who feels cheated may legally break the lease or sue you for the value of your promise.

Violating tenants’ rights to privacy.

Most states have detailed rules about when, for what reasons, and with how much notice you may enter a tenant’s home. Think of it in personal terms as someone with a mortgage and how it would feel if the bank could come into your home without notice because they still “own� the premises. Landlords are not

Legal mistakes landlords must avoid

able to stop by unannounced, asking to check things over, perform an on-the-spot repair, or show the place to prospective tenants without notice (48-hours in Washington State). It IS permissible, even recommended, to drive by on a regular basis and look at the condition of the house and yard from the outside, but to enter the premises, you must give notice.

Repeated violations of a tenant’s privacy, or even outrageous violation, can excuse a tenant from any further obligations under the lease and might also result in court-ordered money damages against the landlord.

Using security deposits for the wrong projects. The most frequent types of cases heard in small claims court are arguments over security deposit retentions. The basic rule, that deposits should be used only to cover damage beyond wear and tear, needed cleaning, and unpaid rent, is not hard to adhere to. Still, it is often heard that there are some landlords that use the deposit to cover appliance upgrades, cosmetic improvements and other refurbishing, not repairs. Carpet is the biggest one. Carpets do need replacing, so the best way to prepare for that is to increase the rent of each unit a certain amount, say $5/month, and put that into a “carpet fund� or other long-term savings account marked for wear and tear. Most landlords who use the security deposit for improper reasons lose their cases in small claims court.

Ignoring dangerous conditions in and around the rental. Landlords in virtually every state are required to offer and maintain housing that meets basic health and safety standards, such as those set by state and local building codes, health ordinances, and the landlord tenant law. If you fail to take care of important repairs, deal with environmental hazards, or respond if your property becomes a target for graffiti or criminals, tenants may break the lease.

Keeping security deposits when tenants break a lease. When tenants break a lease and leave early, landlords often keep the entire deposit, reasoning that the tenant’s bad behavior justifies doing so, and that they need it to cover lost rent. Remember to only deduct the cost of repairs, damages, and the actual amount of lost rent. Keeping a two month’s rent deposit when the unit was re-rented in one month is not legal.

Failing to return security deposits according to law. There are deadlines by which a landlord must itemize the deductions from a security deposit (LLA form 903) and return the balance to the tenant. It’s not an uncommon tenant complaint that they may wait many weeks or even months for this accounting. If it can be shown that a landlord withheld the security deposit accounting past the deadline, a judge could order the landlord to pay two or three times the deposit to the tenant. In Washington State, the deadline is 14 days (RCW 59.18.208).

FHA: “Back to work�

Question: We did a short sale on our home in May 2012. We then bought a house with cash in October 2012. Can we get a new mortgage on our current home?

A short sale is a situation where a home has been sold for less than the mortgage debt, meaning the lender has taken a loss. As you can imagine, this is not a result that thrills lenders.

Unfortunately, there are several factors that will prevent an instant refinancing in your situation.

But, the good news is that it may be possible to get a new loan in a few months.

First, because you had a short sale, your last loan is seen as a “not paid as agreed� account for credit-scoring purposes. This will lower your credit as much as a deed-in-lieu of foreclosure or an outright foreclosure.

For many lenders, this is a huge red flag and an instant turnoff.

Second, your short sale took place less than a year ago. You have not had enough time to re-establish your credit as far as the lender’s concerned.

Third, what you want is cash-out refinancing. You’re not seeking a new loan to get a new rate or convert from adjustable-rate financing to fixed. This is another red flag for lenders.

So, what’s the good news?

In August, the Department of Housing and Urban Development announced a new FHA mortgage plan, which, in some cases, can allow troubled borrowers to get financing in as few as 12 months. Under the FHA “Back to Work� program, the government will insure loans for those who have had a negative “economic event,� such as a loss of income or a bout of unemployment.

Prospective borrowers must show that the hard times they encountered were for reasons beyond their control, that their finances have recovered and that they will take an HUD-approved counseling course.

The FHA “Back to Work� program is an opportunity for people hurt by economic events to get mortgage financing again. However, it’s not a free pass.

Expect lenders to review mortgage applications with incredible zeal before giving the OK to applicants with a recent history of financial stress.

Mixed-use, walkable communities are all the rage for modern homebuyers – and for good reason.

mericans favor walkable, mixed-use neighborhoods that provide shorter commutes, per the results of a National Association of REALTORSÂŽ survey. According to the study, 60 percent of those polled prefer a community with a blend of houses and stores and other businesses that are easy to get to on foot versus communities that involve more driving between work, home and recreation.

Additionally, the survey revealed that, although a property’s size does matter to consumers, they’re willing to sacrifice size for a coveted neighborhood and less time commuting.

However, more than half said they’d sacrifice a home with a larger yard if it resulted in a shorter work commute or it meant living within walking distance of stores, schools and restaurants And, 78 percent indicated that a house’s size is less important than their chosen neighborhood.

Eric Fredericks, a Rancho Cordova, Calif.-based urban planner and founder of website/blog Walkable Neighborhoods, says the latter statistic surprises him the most. “The trend for decades in America was larger and larger houses to accommodate additional belongings, but I think with the popularity of walkable neighborhoods and the aging population, Americans are starting to

realize that driving to places may not always be an option,� Fredericks says. “Also, a lot of folks have learned about the benefits of having options within walking distance.�

Convenient Scores As to why 60 percent favor neighborhoods with a mix of homes and retail offerings, “the old adage, ‘location, location, location’ has, in part, given way to ‘convenience, convenience, convenience,’� says Jon Stewart, agent with John L. Scott Real Estate in Seattle. “With the lives of those in both urban and suburban areas becoming more complex by the day, the trend of viewing areas offering a mixture of residential housing and commercial convenience with shorter commutes will, in my opinion, only increase,�

Stewart says. “Anything to reduce time in the car and increase time concentrated on living will be prioritized.�

Lindsey Kinnsch Michael, mortgage loan consultant with Kinecta Federal Credit Union in Manhattan Beach, Calif., says living in mixed-use, walkable communities offers several advantages to homeowners. “You can get exercise easily and conveniently, you can save a ton of money on gas and car maintenance, and you will most likely take advantage of more opportunities the community affords you because you’re exposed to them daily,� Michael says.

She adds, “There is also a comfort in knowing that you can rely on your own two feet, as opposed to a vehicle, to get where you need to go on a daily basis.�

Individual Preferences However, the decision to compromise home size for easy accessibility and proximity is not an easy one for every home shopper to make, Stewart says. “It’s as individual a decision as those making the choice. There are still consumers who are looking for the 4,000-plus square foot home on two acres of land. But in areas that offer mixed-use neighborhoods, there is a trend toward either bungalow living or larger homes designed to encompass most of the lot. In urban areas, there is no short supply of clients who are very willing to compromise size for the sake of convenience,� Stewart says. “It’s a matter of the individual’s definition of ‘quality of life.’�

Before selecting a neighborhood, experts recommend considering several important criteria. “Ask yourself,� Michael advises, “will you feel safe in the neighborhood and the home? Does the home’s layout and storage capacity make sense for your life? Do you have guaranteed parking?

And can you walk easily to places you would frequent and that would fit into your lifestyle?�

Also, before choosing a mixeduse area, “consider noise,� says Rob Anzalone, CEO of Fenwick Keats Real Estate in New York City. “Is there commercial traffic? Are there noisy restaurants or bars? What is the neighborhood zoning? And will you have close proximity to parks and green public areas?�

These additional aspects can change the way people view walkable and mixed-use communities.
