to Renting Hoarding has increased in rentals, too Landlord Association of the Inland NW

andlords and tenants alike, often just assume that once the leased-up paperwork is done, all that’s left is to pay the rent on time, abide by the terms of the lease, and keep the rental clean. But occasionally things don’t go as planned. Circumstances change – illness, reduction of income, stresses in personal relationships, and other pressures can change a tenant’s behaviors and although it is rare, hoarding can be one of those changes. Hopefully, property managers and landlords check their rentals each spring to check the smoke detector batteries or each fall to change the furnace filters. During these scheduled maintenance visits, a check for leaks, torn screens, and other damage is a good idea, too. Rental property must be visited at regular intervals since not entering a unit for a year or more at a time can yield big surprises. In Washington State, a landlord or property manager must post, mail or serve in person a 48Hour Notice to Enter prior to going into a rental unit, and if a tenant or tenants object, there is a $100 per day fine for refusal to comply with the 48-Hour Notice. But don’t let the fact that a notice must be served deter you from checking each rental unit on a semi-annual or quarterly basis. It can be a real shock when a routine inspection of an apartment or home reveals that a tenant has become a hoarder. And hoarding is very different from just having too much stuff in a small space or from just having a messy place. Hoarding is being unable to dispose of almost anything the tenant brings into the house (empty food containers, newspapers, clothing no longer wearable, etc.), and also the compulsion to acquire ever more items, even things they have no use for. Signs of hoarding are that all the surfaces are covered with stacks of things, even sinks and stovetops. When the inside of the rental unit is full, it will spill over to the garage, the cars and yards. There may be very little room to actually walk through the rooms, perhaps just a singlefile path, and items may be piled higher than a person’s height. Hoarding is thought by some to be caused by a change in brain chemistry, psychological or emotional reactions to stress or trauma. Some

experts believe the condition has a genetic or inherited component to it and some circumstance occurs that triggers a hoarding response. Recent reports say there are medications that can help people with hoarding compulsions. Other times, specific therapies and intervention have the best success. Many times the individual will hoard items that he or she feels has an important emotional significance, a reminder of happier times, or represent a beloved person or pet. Most hoarders relate that they feel safer when they are surrounded by the things they collect or when all the space around them is filled. It’s important for a landlord or property manager to remember that if the tenant is a true hoarder, asking the tenant to “clean up the place,” a notice to comply with lease obligations, or threats to evict will not result in a discarding of the excessive collection of items. A decision must be made whether to contact the tenant’s family for help and support, get professional help for the tenant, and persuade the tenant to move out, or proceed toward eviction. It can be extremely advantageous to have the tenant begin therapy and work toward solving the problem before you push for a move-out, since the landlord will be the one who has to sort, box up, label, and store all the property the tenant has in the unit, unless the tenant is in a mental position to perform or start that process. Hoarding is a serious problem, since it often results in mold growth, rodent infestations, and a greatly increased risk of fire, structural damage, and safety issues like tripping over items, being injured or trapped under falling stacks of things. Also, this way of living can create an inability to perform daily tasks such as cooking or bathing, leading to unsanitary conditions. Living with piles of trash, spoiled food, even human or animal waste can promote the growth of bacteria and insect nests. Blocked exits can inhibit getting out in the event of fire. There are now organizations, social services, therapeutic and medical help for hoarders. There are companies that have trained professionals to clean the dwelling after a hoarder has moved from the property, and remove all traces of mold and pests. But catching a problem in the beginning is, as always, the best solution.

I lost my job three years ago and my unemployment has run out. I’ve been trying to refinance with a no-cost mortgage and without increasing my debt. My loan servicer does not do refinancing and refuses to lower my interest rate. What can I do?

Answer: Your situation is very difficult because, without income, a lender cannot demonstrate that the loan will be affordable to you. Let’s imagine that a lender will allow up to 28 percent of your income to be used for principal, interest, taxes and insurance – known as PITI. Let’s also imagine that a lender will allow up to 36 percent of your income to be used for PITI plus recurring monthly debts such as student loans, car payments and credit card bills. These formulas make a lot of sense, but they assume that the borrower has enough income to make them work. For unemployed borrowers, one option might be the Home Affordable Unemployment Program. However, there’s a very big catch to the government’s unemployment assistance effort: Among other requirements, you must be both unemployed and eligible for unemployment benefits. A second hitch is that there’s a three-month trial period in which mortgage payments must be made in full and on time. Miss a payment and you cannot continue to participate. An alternative is the $7.6-billion Hardest Hit Housing Markets Fund. Eighteen states provide assistance under this program, but the requirements vary. In California, for example, you can only gain access if your servicer participates in the plan. If your servicer does participate, then California offers such options as nine months of mortgage payment assistance, principal reductions and reinstatement programs for those have not been making their payments. It can’t possibly hurt to contact assistance programs to see if you qualify. If not, ask if they can recommend resources in your area. Another option is to contact your state’s attorney general because they often work with lenders and programs.

or the past two decades, suburban areas have been making a slow transition from car-dependent to people-oriented design, with more options for walking, cycling or public transportation, according to Urban Land Institute, a nonprofit research and education organization. ULI recently published a report, “Shifting Suburbs: Reinventing Infrastructure for Compact Development,” detailing how this change is mostly driven by generation Y, who favor the convenience of urban-style living in more densely populated areas. The U.S. population is expected to increase by 95 million in the next 30 years, and most of the growth will occur in suburban towns, which makes smart suburban land use essential to growth. But redeveloping these areas is harder in practice than in theory, according to the report. The report recommends that local officials enact policies to support new infrastructure, including renovating mall complexes, changing road layouts and consolidating storefronts to a town center. The report includes a case study of Dublin, Ohio, one of the fastest growing suburbs in the country. The city manager recognized the need for more convenient housing options for an incoming wave of young professionals. Part of Dublin’s plan to manage this growth was to build wider sidewalks, more public spaces and better roadways. Other towns have already begun this huge undertaking with mixed results. ULI researchers acknowledge that funding, zoning issues and opposition from residents can slow or stop the shifting suburban landscape. Some cities may lack the personnel with the skill sets to develop urban-like areas. The report suggests that suburban areas form partnerships between public and private sectors to help fund projects. Projects should include redeveloping suburban infrastructure with intricate planning and careful designers. Companies may be enticed to relocate in suburban areas where talented young professionals live instead of in urban areas. Due to demographic changes noted in the study, researchers say that suburbs must shift their focus from baby boomers to the next generation of young workers.
